Customs (Obligations on Cargo Terminal Operators) Instrument 2023

The Instrument is short and revolves around a few tightly defined legal concepts and mechanics.

• Source of power: The Instrument is made under s 102CJ of the Customs Act 1901 (s 3). That is the statutory authority the Comptroller‑General of Customs used to make the instrument. The instrument itself does not reproduce s 102CJ; it implements obligations pursuant to that enabling provision.

• Scope of application and defined terms: The Instrument applies to “cargo terminal operators”, a term the Instrument tells the reader is defined in the Customs Act 1901 (s 4 note). It introduces its own operational definitions:

  • “closed‑circuit television” includes wholly or partially wireless closed‑circuit television (s 4).
  • “closed‑circuit television system” expressly includes the equipment and any equipment, materials, utilities or infrastructure necessary to enable the system to be operated or maintained (s 4). This is a deliberately broad definition that extends the system beyond cameras to supporting infrastructure.
  • “relevant person” is a composite definition comprising: an officer of Customs; a person acting on behalf of the Department; a person providing services in relation to installation/operation/maintenance/removal of the system; and officers or employees of such persons (s 4).

• Obligations imposed: The Principal obligations are set out in two sections:

  • Installation obligations (s 6): On request from an officer of Customs, a cargo terminal operator must provide relevant persons access to a cargo terminal to install a CCTV system to be operated by or on behalf of the Department (s 6(1)). Subsection 6(2) lists types of access that must be provided to enable preparatory work, make necessary modifications, install the system, and connect to power and utilities. Subsection 6(3) lists specific infrastructure access (poles, pit and pipe, suitable rooms for racks and servers, and other existing infrastructure). Subsection 6(4) requires the operator to ensure all reasonable facilities and assistance are given to relevant persons to enable installation. Subsection 6(5) permits the request to be targeted at particular relevant persons or classes of relevant persons.
  • Operation, maintenance and removal obligations (s 7): On request from an officer of Customs, a cargo terminal operator must provide relevant persons with ongoing access for operation, maintenance or removal (s 7(1)). Subsection 7(2) requires access for post‑installation assessments, and connection to power and utilities. Subsection 7(3) imposes an obligation to provide all reasonable facilities and assistance to enable operation, maintenance or removal. Subsection 7(4) similarly allows targeted requests.

• Ministerial/administrative decision point: Access is required “on request by an officer of Customs” (s 6(1), s 7(1)). The Instrument therefore places a decision to trigger the operator’s obligation in the hands of an officer of Customs. The scope of who may attend follows from the “relevant person” definition (s 4).

• Commencement and formality: The Instrument names itself (s 1) and states commencement mechanics using the table that fixes commencement to “the day after this instrument is registered” (s 2(1) table). The Instrument also includes a standard note that the commencement table relates only to the instrument “as originally made” (s 2(1) note).

• Omissions in the Instrument: It contains no express provisions about compensation to terminal operators, notice periods, recordkeeping obligations, privacy or data safeguards, time limits for access, dispute resolution, penalties, or constraints on the Department’s use of the CCTV system. Those matters consequently fall either to the underlying Customs Act 1901 or other laws; the Instrument itself is silent.

These concepts frame the operator’s duties and the Department’s practical ability to place personnel and contractors onto private or commercial cargo terminal premises to install and operate CCTV infrastructure.

The Instrument directly affects three defined groups and, indirectly, other stakeholders who interact with cargo terminals.

• Cargo terminal operators: The primary duty‑bearer is the cargo terminal operator, a term whose statutory meaning is stated to be found in ss 4 and 102B of the Customs Act 1901 (s 4 note). The operator must provide access, facilities and assistance on request by an officer of Customs for the installation, operation, maintenance and removal of CCTV systems (ss 6 and 7). This imposes obligations on whichever entity holds legal responsibility as the cargo terminal operator under the Customs Act 1901.

• Relevant persons: The Instrument defines “relevant person” as including:

  • an officer of Customs;
  • a person acting on behalf of the Department;
  • a person providing services in relation to the installation, operation, maintenance or removal of a CCTV system that will be operated by or on behalf of the Department; and
  • officers or employees of a person mentioned above (s 4). Relevant persons therefore include Departmental officers and third‑party contractors or their staff who will perform on‑site work. The Instrument gives those relevant persons the right to enter cargo terminal premises when an officer of Customs requests access (s 6(1), s 7(1)).

• The Department and officers of Customs: The Department, through its officers, is the decision maker who triggers the operator’s obligations. Officers of Customs may request access and identify the relevant persons who are to be granted access (s 6(1), s 7(1), s 6(5), s 7(4)). The Instrument therefore operationalises the Department’s capacity to place personnel and service providers on terminal sites.

Indirectly affected parties include:

• Tenants, licensees and cargo owners who operate within the terminal: The obligation to provide access extends to parts of the terminal infrastructure (poles, pit and pipe, rooms for racks and servers, and other existing infrastructure) and to enable preparatory work and modifications to premises (s 6(2)-(3)). That could require coordination with tenants or cargo operators who utilise the terminal facilities, as the operator must facilitate work that may affect everyday terminal operations.

• Contractors and service providers engaged by relevant persons: The Instrument vests rights of access in persons providing services (s 4). Those contractors will be entitled to entry and assistance from the operator, subject to the triggering request.

• Security, health and safety and insurance stakeholders: While the Instrument does not mention workplace health and safety, insurance or security clearances, the practical consequence is that operators must allow third‑party personnel onto premises and permit modifications and use of utilities (ss 6 and 7). This implicates site safety, building compliance and insurance arrangements. The Instrument places the obligation to provide access on the operator; it does not specify who is responsible for ensuring compliance with other regulatory obligations that may apply on a site.

• Third parties with privacy interests: The Instrument mandates installation and operation of CCTV systems but is silent on data handling, retention, access to footage, or privacy safeguards (s 4; Parts 2). Any individuals or businesses with privacy interests in footage captured within the terminal are indirectly affected, but the Instrument does not itself set privacy rules.

Who pays: The Instrument does not allocate costs or provide for compensation. It requires operators to enable access, make modifications and provide facilities and assistance (ss 6(2)-(4), 7(2)-(3)), but it does not specify whether the Department or operators bear the capital, operational, alteration or security costs associated with the installation, operation, maintenance or removal of the system. That silence leaves cost allocation to other instruments, contractual arrangements, or the customs legislation where applicable.

Geographic and temporal scope: The Instrument applies to “a cargo terminal” without geographic qualification; commencement is the day after registration of the instrument (s 2). The obligations for ongoing access (s 7(1)) allow the Department to request continued entry for operation, maintenance and removal; no time limits or termination mechanics are included.

This section sets out the specific legal duties imposed by the Instrument and the corresponding rights it creates for relevant persons.

Duties of cargo terminal operators

• Provide access for installation: On request by an officer of Customs, the cargo terminal operator must provide relevant persons with access to the cargo terminal for the installation of a closed‑circuit television system to be operated by or on behalf of the Department (s 6(1)). The duty to provide access is triggered by a request from an officer of Customs.

• Enable preparatory and modification work: Access must be provided to enable relevant persons to undertake preparatory work to determine whether and where to install the system and to make necessary modifications to the premises to enable installation (s 6(2)(a)-(b)). This places a duty on the operator not only to allow physical entry but also to facilitate work that may alter the premises.

• Enable installation and utility connections: Operators must allow installation of the CCTV system and permit connection to and use of the power supply and other utilities necessary for installation (s 6(2)(c)-(d)). This imposes practical obligations to make electrical and utility systems available for use by relevant persons.

• Provide access to specific infrastructure: Operators must provide access to infrastructure items specifically listed: poles, pit and pipe, suitable rooms to install CCTV racks and servers, and other existing infrastructure necessary for installation (s 6(3)(a)-(d)). Operators therefore must allow use of structural and built infrastructure.

• Provide reasonable facilities and assistance: The operator must ensure that all reasonable facilities and assistance are given to relevant persons to enable installation (s 6(4)). The term “reasonable” is not defined within the Instrument; its meaning will be determined by the factual circumstances of each request and any applicable legal standards.

• Provide ongoing access for operation, maintenance and removal: On request by an officer of Customs, operators must provide relevant persons with ongoing access for these functions (s 7(1)). This obligation is continuous in character: “ongoing access” is not temporally bounded in the Instrument.

• Enable post‑installation assessments and utility use: Access for conducting infrastructure assessments necessary after installation to ensure the system performs its function is mandated, and operators must allow connection to and use of power and other utilities necessary for operation, maintenance or removal (s 7(2)).

• Provide facilities and assistance for O/M/removal: The operator must provide “all reasonable facilities and assistance” to enable the operation, maintenance or removal of the system (s 7(3)).

Rights and decision points granted to the Department and relevant persons

• Right to request access: The Department, through an officer of Customs, holds the trigger right to request access to the cargo terminal for the purposes stated in ss 6 and 7 (s 6(1), s 7(1)). The instrument places the activation of the operator’s obligations in the hands of an officer of Customs.

• Right of access for relevant persons: When a request is made by an officer of Customs, “relevant persons” have the right to be permitted access to the cargo terminal for installation, operation, maintenance or removal of the CCTV system (s 6(1), s 7(1)). The broad definition of relevant persons includes contractors and their officers or employees (s 4).

• Right to access specific infrastructure and utilities: Relevant persons are entitled to access poles, pit and pipe, rooms for rack and server installations, and to connect to and use power and other utilities as necessary (s 6(2)-(3), s 7(2)).

• Targeted requests: An officer’s request can be to specific named individuals or to classes of persons, enabling the Department to structure access authorisations according to operational needs (s 6(5), s 7(4)).

What the Instrument does not do

• No compensation clause: The Instrument does not create a payment, reimbursement or compensation obligation from the Department to the cargo terminal operator for the time, facilities, physical modifications or utilities used. It mandates provision of access and assistance but is silent as to who bears the cost.

• No notice or time limits: The Instrument does not prescribe notice periods for requests, limits on the duration of “ongoing access”, or timeframes for the completion of installation or removal.

• No operational restrictions on use of CCTV material: The Instrument does not address data handling, privacy safeguards, retention periods, or access to footage. It also does not limit the Department’s or relevant persons’ activities beyond the general requirement that the operator must provide reasonable facilities and assistance.

• No definition of “reasonable facilities and assistance”: The standard is not elaborated within the Instrument; what counts as reasonable will depend on the context and any applicable external legal standards.

These duties and rights create a clear administrative mechanism that enables the Department to place and maintain CCTV infrastructure at cargo terminals, with the operator obliged to facilitate physical and utility access, but leave open several operational and commercial questions that the Instrument does not itself resolve.

The Instrument itself contains no express penalty provisions, infringement notices, fines, or administrative sanctions. Its enforcement mechanism is therefore not specified within the four corners of the Instrument.

• Silence on penalties: There are no sections in the Instrument that prescribe civil penalties, criminal offences, infringement notices, or administrative enforcement regimes for failure to comply with obligations in ss 6 or 7. The Instrument thus imposes duties without baking in any express sanctioning or remedial mechanism inside the instrument text.

• Triggering authority: The operative trigger for the operator’s obligations is a request by an “officer of Customs” (s 6(1), s 7(1)). The Instrument therefore places the initial decision power with Customs officers; how an operator disputes or resists a request is not specified.

• Reliance on enabling Act for enforcement: The Instrument is made under s 102CJ of the Customs Act 1901 (s 3). Enforcement powers, penalty regimes, or remedies incident to non‑compliance may exist in the Customs Act itself or in other statutory provisions, but the Instrument does not reproduce or reference any such enforcement measures. Any enforcement or penalty mechanism would need to be located in the parent statute (Customs Act 1901) or other laws; the Instrument itself provides no independent enforcement text.

• Practical enforcement considerations: In practice, an officer of Customs requesting access may have statutory powers under the Customs Act or other legislation to compel compliance; however, the Instrument does not identify or cross‑reference those powers. The absence of penalty provisions in the Instrument means that recourse for a cargo terminal operator is likely to involve the usual administrative law channels, negotiation with the Department, reference to the enabling Act, or court review of any coercive actions, rather than reliance on the Instrument for enforcement detail.

• Compliance assurance: The Instrument places an obligation to provide “all reasonable facilities and assistance” (ss 6(4), 7(3)). Absent an express statutory penalty, compliance may be achieved mainly through administrative pressure, coordination, and the Department’s operational leverage, though the specific legal compulsion mechanism is not set out in the Instrument.

Users of this Instrument should therefore look to the Customs Act 1901 and other statutory or regulatory instruments for express enforcement mechanisms or penalties, because the Instrument itself does not supply them.

The Instrument is framed as a delegated instrument under the Customs Act 1901 and interacts with that Act through definitions and enabling authority. The Instrument does not mention other statutory schemes, privacy regimes, building approvals, workplace health and safety laws, telecommunications or electricity regulation, or contract law; these interactions therefore remain indirect, and the Instrument leaves them to be resolved under the relevant legislative frameworks.

Direct statutory interactions stated in the Instrument

• Enabling provision: The Instrument is made under s 102CJ of the Customs Act 1901 (s 3). Its authority and any limits on it derive from that section and related provisions of the Customs Act. The Instrument does not restate the content of s 102CJ; it relies on that section for its validity and scope.

• Definitions from the Customs Act: The Instrument explicitly notes that a number of expressions are defined in ss 4 and 102B of the Customs Act 1901, explicitly including “cargo terminal”, “cargo terminal operator”, and “officer of Customs” (s 4 note). That cross‑reference means the Instrument operates in conjunction with statutory definitions found in the Customs Act.

Areas of legal interaction the Instrument is silent on

• Privacy and data protection: The Instrument mandates installation and operation of CCTV systems but contains no provisions about the collection, storage, access, disclosure, retention or destruction of images or other data captured by CCTV. It does not reference the Privacy Act 1988 or state privacy principles. Therefore, any requirements under privacy or surveillance legislation would need to be assessed separately to determine how they apply to systems installed pursuant to this Instrument.

• Telecommunications, electrical and building regulation: The Instrument requires access to power supplies, utilities and physical infrastructure (s 6(2)(d), s 6(3), s 7(2)), and permits modifications to premises (s 6(2)(b)). Such works will typically engage building codes, electrical safety standards and municipal approvals. The Instrument contains no express carve‑outs or derogations from those laws, so operators and the Department’s contractors will need to ensure compliance with applicable building, electrical and planning laws.

• Workplace health and safety: The Instrument requires operators to provide access to external persons and to permit potentially intrusive works (ss 6 and 7). Workplace health and safety obligations, under state or federal regimes, are not mentioned. Parties implementing the Instrument will therefore need to coordinate compliance with applicable health and safety requirements when granting access and permitting works.

• Contractual and property rights: The Instrument requires operators to permit third‑party access and modifications to premises. These actions may interact with leases, licences, easements, mortgage covenants and other property or contractual arrangements. The Instrument does not address or displace private contractual rights; it imposes a statutory obligation on the cargo terminal operator, which may create tension with private agreements. The Instrument does not prescribe how conflicts between statutory requests and private contracts should be reconciled.

• Intelligence, national security or customs powers: The Instrument is situated within the customs domain and empowers the Department to place CCTV infrastructure. It does not cite other national security or intelligence powers, nor does it constrain how footage may be used under other laws. Where use of CCTV engages intelligence or security agencies, or other statutory powers, those interactions are not articulated in the Instrument.

Practical implication of these interactions

• The Instrument creates a bespoke, narrow access regime for CCTV installation and lifecycle activities but leaves operational, safety, privacy and contractual matters to other legal frameworks. Parties must therefore navigate a layered compliance environment: the operator must comply with the Instrument’s access and assistance duties while ensuring compliance with building, utility, privacy and occupational safety laws, and while managing contractual obligations to tenants and financiers.

• The Instrument’s reliance on terms defined in the Customs Act 1901 (s 4 note) means that the determinative legal meanings for key terms will be found in that Act and will shape the Instrument’s reach.

In short, the Instrument is a targeted administrative tool that must be implemented within a broader statutory and regulatory ecosystem; it provides no express exemptions or rules for how it interacts with other laws.

The Instrument contains limited amendment history material within its own text.

• Original making and date: The Instrument is dated 12 May 2023 and is signed by Michael Outram APM, Comptroller‑General of Customs. The signature block and date appear on the face of the Instrument.

• Commencement: The Instrument provides a commencement table that states that “the whole of this instrument” commences “the day after this instrument is registered” (s 2(1) table). The note to the commencement table states that the table relates only to the provisions of the Instrument “as originally made” and that it will not be amended to deal with any later amendments of the Instrument (s 2(1) note). That is standard drafting for instruments but signals that any future amendment will be separately recorded.

• No recorded amendments in the Instrument text: The Instrument as supplied does not contain any further schedules, amending clauses, or recorded legislative amendments. There is an explicit caution that the commencement table relates only to the instrument as originally made (s 2(1) note), which is a procedural statement rather than an amendment log.

• Practical consequence: Based solely on the Instrument text, the legal history available is the date of execution (12 May 2023), the identity of the making official (Comptroller‑General of Customs) and the commencement mechanism (commencement the day after registration). The Instrument does not set out a revocation clause, transitional provisions, or savings for pre‑existing arrangements.

For a complete amendment history beyond the text of the Instrument itself, one would need to consult the official register of legislative instruments, the Commonwealth Government Gazette or consolidated instrument records. None of that material is reproduced in the Instrument text provided.

The Instrument contains no litigation history, case citations or references to judicial interpretation. It does not name any court decisions, nor does it refer to any past disputes or administrative decisions about its scope or enforcement.

• No cases referenced: The Instrument does not reference any cases or prior decisions. The definitions note refers to sections of the Customs Act 1901 where some key terms are defined, but no judicial material is cited.

• No declaratory or enforcement provisions linked to proceedings: The Instrument contains no provisions about review, appeal, or dispute resolution processes arising from its obligations. It likewise does not specify penalty provisions that might give rise to enforcement litigation under the Instrument itself.

• Practical implication: Absent recorded litigation in the Instrument, the legal contours of terms such as “reasonable facilities and assistance”, the scope of “ongoing access”, or the obligations to permit modifications and use of utilities remain untested by courts in the material supplied. If disputes arise between cargo terminal operators and the Department (or relevant persons), litigation would likely engage the underlying Customs Act 1901, administrative law principles, contract law and any applicable privacy/occupational health and safety regimes. Any judicial treatment of the Instrument would therefore appear in external case law not included in the Instrument text provided.

Readers looking for precedents or interpretive guidance will need to search case law databases or administrative decisions that post‑date this Instrument to determine whether courts or tribunals have interpreted its provisions.

This Instrument contains several practical gaps, ambiguities and operational triggers that create implementation and compliance issues for cargo terminal operators, Departmental officers and their contractors. The notable “gotchas” are factual points in the text that will commonly create friction.

1. Broad definition of “closed‑circuit television system”

   • The Instrument defines a closed‑circuit television system to include “any equipment, materials, utilities or infrastructure required in order to enable the closed‑circuit television system to be operated or maintained” (s 4). That extends obligations beyond cameras to power, racks, servers and potentially substantial infrastructure work. Operators should not assume minimal installations.

2. “Relevant person” includes contractors and their employees

   • “Relevant person” explicitly includes persons providing services and their officers or employees (s 4). The operator must allow third‑party contractors on site, which can complicate onboarding, security vetting, insurance and access control for personnel who are not Departmental officers.

3. No compensation or cost allocation

   • The Instrument requires operators to permit preparatory work, modifications, installations, use of utilities and “all reasonable facilities and assistance” (s 6(2)-(4), s 7(2)-(3)), but it is silent about who pays for capital works, utility consumption, or remediation. Operators must be prepared to absorb or negotiate costs elsewhere because the Instrument supplies no payment mechanism.

4. “Reasonable facilities and assistance” is undefined

   • The repeated “reasonable” standard (s 6(4), s 7(3)) is context dependent. Operators may face disputes about what is reasonable, for example whether to provide dedicated rooms, security escorts, or out‑of‑hours access without extra charge.

5. No notice, timing or duration limits

   • The Instrument does not require advance notice for requests, set reasonable timeframes for granting access, or limit the duration of “ongoing access” (s 7(1)). The Department can seek “ongoing” access; the Instrument does not define periodicity or termination.

6. Potential conflict with other legal obligations

   • The Instrument allows modifications to premises and use of utilities (s 6(2)(b), s 6(2)(d)), yet it contains no express reconciliation with building, electrical, planning, privacy or workplace health and safety laws. Operators must manage possible conflicts or additional compliance costs when Ministry contractors perform work on site.

7. Requests may be class‑based

   • Requests may be directed to classes of relevant persons (s 6(5), s 7(4)), which allows broad delegation of access rights and could permit many contractors to enter site premises without individual authorisation beyond the officer’s request.

8. “Ongoing access” includes removal

   • The access requirement covers removal of the system (s 7(1)) which may require prolonged occupation for decommissioning and restoration of premises. The Instrument does not require the Department to restore premises or cover restoration costs.

9. No data, privacy, or use controls

   • The Instrument is silent on footage use, disclosure, retention or access. Operators may be exposed to reputational or legal risk arising from privacy impacts or community expectations, yet the Instrument does not provide safeguards or direction.

10. Enforcement path is not specified

    • There are no penalty or enforcement clauses in the Instrument. Operators seeking to resist requests will need to ground any contest in the enabling Act or administrative law, since the Instrument itself does not prescribe remedies or penalties for non‑compliance.

11. Practical facilities list is illustrative not exhaustive

    • The list of specific infrastructure in s 6(3) , poles, pit and pipe, suitable rooms for racks and servers, and other existing infrastructure , is illustrative: subsection 6(3)(d) allows access to “any other existing infrastructure necessary for the installation”. That can lead to operator obligations extending into varied parts of the facility.

12. Ambiguity about who performs works

    • The Instrument allows relevant persons (which include service providers) to perform installation, but it does not explicitly say whether the Department or the operator arranges or pays for contractor services. This gap can reveal differing operational assumptions between parties.

13. Interaction with leases and third‑party rights

    • The Instrument may require activity that interferes with tenant operations or premises subject to leases. The Instrument does not provide a mechanism to override or reconcile private contractual rights, leaving operators to manage third‑party relations.

Operators and Departmental personnel should approach each request with a checklist addressing these gotchas: verify who the relevant persons are, plan for insurance and safety compliance, confirm responsibility for costs, obtain written requests and scope, and coordinate with tenants and utility providers. The Instrument’s text provides rights of access but not the operational answers to these common logistical and legal tensions.

Compliance with the Instrument requires operational, contractual and legal steps that convert the textual obligations into predictable procedures. The Instrument’s obligations are triggered by a request from an officer of Customs (s 6(1), s 7(1)), and the cargo terminal operator must provide access, facilities and assistance as specified. The following steps map to the Instrument’s provisions and the practical issues its silence creates.

1. Maintain clear organisational responsibilities

   • Designate a single point of contact (POC) for handling requests from officers of Customs. That POC should be authorised to coordinate physical access, allocate facilities, manage contractors and record compliance. The Instrument centralises the consent trigger with officers of Customs (ss 6(1), 7(1)), so a procedural route to accept and action a request is essential.

2. Establish procedures to accept and document requests

   • Require requests from an officer of Customs to be in writing where practicable, detailing the nature of access sought, who the relevant persons are (individuals or class), expected start and end dates, types of work (preparatory, modification, installation, assessment, operation, maintenance, removal), and any special requirements. While the Instrument allows oral requests, having written records will assist if there are disputes about scope or timing (s 6(5), s 7(4)).

3. Prepare technical and physical facilitation plans

   • Audit the terminal to identify poles, pit and pipe, rooms suitable for racks and servers and other existing infrastructure referred to in s 6(3). Map locations where CCTV components can be installed and identify potential load on power and utilities required under ss 6(2)(d) and 7(2). This prepares the operator to respond promptly to preparatory work requests (s 6(2)(a)).

4. Create protocols for granting visitor and contractor access

   • Because “relevant person” includes service providers and their staff (s 4), create onboarding, security clearance and induction procedures specifically for Department contractors. Standardise checks for identity, insurance, licences and site safety inductions to reduce friction when access is requested.

5. Plan for premises modifications and safety compliance

   • Develop a checklist for modifications that may be required (s 6(2)(b)), including whether local building approvals, electrical safety work notices, shut‑downs or permit requirements are triggered by installation works. Ensure safe work method statements and WHS compliance for contractors conducting installation, operation, maintenance or removal (s 7(2)-(3)).

6. Establish utility access and metering arrangements

   • The Instrument requires connection to and use of power and other utilities necessary for installation and operation (ss 6(2)(d), 7(2)). Agree procedures to manage utility usage, including temporary connections, metering or sub‑metering for Department equipment, and protocols for electricity supply continuity and safety. Given the Instrument’s silence on costs, record utility usage and seek contractual clarification with the Department where appropriate.

7. Insurance and indemnity management

   • Ensure brought‑in contractors have insurance that meets operator standards, and that contracts with tenants and landlords are reviewed to understand any liability shifts. Because the Instrument provides access rights but no indemnity or compensation clauses, operators should seek to allocate risks through separate agreements where feasible.

8. Records and audit trails

   • Track each request and the access provided in a central register: date and time of request, officer making the request, identity of relevant persons, descriptions of works carried out, utilities used, areas modified, safety certifications, and any damage or incidents. These records will assist in any subsequent dispute and support auditability for compliance with other laws.

9. Contractual and lease governance

   • Review existing lease and licence arrangements to identify conflicts that may arise when granting access or permitting modifications. Where possible, create template consent forms or clauses for tenants, and negotiate arrangements with the Department if necessary to reconcile statutory obligations with private contractual rights.

10. Cost and budget planning

    • Because the Instrument is silent on compensation, prepare internal budgets for potential costs arising from access facilitation: security escorts, administrative overheads, infrastructure sharing, temporary relocations, and restoration after removal. When costs are material, seek to negotiate reimbursement or cost‑sharing arrangements with the Department, documented in separate agreements.

11. Data protection and privacy planning

    • Although the Instrument does not set privacy rules for footage, an operator should assess privacy impacts of having CCTV installed and coordinate with the Department on placement and signage to manage stakeholder expectations. Prepare to document data flows and obtain advice on applicable privacy laws given likely third‑party access to images.

12. Dispute and escalation path

    • Establish an internal escalation path for contested requests (e.g. requests that interfere with safety, breach leases, present insurance gaps, or require large‑scale modifications). Include contact points within the Department and, where possible, require written confirmation of requests to allow negotiation on scope and cost.

13. Decommissioning and restoration

    • For removal work (s 7(1)), document expected restoration obligations and quality standards. Since the Instrument does not require the Department to restore premises or pay for restoration, negotiate a decommissioning protocol that clarifies responsibility for reinstatement.

14. Training and compliance testing

    • Train operational staff on the instrument’s requirements, definitions (e.g. who is a “relevant person”), and the documentation required to show compliance. Undertake periodic drills to test how quickly access and facilities can be provided.

15. Legal review and liaison

    • Maintain a legal contact who can advise on how the Instrument interacts with the Customs Act 1901, lease obligations, privacy law and safety regulations. Where an access request is likely to raise complex legal issues, engage legal counsel early.

By following these steps, a cargo terminal operator converts the Instrument’s textual obligations into operational fidelity. Key practical aims are to create a written trail for each request, mitigate safety and privacy exposures, clarify cost and liability allocations where possible, and ensure that service providers and Department personnel are integrated into the operator’s site governance arrangements. The Instrument requires operational readiness for potentially broad infrastructure work but gives the operator no express contractual or compensation framework; compliance therefore depends on marrying administrative cooperation with careful risk management and documentation.
