Customs (Indonesian Rules of Origin) Regulations 2019

The regulations rely on several key concepts defined by cross-reference to section 153ZLK of the Customs Act. These include “Australian originating goods”, “Certificate of Origin”, “Declaration of Origin”, “Harmonized System”, “non-originating materials”, “originating materials”, “production”, “territory of Australia”, and “territory of Indonesia”. The actual definitions are not repeated in the regulations; users must consult the Act and the IA-CEPA text for precise meaning. This layered approach means that a change in the Act’s definition flows through to the regulations without amendment, but it also increases the difficulty of interpreting the rules without multiple documents.

The central concept in Part 2 is the “change in tariff classification” requirement. Goods that incorporate non-originating materials must demonstrate that those materials underwent a sufficient transformation to qualify as originating. The regulations do not prescribe specific tariff shifts; they merely state that a non-originating material that does not satisfy a particular change is taken to satisfy it if it was produced entirely in Indonesia or Indonesia and Australia from other non-originating materials that themselves satisfy the change. This cascading rule allows vertically integrated producers to aggregate processing steps across borders to meet origin thresholds, which is a relatively liberal approach compared to some free trade agreements that require direct transformation from non-originating inputs.

Part 3 introduces “qualifying value content” as an alternative or supplement to tariff change. The direct/build-up method (section 6) sums the IA-CEPA material cost (value of originating materials), labour costs, overhead costs, other costs (including transport and handling to the point of export), and profit, then divides by the customs value of the goods. The indirect/build-down method (section 7) starts with customs value and subtracts the value of non-originating materials. Both methods produce a regional value percentage; the higher the percentage, the more local content the goods contain. Exporters can choose which method to apply, which gives flexibility but requires careful calculation because the two methods can yield different results depending on cost structures.

Part 4’s valuation rules are critical. Section 8 values non-originating materials imported by the producer according to the WTO Customs Valuation Agreement, and for originating materials on the assumption they were imported. For non-originating materials acquired by the producer (not imported), the value is the earliest ascertained price paid. Deductions are allowed for freight, insurance, packing, duties, taxes, customs brokerage fees (if not refundable), waste and spoilage (net of reusable scrap), processing costs incurred in Indonesia or Australia, and costs of originating materials used in producing the non-originating materials. These deductions effectively lower the value of non-originating materials for the build-down method, making it easier to meet regional value content thresholds.

Sections 9 and 10 extend these valuation rules to accessories, spare parts, tools, instructional materials, and packaging. They are treated as originating or non-originating depending on their own status and must be included in the qualifying value content calculation. This prevents exporters from artificially excluding low-value non-originating items that come with the goods.

Part 5’s “records” concept is straightforward but operationally heavy. The exporter must keep detailed evidence of purchase, classification, valuation, and origin documentation for at least five years. Records can be kept anywhere, but must be in a form that enables verification and, if not in English, must allow ready translation. This imposes a continuing compliance cost even after goods have been shipped and duties paid.

The regulations primarily affect Australian exporters who wish to claim preferential tariff treatment under the IA-CEPA when exporting goods to Indonesia. This includes manufacturers, producers, and traders of goods that incorporate non-originating inputs. The exporter is the party required to keep records under section 11, so the compliance burden falls on them, even if they outsource production or source materials from third parties.

Indonesian exporters to Australia also have an interest, because the same rules apply in reverse (mirror provisions in other instruments handle Indonesian exports to Australia). However, the regulations themselves are expressed from Australia’s perspective; they define how Australian authorities will verify origin for goods exported from Australia. Indonesian producers must similarly comply with Indonesian origin rules, but those rules are not in this instrument.

Customs brokers, trade consultants, and logistics firms will need to understand the calculation methods to advise clients. Accountants and in-house finance teams must be able to apply the direct/build-up and indirect/build-down formulas, which require accurate tracking of material costs, labour costs, overheads, and profit. The definitions of overhead costs and profit cross-reference Article 4.5 of Chapter 4 of the Agreement, so practitioners must consult the IA-CEPA text itself for those definitions.

Small and medium-sized enterprises are disproportionately affected because they lack dedicated trade compliance staff. The record-keeping obligations (section 11) require evidence of purchase, payment, classification, and value for every component, including accessories and packaging. For a producer using dozens of inputs from multiple suppliers, the administrative burden can be substantial. The five-year retention period means records must be stored and accessible long after the transaction is complete.

Government agencies are also affected: the Australian Border Force and the Department of Home Affairs must assess claims of origin, audit compliance, and potentially deny preferences if documentation is inadequate. The regulations give them a clear framework for valuation, but the complexity of calculations and cross-referenced definitions may lead to disputes over interpretation.

Indonesian customs authorities are affected because they will apply the origin rules to imported Australian goods. If an Australian exporter fails to meet the rules, the goods may be subject to full most-favoured-nation tariffs, negating the trade benefit. Conversely, if the rules are met, the exporter receives a cost advantage over competitors from countries without a free trade agreement with Indonesia.

Finally, consumers and importers in Indonesia are indirectly affected: goods that qualify for preferences may be cheaper, increasing demand. But if compliance costs are high enough to discourage participation, the volume of preference-claimed trade may remain low, blunting the intended liberalisation.

The primary duty under the regulations is on the exporter to determine origin correctly and maintain supporting records. Section 11(1) lists specific records that must be kept: purchase records for the goods and for any accessories or packaging, evidence of payment, evidence of Harmonized System classification, valuation evidence, and a copy of the Certificate or Declaration of Origin. There is no discretion to keep less; the list is exhaustive. The exporter also has a duty to retain these records for five years from the date of export (section 11(2)). This is a longer period than some other trade record-keeping requirements (which are often four years), so exporters must be aware of the extended timeline.

The exporter has a duty to keep records in a form that allows a determination of whether goods are Australian originating (section 11(3)(b)(i)). This implies that even if records are not in English, they must be kept in a place and form enabling an English translation to be readily made (section 11(3)(b)(ii)). If records are electronic, they must be readily convertible into hard copy in English (section 11(3)(b)(iii)). These obligations ensure that Australian Border Force officers can audit the records regardless of where they are stored.

There is also a duty to apply the correct calculation method for qualifying value content. The exporter may choose either the direct/build-up method or the indirect/build-down method, but must do so consistently for each shipment. The formulas are set out in sections 6 and 7, and the values used must be calculated under Part 4. If the exporter makes a mistake in valuation (e.g., failing to deduct freight or duties as permitted), the qualifying value content percentage may be miscalculated, leading to a false claim of origin.

The exporter has a right to use the cascading rule in section 5 to satisfy the change in tariff classification even if a non-originating material does not individually meet the tariff shift. This is valuable for producers who process materials in stages across both Australia and Indonesia. Without this rule, each non-originating input would have to undergo a tariff shift individually, which might be impossible if the input itself is a complex intermediate good.

The exporter also has the right to include accessories, spare parts, tools, instructional materials, and packaging in the qualifying value content calculation, as long as the conditions in sections 9 and 10 are met. This means that if these items are originating, they boost the regional value content percentage; if they are non-originating, they reduce it. There is no option to exclude them: the regulations require their inclusion.

The exporter does not have a right to choose which valuation method for materials under Part 4; section 8 prescribes specific rules based on whether materials are imported, acquired, or produced. However, the exporter can influence the valuation by how they structure their supply chain. For example, by importing non-originating materials directly rather than acquiring them from a domestic middleman, the valuation may be different (earliest ascertained price paid under s 8(2)(c) vs. import valuation under s 8(2)(a)).

The regulations themselves do not create separate penalties. Enforcement is through the Customs Act 1901 and potentially the Criminal Code. False or misleading statements about origin, or failure to keep required records, can attract penalties under existing customs law. For example, making a false declaration in a Certificate or Declaration of Origin may constitute an offence under section 234 of the Customs Act (false statements) or section 137.1 of the Criminal Code (providing false information to a Commonwealth officer). Penalties can include fines and imprisonment, depending on the severity.

Failure to keep records as required by section 11 could result in an infringement notice or prosecution under customs legislation. Although the regulations do not specify a penalty, the Act under which they are made (Customs Act 1901) provides for record-keeping obligations in other contexts, and non-compliance can attract penalties. For instance, section 126ALF of the Customs Act (cross-referenced in section 11(1) of the regulations) likely imposes an obligation to keep records, with penalties for breach.

The practical enforcement risk for exporters is that if they cannot produce the required records during an audit, the Australian Border Force may deny the origin claim. This could result in retrospective payment of full tariffs on goods already exported, plus interest. In a worst-case scenario, Indonesian customs may also impose penalties for false preferential claims.

There is no specific penalty amount in the regulations; instead, enforcement is governed by the broader customs framework. This means that exporters must have robust compliance systems to avoid investigation. The five-year record retention period extends the window for potential audit, so records must survive personnel changes and system upgrades.

The cascading rule in section 5 and the two QVC methods in Part 3 give some flexibility, but they also increase the risk of honest error. An exporter may mistakenly apply the wrong method or miscalculate a deduction. The regulations do not provide a safe harbour or de minimis error tolerance. If a mistake is discovered, the exporter may have to defend their original calculation, or pay the difference.

The regulations also interact with Indonesia’s own enforcement mechanisms. If Indonesian customs finds that an Australian shipment does not meet the origin rules, they will assess duty at the full rate. Australian authorities may then initiate a verification process under the IA-CEPA, which could involve additional compliance costs for the exporter to prove origin. Failure to cooperate can lead to the exporter being excluded from future preferences.

Given the complexity, legal risk, and potential for large tariff liabilities, exporters are well-advised to engage specialist trade lawyers or customs brokers to review their origin calculations and record-keeping processes. The regulations do not impose a duty to audit, but the absence of a penalty creates no safe harbour.

The regulations sit within a broader legislative framework. They are made under the Customs Act 1901, specifically under powers granted by that Act. Many key definitions are not in the regulations but in section 153ZLK of the Customs Act, meaning practitioners must read both instruments together. The Act also contains the substantive rules for claiming preferential treatment, including provisions about certificates and declarations of origin. The regulations only flesh out the technical origin rules (tariff change, QVC, valuation, records).

The regulations interact with the IA-CEPA itself. The Agreement is a treaty between Australia and Indonesia. The regulations give domestic legal effect to the origin rules of Annex 4-A of the IA-CEPA (or similar). Because the Agreement is defined by reference to section 153ZLK of the Act, the regulations incorporate any amendments to the Agreement by reference. This means that if the IA-CEPA is amended, the regulations automatically adjust to the new terms (subject to any later amending instrument).

The regulations also refer to the Agreement on Implementation of Article VII of the GATT 1994 (the WTO Customs Valuation Agreement). Section 8 requires valuation of non-originating materials by the producer to be worked out in accordance with that Agreement. This links the regulations to international customs valuation standards, ensuring consistency with WTO obligations but importing a complex set of valuation rules that are themselves cross-referenced. For example, the WTO Valuation Agreement uses six methods of valuation; the regulations do not specify which method to use for materials, only that it must be ‘in accordance with’ the Agreement. This gives flexibility but also uncertainty.

The regulations interact with the Customs (Origin of Goods) Regulations 1988 and other origin rules for different free trade agreements. Exporters must ensure they are applying the correct set of rules for Indonesia versus, say, China or Japan. The IA-CEPA rules in these regulations are specific to the Australia-Indonesia bilateral context; they differ in methodology and thresholds from other agreements. Using the wrong regulation could lead to incorrect claims.

The record-keeping obligations in section 11 interact with the general record-keeping requirements in the Customs Act (e.g., Part VIII, Division 1). Exporters may already be required to keep records for customs purposes; the regulations add additional specific items such as accessories valuation and origin documents. The five-year period may differ from other record-keeping requirements, creating a need to coordinate retention schedules.

The regulations also interact with Australian taxation law, particularly for transfer pricing. The valuation of materials, especially when related parties are involved, may be scrutinised. Using the earliest ascertained price (section 8(2)(c)) could conflict with arm’s length principles if the price is artificially low. Exporters should ensure that valuations are consistent with both customs and tax requirements to avoid conflicting audits.

There is no interaction with state or territory laws; the regulations are entirely federal, dealing with international trade.

The regulations commenced on 12 December 2019, as signed by the Governor-General. They came into force at the same time as Schedule 2 to the Customs Amendment (Growing Australian Export Opportunities Across the Asia-Pacific) Act 2019, which amended the Customs Act to insert the IA-CEPA provisions. According to the commencement table in section 2, the whole instrument took effect on that date. There have been no subsequent amending instruments listed in the text provided. The user’s source does not include any later amendments; based solely on the information given, the regulations remain as originally made.

The regulations were made under the authority of the Customs Act 1901 and relied on the then-current version of the Act and the IA-CEPA. Any change to the underlying Act (e.g., amendment to section 153ZLK) would alter the definitions used in the regulations without need to amend the regulations themselves. Similarly, changes to the IA-CEPA would flow through because the definitions cross-reference the Agreement. However, any substantive change to the origin rules (e.g., a new method of calculation or a different deduction rule) would require an amending regulation.

The absence of amendment history suggests stability, but users should verify with the Federal Register of Legislation for any subsequent changes. It is possible that minor corrections or updated references (e.g., changes in treaty series numbers) have been made since 2019. The note in section 4 regarding the Marrakesh Agreement acknowledges that the Australian Treaty Series number may have changed; the regulation as originally drafted used the 2019 version.

Given the limited source, we cannot comment on proposed amendments or review processes. The default assumption is that the regulations have not been amended.

The source text does not contain any reference to litigation. No cases are mentioned in the regulations themselves. Based solely on the provided material, there is no recorded judicial consideration of these regulations. This is not surprising for a relatively niche statutory instrument that has been in force for a few years. Disputes over origin claims under the IA-CEPA may have been resolved administratively or through the dispute settlement mechanism in the Agreement, rather than through Australian courts.

If litigation were to arise, it would likely involve challenges to the valuation methodology, the cascading rule, or the record-keeping obligations. For example, an exporter might argue that the deduction provisions in section 8(3) were incorrectly applied by the Australian Border Force, or that the cascading rule should apply to a particular material. Cases under other origin regulations (e.g., for the New Zealand or ASEAN agreements) may provide persuasive guidance but are not binding.

It is also possible that litigation could stem from penalties imposed under the Customs Act for false claims in Indonesia origin matters. The regulations themselves are not the direct source of penalties, but they define the rules that, if broken, trigger penalty provisions. Any court case would likely interpret the meaning of ‘customs value’ as used in the formulas, or whether a particular deduction is allowable.

Without specific case citations, practitioners must rely on the text and general customs law principles. The lack of litigation history may indicate that the rules have been applied consistently or that disputes are resolved informally. It could also mean that the regulations have not been heavily used, perhaps because IA-CEPA trade volumes are modest or because exporters have avoided claiming preferences due to compliance costs.

Several traps exist for the unwary.

First, the cascading rule in section 5 applies only if the non-originating material is produced entirely in the territory of Indonesia, or entirely in Indonesia and Australia. This means that if any part of the production of that intermediate material occurred outside those two countries, the rule does not apply. Exporters who source components from third countries and then assemble them in Indonesia cannot cascade through that assembly step.

Second, the valuation deduction in section 8(3) for duties, taxes and customs brokerage fees requires that those amounts have been paid and are not refundable or recoverable. If an exporter later obtains a duty drawback on those imported materials, the deduction may become invalid retroactively. This could affect the qualifying value content calculation for goods already exported. Exporters must monitor whether any duties are later refunded and adjust records accordingly.

Third, the definition of “labour costs” in section 6 for the direct/build-up method is limited to “wages, remuneration and other employee benefits associated with the production of the goods”. It does not include costs of contract labour or outsourced services. If a producer uses external contractors for processing, those costs may not be counted as labour costs and must instead be captured elsewhere (e.g., as other costs or overheads). This could lower the QVC percentage compared to in-house production.

Fourth, the record-keeping requirement for exporters in section 11(1)(c) requires “evidence that payment has been made for the goods”. This is narrower than evidence of the purchase price. If the exporter has only a contract or invoice but no proof of actual payment (e.g., bank transfer record), they may be in breach. Payment evidence must be kept for both the exporter’s purchase of the goods and the onward sale to the Indonesian buyer, which is unusual and potentially onerous for long supply chains.

Fifth, the inclusion of accessories, spare parts, tools, and instructional materials is mandatory if the conditions in section 9 are satisfied. Exporters cannot choose to exclude them from the QVC calculation. If a non-originating accessory is included, it reduces the percentage; the exporter must be aware of this and may need to source accessories from within Australia or Indonesia to maintain origin.

Sixth, the five-year record retention period runs from “the day of exportation of the goods” (section 11(2)). This is an absolute period; if records are destroyed or lost before five years, the exporter may be unable to defend an audit. The period cannot be shortened by agreement.

Seventh, the regulations do not provide examples of the calculations. Exporters must interpret the formulas themselves, and errors are easy to make. The direct/build-up method requires adding “IA‑CEPA material cost”, “labour costs”, “overhead costs”, “other costs”, and “profit”. Each of these items must be calculated consistently. “Overhead costs” and “profit” are defined by reference to Article 4.5 of Chapter 4 of the Agreement, which is not reproduced in the regulations. Exporters must locate that treaty text and interpret it correctly.

Eighth, the valuation of non-originating materials acquired by the producer is “the earliest ascertained price paid for the materials by that producer” (section 8(2)(c)). This does not allow the exporter to use a later price if it is higher; it locks in the first price. If the producer paid a low intercompany price for materials from a related party, that price applies even if it is below arm’s length. This could lead to a higher QVC percentage (because the cost of non-originating materials is lower), but it may attract transfer pricing scrutiny.

Finally, the regulations apply only to goods exported from Australia to Indonesia. Australian importers from Indonesia are covered by separate rules. Confusion between the two sets of rules is common. Exporters must ensure they are applying these regulations, not the import rules.

Compliance requires a systematic approach. Exporters should first determine whether the goods they export to Indonesia are wholly obtained or produced entirely from originating materials. If so, they automatically satisfy origin and need only the required documentation. If not, they must apply the rules in Parts 2 and 3.

Step one: Identify all non-originating materials used in the goods. For each, assess whether it satisfies the change in tariff classification. If it does, proceed directly to QVC calculation (if required). If it does not, check whether the cascading rule in section 5 applies: was the material produced entirely in Indonesia or in Indonesia and Australia from other non-originating materials that themselves satisfy the change? If yes, the material is deemed to satisfy the requirement. Keep detailed records of the production chain to support this claim.

Step two: Choose a method for calculating qualifying value content. The direct/build-up method (section 6) requires the exporter to calculate the sum of IA-CEPA material cost, labour costs, overhead costs, other costs, and profit, then divide by customs value. The indirect/build-down method (section 7) starts with customs value and subtracts the value of non-originating materials. Whichever method yields a percentage meeting the applicable threshold (specified in the IA-CEPA or the Act) can be used. Neither method is automatically more advantageous; it depends on the cost structure. Exporters should model both methods to see which gives a higher percentage, then use that method consistently for similar goods.

Step three: Value all materials correctly under Part 4. For non-originating materials imported by the producer, use the WTO Customs Valuation Agreement. For originating materials, use the same Agreement as if they were imported. For non-originating materials acquired domestically, use the earliest ascertained price paid. Remember to deduct the allowable items in section 8(3): freight, insurance, packing, duties (if not refundable), waste, processing costs, and costs of originating materials used to produce the non-originating materials. These deductions reduce the value of non-originating materials, which helps in the build-down method. Keep evidence for each deduction.

Step four: Determine the status of any accessories, spare parts, tools, instructional materials, and packaging. If they are originating, include them in the IA-CEPA material cost; if non-originating, include them in the value of non-originating materials. They cannot be ignored.

Step five: Ensure records meet the requirements of section 11. The exporter must collect and retain: purchase records (both for the exporter’s acquisition and the buyer’s acquisition), evidence of payment (bank statements, receipts), Harmonized System classification evidence, valuation records for accessories and packaging, and a copy of the Certificate or Declaration of Origin. Records may be kept outside Australia but must be accessible, and if electronic, easily convertible to hard copy in English. If original records are not in English, the exporter must be able to produce a ready translation.

Step six: Maintain the records for five years from the export date. This may require a document retention policy that separates IA-CEPA records from other customs records (which may have different retention periods). Use a filing system that links the records to each shipment’s Certificate or Declaration of Origin.

Step seven: If the exporter uses the direct/build-up method, they must calculate labour costs, overheads, other costs, and profit accurately. Labour costs only include employee wages and benefits, not contractor payments. Overhead and profit definitions come from Article 4.5 of Chapter 4 of the Agreement. Obtain a copy of that treaty text and maintain a working paper showing how each component was derived.

Step eight: Review compliance periodically, especially if supply chains change, new suppliers are used, or the IA-CEPA is amended. The regulations do not require a compliance officer or external audit, but periodic internal checks reduce the risk of error.

Step nine: Consider seeking professional advice if the goods are complex or if the qualifying value content is borderline. An error could result in the loss of tariff preferences and potential penalties.

By following these steps systematically, exporters can reduce the compliance burden and increase confidence that their goods will receive preferential treatment when entering Indonesia.
