Currency (Royal Australian Mint) Determination (No. 5) 2016

The instrument operates through statutory specification. Its central legal technique is to amend the operative content of the Currency Act 1965 by registering detailed technical specifications as if they were included in the Act’s Schedule (s 5(2)). Two primary legal objects are therefore created: (1) standard composition entries for denominations (s 5(2)(a)-(b)); and (2) standard weight, allowable weight variation, design and dimensional entries (s 6(2)). The Schedule is structured in two parts: Part 1 is the tabular technical specification for each coin item; Part 2 is a legend explaining the coded symbols used in Part 1 (Schedule 1, Parts 1-2).

Technical attributes specified include: composition (metal alloy or pure metal content), standard weight and its allowable variation, maximum diameter or other dimension, maximum thickness, shape (circular S1 or dodecagonal S2), edge treatment (interrupted milling E1, plain E2, continuously milled E3), obverse design O1 (effigy of Queen Elizabeth II with certain inscriptions), and specific reverse designs R1-R4 with stepwise elements and required textual inscriptions (Schedule 1, Part 1 and Part 2). The coin designated as Item 3 ($1) is specified as "At least 99.9% silver" with a standard weight of 31.103 g and a +0.80 g allowable variation; the reverse R3 for that item includes the literal marking “1 oz .999 Ag” (Schedule 1, Part 1 items 3 and Part 2 item 9). The presence of coloured stripes in R1 is an express part of the reverse design (Schedule 1, Part 2 item 7).

Statutory linking and non-derogation rules are also present. Sections 5(3) and 6(4) explicitly state that the respective sections do not affect other provisions of determinations made for the same paragraphs of the Act. The commencement clause (s 2) frames when the technical specifications acquire effect, and the note accompanying the commencement table clarifies that column 3 content in that table is not part of the instrument (s 2(2)). By specifying that the Act "has effect, on and after the day on which this instrument commences, as if" the Schedule contained the listed denominations and compositions (s 5(2)), the instrument converts the schedule entries into statutory standards for the Act’s purposes rather than merely administrative guidelines.

The design entries are prescriptive in text, including inscriptions, imagery, colours and designer initials. O1 requires the effigy and inscriptions including the initials "IRB"; R1-R4 contain multi-element pictorial and textual requirements (Schedule 1, Part 2 items 6-10). Those prescriptive features convert design choices into statutory criteria that the Royal Australian Mint must meet if it is to produce coins that conform to the Act as amended by this determination. The instrument does not itself provide production instructions beyond the measurements and design descriptions in Schedule 1, but those descriptions are sufficiently detailed to govern the finished product’s visual and physical attributes.

Directly affected actors are the Ministerial office that made the determination, the Royal Australian Mint (the minting authority referenced by the instrument’s title), and any person or entity responsible for producing coins that comply with the Currency Act 1965. The instrument is made by the Minister for Small Business (Michael McCormack) and, by operation of sections 5 and 6, imposes statutory specifications that the Act will treat as part of its Schedule (s 3; ss 5-6). Where the Mint issues coins intended to be lawful currency under the Currency Act, those coins will need to match the compositions, weights, dimensions and designs specified in Schedule 1, Part 1.

Secondary but materially affected parties include: suppliers of metal alloys and refiners (because the instrument specifies precise compositions, e.g. “copper, aluminium and nickel” for $2 and “at least 99.9% silver” for $1, Schedule 1 Part 1 items 1 and 3); coin-accepting equipment operators and manufacturers (vending machines and transport ticketing devices that rely on size, weight and edge for validation will need to account for the listed maximum diameters, thicknesses and edge treatments described in Schedule 1); banks and cash-handling businesses that sort and transport coinage; and numismatists, collectors and dealers because the instrument specifies collectible features such as designer initials and coloured stripes (Schedule 1 Part 2 items 7-10). Insurance and valuation professionals in the bullion market will have an interest in the $1 coin’s silver specification and the literal marking “1 oz .999 Ag” specified in R3 (Schedule 1 Part 2 item 9).

Legal practitioners and compliance officers dealing with currency regulation are affected because the instrument converts the technical specifications into statutory standards under the Currency Act (s 5(2), s 6(2)). Any entity that manufactures coins, or wishes to issue coin-like objects that might be mistaken for legal tender, must take these statutory specifications into account when advising clients or designing products.

Consumers are affected indirectly. The public who use cash will receive coins that display the prescribed obverse and reverse designs and that match the physical dimensions and tolerances in Schedule 1 Part 1. Operators of devices that accept coinage may bear the operational costs of re-calibration or retrofit to accept coins with specified dimensions, shapes (circular or dodecagonal) and edge features (Schedule 1 Part 1). The instrument does not itself allocate financial responsibility for any such adaptation costs.

Finally, the instrument will interest any stakeholders in intellectual property or image rights only to the extent that the Mint must adhere to the specified obverse and reverse elements; the instrument itself prescribes the designs and inscriptions (e.g. O1 includes “IRB” and the reverse items include designer initials), but it does not address copyright or licensing rights in the legislation text provided.

The determination creates statutory technical standards rather than prescriptive operational duties in the form of step-by-step production orders. The legal effect is that, from commencement, the Currency Act will operate as if its Schedule included the denomination and composition references and the standard weight, allowable variation, design and dimensions specified in Schedule 1 of the instrument (s 5(2); s 6(2)). This conversion produces de jure standards: coins matching those entries will meet the statutory specifications for the Act’s purposes.

Who has the duty to comply? The instrument itself does not expressly name a duty-holder beyond the legal mechanism that makes the specifications part of the Act. The practical duty to produce coins conforming to the statutory specifications will fall to the authority responsible for minting, in practice the Royal Australian Mint, and to any manufacturer producing coins intended to be lawful under the Currency Act. The text prescribes what the standard must be for composition (for example Item 1: “Copper, aluminium and nickel”; Item 3: “At least 99.9% silver”) and what the physical tolerances must be (standard weights and allowable variations, maximum diameters and thicknesses in Schedule 1 Part 1).

Rights created or secured by the instrument are primarily the right to produce, issue or treat coins as lawful currency if they conform to the specifications now incorporated into the Act. The instrument’s language , that the Act "has effect... as if" the Schedule contained the listed items , implies that coins meeting those specifications are the statutory standard for the Act’s purposes (s 5(2)). The obverse O1 requirement and the reverse entries R1-R4 specify the exact inscriptions, images, colours and designer initials to be used; these entries create the legal benchmark for what constitutes the authorised obverse and reverse designs for the specified denominations (Schedule 1 Part 2 items 6-10).

The instrument does not itself create criminal offences, pecuniary penalties, licensing requirements or administrative powers within its text. Sections 5(3) and 6(4) note that the sections do not affect other provisions of determinations for the same purposes (ss 5(3), 6(4)), which implies that other determinations or provisions within the Currency Act may deal with enforcement, offences, or administrative powers. The instrument therefore establishes mandatory technical standards that will be enforceable only through whatever enforcement mechanisms the Currency Act provides, but the instrument does not itself enact or describe those enforcement mechanisms.

Operationally relevant duties for producers include achieving the specified shape (S1 or S2), edge treatment (E1-E3), obverse and reverse designs (O1; R1-R4), and staying within the listed dimensional tolerances. For example, the $2 coin must be copper/aluminium/nickel, weigh 6.60 g with ±0.60 g variation, measure no more than 20.62 mm in diameter and 3.70 mm thickness, be circular and have interrupted milling (Schedule 1 Part 1 item 1). Those are the concrete standards to be met for the Act’s purposes.

The instrument itself contains no penalty provisions, offence definitions or enforcement mechanisms. Sections 5(3) and 6(4) expressly state that the respective sections do not affect any other provision of a determination made for the same purposes (ss 5(3), 6(4)), indicating that enforcement and penalties , if any , are to be found in other parts of the Currency Act 1965 or in other determinations rather than within this instrument. The instrument is limited to specification: it incorporates denominational and technical standards into the Schedule to the Act and prescribes design elements (s 5; s 6; Schedule 1).

Because the instrument does not itself prescribe sanctions, any compliance failure would be actionable only to the extent the Currency Act or other applicable laws create offences or enforcement powers for producing, circulating or presenting non-conforming coinage. The determination’s text does not list those mechanisms or reference specific enforcement sections beyond the enabling provisions (paragraph 13(2)(b) and subsection 13A(1) of the Currency Act 1965, s 3). Readers must therefore consult the Currency Act 1965 for the statutory enforcement framework applicable to coins that do not meet the Schedule’s standards.

Practical enforcement modalities that are logically implicated by the instrument’s content include quality control checks at the minting stage (to ensure standard weight and allowable variation), acceptance testing by cash-handling operators, and rejection protocols for non-conforming pieces in vending and counting equipment. Those are consequences of the specification of precise weights, dimensions, shapes and edges in Schedule 1 Part 1, although the instrument itself does not specify who conducts inspections or how they are to be carried out.

In short, enforcement and penalty rules are outside the text of the instrument as provided. The instrument creates the statutory standard; enforcement depends on the Currency Act and any other relevant statutes or administrative instruments that govern compliance, offences and sanctions. This instrument does not modify or set those enforcement mechanisms within its own provisions.

This determination is explicitly made under the Currency Act 1965 (s 3) and is structured to modify the effective content of that Act by incorporation of the Schedule entries. Section 5(1) states that the section is made for the purposes of paragraph 13(2)(b) of the Act and section 6(1) states that the section is made for the purposes of subsection 13A(1) of the Act (ss 5(1), 6(1)). The operative mechanism is to make the Act "have effect... as if" the Schedule contained the specified denominations and compositions (s 5(2)), and to specify that items in the Schedule 1 tables describe the standard weight, allowable variation, design and dimensions for statutory purposes (s 6(2)-(3)). Therefore the instrument amends, in effect, the Schedule to the Currency Act 1965 as a matter of statutory operation.

Beyond the Currency Act itself, the instrument does not reference or purport to amend any other statute, regulation or administrative instrument. Sections 5(3) and 6(4) state the instrument does not affect other provisions of a determination made for the same purposes, indicating a ring-fencing relative to other determinations under the same enabling Act (ss 5(3), 6(4)). The instrument also includes a formal commencement process and a note that the commencement table relates only to the instrument as originally made, a drafting convention relevant to legislative publication rather than substantive interplay with other laws (s 2(1)-(2)).

Because the instrument prescribes specific inscriptions and designs (for example O1 requires the effigy of Queen Elizabeth II and inscriptions “ELIZABETH II”, “AUSTRALIA”, a year and “IRB”, Schedule 1 Part 2 item 6), it interacts in practice with any legal regimes that govern use of royal effigies or protected marks. However, the determination itself does not assert or address intellectual property, trademarks or copyright; it simply prescribes what must appear on authorised coins. Any separate legal rules in those domains remain applicable and would govern third-party reproduction or commercial use, but those laws are not amended or quoted in this instrument.

Where other statutes or regulations define "legal tender" or set out currency handling, counting and banking obligations, those provisions will now operate against the background that the denominations, compositions and specifications listed in Schedule 1 are the statutory standard under the Currency Act. The instrument does not itself alter legal tender status; it alters the content of the Act’s Schedule. For enforcement and application across government agencies (for example customs, tax, or trade regulation), practitioners must read this instrument together with the Currency Act and any other relevant legislative instruments to determine how a coin’s statutory conformity affects duties and rights under those regimes.

The instrument contains its own limited amendment history statements within the commencement table and notes. Section 2 provides the commencement mechanism: the whole instrument commences the day after it is registered (s 2 and the commencement table). The note attached to the commencement table expressly states that the table relates only to the provisions of the instrument as originally made and will not be amended to deal with any later amendments of this instrument (s 2(1) note). Section 2(2) clarifies that any information in column 3 of the commencement table is not part of the instrument and can be edited in published versions (s 2(2)). Those are internal drafting and publication notes about the instrument’s lifecycle rather than substantive legal amendments.

The instrument’s front matter identifies a single making event and date: it was made and dated 2 December 2016 by the Minister for Small Business, Michael McCormack. There is no embedded schedule of prior amendments and no subsequent amendment entries within the instrument text supplied. Sections 5(3) and 6(4) reiterate that these sections do not affect other provisions of determinations made for the same purposes, signalling that other determinations could exist and that this instrument sits alongside them rather than replacing them in toto (ss 5(3), 6(4)).

Because the text supplied is self-contained and does not include later amending instruments, there is no recorded later amendment history in the instrument itself. The instrument’s internal notes disavow editorial changes to the commencement table as being part of the instrument (s 2(2)), and the declared commencement timing is the only dated event recorded in the document. For authoritative amendment history after registration or for any subsequent legislative changes to the Currency Act’s Schedule or related determinations, users must consult the official legislative register or consolidated versions of the Currency Act and subordinate instruments. The instrument’s own text does not record such subsequent changes.

The instrument contains no litigation history, judicial citations or references to legal proceedings. It is a determination made under the Currency Act 1965 and, as supplied, the document records its making (Michael McCormack, Minister for Small Business) and its date (2 December 2016) but contains no notes about legal challenges, court decisions, or disputes arising from its operation.

Because the text itself does not record litigation, there are no case names, judgments or legal interpretations provided in this instrument. The absence of litigation history in the instrument does not preclude later judicial review or disputes in practice, but any such proceedings would lie outside the instrument’s text and must be identified by searching judicial and tribunal records or legal databases for challenges to this determination or disputes concerning coins produced under its specifications.

Practitioners should therefore treat the instrument as a primary source of statutory specifications and consult external legal databases and court records for any litigation that may have arisen after its making. The instrument contains no procedural provisions for dispute resolution, appeals or administrative review specific to the determinations made within it; any such mechanisms would be located in the Currency Act 1965 or other relevant statutes, not in this determination as provided.

The instrument contains several precise technical details and drafting features that can produce operational surprises if they are overlooked.

1. Composition and precious metal content: Item 3 specifies the $1 coin composition as "At least 99.9% silver" with a standard weight of 31.103 g and allowable variation +0.80 g (Schedule 1 Part 1 item 3). The reverse R3 then explicitly requires the inscription “1 oz .999 Ag” (Schedule 1 Part 2 item 9). Those two textual points together indicate a bullion-style silver coin with markings that state an ounce and purity. The drafting uses both a composition standard ("At least 99.9% silver") and a reverse inscription that states “1 oz .999 Ag”; practitioners should note the potential operational tension between the composition wording and the literal marking on the reverse if production tolerances vary.

2. Design elements include colour: R1 requires a pattern of yellow, green, blue and indigo coloured stripes superimposed on concentric circles (Schedule 1 Part 2 item 7). Coloured elements on coins require specific minting techniques and may affect production cost and the ability of coin-accepting equipment to recognise coins visually or by optical sensors; colour is an express statutory design element.

3. Shape and dimensional variety: The 50c is dodecagonal (S2) and other coins are circular (S1). Diameters and thicknesses vary significantly (for example the $1 coin is listed at maximum diameter 40.30 mm while the $2 coin is only 20.62 mm , Schedule 1 Part 1 items 1 and 3). These dimensional differences are material to coin-handling and sorting equipment which may need recalibration.

4. Edge treatment variance: Edge specifications differ across coins (E1 interrupted milling for $2; E2 plain for 2c and 50c; E3 continuously milled for $1). Edge features can be a key validation parameter for automated acceptance systems.

5. Obverse standard: O1 mandates the effigy of Queen Elizabeth II together with specific inscriptions including “IRB” (Schedule 1 Part 2 item 6). That links the statutory obverse to a specific artist's initials and a particular effigy style, which will be binding for authorised coinage.

6. Presence of historically unusual denominations: The instrument includes a 2c coin (Item 2) with composition “Copper, tin and zinc” and precise dimensions and tolerances (Schedule 1 Part 1 item 2). Although the instrument supplies a specification for that denomination, practitioners should note the instrument does not comment on circulation policy or legal tender status; inclusion in the Schedule is a technical specification, not an operational statement about minting frequency or distribution.

7. Allowable variation asymmetry: The $1 coin list shows a standard weight 31.103 with a +0.80 variation but no explicit negative tolerance expressed in the table (Schedule 1 Part 1 item 3). The table format for other items supplies symmetric ± tolerances. Practitioners should read the $1 entry carefully to confirm the intended tolerance range.

8. Literal inscriptions and designer initials: Reverse items specify literal texts and designer initials (for example R1 requires the designer's initials “TD” and “C”; R4 requires initials “AB”) (Schedule 1 Part 2 items 7 and 10). These are statutory elements to be included on the coin face and are not mere artistic suggestions.

9. Commencement technicality: The whole instrument commences the day after registration (s 2 and commencement table). Any production or planning must account for the legal commencement rather than the signature date.

10. Non-exhaustive interaction with other determinations: Sections 5(3) and 6(4) explicitly state these sections do not affect other provisions of determinations made for the same purposes (ss 5(3), 6(4)). Practitioners must check other determinations under paragraphs 13(2)(b) and subsection 13A(1) of the Currency Act to understand the full statutory matrix governing coin specifications and any operational exceptions.

For authorities and manufacturers responsible for coin production, compliance means the final minted product must match the statutory specifications set out in Schedule 1 Part 1 and the design explanations in Part 2 from the instrument’s commencement date. The practical compliance steps follow from the instrument’s machine-readable requirements:

1. Confirm commencement and legal effect. Verify the instrument’s registration date and ensure that minting and issuance plans comply with the date set out in the official register, because the instrument commences "the day after this instrument is registered" (s 2).

2. Material procurement and testing. Source alloy batches to meet the specified compositions exactly: for example Item 1 ($2) "Copper, aluminium and nickel"; Item 2 (2c) "Copper, tin and zinc"; Item 3 ($1) "At least 99.9% silver"; Item 4 (50c) "Copper and nickel" (Schedule 1 Part 1). Implement metallurgical assays to verify purity and alloy percentages before production runs.

3. Weight and tolerance control. Set up quality control to hit the listed standard weights and allowable variations: e.g. $2 6.60 g ±0.60; 2c 5.2 g ±0.50; $1 31.103 g +0.80 (note the single-sided tolerance entry and confirm how to interpret it operationally); 50c 15.55 g ±0.96 (Schedule 1 Part 1). Maintain measurement records and batch sampling protocols to demonstrate conformity.

4. Dimensional and shape conformity. Configure dies and striking presses to produce coins at or below the maximum diameter and thickness indicated (Schedule 1 Part 1 items 1-4). For the 50c dodecagonal shape (S2), ensure blanking, upsetting and edge-forming processes create the correct polygonal outline.

5. Edge and surface treatments. Apply the prescribed edge treatments: interrupted milling (E1), plain (E2), or continuously milled (E3) as assigned in Part 1. Ensure the minting line has tooling capable of producing these treatments consistently.

6. Obverse and reverse design fidelity. Produce obverse that meets O1 requirements , effigy of Queen Elizabeth II and inscriptions “ELIZABETH II”, “AUSTRALIA”, the year in Arabic numerals and “IRB” (Schedule 1 Part 2 item 6). Produce reverse artwork that matches the R1-R4 textually and pictorially, including coloured elements where required (for example R1’s pattern of yellow, green, blue and indigo stripes, Schedule 1 Part 2 item 7). Legal compliance requires inclusion of specified inscriptions such as “TWO DOLLARS”, “ONE DOLLAR”, “1 oz .999 Ag”, and designer initials where stated.

7. Testing with coin-accepting equipment. Because the instrument specifies weights, diameters, thicknesses, shapes and edges, perform acceptance testing with vending machines, currency validators and coin counters to verify interoperability. Document any calibration adjustments required by third-party equipment providers; record testing protocols.

8. Records and traceability. Maintain production logs that record batch composition assays, weight/dimension checks, die approval sign-offs, and sample images showing inscriptions and designer initials (e.g. “TD”, “AB”, “IRB”) to demonstrate compliance with the statutory text.

9. Coordinate with cash-handlers and banks. Notify cash-handling organisations and commercial banks of the new specifications so they can update handling and sorting procedures. Because the instrument prescribes specific physical attributes, coordination reduces the risk of sorting or acceptance errors in circulation.

10. Review related determinations and the Currency Act. Because sections 5(3) and 6(4) say these sections do not affect other determinations made for the same purposes (ss 5(3), 6(4)), check for other determinations under the Currency Act 1965 that may contain complementary specifications, exceptions, or operational rules governing issuance, legal tender status, or enforcement. Consult the Currency Act for enforcement and legal tender definitions not included in this instrument.

11. Address bullion-specific declarations. For the $1 coin specified as "At least 99.9% silver" and bearing “1 oz .999 Ag” (Schedule 1 Part 1 item 3; Part 2 item 9), ensure assay records support the marking and that marketing and distribution comply with any commodity disclosure rules even though those rules are outside this instrument’s text.

12. Quality assurance sign-off. Before commercial release, obtain final approvals that the coin’s physical and pictorial attributes match Schedule 1 Part 1 and Part 2 verbatim, including colour usage, inscriptions, and designer initials. Keep archival specimens for legal and compliance reference.

Following these concrete steps will align production and issuance activity with the statutory standards established by this determination. Where the instrument is silent on enforcement or administrative procedures, operators should seek guidance from the bodies that administer the Currency Act or obtain legal advice to ensure procedural compliance with any statutory or administrative requirements that sit alongside these technical specifications.
