Curriculum Council Regulations 2005

The regulations rest on a small set of operational concepts, each defined or given effect in particular provisions.

Unique reference number and student record (regs 4, 13): The Authority must set administrative arrangements for allocating a unique reference number (URN) to students for whom a student record is opened under Part 3A of the Act (reg 4(1)). The person required by the Act to open a student record must allocate the URN in accordance with those arrangements (reg 4(2)), and that URN is “prescribed” for the purposes of s 19E(c) of the Act (reg 4(3)). The term unique reference number is also used as the identifying method for candidates in practical examinations (reg 24(2)) and is required to appear on examination identification documents issued by the Authority (reg 16(1)).

Information supply and timing obligations (regs 5-7, 9): Principals and non‑school providers are legally obliged to supply particulars of students’ results and enrolment/employment status to the Authority (regs 5 and 6). A student record must be opened not later than the end of the first term of the relevant school year (reg 7(1)). Information that principals and providers must give (regs 5-6) is due by specific deadlines: generally by 31 December for year‑end data (reg 7(2)), 14 days after enrolment/employment for providers caught by s 19F(2)(b) or (3) unless subreg (4) or (5) applies (reg 7(3)), or 7 days after cessation for providers in s 19F(5) (reg 7(6)). The Authority can extend compliance timeframes on request (reg 7(7)). Reg 9 prescribes data that must be provided to the Director of Catholic Education and the Association of Independent Schools of Western Australia, including specified enrolment and course participation counts as at 31 December each year, with that information due by 28 February in the following year (reg 9(2), (3)).

Fees and Ministerial fee‑making (regs 10-12; Schedule 1): Fees for Australian resident students are those in Schedule 1 (reg 10). For non‑residents the Minister can determine fees (reg 11(2)) and may set differing fees by course, school, country of origin or other cost‑related criteria (reg 11(3)). Charges for publications may also be determined by Ministerial instrument (reg 12(3)). Schedule 1 lists discrete items and dollar amounts for certification, assessment and examination services (Schedule 1, items 1-14).

Examination architecture (Part 4, regs 13-28): The regulations define candidate and examination terms (reg 13), establish who must take examinations (reg 14(2)), require written notice of time and place (reg 15), and require Authority‑issued identification documents (reg 16). Supervisors are appointed by the Authority and are directed to secure examination materials (reg 17). Candidate conduct rules set what may be brought into the exam (reg 18(2)), require answers in English unless the Authority directs otherwise (reg 19), and govern food/drink, communication with others, removal of materials, and leaving the examination centre (regs 20-23). Practical examinations have special anonymity and authenticity requirements (reg 24). Special arrangements are available for candidates with disability, illness or injury and there is a separate special consideration route for acute problems (reg 25). Misconduct including fraud or collusion can lead to mark reduction (including to zero) by a relevant committee (reg 26), and appeals are available with tight timelines and committee appointment requirements (regs 26-28).

Research disclosure procedures (Part 5, regs 29-35): These regulations operationalise s 32B disclosure by requiring written requests that identify methodology and indicate whether human research ethics committee approval exists (reg 31). Non‑government requests that may involve personal information are to be referred to a Board committee for advice on whether disclosure would involve personal information and on the recipient’s ability to secure and comply with conditions (reg 32(3)-(4)). The Board must maintain a register of requests (reg 33) that records certain specified items including whether personal information categories were disclosed (reg 33(2)-(3)), but the register must not itself include personal information (reg 33(4)). If a request is refused, written notice of refusal and reasons must be provided to the applicant (reg 34). The Authority’s annual report must report on the number, nature and outcome of accepted requests (reg 35).

Cross‑referenced statutes and standards: Some definitions and authorities depend on other Commonwealth or State instruments. The definition of Australian resident refers to the Australian Citizenship Act and the Migration Act (reg 3). Reg 9 cross‑references the School Education Act 1999 s 11B for course categories. Part 5 references the National Ethical Statement (the National Statement on Ethical Conduct in Human Research) and the National Health and Medical Research Council Act 1992 (reg 30), and reg 32 uses definitions from the Public Sector Management Act 1994 to define “non‑government request” boundaries.

In short, the main operational building blocks are a URN‑centred student record system, mandated and time‑bound information reporting by schools and providers, fee schedules and ministerial fee‑making powers, a set of procedural rules for high‑stakes external examinations (including misconduct and appeals), and a structured Board process for research access to Authority information including committees, a register and reporting obligations.

The regulations create obligations and rights for several identifiable groups and institutions. The text itself specifies the actors; the effects follow from who must act, who pays, and who may access information.

Students: All students in the scope of Part 3A of the Act are affected because the Authority must open a student record for them and allocate a unique reference number (reg 4(1)-(3)). Students in the final year of the compulsory education period are specifically affected by mandatory examination requirements (reg 14(2)), by practical examination identification and declaration requirements (reg 24(2)-(3)), and by special arrangements procedures and special consideration pathways for illness or disability (reg 25).

Parents and guardians: Indirectly affected because schools and providers must supply information about students’ enrolments and results to the Authority (regs 5-7), and because the register and disclosure mechanisms may result in student information being made available for research in anonymised or conditionally disclosed forms (regs 31-35).

School principals and schools: Principals of schools are directly mandated to inform the Authority of the results achieved by each student enrolled at the end of each school year, for students from the first year of the relevant education period to the final year of the compulsory education period (reg 5(1)-(2)). Principals must submit some applications and evidence to the Authority on behalf of student applicants seeking special arrangements (reg 25(5)). School managers/examination centre managers are responsible for securing examination materials supplied to the centre (reg 15(2)) and ensuring supervisors implement the Authority’s directions (reg 17(2)).

Other providers: The regulations apply to providers other than schools listed in the table in the definition of “provider” in s 19A(2) of the Act, including employers of apprentices, trainees and other categories (reg 6(1)-(3)). Providers must give particulars of final results at assessment and notify the Authority about enrolment or employment events within specified short timeframes (reg 7(3), (6)).

Private candidates and non‑school candidates: Persons not enrolled at a school may sit Authority examinations as private candidates if they meet residency, application timing and fee‑payment requirements (reg 14(3)). Schedule 1 prescribes fees for non‑school candidates and late entries (Schedule 1 items 6-9).

The Authority and the Board: The Authority administers records, URN allocation (reg 4), issues identification documents for examinations (reg 16), appoints supervisors and committees (regs 17, 26(1), 27(1)), and receives and processes data from providers (regs 5-7). The Board, through Part 5, is the decision‑maker on disclosure requests, must appoint committees to advise on non‑government requests and maintain a public register of requests (regs 29-35).

Minister and Government bodies: The Minister has discretion to set fees and charges for non‑residents and publications by Gazette instrument (regs 11(2), 12(3)), and reg 9 requires particular data to be supplied to the Director of Catholic Education and the Association of Independent Schools of Western Australia, which are named recipients for state schooling data (reg 9(1)). Part 5 uses definitions from the Public Sector Management Act 1994 to distinguish government from non‑government requestors (reg 32(1)).

Human research ethics committees and researchers: Researchers seeking Board disclosure of relevant information must submit written requests satisfying reg 31, and indicate whether their research has been approved by a human research ethics committee constituted under the National Statement (reg 30, reg 31(c)). Non‑government research requests that are likely to involve personal information must be considered by a Board committee for suitability (reg 32).

Community and peak school organisations: The Director of Catholic Education and the Association of Independent Schools of Western Australia receive statistical datasets as prescribed in reg 9 and are therefore users of the Authority’s datasets for planning or oversight purposes.

Who pays: Schedule 1 enumerates fees payable by students and private candidates for certification, assessment and examination services (Schedule 1 items 1-14). The Minister’s power to set fees for non‑residents and publications (regs 11(2), 12(3)) means fees for some users are subject to executive determination.

In brief, the regulations affect students (especially final‑year and examination candidates), principals and schools, non‑school providers and employers who train or employ students/apprentices/trainees, private candidates, researchers seeking data access, and the Authority/Board and the Minister who exercise operational and fee‑setting powers.

The regulations set out concrete duties for particular actors, and confer procedural rights (for example appeal rights) in narrow, tightly time‑bounded ways. The following is a compact mapping of statutory duties and express rights.

Duties on the Authority and Board

• Establish URN allocation arrangements and issue URNs for students as required by the Act (reg 4(1)-(3)). The URN is the prescribed identifier for student records (reg 4(3)).

• Issue identification documents to candidates that contain the candidate’s URN and other identifying information (reg 16(1)). The Authority must give written notice of examination time, place and attendance time to candidates (reg 15(1)).

• Appoint supervisors and ensure secure custody of examination materials (reg 17(1)-(2)); appoint relevant committees and appeals committees to deal with misconduct and appeals (regs 26(1), 27(1)), and, subject to the Authority’s directions, committees determine their own procedure (reg 28).

• Accept only written disclosure requests that provide sufficient information to understand the objectives and methodology of the research and identify the relevant information sought, and which indicate whether human research ethics committee approval exists (reg 31).

• Appoint at least one committee to review non‑government requests (reg 32(2)) and maintain a register of requests containing specified details (reg 33(1)-(3)). Provide written notice and reasons when refusing a request (reg 34), and report requests in the Authority’s annual report (reg 35).

Duties on schools, principals and providers

• Open student records for students for whom they are responsible, allocate URNs in accordance with the Authority’s arrangements (reg 4(2)) and comply with Act provisions referenced in the regulations (reg 4).

• Principals must inform the Authority of results achieved by a student enrolled at the end of the school year, for students from the first year of the relevant education period to the final year of the compulsory education period, in accordance with Authority requirements (reg 5(2)).

• Providers other than schools must give particulars of final results for students, apprentices or trainees when assessed (reg 6(2)), and employers who employed certain employees on 1 December must inform the Authority of that employment (reg 6(3)).

• Timely reporting obligations: a student record must be opened not later than the end of the first term (reg 7(1)); year‑end information for regs 5 and 6 must be given no later than 31 December of the year (reg 7(2)); other providers must give specified information within 14 days of enrolment/employment (reg 7(3)); providers must notify cessation within 7 days (reg 7(6)). The Authority may extend time on request (reg 7(7)).

Duties on candidates

• Candidates must produce their identification document when requested by a supervisor (reg 16(2)).

• Candidates must not bring unauthorised materials into an examination (reg 18(2)) and must comply with reasonable directions from supervisors or other authorised persons (reg 18(4)). Answers must be in English unless the Authority allows otherwise (reg 19). Food and drink rules, communication restrictions and prohibitions on removing materials are set out at regs 20-23. Practical examination submissions must be accompanied by signed declarations (reg 24(3)-(4)).

Rights of appeal and process protections

• If a relevant committee reduces a candidate’s marks for misconduct, the candidate has a right to appeal in writing within 7 days of notification of the reduction (reg 26(3)-(5)). The appeals committee must be appointed within 5 days of receipt of the appeal or of required evidence (reg 27(2)) and must notify the candidate of its decision before publication of the results (reg 27(5)). The appeals committee may confirm the reduction or increase marks up to their pre‑reduction level (reg 27(4)).

• Researchers/applicants: the Board must refuse or approve requests only after the procedural tests in regs 31-33, and if the Board refuses an accepted request it must provide written notice with reasons (reg 34). The register and annual report provide transparency about requests and outcomes (regs 33, 35).

Fee and charge entitlements and obligations

• For Australian resident students, fees and charges are as set out in Schedule 1 (reg 10). For non‑residents, the Minister may determine fees (reg 11(2)-(3)). Publication charges are determined by Ministerial instrument if any (reg 12(2)-(3)).

Discretion and delegation

• The Authority has discretionary authority to make a range of operational decisions: it may issue exemptions (reg 14(2)), approve special arrangements for disabled or ill candidates (reg 25(1)), grant special consideration (reg 25(3)-(4)) and extend compliance timeframes (reg 7(7)). The Board may direct committees to reconsider advice (reg 32(5)). These delegations are explicit in the text.

In summary, the regulations set out a system of duties for data collection and timeliness, operational duties and powers for examination integrity and candidate management, fee liabilities for particular classes of users, and procedural protections for candidates and applicants for research disclosure. The regulatory architecture mixes prescriptive obligations (deadlines, data items) with discretionary operational powers for the Authority and the Board.

The regulations prescribe operational enforcement mechanisms and remedial outcomes rather than criminal fines or administrative pecuniary penalties within the text provided. Enforcement is primarily administrative and procedural. Key points from the text:

Examination misconduct and marks reduction (reg 26): The principal enforcement tool linked to examinations is the power of a relevant committee to reduce a candidate’s marks (including to zero) for fraud, collusion or other misconduct during an examination (reg 26(2)). Misconduct is defined to include specified breaches such as failure to produce ID, bringing unauthorised materials into the examination, failing to comply with supervision directions, answering in a language other than English where not permitted, consuming food or drink contrary to the rules, communicating with others and removing exam materials, and breaches of the practical examination declaration requirements (reg 26(1) definition of misconduct and cross‑references to regs 16(2), 18(2) and (4), 19, 20(1), 21(2), 22, 23, 24(3)-(4)).

Appeal rights and timelines (regs 26-27): Candidates whose marks are reduced may appeal in writing within 7 days (reg 26(3)-(4)). The Authority must appoint an appeals committee of at least two suitable persons within 5 days after receipt of the appeal (or within 5 days after required evidence is received) (reg 27(2)). The appeals committee must decide and notify the candidate of its decision before results are published (reg 27(5)). Remedies available to the committee are confirm the reduction or increase marks up to the original pre‑reduction level (reg 27(4)). Those time constraints structure the enforcement process.

Security and custody obligations (regs 15(2), 17(2)): Examination centre managers and supervisors have obligations to keep examination papers and materials secure as directed by the Authority (reg 15(2), 17(2)). The regulations do not specify separate sanctions for breaches of duty other than the consequences under reg 26 for candidate misconduct and the Authority’s discretion to exclude a late candidate (reg 18(1)). The text does not specify separate enforcement mechanisms against centre managers or supervisors; any further sanctioning would depend on other statutory or contractual frameworks.

Compliance with information supply requirements (regs 5-7, 9): Schools and providers are subject to time‑based obligations to report results and enrolment/employment events to the Authority (reg 7). The regulations prescribe deadlines, and the Authority may extend time (reg 7(7)). The regulations do not set out specified fines or other express sanctions within the text for late or non‑compliance; enforcement mechanisms for non‑compliance are therefore not specified in these regulations and, if any, would rely on provisions of the Act or other administrative powers.

Board discretion and committee processes for disclosure (regs 31-34): For requests for disclosure of information, the Board may refuse requests. If it refuses, it must provide written notice of the refusal and reasons to the applicant (reg 34). The register requirement (reg 33) and the obligation to report in the annual report (reg 35) create transparency and reputational enforcement mechanisms for decisions on disclosure.

Ministerial fee determinations (regs 11-12): The Ministerial instruments that set fees for non‑residents and publications are subject to the ordinary legal controls on statutory instruments (publication in the Gazette) but the regulations do not themselves provide direct penalties for non‑payment; non‑payment consequences would be governed by the Authority’s policies or the Act.

Absence of criminal or pecuniary penalty provisions in the text: The regulations do not specify criminal offences, monetary fines or licence suspensions. The primary enforcement levers are administrative (mark reduction, exclusion from examinations, refusal of disclosure requests) and reporting/transparency obligations.

In short, enforcement within the regulations is chiefly administrative, channelled through the Authority’s discretion to reduce examination marks and to accept/refuse disclosure requests, and through obligations on supervisors and principals to secure materials and report data respectively. The regulations embed procedural protections and appeal routes (regs 26-28). For any criminal, pecuniary or other statutory penalties, one must look to the Act itself or to other applicable laws, because these regulations limit themselves to administrative and procedural remedies.

The regulations are cross‑referential and operate in a statutory ecosystem. The text expressly invokes or depends on a number of other Commonwealth and State statutes and standards. Each interaction is set out in the regulations and should be noted for compliance, jurisdictional reach, and evidentiary requirements.

Australian Citizenship Act and Migration Act (reg 3): The definition of Australian resident in reg 3 adopts terms from the Commonwealth Australian Citizenship Act and the Migration Act. The URN and reporting framework therefore depends on Commonwealth definitions for residency status, which in turn informs fee categorisation under regs 10-11 and eligibility for private candidature (reg 14(3)(a) requires residency of the State).

School Education Act 1999 (reg 9): Reg 9 refers to section 11B(1) of the School Education Act (SE Act) to categorise courses and options in the final two years of compulsory education. The dataset the Authority must provide to the Director of Catholic Education and the Association of Independent Schools requires counts for children undertaking course options listed in s 11B(1)(a), (b), (e) and for apprentices, trainees and employed children per s 11B(1)(c)-(d) (reg 9(2)(c)-(g)). Therefore, the Authority’s data collection and reporting must map directly to the SE Act’s statutory categories.

Public Sector Management Act 1994 (reg 32): Reg 32 defines “non‑government request” by reference to the Public Sector Management Act definitions for “agency” and “non‑SES organisation.” That statutory definition controls whether the Board must appoint a committee to review the request. The interplay imposes a separation between requests from government agencies and those from private or non‑government entities, with additional scrutiny for the latter.

National Statement on Ethical Conduct in Human Research and NHMRC Act (reg 30): Part 5 requires applicants to indicate whether their research has been approved by a human research ethics committee constituted and acting under the National Ethical Statement, defined as the National Statement on Ethical Conduct in Human Research issued under the National Health and Medical Research Council Act 1992 (reg 30). This links the Board’s disclosure decisions to nationally accepted ethical standards for human research, and the Board’s processes cannot ignore the existence or absence of HREC approval in assessing requests (reg 31(c)).

Financial Management Act 2006 (reg 35): The Authority’s annual report prepared under the Financial Management Act 2006 Part 5 must include reporting on the number, nature and outcome of requests accepted under reg 31 (reg 35). This creates a statutory obligation of public financial reporting and transparency in the Authority’s annual accounts process.

School Curriculum and Standards Authority Act 1997 (throughout): The regulations implement and give operational detail to various sections of the Act. Several regulations explicitly reference Act sections: for example, reg 4 (Act s 19E), regs 5-7 (Act ss 19C, 19D, 19G, 19F), reg 9 (Act s 19P), and regs 29-35 implement s 32B disclosure procedures. Compliance obligations for opening records, providing information, and the scope of the Authority’s disclosure powers therefore arise from the Act and are given effect or timing through these regulations.

Gazette instruments and subordinate law (regs 11-12): The Minister’s power to determine fees for non‑residents and publication charges by instrument published in the Gazette brings in the normal mechanisms of subordinate legislation and their controls. Any fees set under regs 11(2) or 12(3) will be Gazette instruments and operate as delegated executive decisions.

Statutory definitions and evidentiary standards: The regulations require evidence (medical certificates, statutory declarations) for special arrangements or practical exam declarations (regs 24(4), 25(2)-(4)). Those evidentiary requirements interact with the rules of other statutory instruments or public sector policies governing the form of medical evidence or statutory declarations.

In practice, compliance requires reading these regulations in tandem with the Act and, where referenced, the School Education Act, the Public Sector Management Act, the National Statement and the Financial Management Act. Operational staff must ensure that residency categorisations, course options and research ethics approvals are determined in accordance with the external statutes and standards named in the regulations.

The compilation table and marginal notes within the text record the regulations’ amendment history from their commencement through numerous instruments. The following timeline is drawn directly from the compilation table and the notes that accompany the text.

• Original regulations: Made as Curriculum Council Regulations 2005, published 23 December 2005, came into operation 1 January 2006 (reg 2).

• 2006 amendments: Curriculum Council Amendment Regulations 2006 published 18 October 2006 (amendment entry in reg 3 notes).

• 2009 amendments: Curriculum Council Amendment Regulations 2009, published 6 March 2009, operative for certain provisions from 6-7 March 2009.

• 2012 amendments: Curriculum Council Amendment Regulations 2012, published 14 August 2012, with other regulations operative from 15 August 2012. Also the School Curriculum and Standards Authority Amendment Regulations 2012 published 7 December 2012, operative from 8 December 2012, which included re‑naming and inserted headings (noted in the top of the text).

• 2013, 2014, 2017 amendments: Amendment Regulations in those years are recorded with publication dates (6 September 2013, 26 August 2014, 24 November 2017) and the typical commencement rules (see compilation table).

• 2020 amendments: School Curriculum and Standards Authority Amendment Regulations 2020 (SL 2020/233), published 4 December 2020 and operative 5 December 2020. These amendments notably inserted Part 5 , Procedures for disclosure of relevant information (regs 29-35) and defined the regime for research requests.

• 2022 and 2023 fees amendments: Education and Training Regulations Amendment (Fees and Charges) Regulations 2022 (SL 2022/61) commenced 1 July 2022; Education Regulations Amendment (Fees and Charges) Regulations 2023 (SL 2023/67) commenced 1 July 2023 and inserted an updated Schedule 1 fee table as noted in the Schedule (SL 2023/67 r. 8). The Schedule 1 in the consolidated text is noted as inserted SL 2023/67 r. 8.

Reprints: Reprint 1 as at 19 October 2012 and Reprint 2 as at 1 March 2013 are listed in the compilation table, indicating the regulations were periodically reprinted incorporating prior amendments.

Marginal notes and amendments: Specific regulations were amended across the amendment instruments; for example, regulation 3 was amended (Gazette 18 Oct 2006 p. 4453; 7 Dec 2012 p. 5984), regulation 4 was amended 14 Aug 2012 p. 3833, and regulations 5-7 were inserted or amended in 2012 (7 Dec 2012 p. 5984-5). The Schedule 1 was inserted by SL 2023/67 (r. 8).

Other notes: The explanatory footnotes indicate changes to Commonwealth references (for example, the Australian Citizenship Act reference is updated following repeal and replacement at Commonwealth level).

For legal work, the compilation table indicates the sequence of amendments and the operative dates of each amendment. Operational managers should confirm whether later Statutory Rules or reprints exist beyond SL 2023/67, but the compilation table provides the chronological amendment trace up to 16 June 2023 with substantive commencement on 1 July 2023 for the Schedule.

The text provided does not include or reference any case law or litigation history. There are no judicial decisions, appeals court citations, or tribunal determinations recorded in the regulations themselves or in the compilation table supplied.

Accordingly, within the corpus provided:

• There is no recorded litigation history attached to these regulations.

• No cases are named in the regulations or their notes.

If litigation history is relevant to a particular question (for example, enforcement of information‑supply obligations, challenges to disclosure of student data for research, or disputes about the application of misconduct/marks reduction provisions), researchers should search case law databases and administrative tribunal records for disputes involving the School Curriculum and Standards Authority, the Board, or the Authority’s regulations and decisions. The regulations themselves do not supply that information.

The regulations contain several operational details, tight timelines and cross‑references that create practical compliance risks and procedural pitfalls. The following items are concrete operational “gotchas” that flow directly from the text.

1. Multiple short deadlines for provider reporting (reg 7): Providers in section 19F(2)(b) or (3) must generally give information to the Authority not later than 14 days after the student is enrolled or employed (reg 7(3)). Providers mentioned in s 19F(5) must notify cessation within 7 days (reg 7(6)). Year‑end information required under regs 5 and 6 is due by 31 December (reg 7(2)). Failure to meet these discrete deadlines could create data gaps; the only statutory relief within the regulations is the Authority’s power to extend time on request (reg 7(7)).

2. URN allocation is mandatory and prescribed (reg 4): A person required to open a student record must allocate the URN in accordance with administrative arrangements set by the Authority (reg 4(2)). Operational staff must ensure they follow the Authority’s URN procedures and record the URN as the prescribed identifier (reg 4(3)). In practical examinations, identification by URN is explicitly required (reg 24(2)).

3. Principals’ reporting obligation covers all enrolled students at year end (reg 5): Reg 5(2) requires the principal to inform the Authority of results achieved by each student enrolled at the end of the school year for the school, whether full‑time or part‑time, for years from the first year of the relevant education period to the final year of compulsory education. This is broad and includes part‑time students; principals need to ensure they capture all part‑time enrollments.

4. Practical examination authenticity and witnessing requirements (reg 24): Student submissions must be accompanied by a written declaration signed by the student and witnessed by the supervising teacher and the principal (reg 24(3)). Private candidates must supply a statutory declaration (reg 24(4)). Failure to provide the required witness or statutory declaration may be treated as misconduct under reg 26 and can lead to marks reduction.

5. Medical evidence and timelines for special consideration (reg 25): For special arrangements, candidates must apply reasonably before the exam and provide evidence the Authority reasonably requires (reg 25(2)). For acute illness on the exam day, special consideration applications must be made on or before 28 November in the relevant year (reg 25(4)). Those precise timing requirements require administrative foresight and careful documentation; the regulations leave what is “reasonable” to the Authority’s judgment.

6. Misconduct definition pulls in multiple provisions (reg 26): The definition of misconduct cross‑references numerous specific rules (reg 26(1)). Practitioners should note that a wide set of breaches (including failure to produce ID, non‑compliance with supervisor directions, unauthorised materials and declaration failures) are bundled into the misconduct concept that can lead to mark reduction. The consequence is administrative, not criminal, but outcome‑determinative for the student.

7. Appeal timeframes are tight (reg 26(3), reg 27(2)): After a mark reduction, a candidate has only 7 days to appeal (reg 26(3)), and the appeals committee must be appointed within 5 days of receipt of the appeal or required evidence (reg 27(2)). These short windows require prompt notification systems when a mark reduction is imposed.

8. Research disclosure register must not include personal information but must record whether categories of personal information were disclosed (reg 33): Reg 33(3) requires the register to state whether certain personal information types were disclosed, while reg 33(4)(a) mandates the register must not itself include personal information. This means that public transparency about disclosure requests is required, but care must be taken not to publish actual personal data.

9. Non‑government request committee advice scope (reg 32(4)): A committee reviewing a non‑government request must advise on whether the request would require disclosure of personal information and on the prospective recipient’s capacity to secure the information and comply with conditions and applicable laws, as well as assess harm and research benefits (reg 32(4)(a)-(b)(i)-(v)). There is scope for tight scrutiny and iterative review because the Board may direct reconsideration of the committee’s advice (reg 32(5)).

10. Ministerial fee‑making powers for non‑residents and publications (regs 11-12): For students who are not Australian residents, fees may be set by Ministerial instrument and can vary by a broad set of criteria including country of origin and previous education (reg 11(3)). Likewise, publication charges may be set by instrument (reg 12(3)). Providers and students must be aware that Schedule 1 applies to Australian residents only; non‑resident fees might change by administrative instrument.

11. Cross‑statutory definitions affecting eligibility and classification (reg 3, reg 9): Residual dependency on Commonwealth Acts (Australian Citizenship Act, Migration Act) and the School Education Act means changes in those statutes or policy interpretations could alter who is classified as an Australian resident for fee purposes or how course categories are recorded. Administrative systems must keep definitions in sync across statutes.

12. Absence of explicit pecuniary sanctions within the regulations (see “Penalties and enforcement”): The regulations do not set out monetary fines for late reporting or non‑compliance with data supply obligations. That can be a gotcha for those expecting explicit penalties , enforcement is primarily administrative, including potential reputational and procedural consequences. Compliance planning should therefore assume that the Authority will use administrative levers and that operational non‑compliance may result in data removal or certification issues rather than statutory fines under these regulations.

These concrete procedural items are the main operational risks and “gotchas” visible on the face of the regulations. They centre on short compliance windows, strict evidentiary requirements for practical exams and special arrangements, the broad definition of misconduct, and the interplay between public transparency and protection of personal data in the research disclosure register.

Compliance with these regulations requires an operational plan that aligns school/provider administration, examination management and research request handling with the regulatory deadlines, evidentiary requirements and authority directions. The following is an actionable compliance checklist, referencing the specific regulations.

Student records and URN

• Ensure the Authority’s URN allocation arrangements are implemented locally. Where the school or provider is required to open a student record under the Act, allocate a unique reference number in accordance with the Authority’s arrangements (reg 4(1)-(3)). Keep URNs recorded in student management systems and use URNs on examination identification documents and practical examination submissions where required (reg 16(1), reg 24(2)).

Information supply and timelines

• Annual year‑end reporting: For students in any school year from the first year of the relevant education period to the final year of compulsory education, the principal must inform the Authority of the results achieved during that school year in accordance with Authority requirements (reg 5(1)-(2)). Ensure internal calendar and data extraction processes deliver this information to the Authority by 31 December for the relevant year (reg 7(2)).

• Provider enrolment/employment events: Providers who fall within s 19F(2)(b) or (3) must notify the Authority of enrolments/employments not later than 14 days after the student is enrolled or becomes employed (reg 7(3)). Employers mentioned in s 19F(5) must notify cessation and the date of cessation within 7 days (reg 7(6)). Put automated alerts and staff responsibilities in place to meet these deadlines. If circumstances prevent compliance, prepare a written request to the Authority seeking an extension under reg 7(7).

• Data supplied to peak bodies: For the datasets required by reg 9, ensure extraction and reconciliation processes produce counts as recorded in the Authority’s database as at 31 December, and supply the requisite counts no later than 28 February in the following year (reg 9(2), (3)). Map local course coding to SE Act s 11B categories to populate reg 9(2)(c)-(j) accurately.

Examination administration

• Candidate eligibility and private candidacy: Confirm student enrolment status before admitting candidates to examinations. Students enrolled in a pair of stage 2 or stage 3 units in the final year of compulsory education must take the examination unless given a written exemption by the Authority (reg 14(2)). For private candidates, verify State residency, receipt of a timely written application and payment of the relevant fee (reg 14(3)).

• Notices and identification: Issue or ensure candidates obtain the Authority’s written notice of examination centre, date and time no later than the Authority’s specified timeline (reg 15(1)). Maintain a log of Authority identification documents issued to candidates; supervisors must be able to request production of the ID (reg 16(1)-(2)). Ensure exam entry procedures include verification of ID and URN.

• Supervisor and security protocols: Appointment of supervisors must be in accordance with Authority directions (reg 17(1)). Supervisors and examination centre managers must store and handle examination material securely per Authority directions (reg 15(2), reg 17(2)). Document chain‑of‑custody, material access logs and secure transport/storage arrangements.

• Candidate conduct and allowed materials: Communicate to candidates that they may only bring approved materials into the examination (reg 18(2)), must answer in English unless authorised otherwise (reg 19), and must not consume food or drink except water in an approved container (reg 20(1)). Supervisors must be authorised to inspect materials and direct candidates (reg 18(3)-(4)). Publish and circulate the Authority’s conduct rules and confirm candidate acknowledgement.

Practical examinations and authenticity declarations

• For student practical submissions, obtain the required signed statement declaring the work is the student’s own, signed by the student and witnessed by the supervising teacher and the school principal (reg 24(3)). For private candidates, obtain a statutory declaration to the same effect (reg 24(4)). Keep witness signatures and statutory declarations filed with the submitted materials.

Special arrangements and medical evidence

• For candidates who need special arrangements because of disability, illness or impairment, require written applications well before the examination, gather the medical or other evidence the Authority reasonably requires, and submit via the school principal where the candidate is a student (reg 25(1)-(2), (5)). For acute illness on the day, ensure students or schools lodge a special consideration application on or before 28 November, with supporting evidence (reg 25(3)-(4)).

Handling misconduct and appeals

• Have clear internal processes for promptly notifying candidates of any marks reduction decision. If a reduction is made, notify the candidate in writing and advise of the 7‑day appeal right (reg 26(3)-(4)). Prepare and submit appeal evidence within the prescribed timeframe and coordinate with the Authority’s appeals committee deadlines (reg 27(2)). Maintain records of all communications and evidence.

Fees and payments

• For Australian resident students, apply Schedule 1 fees where applicable (reg 10; Schedule 1). For private candidates and non‑school candidates, ensure fees for entries (including late entries and non‑enrolled candidates) are collected per Schedule 1 items 6-9. For non‑residents, verify whether a current Ministerial determination under reg 11 applies; if so, apply those fees instead of Schedule 1. For publications, check whether Ministerial determinations apply (reg 12(2)-(3)).

Research disclosure requests

• If you intend to request disclosure of relevant information from the Board, ensure the request is in writing and includes sufficient information to enable the Board to understand objectives and methodology and to identify the relevant information requested, and indicate whether the research has been approved by a human research ethics committee (reg 31(a)-(c)). If you are a non‑government applicant and your request may involve personal information, anticipate referral to a Board committee for assessment against the criteria in reg 32(4).

• If appointed to receive personal information, be prepared to demonstrate your organisation’s capacity to secure the information, compliance with any imposed conditions, and compliance with written laws, guidelines or policies applicable to the research (reg 32(4)(b)(i)-(iii)). Expect evaluation of risk of harm and research benefits (reg 32(4)(b)(iv)-(v)).

Recordkeeping and reporting

• Maintain internal records of all data supplied to the Authority and of all requests for disclosure. The Board must maintain a public register with specified details for each request (reg 33(1)-(3)), and the Authority must report requests accepted by the Board in its annual report prepared under the Financial Management Act 2006 (reg 35). Keep redacted logs of disclosure decisions to facilitate this reporting, ensuring no personal information appears in the register (reg 33(4)(a)-(b)).

Cross‑statutory checks

• Ensure reliance on the correct statutory definitions for residency and course categories by aligning local practice with the Australian Citizenship Act provisions and the Migration Act for residency classifications (reg 3), and with the SE Act s 11B for course option classification (reg 9(2)).

Training and policies

• Provide training for principals, teaching staff, supervisors and administrative staff on (a) URN allocation and use, (b) reporting deadlines and data extraction processes, (c) examination security and misconduct definitions, and (d) special arrangements and evidence requirements. Document policy templates for exam day security, chain of custody, candidate declaration forms for practical examinations and protocols for special consideration applications.

Audit and contingency

• Implement audit routines to reconcile school and provider records with the Authority’s database as at 31 December, and verify data submitted to the Director of Catholic Education and AISWA for reg 9 outputs. Keep a contingency plan for late submissions, including a template extension request to the Authority under reg 7(7).

By following these concrete procedural steps and mapping each action to the numbered regulation, schools, providers and researchers can align their operational procedures to the statutory requirements the regulations impose.
