Plain English Summary

2/10 complexity

This by-law implements part of Australia's free trade deal with Chile into Australian customs law.

What it does:

Officially recognises Article 3.7 of the Australia-Chile Free Trade Agreement for the purposes of Item 16 in Schedule 4 of the Customs Tariff Act 1995
Item 16 is the provision that allows goods to qualify for reduced or zero customs duty (preferential tariff rates) when imported from countries with which Australia has trade agreements

Who it affects:

Businesses importing goods from Chile into Australia
Customs brokers handling Australia-Chile trade
Exporters seeking preferential tariff treatment

Why it matters: Without this by-law, Australian Customs couldn't apply the specific rules in Article 3.7 (which typically cover how to determine if goods truly originate from Chile) when deciding whether to charge reduced duty rates. It ensures the trade agreement actually has legal effect at the border.
