What it does
This instrument, titled the Currency (Royal Australian Mint) Determination 2001 (No. 1), is a statutory instrument made by the Minister for Financial Services and Regulation under subsection 13A(1) of the Currency Act 1965, as recorded on the face of the Determination (header and author line). The Determination’s operative mechanics are simple and narrow. Section 3(1) states that the Determination “specifies, for a coin having the denomination and standard composition specified in columns 2 and 3 of Part 1 of Schedule 1, the standard weight, the allowable variation from that weight, the dimensions and the design specified in columns 4, 5 and 6 of that Part.” Section 3(2) clarifies that the reference to the diameter of a coin in item 110 is the distance between two parallel faces of the edge of the coin. Section 2 sets the commencement point as “on gazettal.” Section 1 gives the instrument its name.
Mechanically, the Determination operates by attaching technical specifications to a list of ten numbered items in Schedule 1 Part 1 (items 101-110). Each item pairs a denomination with a composition, a standard weight plus an allowable variation in grams, maximum diameter in millimetres, maximum thickness in millimetres, and coded design features (shape, edge, obverse, reverse). Part 2 of Schedule 1 decodes those design symbols into detailed descriptions of shape (S1, S3), edge treatment (E1, E3, E4), obverse motifs (O22, O26) and reverse motifs (R260-R269). Section 4 expressly states that “The specifications in this Determination do not affect any other Determination of the specifications of a coin,” preserving the continued operation of other determinations.
In short, the instrument prescribes physical and visual attributes for a small set of coin issues: multiple $5 silver coins (items 101-106), 20 cent coins (items 107 and 109), $1 coin (item 108) and 50 cent coin (item 110). It sets tolerances for manufacturing (weight variations and maximum dimensions) and mandates precise design elements via the protocol of symbol decoding in Part 2. The Determination contains no provisions within its text dealing with penalties, enforcement procedures, recordkeeping obligations, or funding for production. Any enforcement, compliance remedies or criminal/administrative consequences would appear, if at all, in the parent statute under which this instrument was made; they do not appear on the face of the Determination itself.
