Currency (Royal Australian Mint) Determination 2005 (No. 1)

The central concept of this Determination is the legal specification of a coin under subsection 13A(1) of the Currency Act 1965. A coin specification under that provision comprises six mandatory elements: denomination, standard composition, standard weight with allowable variation, dimensions (diameter and thickness), shape, edge, and design (both obverse and reverse). These elements together define the coin as a matter of law for the purposes of currency production, legal tender status, and authenticity verification.

Denomination is the face value in Australian currency: $5, $1 or 50 cents. Denomination determines legal tender limits under the Currency Act independent of metal value. Standard composition is the target alloy or purity. Two types appear: base metal (copper-zinc-aluminium-tin for Item 1; copper-nickel for Item 5) and precious metal (at least 99.9 per cent silver for Items 2 and 4; at least 99.9 per cent silver partially plated with 99.99 per cent gold for Item 3). The phrase "at least 99.9 per cent silver" is a purity floor, not a precise target; coins must not fall below that fineness. For Item 3, the plating must be 99.99 per cent gold but the base composition is not specified beyond being silver of at least 99.9 per cent. Standard weight is a target, with an allowable variation expressed as a plus/minus range: for example, 20.00g plus or minus 0.50g for Item 1, and 60.50g plus or minus 0.80g for Item 3. Coins within the variation range are legally compliant even if they differ from the standard weight. Coins outside the range may not meet the specification and could theoretically lack the legal status of coins made under the Act.

Dimensions are given as maximum diameter and maximum thickness, not as targets with tolerances. This is asymmetrical with the weight specification. Maximum diameter means the coin cannot exceed that measurement; coins smaller than the maximum are permissible provided they are within other specifications. Similarly for thickness. The use of "maximum" rather than a target plus tolerance creates ambiguity for coins produced slightly undersized: they would comply, but a coin that is thick enough to jam a vending mechanism might technically comply on paper while being commercially problematic. Shape is circular for the $5 and $1 coins, and dodecagonal (12-sided) for the 50 cent coins. Edge is continuously milled for the $5 and $1 coins, and plain for the 50 cent coins. Edge type affects coin stacking, vending machine acceptance, and counterfeit detection.

Design is defined at a detailed descriptive level. The obverse and reverse descriptions are prescriptive: all inscriptions, images, and their arrangement must match the description. For Item 3, the design includes a physical insert: a gold-plated insert reproducing an 1855 half-sovereign coin. This is a manufacturing specification that requires the Mint to physically embed a separately produced element into the coin. The Determination does not specify the method of insertion or adhesion; only the design outcome. The inclusion of logos (Melbourne 2006 Commonwealth Games logo), institutional marks (the "KJ" monogram on the 50 cent coins, likely of the designer or engraver), and crown imagery means the designs incorporate third-party intellectual property. The Mint must have appropriate licences to reproduce those elements, but that is outside the scope of the Determination itself.

The Determination directly binds the Royal Australian Mint as the producer of these coins. The Mint must manufacture each coin to the specifications set out in Schedule 1, or the coin will not satisfy the requirements of subsection 13A(1) of the Currency Act. The Minister or the Secretary of the Department of the Treasury, who administers the Currency Act, is affected to the extent that the specifications define what coins are lawfully produced under that Act. No other person is directly required to do or refrain from doing anything by this Determination. It is a legislative instrument but not one that imposes obligations on private parties. However, the indirect effects are broader.

Collectors and numismatists are significantly affected because the specifications determine what coins exist in the market, their composition, and their authenticity benchmarks. A collector who purchases a coin believing it to be made under this Determination can use the published specifications to verify weight, dimensions, design and composition. Coin dealers and auction houses rely on the published specifications for cataloguing, grading and valuation. The allowable weight variation creates a range within which a coin can be considered within spec, affecting grading standards and resale value.

Investors in precious metals are affected by Items 2, 3 and 4, which contain silver at 99.9 per cent minimum purity and Item 3 gold plating at 99.99 per cent. The coins have both face value and bullion value. An investor needs to know the precise composition to calculate metal content. For Item 2: 36.31g of silver. For Item 3: 60.50g of silver plus a gold plating of unspecified weight (the Determination does not specify the plating weight or thickness). For Item 4: 18.24g of silver. The market value of these coins as bullion depends on the metal content within the allowable tolerances. The gold plating weight on Item 3 is not specified, so its contribution to bullion value is uncertain.

Businesses that might accept these coins as legal tender are indirectly affected. The $5 and $1 coins are legal tender for debts up to $5 for silver coins and $1 for base metal coins (under the Currency Act). The 50 cent coins are legal tender for debts not exceeding $5 if of the base metal type, or $5 if of the silver type. A business that receives a $5 silver coin as payment must accept it for a debt of $5 or less, but the coin's silver content may be worth more than $5, creating an incentive for the holder to melt it rather than spend it. This pricing distortion is a design trade-off the Determination does not address.

The Royal Australian Mint's competitors in the private medal and coin industry are affected because the Mint produces these coins as legal tender. Private mints cannot produce coins with identical specifications without infringing the Mint's monopoly under the Currency Act to produce coins that are legal tender. However, they can produce similar themed medals or tokens, provided they are not denominated, do not use the same designs, and are not represented as currency. The Determination implicitly defines the boundary of the Mint's production authority.

The Determination imposes no duties and confers no rights on private persons directly. It is a specification instrument. The duties and rights it creates arise indirectly through the Currency Act and the common law treatment of currency.

The Royal Australian Mint has a duty to produce each coin in accordance with the specifications. This duty is administrative and operational; a failure to meet specifications would mean the coin is not a coin made for the purposes of section 13A(1) of the Currency Act, which could affect its status as legal tender. Practically, the Mint must implement quality control procedures to ensure weight within allowable variation, composition at or above minimum purity, dimensions at or below maximums, and designs matching the descriptions. The Mint also has a duty not to produce coins with specifications that differ from this Determination if they purport to be the same coin.

The public has the right to tender these coins as legal tender within the limits set by the Currency Act. For $5 coins, the legal tender limit is $5 for debts if the coin is of base metal, and $5 if the coin is of silver (the Act specifies different limits for different denominations and compositions; the $5 coin of base metal can be used for debts up to $5, and the $5 coin of silver similarly up to $5). For the $1 coin, the limit is $1. For 50 cent coins, the limit is $5 for the copper-nickel version and $5 for the silver version. A creditor must accept the coins as payment up to those limits. A creditor may refuse payment in these coins for amounts exceeding the legal tender limits. The Determination does not itself set these limits; they come from the parent Act.

The public also has the right to rely on the published specifications as an accurate description of the coin. If a coin purports to be made under this Determination but does not match the specifications, the holder may have a cause of action against the Mint for issuing a defective or non-conforming product, though that would turn on contract or consumer law rather than the Determination itself. The Competition and Consumer Act 2010 would apply if the coin were supplied in trade or commerce and was not of acceptable quality.

The Treasurer or Minister has the right to make further determinations under subsection 13A(1) amending or replacing this Determination. Section 4 of this Determination expressly preserves that power by not affecting any other determination. The Mint cannot unilaterally change specifications; only a new determination by the Minister can alter them.

Collectors and dealers have a right to inspect the specifications for authentication purposes. The Determination is a public legislative instrument, freely available on the Federal Register of Legislation. Any person can compare a physical coin against the published specifications. The allowable weight variation creates a band within which a coin is within spec, and coins outside that band may be counterfeit or manufacturing defects. The public has no right to demand the Mint verify a coin's authenticity, but the specifications provide the benchmark.

The Determination itself creates no penalties and has no independent enforcement provisions. It is a specification instrument under the Currency Act, and the enforcement mechanisms come from the parent Act, not from this Determination.

Under the Currency Act, the relevant offences relate to counterfeiting. Section 14 creates an offence for making a counterfeit coin resembling current coin. Section 15 covers dealing with counterfeit coins. Section 16 covers possession of counterfeit coin. Section 17 covers making or possessing instruments for counterfeiting. The penalties under the Currency Act include imprisonment for up to 14 years for some offences (section 14 provides for 14 years imprisonment). The specifications in this Determination are directly relevant to prosecutions under those provisions because they define what a genuine coin of each type looks like in terms of weight, diameter, thickness, composition and design. A coin that purports to be one of these five specified coins but does not meet the specifications is, by definition, not a genuine coin made under the Act. The specifications therefore serve as the evidentiary benchmark for authenticity in prosecutions.

The Criminal Code Act 1995 also applies to counterfeiting currency offences. The Criminal Code contains general principles of criminal responsibility, including fault elements, that apply to all Commonwealth offences. A person charged with making a counterfeit $5 silver coin, for example, would face a prosecution in which the prosecution must prove the coin did not meet the specifications in Schedule 1 of this Determination and that it was made with the intention that it be uttered or used as genuine currency.

Enforcement is carried out by the Australian Federal Police, the Australian Transactions and Reporting Analysis Centre for related money laundering matters, and the Reserve Bank of Australia's note-issuing functions (though the Mint handles coinage). The Currency Act provides the substantive offences; the Determination provides the factual specifications.

For the Royal Australian Mint itself, there is no external enforcement mechanism for failing to meet the specifications. If the Mint produced coins that did not meet the specifications, the coins would not be coins made under subsection 13A(1) and would not be legal tender. The Mint would face internal accountability to the Minister and the Treasurer, but not criminal or civil penalties under this Determination. A member of the public who receives a non-conforming coin could potentially sue the Mint in tort or contract, but the Determination does not create a private right of action.

The Public Governance, Performance and Accountability Act 2013 would apply to the Mint as a Commonwealth entity, requiring it to use public resources properly. Producing non-compliant coins could be a breach of that duty, but again this is external to the Determination. The Determination itself is purely definitional.

This Determination is a legislative instrument made under the Currency Act 1965. It occupies a narrow niche within a broader legal framework. Its primary interaction is with the parent Act. Section 13A(1) of the Currency Act empowers the Minister to determine specifications for coins to be minted by the Royal Australian Mint. This Determination exercises that power. The Currency Act also sets the legal tender limits for coins, the offences for counterfeiting, and the powers of the Treasurer to order the minting of coins. This Determination does not alter any of those provisions; it merely specifies the characteristics of particular coins that fit within the existing framework.

The Determination interacts with other coin specifications. Section 4 provides: "The specifications in Schedule 1 do not affect any other determination of the specifications of a coin." This means the five coins specified coexist with any other coins specified under separate determinations. The Mint may have multiple active determinations for different coins, each with their own specifications. A coin dealer or collector must consult the relevant determination for a particular coin, not rely on a single consolidated specification. This creates a compliance burden in that the specifications for the standard circulating coinage (the $2, $1, 50c, 20c, 10c and 5c coins) are set by other instruments, and this Determination does not modify them. The same denomination can have multiple specifications across different determinations, as this Determination itself shows: Item 4 (silver 50c) and Item 5 (copper-nickel 50c) share a denomination but differ in composition, weight and precious metal content while sharing diameter, thickness, shape and design.

The Trade Marks Act 1995 and Designs Act 2003 may be relevant to the designs on these coins. The Melbourne 2006 Commonwealth Games logo, the Queen's Baton Relay imagery, and the crown design are likely subject to trade mark or copyright protection. The Mint must have licences to reproduce these elements. The Determination does not address intellectual property rights; it assumes the Mint has the necessary authority. If a private third party reproduced the coin designs without permission, that party could face infringement proceedings, but the Determination does not provide defences or authorise third-party use.

The Australian Charities and Not-for-profits Commission Act 2012 and taxation laws interact where these coins are purchased as collectibles or investments. Goods and Services Tax treatment of precious metal coins depends on whether they meet the definition of "investment grade precious metal" under the A New Tax System (Goods and Services Tax) Act 1999. The determination of fineness (99.9 per cent silver) is relevant to that GST treatment. Coins that are legal tender and of investment grade may be GST-free. The Determination's specification of 99.9 per cent silver for Items 2, 3 and 4 supports a GST-free classification, but only if the other criteria are met.

The Competition and Consumer Act 2010 (including the Australian Consumer Law) applies to the Mint's supply of these coins to the public. The coins are goods supplied in trade or commerce. They must be of acceptable quality, match their description, and not be misleadingly promoted. The published specifications in this Determination form part of the description of the goods. If a coin is sold as a $5 silver coin but does not meet the 99.9 per cent silver specification, that would be a breach of the consumer guarantee as to description and quality. The allowable weight variation means coins at the lower end of the tolerance are still within spec, but a consumer who buys expecting exactly 36.31g of silver may feel misled if the coin is 35.70g (within the 0.64g variation). The consumer law would likely defer to the Determination's specifications, meaning the coin is as described if it falls within the tolerance.

The Currency (Royal Australian Mint) Determination 2005 (No. 1) was originally registered on 17 February 2005 (F2005L00325) and commenced on 18 February 2005, the day after registration. The instrument as originally made contained the specifications as they stood at that date. The compilation text provided to the reader includes amendments up to 9 August 2005, meaning the version from that date is the one reflected in Schedule 1.

The amending instrument is the Currency (Royal Australian Mint) Determination 2005 (No. 1) Amendment Determination 2005 (No. 1), registered on 8 August 2005 (F2005L02201), which commenced on 9 August 2005. The amendment history in Endnote 4 shows: "Sch 1 am F2005L02201". That is the only amendment recorded. Schedule 1 was amended, but the compilation does not specify which items were added or changed by the amendment. The text of Schedule 1 as compiled includes all five items. It is impossible from this compilation alone to know whether the amendment (a) added Items 4 and 5 (the 50 cent coins), (b) added Item 3 (the $1 gold-plated coin), (c) changed the designs of any items, or (d) adjusted weight or dimension tolerances. The user is limited to what the source states. The compilation notes that it "was prepared on 19 November 2013" and "includes any commenced amendment affecting the legislation to that date." No subsequent amendments are recorded. The endnotes confirm: Endnote 5 "Uncommenced amendments [none]", Endnote 6 "Modifications [none]", Endnote 7 "Misdescribed amendments [none]". The instrument appears to have been amended once and then remained static.

The legislation history format shows the original determination had no application, saving or transitional provisions listed. The amendment determination also had none. This is unsurprising for a specification instrument; it does not affect substantive rights or obligations that would require transitional arrangements. The coins specified are commemorative, likely produced in limited mintages, so the amendment presumably added or adjusted specifications for coins not yet produced or in the process of production.

Practitioners note that the existence of an amendment means a researcher must check the original instrument to see what the pre-amendment specifications were, if relevant to determining the specifications of coins produced between February and August 2005. Coins minted in that period would have been subject to the original specifications; coins minted after 9 August 2005 would be subject to the amended specifications. The compilation does not separately set out the original text or mark changes. This is a standard limitation of compilations.

This Determination has no recorded litigation history. The endnotes in the compilation contain no references to court decisions, and the source text does not mention any cases. The absence of litigation does not mean the Determination has never been tested in court; it means the compilation as prepared by the Office of Parliamentary Counsel does not include any case annotations. Legislative instrument compilations in Australia do not routinely include case references, so one cannot conclude from the compilation alone that no case has considered the Determination.

Given the nature of the Determination, litigation is unlikely. It is a technical specification instrument. Private parties rarely have standing to challenge it directly, and the limited rights it creates are unlikely to generate disputes. Disputes that could arise include: (a) a prosecution for counterfeiting where the defence argues the coin in question meets the specifications and is therefore genuine; (b) a consumer law claim against the Mint where the coin does not meet the published specifications; (c) a tax dispute over the GST treatment of the coin where the composition is contested; (d) a dispute over legal tender between a creditor and debtor where the coin's denomination or composition is relevant to the legal tender limit. The author is aware of no reported Australian case involving the specifications in this specific Determination.

The Determination might be referenced in evidence in a criminal trial for counterfeiting. The prosecution would lead evidence comparing the alleged counterfeit to the published specifications. The Determination would be tendered as a public document under the Evidence Act 1995 (Cth) s 147. Defence counsel might challenge whether the coin meets the weight variation or composition standards, requiring expert evidence. The "maximum" diameter and thickness language could be litigated: if a coin is 38.91mm in diameter (exceeding the 38.90mm maximum for Items 1 and 2), is it necessarily counterfeit, or is there a manufacturing tolerance implied? The Determination does not provide a tolerance for diameter, only a maximum. A court could interpret "maximum diameter" as an absolute limit or as a design specification that allows reasonable manufacturing tolerance. This ambiguity is a potential litigation point, though no case appears to have tested it.

For the $1 coin (Item 3), the gold plating is specified as "99.99% gold" but no minimum thickness or weight is stated. A dispute could arise if the plating is thinner than expected by purchasers. The Determination would not resolve that dispute because it does not specify plating weight. The Mint's marketing or packaging representations would be more relevant than the Determination itself.

The practical absence of litigation history suggests the Mint has either produced coins within specification or that any disputes have been resolved without litigation. It may also reflect that the commercial value of each coin is relatively low and the cost of litigation prohibitive for individual collectors.

Several features of this Determination reward careful reading. The first is the asymmetry between weight and dimension tolerances. Weight is expressed as a standard plus a plus/minus allowable variation (e.g. 20.00g plus or minus 0.50g). Diameter and thickness are expressed only as "maximum" values (e.g. maximum diameter 38.90mm). There is no minimum diameter or thickness specified. This means a coin that is slightly smaller in diameter or thinner than the stated maximum is still within specification, provided it otherwise conforms. For a coin that is 38.80mm in diameter, it complies even though that is 0.1mm below the maximum. But a coin that is 38.91mm in diameter exceeds the maximum and is non-compliant. The Determination does not say whether "maximum" is an absolute limit or a design target. If it is an absolute limit, the Mint must produce coins that never exceed the stated diameter. If it is a design target with implied manufacturing tolerance, then a coin that is 38.91mm might still be considered within spec. This is not clarified in the instrument. Practitioners should treat the maximums as strict, because the instrument does not provide an allowable variation phrase for dimensions as it does for weight.

Second, the composition for Item 1 is listed as "Copper, zinc, aluminium and tin" without proportions. The Determination does not specify the alloy percentages. The Mint is free to choose any proportions of those four metals, provided all four are present and the resulting coin meets the other specifications. This gives the Mint manufacturing flexibility but leaves a collector or verifier with no precise composition benchmark for authentication. The coin could be 90 per cent copper and 10 per cent combined zinc, aluminium and tin, or could be 70 per cent copper and 30 per cent others. The Determination does not say. For Items 2, 3 and 4, the silver purity is given as "at least 99.9%", which is a floor but not a ceiling. Coins could be 99.99% silver and still comply. However, the composition of the non-silver 0.1 per cent is not specified. For Item 5, the copper-nickel composition is given without proportions, similar to Item 1.

Third, Item 3 specifies gold plating of "99.99% gold" but does not specify the plating thickness or weight. A collector or investor cannot determine from this Determination how much gold the coin contains. The bullion value of the gold is unknowable from the public specification alone. The Mint may have internal specifications, but they are not published in this instrument. The plating weight could be negligible or substantial; the Determination does not constrain it.

Fourth, the Determination uses "allowable variation" only for weight, but the phrase is ambiguous. Is the variation allowable for any individual coin, or as a batch average? The instrument says "Standard weight and allowable variation: 20.00g plus or minus 0.50g". This is typically interpreted as each individual coin must be within that range, but the instrument does not explicitly say so. In practice, the Mint likely uses batch statistical sampling, but the legal requirement is not stated.

Fifth, the obverse of Item 3 includes a gold-plated insert reproducing an 1855 half sovereign. The Determination does not specify which metal the insert contains under the gold plating. It says "a gold plated insert representing the obverse of an 1855 half sovereign gold coin". The gold plating must be 99.99% gold, but the core of the insert could be base metal or a different alloy. The composition of the underlying insert is not specified. The same issue applies to the reverse insert.

Sixth, the reverse design for Items 4 and 5 includes the inscription "KJ". The Determination does not explain whose monogram this is. It is likely the engraver or designer's initials (probably Kate J.). A reader must infer this; the Determination does not say. For Items 1 and 2, the obverse includes "IRB" for Ian Rank-Broadley. The use of designer monograms without explanation is standard but can be confusing for authentication purposes.

Seventh, Section 4 preserves other coin specifications. This means the same denomination may be specified in multiple determinations. A person who holds a $5 coin must check which determination applies to that particular issue. A single denomination can have multiple lawful specifications simultaneously.

Eighth, the Determination specifies the obverse design includes "an effigy of Queen Elizabeth II" for Items 1, 2, 4 and 5, but does not specify which portrait (e.g. the 1985 Mak portrait, the 1998 Rank-Broadley portrait, or a later one). The monogram "IRB" indicates Rank-Broadley, but the coin is dated 2006 or 2005, and Rank-Broadley's effigy was introduced in 1998. A collector wanting to know which specific effigy must look at the design itself, not the text of the Determination.

Compliance with this Determination is relevant to the Royal Australian Mint as producer, to persons handling these coins as legal tender, and to persons authenticating them. The Mint must ensure that each coin produced under this Determination meets all six specification elements in Schedule 1. For weight, each coin must fall within the standard weight plus or minus the allowable variation. For the $5 base metal coin (Item 1): 20.00g plus or minus 0.50g, meaning 19.50g to 20.50g. For the $5 silver coin (Item 2): 36.31g plus or minus 0.64g, meaning 35.67g to 36.95g. For the $1 coin (Item 3): 60.50g plus or minus 0.80g, meaning 59.70g to 61.30g. For the 50 cent silver coin (Item 4): 18.24g plus or minus 0.40g, meaning 17.84g to 18.64g. For the 50 cent base metal coin (Item 5): 15.55g plus or minus 0.40g, meaning 15.15g to 15.95g.

For dimensions, the coin's diameter must not exceed the stated maximum. For Items 1, 2 and 3, that is 38.90mm, 38.90mm and 50.20mm respectively. For Items 4 and 5, 31.65mm. Thickness must not exceed 2.65mm for Item 1, 3.50mm for Item 2, 3.80mm for Item 3, and 2.80mm for Items 4 and 5. The Mint should have quality control processes to measure dimensions and reject coins exceeding the maximums. Because no minimum is stated, the Mint has discretion to produce coins smaller than the maximum, but should be consistent to maintain public confidence and avoid variation in stacking or weight.

For composition, the Mint must ensure the alloy meets the standard. For Items 1 and 5, the composition is given only as elemental constituents without proportions, so compliance means using those four metals (copper, zinc, aluminium and tin) or two metals (copper and nickel) respectively, in any proportions. No purity floor or ceiling is stated. For Items 2 and 4, the silver must be at least 99.9 per cent. For Item 3, the silver must be at least 99.9 per cent, and the plating must be 99.99 per cent gold. The Mint should test fineness using appropriate metallurgical analysis and maintain certificates of assay.

For shape, edge and design, the Mint must match the descriptions exactly. The dodecagonal shape for Items 4 and 5 must have 12 sides. The edge must be plain (not milled) for those items, and continuously milled for Items 1, 2 and 3. The design descriptions are prescriptive; the Mint must verify that every inscription, representation and layout matches. The inclusion of the "KJ" monogram on Items 4 and 5 is mandatory. Any variation from the description would produce a non-compliant coin.

For persons accepting these coins as legal tender, compliance means verifying denomination and authenticity. A business should check the coin's weight, diameter and magnetic properties (copper-nickel is non-magnetic; silver is also non-magnetic but has different conductivity). The easily tested parameters are weight (using a precision scale) and diameter. If a coin falls outside the weight variation or exceeds the maximum diameter, it may be counterfeit or defective and the business may refuse it. The legal tender limits under the Currency Act apply; a business is not obliged to accept more than $5 in silver or base metal coins of 50 cent denomination, or more than $1 in $1 coins, or more than $5 in $5 coins.

For collectors and authenticators, the published specifications provide a benchmark. A collector should weigh the coin, measure diameter and thickness, check the edge type (plain vs milled), verify the dodecagonal shape for 50 cent coins, and examine the design details including inscriptions, the "IRB" monogram, the crown and bridge imagery, and the "KJ" monogram. For the $1 coin, the gold plating insert must be present and correctly oriented. Non-compliance with any one element suggests a counterfeit or a manufacturing error.

The Determination does not require record-keeping, reporting or notification. The Mint's internal quality records are not mandated by this instrument. The main compliance burden falls on the Mint to produce according to spec. For everyone else, compliance is passive: knowing the specifications and using them for verification if needed.
