What it does
This Determination, titled Currency (Royal Australian Mint) Determination 2008 (No. 5), is a ministerial instrument made under subsection 13A(1) of the Currency Act 1965 (see the instrument heading and s 3). It sets out precise, technical specifications for three coin types in Schedule 1: two $1 coins and one $10 coin. The Determination performs the narrow legal function of declaring the coins’ standard composition, standard weight and allowable variation, maximum diameter, maximum thickness, shape, edge treatment, and the obverse and reverse designs, for each listed item (s 3; Schedule 1).
Mechanically, the instrument does the following:
- Names the instrument and records the maker and date, NICK SHERRY, Minister for Superannuation and Corporate Law, dated 15 May 2008 (s 1; instrument header).
- Establishes commencement as the day after registration (s 2).
- Specifies that each item in Schedule 1 is intended to satisfy the matters listed in subsection 13A(1) of the Currency Act 1965, namely composition, weight and allowable variation, dimensions, and design (s 3; Schedule 1).
- Shields the Schedule 1 specifications from altering any other existing determination of coin specifications (s 4). In other words, these specifications are additive or particular, and do not repeal or modify other determinations.
- Provides detailed technical parameters for three coin issues: a standard-composition $1 coin (copper, aluminium and nickel), a $1 coin of not less than 99.9% silver, and a $10 coin of not less than 99.99% gold (Schedule 1, Items 1-3). Each listing states the precise standard weight and permissible tolerance, maximum diameter and thickness, shape, the edge form, and the exact obverse and reverse design elements required.
