Customs (Deployment of Approved Firearms and Other Approved Items of Personal Defence Equipment) Directions 2026

The Directions are organised around a short set of operational concepts. The key concepts are present in the instrument text and operate as the organising rules for issuance, possession, use, recall and storage.

Roles and decision‑makers

• Authorised arms issuing officer, officer authorised to carry arms, and officer of Customs are defined concepts carried over from the Customs Acts and used throughout (cl 4 note; cls 6-9). The Directions add clarifying role thresholds for “relevant officer” in some provisions: a relevant officer is either an APS Level 6 or higher in the Australian Border Force or the direct supervisor of the officer authorised to carry arms (cl 6(5); cl 7(6)). Recall authority is extended to Executive Level 1 (EL1) officers or higher in cl 8(2).

Permitted circumstances for issue and use

• Issue is limited to three stated circumstances: deployment to enable safe exercise of statutory powers for planned or other tasks; delivery of training for that purpose; and maintaining serviceability for that purpose (cl 6(2)). Use follows the same tripartite structure: enabling safe exercise of powers, training, and serviceability (cl 9(2)). The instrument therefore ties operational authorisation to the functional purpose of safety in exercising statutory powers.

Fit‑for‑duty and discretionary non‑issuance

• The instrument conditions issue on fitness to safely use equipment. Where an officer indicates illness, is visibly impaired, or their ability is “under reconsideration”, the relevant officer may refuse issue or direct an authorised issuing officer to refuse (cl 6(4)). Similarly, relevant officers may direct an officer authorised to carry arms to return equipment where similar incapacity or reconsideration applies (cl 7(3)-(4)).

Security states and storage

• The Directions distinguish between a “secure state” when equipment has been deployed to be used as soon as practicable and “all other circumstances” when items must be secured in accordance with cl 10 (cl 7(6)). Secure storage when recalled is defined to be either a lockable storage space with restricted access, or a lockable container in possession of an authorised issuing officer or an officer authorised to carry arms (cl 10(2)). The instrument provides definitional detail for the storage terms: a lockable storage space is a fixed compartment or facility with restricted access and a lockable container is an impact resistant container capable of being locked at two separate points (cl 10(3)).

Recall mechanics and timing

• Approved firearms and other approved items may be recalled at any time by an authorised arms issuing officer or an EL1 or higher (cl 8(2)). All items issued for a task are recalled at the conclusion of that task or activity, which encompasses training or maintenance (cl 8(3)). Officers must return recalled items “as soon as practicable” (cl 8(4)-(5)); authorised issuing officers ensure recalled items are returned to secure storage as soon as practicable (cl 8(5)).

Compliance and administrative consequences

• The instrument does not specify criminal sanctions or fines. Instead it sets out that failure to comply, unless otherwise permitted by the Directions, “may result in action being commenced to determine whether that officer has breached the APS Code of Conduct” (cl 11). The Notes appended to cl 11 cross‑refer to the Public Service Act’s APS Code of Conduct (s 13) and termination provisions and to section 32 of the Australian Border Force Act for termination where serious misconduct is reasonably believed (cl 11 notes).

Definitions and cross‑references

• The Directions import and reiterate defined terms from the Customs Acts and the Public Service Act for classification levels and organisational names, and explicitly define “secure state”, “lockable storage space” and “lockable container” (cl 4, cl 7(6), cl 10(3)). The instrument also notes procedural application in the external territories via the Customs Act equivalents (cl 3).

Together, these concepts create an operational framework: authorised issuing officers may issue only in set circumstances; fitness and supervisory discretion can prevent issue or require return; use is authorised only for safety, training, or maintenance purposes; and recalled items must be secured in specified ways. The instrument therefore operates as a set of operational limits and duties attached to the handling of approved firearms and approved items of personal defence equipment by Customs personnel.

Primary persons and entities

• Officers of Customs who are authorised to carry arms, authorised arms issuing officers, and officers of Customs more broadly are the immediate subjects of the Directions. The instrument repeatedly addresses behaviour and duties of an “authorised arms issuing officer” and an “officer authorised to carry arms” (cls 6-10). The instrument is made under the Customs Act and equivalent external territories Customs Acts, so it applies in the external territories where those Acts apply (cl 3).

Employment status and administrative exposure

• The instrument explicitly frames enforcement, in part, through public service employment rules. Clause 11 states that a failure to comply by an authorised arms issuing officer, or an officer authorised to carry arms, employed under the Public Service Act may result in action to determine whether the APS Code of Conduct has been breached. The Note to cl 11 cross‑refers to the APS Code of Conduct (s 13 of the Public Service Act) and termination under paragraph 29(3)(g) of that Act. The Note also cross‑refers to section 32 of the Australian Border Force Act for possible termination where the Secretary or Commissioner reasonably believes the conduct amounts to serious misconduct (cl 11 notes). Those cross‑references mean that employees who are APS employees are the primary subjects of the disciplinary mechanisms described.

Who may direct or recall

• The Directions allocate decision‑making power to defined senior roles. “Relevant officer” in cls 6 and 7 is either an APS Level 6 or higher in the Australian Border Force, or the direct supervisor of the officer authorised to carry arms (cl 6(5), cl 7(6)). Clause 8(2) extends recall authority to authorised arms issuing officers and to APS employees holding, or performing the functions of, an Executive Level 1 position or higher in the Australian Border Force. These role definitions identify who may exercise refusal and recall powers and who bears responsibility for returning items to secure storage.

Operational support personnel and training

• The Directions permit the issuance and use of approved firearms and other approved items for delivery of training to “an officer of Customs” and permit other officers to handle equipment while assisting those who are authorised to carry arms as part of training or operational assistance (cl 6(2)(b), cl 9(3)). The scope of those provisions therefore affects instructors, trainees and assisting officers within Customs operations.

Excluded or unspecified groups

• The instrument is framed around authorised roles defined in the Customs Acts and the Public Service Act. It does not address contractors, private security providers, or non‑APS personnel. The enforcement mechanics in cl 11 refer to employees “employed under the Public Service Act,” so the administrative sanctions described there are specifically directed at APS employees. The Directions do not create new criminal offences or civil causes of action; they do not explicitly address third parties or external actors.

Geographic application

• The Directions are made under the Customs Act 1901 and expressly state the equivalent authority for the external territories Customs Acts (cl 3). The instrument therefore applies in Commonwealth jurisdiction including those external territories where those Customs Acts apply, consistent with the referenced statutory authorities.

Who pays or bears operational cost

• The instrument does not address funding, resourcing or procurement. It imposes duties on issuing officers, authorised carriers and supervisors, and imposes obligations to secure, recall and return equipment. The Directions therefore impose operational tasks and time costs on those roles, but do not specify who funds training, storage infrastructure, or replacement of equipment.

In short, the Directions primarily affect APS employees within Customs who hold authorised issuing or carrying roles and their immediate supervisors and EL1+ decision makers. The instrument’s disciplinary machinery is tied to APS employment provisions rather than to criminal or civil penalties in the instrument itself.

Duties of authorised arms issuing officers

• May issue approved firearms and approved items of personal defence equipment to an officer authorised to carry arms only in specified circumstances: (a) deployment to enable the safe exercise of powers conferred under the Customs Act or any other Act for a planned or other task or activity; (b) delivery of training for that purpose; (c) maintaining serviceability for that purpose (cl 6(2)). The authorised issuing officer must not issue equipment if they are directed under cl 6(4)(c)(ii) not to do so (cl 6(3)). The issuing officer also has responsibility to ensure recalled items are returned to secure storage as soon as practicable (cl 8(5)).

Duties of officers authorised to carry arms

• An officer authorised to carry arms who has been issued equipment must keep the equipment in a “secure state” while issued (cl 7(2)). “Secure state” is defined to mean, when equipment has been deployed to be used as soon as practicable, a state where items would not inadvertently cause harm; in all other circumstances secure storage in accordance with cl 10 (cl 7(6)). If an officer indicates illness, is visibly impaired, or their ability is under reconsideration, a relevant officer may direct the officer to return issued equipment (cl 7(3)(c)), and the officer must comply by returning items as soon as practicable or causing their return (cl 7(4)-(5)). Officers must maintain security of any equipment issued to them or in their possession (cl 9(4)).

Recall and return obligations

• Approved firearms and items can be recalled at any time by an authorised arms issuing officer or an EL1+ (cl 8(2)). At the conclusion of any task or activity for which items were issued, all items issued for that task are recalled (cl 8(3)). An officer authorised to carry arms must return recalled items to an authorised arms issuing officer “as soon as practicable” (cl 8(4)); authorised issuing officers must ensure recalled items are returned to secure storage as soon as practicable (cl 8(5)).

Secure storage obligations

• When recalled, equipment must be secured in one of two ways: a lockable storage space with restricted access, or a lockable container in possession of an authorised issuing officer, or an officer authorised to carry arms (cl 10(2)). The instrument defines a lockable storage space as a fixed compartment or facility with restricted access, and a lockable container as an impact resistant container capable of being locked at two separate points (cl 10(3)).

Permitted use

• Use is authorised only where it enables the safe exercise of powers under the Customs Act or any other Act, for delivery of training to enable that safe exercise, or to maintain serviceability for those purposes, and use must be consistent with enabling the safe exercise of those powers (cl 9(2)(a)-(b)). The instrument also permits other Customs officers to use or handle equipment for training or to assist the officer issued with equipment to enable the safe exercise of powers (cl 9(3)).

Decision‑making and discretionary powers

• “Relevant officer” in cls 6 and 7 is given a gatekeeping role: an APS Level 6 or higher in ABF, or the direct supervisor, may refuse issue or direct recall if the fitness conditions in cl 6(4) or cl 7(3) arise. Recall authority is also given to EL1+ officers (cl 8(2)). These provisions concentrate operational discretion in supervisory and specified classification roles.

Administrative consequences

• Non‑compliance “may result” in action to determine whether the officer has breached the APS Code of Conduct (cl 11). The Notes to cl 11 explicitly link non‑compliance consequences to the Public Service Act discipline regime (s 13 for the Code; para 29(3)(g) for termination) and to section 32 of the Australian Border Force Act for termination where serious misconduct is reasonably believed (cl 11 notes). The Directions do not prescribe criminal penalties or civil remedies within their text.

Rights and procedural limitations

• The instrument gives officers the right to possess and use approved firearms and other approved personal defence items only within the tightly defined purposes and subject to supervisory direction and recall. It also gives relevant officers the right to refuse issue or direct return where incapacity or reconsideration exists. The Directions do not set out an appeal process within the instrument itself against refusal or recall, nor procedural steps for challenge; disciplinary consequences are framed through employment procedures in the Public Service Act and the Australian Border Force Act as cross‑referenced.

Recordkeeping and proof obligations

• The Directions do not specify recordkeeping requirements, reporting forms, or audit processes. The lack of express administrative record obligations implies that compliance will rely on established departmental administrative processes external to the Directions.

In summary, the instrument creates a set of operational duties and supervisory rights governing issuance, possession, use, recall and storage of approved firearms and personal defence equipment. It outsources enforcement to existing employment discipline mechanisms rather than creating new statutory offences.

Nature of enforcement in the instrument

• The Directions do not create offences, monetary penalties, or express civil liabilities. Instead the instrument frames enforcement as administrative employment consequences. Clause 11 states that unless otherwise permitted by the Directions, a failure to comply by an authorised arms issuing officer, or an officer authorised to carry arms, employed under the Public Service Act may result in action being commenced to determine whether that officer has breached the APS Code of Conduct set out in section 13 of the Public Service Act (cl 11).

Employment consequences referenced

• The Note to cl 11 makes the administrative consequences explicit. It states that a breach of the APS Code of Conduct is a ground for termination of employment under paragraph 29(3)(g) of the Public Service Act. The Note further states that the Secretary or Australian Border Force Commissioner may terminate employment under section 32 of the Australian Border Force Act if the Secretary or Commissioner reasonably believes that the employee’s conduct amounts to serious misconduct and is having, or is likely to have, a damaging effect on the professional self‑respect or morale of APS employees, or on the Department’s reputation with the public, other governments, or persons to whom information may be disclosed under Part 6 of the Australian Border Force Act (cl 11 notes).

Operational enforcement mechanisms

• The Directions themselves embed operational enforcement mechanics by granting supervisory and senior officers the power to refuse issue or direct return or recall of equipment (cls 6(4), 7(3), 8(2)-(4)). Those directions are immediate operational controls: an authorised arms issuing officer may refuse issuance when directed; relevant officers may instruct authorised arms issuing officers not to issue, and may direct a carrying officer to return equipment if incapacity or reconsideration applies (cls 6-7). Recalled items must be returned “as soon as practicable” (cl 8(4)-(5)) and authorised issuing officers must ensure items are returned to secure storage (cl 8(5)). Those operational controls are the front line of compliance.

Standard of proof and procedures

• The instrument does not specify the standard of proof, investigatory procedures, hearing rights, or appeal rights for administrative discipline. It relies on the Public Service Act and Australian Border Force Act frameworks for disciplinary process and termination (cl 11 notes). Practitioners should therefore expect any enforcement process to follow the administrative procedures and safeguards in those Acts rather than being governed by the Directions themselves.

No criminal or civil penalties

• Nowhere in the Directions is a criminal penalty, fine, or civil cause of action created. The instrument confines its remedial and enforcement approach to operational directions, return and storage requirements, and to employment sanctions referred to through cross‑reference.

Practical enforcement implications

• Because recall, refusal and return powers are immediate and available to supervisory officers and EL1+ decision makers, day‑to‑day compliance will be enforced operationally through directions and physical retrieval of equipment. For more serious alleged breaches, the instrument places the outcome within existing employment discipline regimes, which potentially include termination under the Public Service Act and the Australian Border Force Act (cl 11 notes).

In short, enforcement is administrative and employment‑centred. The instrument empowers immediate operational direction and recall, and delegates disciplinary consequences to the APS and ABF statutory employment frameworks rather than creating new statutory penalties.

Statutory basis and subordinate instrument status

• The Directions are made under subsection 189A(2) of the Customs Act 1901 and the equivalent provisions in the external territories Customs Acts (cl 3). As a directions instrument under that statutory head, it is a subordinate instrument that specifies how Customs handles approved firearms and approved items of personal defence equipment within the statutory framework for Customs officers. The Directions therefore operate within the scope of powers conferred by the primary legislation; they do not purport to amend or displace the primary statutory powers themselves.

Cross‑references to the Public Service Act and ABF Act

• Clause 4 imports definitions and cl 11 relies on employment disciplinary machinery in the Public Service Act. Clause 11 and its notes cross‑refer to the APS Code of Conduct set out in s 13 of the Public Service Act and to termination provisions (para 29(3)(g)). The Note to cl 11 also cross‑refers to s 32 of the Australian Border Force Act as a termination ground where the Secretary or Commissioner reasonably believes serious misconduct exists. Those cross‑references mean the Directions must be read in conjunction with the Public Service Act and the Australian Border Force Act when dealing with discipline and termination.

External territories and equivalent Customs Acts

• The instrument explicitly states equivalent making power under the Customs Act (C.I.), (C.K.I.) and (NI) for the external territories (cl 3). It also notes that a number of expressions are defined in the Customs Act and the external territory Customs Acts and that those definitions are relevant (cl 4 note). The Directions therefore apply subject to the definitions and scope of application in those primary instruments in the external territories.

Acts Interpretation Act reference

• Clause 8(3) contains a Note that directs readers to the Acts Interpretation Act 1901 for the interpretation that where multiple tasks or activities are undertaken the recall obligation applies at the end of the tasks or activities. This indicates the Directions rely on general interpretative principles from the Acts Interpretation Act to resolve timing and application questions.

No new criminal regime or civil causes of action in the instrument

• The Directions themselves do not create criminal offences, fines or civil liabilities. They rely on employment discipline for enforcement (cl 11). Any civil or criminal liability that might arise from conduct involving firearms or weapons would remain governed by other statutory regimes external to the Directions, but the Directions do not themselves purport to displace those regimes.

Operational interface with departmental processes

• The Directions do not specify recordkeeping, training standards, or equipment procurement processes. Those operational matters will sit alongside departmental policies, training manuals and asset management systems. Clauses such as the obligation to ensure recalled items are returned to secure storage as soon as practicable (cl 8(5)) and the definitions of storage (cl 10) will interact with any departmental physical security and asset control regimes.

Hierarchy of directives and repeal of earlier instruments

• Clause 5 repeals the Comptroller (Operational Safety) Directions 2021 and Comptroller‑General of Customs (Operational Safety) Directions 2021. The repeal indicates this instrument replaces the previous operational safety directions on these topics. Practitioners must therefore consult this instrument rather than the repealed 2021 instruments for current operational directions.

In short, the Directions operate as a subordinate instrument sitting within the statutory framework of the Customs Acts and as an operational adjunct to the Public Service Act and Australian Border Force Act disciplinary frameworks. They do not create new offence regimes and rely on existing departmental and statutory frameworks for broader matters such as discipline, training and asset management.

Original making and commencement

• The instrument is captioned as the Customs (Deployment of Approved Firearms and Other Approved Items of Personal Defence Equipment) Directions 2026. It is made and signed by Gavan Reynolds, Comptroller‑General of Customs, dated 5 March 2026 (front page). Clause 2 sets the commencement: the whole instrument commences the day after registration, according to the commencement table in cl 2.

Repeals and replacement

• Clause 5 expressly repeals two prior instruments: Comptroller (Operational Safety) Directions 2021 and Comptroller‑General of Customs (Operational Safety) Directions 2021. The repeal is categorical; there is no transitional provision in the text preserving parts of the earlier instruments. Practitioners should therefore treat the 2026 Directions as replacing the repealed instruments for matters within their scope.

No amendments recorded in the text

• The instrument contains the full text as made, and includes the commencement table and a note that the table relates only to provisions as originally made and will not be amended in the instrument text itself (cl 2(2)). The instrument as provided contains no subsequent amendment history or later variations. Any later amendments, if made, would appear in an external instrument register or consolidated version managed by the sovereign publication.

Preambles and notes

• The instrument contains explanatory notes within some clauses that guide interpretation, for example the note in cl 8(3) referencing the Acts Interpretation Act 1901 to clarify the operation of recall at the end of multiple tasks. Clause 4 contains a note that a number of expressions used are defined in the Customs Acts and the external territory Customs Acts. These notes are interpretative aids included in the instrument as made.

Statutory authority and scope

• The instrument is made under subsection 189A(2) of the Customs Act 1901 and under the corresponding subsections for the external territories Customs Acts (cl 3). There is no separate provision in the instrument for amendment procedure; it is a standard subordinate instrument and therefore subject to whatever supervening rules apply to such instruments under the enabling Acts and any applicable legislative instruments procedures.

Practical implications of repeal

• The repeal of the 2021 operational safety directions indicates a conscious replacement of the earlier operational guidance. Because the instrument provides new or consolidated directions for issuance, recall, use and storage, organisations and officers must align policies, training and storage arrangements with the 2026 Directions from their commencement date. The text contains no transitional provisions; operational transition will need to be managed administratively by the department.

Document provenance and authorising officer

• The signature block and the maker’s name are included on the instrument itself (front pages), recording it as an instrument executed by the Comptroller‑General of Customs on 5 March 2026. That marks the formal provenance and identifies the responsible agency head.

In summary, the instrument is an original 2026 Directions instrument that commenced the day after registration, replaces two 2021 operational safety directions, and contains no amendment history within the text supplied.

No litigation recorded in the instrument

• The Directions document itself does not contain any references to litigation, court decisions, tribunal determinations, or challenges. It names no cases and records no disputes or judicial review outcomes.

No case law cited or annexed

• The instrument contains no annexures that reproduce judicial decisions or administrative law determinations. The text is solely the Directions, definitions, commencement, repeal and the administrative enforcement cross‑references. There are no recorded legal opinions appended to the instrument.

Implications for practitioners from the absence of litigation history

• Because the instrument contains no litigation history, practitioners wishing to understand how courts might construe its terms must rely on the instrument’s text and the primary statutes it invokes. The Directions themselves are an administrative instrument; any legal questions about its validity, construction or intersection with other statutory duties would need to be resolved through litigation or administrative review proceedings outside the instrument, but none are mentioned in the text.

Administrative enforcement path reflected instead of court action

• The instrument emphasises administrative enforcement through APS disciplinary processes rather than criminal sanctions or civil penalties (cl 11). Consequently, most immediate consequences of non‑compliance contemplated in the Directions are administrative and employment‑based, not matters that the instrument itself routes to criminal courts. The Directions do not preclude criminal or civil proceedings under other law, but such interactions are not recorded in this instrument.

What the absence does not mean

• The lack of litigation history in the instrument is not a substantive statement about the legality or vulnerability of its provisions. It is simply a record that the instrument does not include precedent or reported disputes. Practitioners seeking to test legal questions arising from these Directions should therefore look to the enabling statutes, departmental policies, and, if necessary, pursue or consult any external case law that may later engage these Directions. The instrument itself contains no such litigation record.

Practical consequence for compliance risk assessment

• From a compliance perspective, the Directions’ enforcement emphasis is administrative. The absence of litigation material means advisers must evaluate compliance risk principally through four lenses available in the instrument: the operational directions for issue/use/recall/storage (cls 6-10); the definition of decision‑maker thresholds (cls 6(5), 7(6), 8(2)); the administrative enforcement route via the APS Code and ABF Act termination provisions (cl 11 notes); and the connection to departmental asset and security controls implicit in cl 10. Any legal challenge to actions taken under these Directions would be an external process not recorded here.

In short, the instrument contains no litigation history or cases; it records administrative, not judicial, enforcement pathways. Any litigation history would have to be gathered from other sources outside the instrument.

Ambiguity of “as soon as practicable”

• Several obligations require prompt action “as soon as practicable” when returning recalled items or when authorised officers must ensure items return to secure storage (cls 7(4)-(5), 8(4)-(5)). That phrase is flexible and fact dependent. The Directions do not define measurable timeframes or specify interim custody arrangements. Operational practice will therefore need to interpret what is practicable in context, and variability can create compliance risk if an officer’s view of “practicable” differs from a supervisor’s.

Different security regimes depending on state

• The Directions distinguish between a “secure state” when equipment is deployed for imminent use and “secure storage” in other circumstances (cl 7(6), cl 10(2)). A secure state when deployed is framed around preventing inadvertent harm, not locked storage. Practically, the permitted security practices differ by context, which may create confusion at handover points between deployed use and recalled/storage phases.

Who counts as a “relevant officer”

• The gatekeeping role rests with “relevant officers”, defined in cls 6(5) and 7(6) as APS Level 6 or higher in the Australian Border Force, or the direct supervisor of the officer authorised to carry arms. That definition ties authority to organisational classification and supervisory relationships. It may be a practical “gotcha” where staffing structures are atypical: for example, temporary acting arrangements, secondments, or outside contractors are not addressed. The instrument refers in cl 11 only to employees under the Public Service Act for disciplinary consequences, leaving non‑APS personnel potentially in a grey area.

Recall authority broadened to EL1+

• Clause 8(2) allows recall by an authorised arms issuing officer or an APS employee holding or performing EL1 functions or higher. That sits alongside the Level 6 supervisor role for issuance decisions. In practice the separation of issuance gatekeeping and recall authority across levels can create coordination issues and conflicting directions during operations.

No express recordkeeping, reporting or audit framework

• The Directions do not set out what records must be kept for issue, return, recall, training, maintenance or incidents. Absence of mandatory recordkeeping increases the risk of disputes about whether directions were followed and complicates administrative investigations referenced in cl 11. Departments will need to rely on separate asset control and administrative policy.

Fitness and “ability under reconsideration”

• The instrument permits refusal or direction to return where ability to use equipment is “under reconsideration” (cls 6(4)(b)(iii), 7(3)(b)(iii)). The phrase is open‑ended and could encompass a range of supervisory actions from temporary administrative review to medical incapacity inquiries. The instrument gives no process for how reconsideration is to be implemented, who triggers it, and what interim safeguards apply while reconsideration occurs.

Storage specification but not capacity or access controls

• The Directions define a lockable storage space and lockable container (cl 10(3)) but do not specify access control lists, audit logs, key control procedures, or technical standards beyond “impact resistant” and “locked at two separate points” for containers. Departments will need to specify the operational security regime to make the specification effective and defensible in an investigation.

No internal appeal or review mechanism in the Directions

• The Directions provide supervisory discretion to refuse issue or direct return but do not specify an internal appeal or review pathway within the text. For disciplinary outcomes, the instrument points to the Public Service Act and ABF Act processes, but for operational directions , for example, a refusal to issue on the basis of “visibly incapacitated” , the instrument does not set an immediate procedural recourse. That may create practical friction in operations.

No express treatment of lost, stolen or damaged equipment

• The Directions require return and secure storage but do not address in‑instrument consequences or mandatory reporting steps for lost, stolen or damaged equipment. Those matters will need to be managed under separate departmental procedures or other statutory reporting obligations not set out here.

Overlap with other legal regimes

• The instrument does not create offences, yet firearms or weapons incidents may engage criminal or state firearms regimes outside this instrument. The Directions do not address how those external regimes operate concurrently. Practitioners should note the Directions do not resolve or incorporate those external regulatory obligations.

In summary, the main practical pitfalls flow from open‑ended phrases such as “as soon as practicable” and “under reconsideration”, mismatch between issuance and recall authorities, lack of specified recordkeeping and audit standards, and no procedural pathways for operational disputes. These operational gaps increase reliance on departmental policy to translate the Directions into daily practice.

Establish a clear issuance protocol aligned to cl 6(2)

• Ensure authorised arms issuing officers issue approved firearms and personal defence items only for the three specified purposes in cl 6(2): deployment to enable the safe exercise of powers, delivery of training for that purpose, and maintenance of serviceability for that purpose. Operational checklists should require the officer issuing to record the purpose, the task or activity, the recipient, date and expected return time.

Implement fitness screening and supervisory sign‑offs

• Before issuing equipment, the authorised arms issuing officer should confirm the officer authorised to carry arms is fit to use the equipment. Clause 6(4) requires refusal where the officer indicates illness, is visibly impaired, or their ability is under reconsideration. Put a simple protocol in place: prior to issue, obtain a fitness declaration or supervisor sign‑off; where visible impairment or illness is present, follow the refusal/recall procedure and document actions. The Directions make the supervisor or an APS Level 6 or higher the “relevant officer” who may direct refusal or recall (cl 6(5); cl 7(6)).

Document issuance and recall with timestamped records

• Because the Directions do not prescribe recordkeeping, create and retain contemporaneous records of issue, return and recall. Records should capture who issued equipment, to whom, for what task, when it was issued, condition and serial numbers, and when and how it was returned to secure storage. For recalls (cl 8), note the recalling officer, the reason, the time of direction, and the time of actual return “as soon as practicable” to demonstrate compliance.

Design and maintain secure storage to meet cl 10

• Ensure recalled items are stored in either a lockable storage space with restricted access or in a lockable container as defined (cl 10(2)-(3)). Translate “lockable storage space with restricted access” into an operational regime with controlled access lists, key or combination control, visitor logs, environmental protection, and regular inspections. For lockable containers, ensure they are impact resistant and capable of being locked at two separate points; maintain inventory control and storage logs.

Create a return and handover protocol for deployed equipment

• For deployed equipment, maintain a “secure state” during operations that prevents inadvertent harm (cl 7(6)(a)). Establish procedures for handovers between shifts or role changes that document continuity of custody and any temporary security measures when items are deployed and need to remain immediately available for use.

Set a recall escalation chain and timing expectations

• Clause 8(2) permits recall by authorised issuing officers and EL1+ officers. Operationalise an escalation chain so officers know who can recall equipment and how to effect immediate return. Given the “as soon as practicable” standard (cls 7(4), 8(4)-(5)), set internal response time expectations appropriate to the operational environment and document any deviation with reasons.

Integrate with training and maintenance schedules

• Clauses 6(2)(b) and 9(2)(a)(ii) allow issuance and use for training and for maintaining serviceability. Ensure training schedules, attendance records, and maintenance logs are kept and explicitly tied to the authorised purposes for issue and use. Record any instances where assisting officers handle equipment under cl 9(3).

Define procedures for incapacity and “reconsideration”

• The Directions permit refusal or recall where an officer indicates illness, is visibly impaired, or ability is “under reconsideration” (cls 6(4), 7(3)). Establish a written chain of command and process for triggering “reconsideration”, including who is authorised to initiate it, what interim steps are required, whether medical advice is necessary, and how long reconsideration may reasonably last. Document decisions and the rationale to support any subsequent disciplinary assessment.

Link operational compliance to APS disciplinary processes

• Clause 11 contemplates disciplinary action under the Public Service Act and possible termination under the ABF Act. Ensure supervisors and HR are aware of the nexus between operational non‑compliance with these Directions and employment discipline. Map the steps from operational breach through internal investigation to possible APS Code of Conduct processes so that investigations are timely, fair and documented.

Deploy asset control and audit mechanisms

• Because the Directions do not set specific audit or inventory requirements, implement routine audits, reconciliation checks of serialised items, and immediate reporting for loss, theft or damage. Ensure any incident reporting aligns with departmental incident protocols so that the supervisory and disciplinary pathways referred to in cl 11 can be commenced with adequate documentary support.

Train supervisors on discretionary powers

• Provide targeted guidance and training to APS Level 6 and EL1 officers and direct supervisors so they understand when to exercise refusal and recall powers (cls 6(4), 7(3), 8(2)). Include scenarios that illustrate visible impairment, medical incapacity, and administrative “reconsideration” to reduce arbitrariness in decisions and to ensure decisions are contemporaneously justified in writing.

Coordinate with broader departmental policies

• Ensure these Directions are integrated with departmental firearms policies, occupational health and safety rules, privacy and medical confidentiality obligations, and any external legal obligations relating to firearms or weapons. The Directions do not contain these cross‑cutting rules, so administrative policy must supply them operationally.

Prepare for administrative investigations

• Given enforcement is administrative, maintain clear, contemporaneous records of issue, return and any supervisory directions. If an investigation under the APS Code of Conduct is initiated (cl 11), well‑kept records demonstrating compliance with the Directions and departmental procedures will support both the department’s position and the officer’s defence.

In summary, compliance requires operationalising the Directions through documented protocols for issuance, fitness screening, recall, secure storage, recordkeeping and supervisory decision‑making, and integrating those protocols with departmental training, asset control and disciplinary frameworks.
