Plain English Summary

2/10 complexity

This by-law officially applies Article 2.6 of the Australia–US Free Trade Agreement to Item 16, Schedule 4 of the Customs Tariff Act 1995, allowing Australian importers to access the reduced or eliminated customs duties on qualifying US-origin goods. It affects importers, customs brokers and Border Force officers who administer and claim preferential tariff rates.

It matters because, without this prescription, the AUSFTA tariff cuts would not operate under Australian law. Effective 1 March 2013 (made under s.271 of the Customs Act 1901).
