Currency (Perth Mint) Determination (No. 5) 2018

The instrument rests on four core legal-technical concepts: delegated specification, statutory incorporation, technical tolerance and symbolic code descriptions.

1. Delegated specification. This is a determination made by an Assistant Minister under the Currency Act 1965 (see s3). The instrument does not itself enact primary law; it exercises delegated power to define technical features of coinage that the Act contemplates being fixed by determination. Section 5 is expressly "made for the purposes of paragraph 13(2)(b) of the Act" and section 6 is "made for the purposes of subsection 13A(1) of the Act" (see ss5 and 6).

2. Statutory incorporation. Section 5(2) operates to make the Act take effect "as if" the Schedule to the Act included the references and standard compositions set out in Part 1 of Schedule 1. That is an incorporating mechanism: the Schedule entries in this determination are to be read into the statutory Schedule for the purposes of the Act, rather than by direct amendment of the primary legislation on its face.

3. Technical tolerances and specifications. The Schedule provides precise numeric standards: metal purities (for example "At least 99.99% gold" for many items), nominal weights with allowable variation in grams (for example "31.157 ± 0.050"), maximum dimensions in millimetres, maximum thickness, shape codes, edge treatment codes and obverse/reverse design codes. These are legal specifications that will govern what constitutes a properly specified coin for the listed denominations once the determination is in force (see Part 1 of Schedule 1 and Part 2 explanations).

4. Symbolic code descriptions. Part 1 uses compact symbols (S1, E1, O1, R1 etc) to record shape, edge, obverse and reverse. Part 2 contains the human-readable descriptions that decode those symbols. The obverse descriptions repeatedly require a design "consisting of a circle immediately inside the rim that surrounds an effigy of Queen Elizabeth II" together with text elements such as "ELIZABETH II", "AUSTRALIA", year numerals and denomination labelling (see O1, O3, O6, O7 etc). Reverse codes specify motifs (kangaroo, kookaburra, wedge-tailed eagle, lunar designs, commemorative images) and contain hallmark letters and microscopic marks (for example "P", "JM", "AH", "microscopic 'P'") which are specified literal elements of the design explanations (see R1-R27).

Taken together these concepts mean the instrument is a technical rulebook. It prescribes which metal-content, size, design and labelling combinations are the recognised standard representations of the listed monetary denominations and compositions for the purposes of the Currency Act. The instrument also contains procedural editorial notes about commencement and that column 3 of the commencement table is not part of the instrument (see s2(2)).

Primary statutory parties. The instrument is made under the Currency Act 1965 and so primarily affects entities that produce, supply or handle Australian coinage created by or associated with the Perth Mint. The authority clause identifies the source of power (s3). Because section 5(2) makes the Act operate "as if" the Schedule included these entries, the instrument directly affects the legal status of the specified coins within the statutory framework that governs currency.

Perth Mint and coin producers. The Perth Mint is the named mint in the instrument title and the Schedule contains multiple designs that match motifs traditionally produced by the Perth Mint (kangaroo, kookaburra, Australian Nugget/Welcome Stranger, Lunar series, etc). The Schedule establishes the technical specifications that must be met for coins of the listed denominations and standard compositions to be treated as the officially recognised coin forms under the Act. This will affect mint engineering, manufacture tolerances, assay practices, hallmarking and quality control.

Financial intermediaries and custodians. Banks, bullion dealers, precious metal traders, custodians and vault operators who accept, trade or hold coins of these denominations have their operational acceptance criteria influenced. Where a coin conforms to the Schedule it will carry the statutory specification; where it does not, custodians may need to treat it as suspect or non-standard. The Schedule includes multiple distinct entries for identical face values and weights but different designs and dimensions. That increases the set of items that custodians and market participants must be able to recognise and verify.

Collectors, investors and consumers. Metal investors and collectors who buy, sell or hold coins listed in the Schedule are affected because the instrument determines the formal technical description and official labelling of those coins (metal purity, weight tolerances, reverse/obverse inscriptions and hallmarks). The face value is recorded for each item; collectors must reconcile face value labelling with intrinsic metal value.

Regulatory and enforcement agencies. Law enforcement, customs and currency regulators who inspect coins for conformity, counterfeit detection or customs valuation will need to use the Schedule as an authoritative reference for the listed denominations and designs. The instrument does not itself state enforcement mechanisms; it provides the technical baseline that other statutory provisions in the Currency Act and other laws will apply to.

Suppliers of non-specified coins. Third party mints or private producers who produce coins that resemble the designs, sizes or compositions specified may be affected indirectly. The Schedule contains explicit design elements and hallmark letters. Those producing confusingly similar items may face commercial or regulatory friction when market actors apply the Schedule as the standard against which they check authenticity.

Stakeholder practicalities. The instrument imposes a compliance and recognition burden on a range of market participants: mints must meet the listed tolerances and design elements; marketplaces and custodians must be able to recognise the multiplicity of listed items; and public information providers must ensure they use the Part 2 symbol explanations when describing the coins.

Duties created by this instrument are mainly technical and procedural rather than penalty-bearing rules inside the instrument itself. The determination performs an incorporative duty on the Act: section 5(2) requires that, on or after commencement, the Act "has effect as if" the Schedule to the Act included the listed denominations and standard compositions. In practice this supplies a legal duty on those interpreting the Currency Act to treat the entries in Schedule 1 of the determination as part of the statutory Schedule for the specified purposes. Section 6(2) places an equivalent mechanism for weight, allowable variation, design and dimensions into effect.

Duties for the mint and producers. The Schedule sets exact technical specifications that the coin issuer is obliged to meet if it wishes its coins to be the standard forms recognised by the Act. For example, Item 1 specifies a $100 coin of "At least 99.99% gold" with standard weight "31.157 ± 0.050 g", maximum diameter 32.60 mm, maximum thickness 2.80 mm, shape S1 (circular), edge E1 (continuously milled) and design codes O1 and R1. That creates a normative benchmark that production must match. The instrument does not itself impose the manufacturing processes, but it sets the required output characteristics.

Rights that follow from specification. By setting the standard composition and design, the instrument confers on coins minted to those specifications whatever legal recognition the Currency Act provides for coins that meet Schedule standards. The instrument does not itself restate the Currency Act’s legal consequences for coins meeting the statutory Schedule; it instead instructs that the Act has effect as if the Schedule entries exist (see s5(2)). Therefore any statutory privileges, obligations or legal effects tied by the Act to coins in its Schedule will follow for coins meeting these specifications. The instrument does not reproduce those downstream legal effects; readers must consult the Currency Act for the content of those rights and duties.

Design detail duties. Part 2 contains precise textual requirements for obverse and reverse designs, including the presence of an effigy of Queen Elizabeth II, the words "ELIZABETH II" and "AUSTRALIA", specified year numerals, denomination labelling (for example "1 DOLLAR" or "10 DOLLARS"), purity inscriptions such as "9999 Ag" or "9999 Au", and hallmark letters such as "P", "JM", "AH", "IRB", "WR", "SD", "LB", "NM", "TV". Where a design code like O1 or R1 is invoked, the design must include the listed elements to conform to that code. This creates a rights/duties link for the artwork and hallmarking: the statutory specification is literal about what inscriptions must appear.

Non-derogation clauses. Sections 5(3) and 6(4) expressly provide that the section does not affect any other provision of a determination made for the same purposes. That preserves other determinations and establishes a duty to read this instrument alongside other existing determinations rather than to treat it as a replacement or repeal.

Administrative particulars. Section 2(2) states that "Any information in column 3 of the table is not part of this instrument" and that such information may be edited in published versions. That creates a duty on users to respect that presentation notes in the commencement table are not operative text and may not be authoritative.

What the instrument does not do in itself. It contains no enforcement or penalty provisions; it does not itself change criminal liability or specify monetary fines. For enforcement and penalty consequences tied to currency standards one must look to the parent statute, the Currency Act 1965, which the instrument cites as its authority (s3).

The instrument itself contains no penalty clauses and includes no enforcement mechanism. There is no clause within the determination that creates offences, fines or enforcement powers. The instrument’s authority provision states it is made under the Currency Act 1965 (s3), and the operative words of sections 5 and 6 effect statutory incorporation of technical specifications into the Schedule to the Act (ss5(2), 6(2)). Because the determination is an instrument under the Act, any penalties, enforcement mechanisms, inspection powers or offences that apply to coinage will be found in the Act itself and other relevant laws; the instrument delegates specification but does not purport to set sanctions.

Implication for enforcement actors. Police, customs, regulatory agencies and courts seeking to determine whether a coin conforms to the statutory standards should consult (a) the Schedule entries in this instrument for the technical specification and (b) the enforcement provisions in the Currency Act 1965 for the powers and penalties applicable where coins fail to meet statutory requirements or where other offences arise. The determination provides the technical baseline that enforcement actors will use to assess conformity but does not provide the penalty framework.

Evidentiary and practical enforcement issues. Because the Schedule lists multiple entries with overlapping face values, similar weights and different designs, enforcement and authentication will require comparing observed physical characteristics to the precise items in Part 1 of Schedule 1 and to design explanations in Part 2. For example, several $100 gold coins are listed with identical weight 31.157 ± 0.050 g but different maximum diameters and different reverse codes (Items 1, 13, 17, 19, 21, 29, 30). An examiner must use the combination of weight, diameter/thickness, shape, edge and obverse/reverse inscriptions to identify the matching Schedule entry. Where microscopic marks are specified in the design explanations (for example "a microscopic 'P'"), enforcement will depend on access to appropriate magnification equipment and accepted testing procedures.

Role of labelling and hallmarks. The Part 2 explanations embed hallmark letters and inscriptions as elements of the specified reverse designs (for example "AH", "P", "JM", "WR"). These design elements may serve as practical markers of conformity. An enforcement agency assessing authenticity should record whether the hallmark letters and inscriptions described in the relevant reverse code are present.

Administrative limits. Section 5(3) and 6(4) confirm that this instrument does not affect other determinations made for the same purposes. That creates a practical enforcement duty to take into account the universe of determinations and the Currency Act when assessing whether a coin is the standard form. The instrument does not state how conflicts between determinations should be resolved; the parent statute and administrative practice will dictate that.

Statutory relationship to the Currency Act 1965. The instrument is explicitly made under the Currency Act 1965 (s3). Sections 5 and 6 state they are made for the purposes of specific provisions of that Act: s5 is made for paragraph 13(2)(b) and s6 is made for subsection 13A(1). Both sections operate by instructing that the Act "has effect, on or after the day on which this instrument commences, as if" the Schedule to the Act contained the references and specifications set out in the instrument (see s5(2) and s6(2)). Thus the interaction is one of delegated statutory specification: the instrument supplies entries that are to be read into the Act’s Schedule for the indicated purposes.

Subordinate instrument status. This is a subordinate instrument under the Currency Act. As such it is likely subject to the usual constraints on delegated legislation, including any publishing, tabling, and disallowance requirements that apply under the Acts Interpretation Act 1901 or under the Currency Act. The instrument itself contains a commencement table and an editorial note that the commencement table refers to the instrument as originally made and will not be amended to deal with later amendments (s2). Section 2(2) also clarifies that information in column 3 of the commencement table is not part of the instrument, which is a common drafting technique to keep explanatory details separate from operative text.

Relationship to intellectual property and Crown representations. The Part 2 obverse descriptions require the effigy of Queen Elizabeth II and the wordings "ELIZABETH II" and "AUSTRALIA". Those are statutory design elements this instrument mandates for the specified obverse codes. The instrument does not address separate intellectual property or licensing arrangements for the effigy or for external artists’ designs. Any copyright, moral rights, or licensing restrictions under other laws would remain applicable and are not displaced by the technical specification here. The instrument therefore interacts with other legal regimes indirectly: it prescribes required inscriptions and motifs; rights in artwork and artist credits remain governed by the laws that cover those subject matters.

Interplay with trade, customs and valuation law. The Schedule sets metal purities and weights. For customs valuation, taxation and trade reporting, those metal-content specifications will be relevant factual inputs. The instrument does not amend customs or taxation laws, but those regimes may take the instrument’s specifications as authoritative evidence of a coin’s metal content and denomination for valuation or duty purposes. The instrument itself makes no tax rulings.

Interaction with anti-counterfeiting and criminal law. The instrument supplies definitions and technical baselines enforcement agencies will use when applying anti-counterfeiting and currency-related criminal offences found in other statutes. The determination does not create offences; it supplies the technical data that will underpin enforcement under other laws, notably the Currency Act or criminal statutes, which must be consulted for enforcement powers and penalties.

Non-repeal and coexistence with previous determinations. Sections 5(3) and 6(4) explicitly state that these sections do not affect any other provision of a determination made for the same purposes. That creates a statutory instruction to read this determination alongside prior determinations rather than as a repeal. Administratively, the Schedule entries in this instrument must be used in conjunction with any earlier determinations until they are expressly repealed or superseded by positive legislative action.

Publication and interpretive notes. Section 2(2) points out that information in column 3 of the commencement table is not part of the instrument and may be edited in published versions. That interacts with the broader statutory and administrative law principle that public explanatory material is not operative; users should rely on operative text. The instrument therefore preserves the separation between operative content and editorial or explanatory notes.

The instrument contains limited internal amendment-history detail. It is titled Currency (Perth Mint) Determination (No. 5) 2018 and is dated 16 October 2018. Section 2 contains a commencement table that states "The whole of this instrument" commences "The day after this instrument is registered." The instrument includes an express note that the table "relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument" (s2). That is a drafting convention indicating the instrument’s internal commencement record is anchored to the original making and not used for tracking subsequent amendments.

No internal amendments are recorded inside the text provided. There is no schedule or history of prior versions attached to the instrument itself. The instrument contains savings language that it "does not affect any other provision of a determination made for the purposes" of the referenced paragraphs of the Act (s5(3), s6(4)). That indicates the drafter intended this instrument to operate alongside other determinations rather than to be exclusive, but it does not provide a chronology or repeal schedule of past determinations.

External amendment process. Because this is a statutory determination under the Currency Act, any amendment to the instrument would require the appropriate delegated authority to make a further determination. The instrument itself does not include a sunset clause or an explicit amendment mechanism. It can be amended, replaced or revoked in accordance with the powers conferred by the Currency Act; those statutory powers are not reproduced in this instrument. The absence of internal amendment entries means stakeholders should check the legislative instruments register, the Currency Act's Schedule, and any subsequent determinations to see if later changes have been made.

Editorial and publication notes. Section 2(2) makes clear that column 3 of the commencement table is not operative. That is an explicit limitation on using the instrument text as a substitute for authoritative legislative registers. Practically, the instrument’s published versions may include changes to explanatory commentary but not to operative text without formal amendment.

Practical record-keeping implication. Users who need to track amendments should consult the official register of legislative instruments and the Currency Act consolidated instrument list. The instrument itself does not provide an amendment trail beyond its original date and commencement instruction.

The instrument as supplied contains no references to litigation, case law, judicial interpretation or precedent. It is a technical delegated instrument recording physical and design specifications and contains no internal discussion of disputes or adjudicated controversies.

Implication for legal research. Because the determination does not cite cases or contain a litigious history, any inquiry into litigation involving these coin specifications must look beyond the instrument to the Currency Act 1965, administrative decisions, tribunal rulings or court judgments that interpret the Act, the determination-making power, or disputes over particular coin issues. The instrument itself provides no record of such litigation.

Potential grounds for future litigation (procedural, evidentiary and interpretive). The instrument’s content suggests the typical legal issues that have the potential to generate disputes, although none are recorded here. Those issues include: whether a particular physical coin conforms to a specified Schedule item when multiple dimensions and markings must be matched; the significance of the phrase "as if there were included in the Schedule" for rights or defences under the Currency Act; and the proper identification and legal effect of hallmark letters and microscopic marks specified in reverse designs. Any litigation on these points will be sourced to the parent Act and evidence about manufacture, assay and design. This instrument provides precise factual content that a court would use as a baseline if and when disputes arise, but the instrument does not itself report any adjudications.

No recorded judicial gloss. Because there is no litigation record in the instrument, readers must not assume any judicial interpretation or settled administrative practice beyond the text. If a legal practitioner needs to rely on how the courts or administrative bodies will treat these specifications, they must search court databases, tribunal decisions and agency guidance that post-date the instrument.

The instrument is compact and technical, but several practical pitfalls arise from its drafting and the way it integrates into statutory and market reality.

1. Multiple entries for identical denominations and weights. The Schedule contains multiple items with the same face value and substantially the same weight but different dimensions or designs. For example, Item 1, Item 13, Item 17, Item 21 and Items 29-30 are all $100 coins with a standard weight noted as 31.157 ± 0.050 g and "at least 99.99% gold", but they differ by maximum diameter, thickness and reverse codes. An examiner or market participant who checks only face value and weight could misidentify which Schedule item a coin conforms to. Authentication requires cross-checking diameter, thickness, shape, edge and obverse/reverse inscriptions (see Part 1 table and Part 2 explanations).

2. "At least" purity phrasing. The Schedule uses formulations like "At least 99.99% gold" and "At least 99.95% platinum". "At least" sets a minimum purity threshold, but the instrument does not set a maximum purity nor specify permitted alloying practices beyond the minimum. Producers and assay labs must be prepared to document actual purity. Where purity exceeds the minimum it will still satisfy the specification, but that may complicate valuation or commercial labelling if buyers expect precise purity numbers.

3. Small tolerances and test methodology. The allowable weight variations are small, in some cases ±0.015 g or ±0.020 g. Confirmation may require calibrated scales and agreed testing procedures. The instrument does not specify test methodology (for example, whether net or gross weight is used, or the temperature/conditions for weighing). That leaves potential disputes about conformity dependent on technical measurement standards outside the instrument.

4. Use of coded design explanations and microscopic marks. Part 1 uses short codes for obverse and reverse designs. Part 2 explains those codes with specific inscriptions including microscopic "P" marks and hallmark letters. Failure to include a microscopic mark could render a coin non-conforming to the exact design description. Practical verification will require magnification and knowledge of where marks should appear. Part 2 does not supply image coordinates; it supplies textual requirements only.

5. Column 3 not operative. Section 2(2) states any information in column 3 of the commencement table is not part of this instrument. Users relying on published versions that include note text in column 3 must be careful: such text is editorial and not binding.

6. No penalty or enforcement detail in this instrument. The instrument supplies specifications only. For consequences of non-conformity, practitioners must consult the Currency Act and other applicable statutes. Mistaking the instrument for setting enforcement rules could create compliance blind spots.

7. Coin face value versus intrinsic value. The Schedule records face values (for example $1, $100, $200) tied to precious metal coins with substantial intrinsic metal value. The instrument does not address how face value interacts with trade or taxation. Market participants should not assume face value equals market value or that statutory specification limits private contract freedom in pricing.

8. Shape and non-circular forms. Items include non-standard shapes: S2 indicates rectangle and S3 indicates figure 8 (see Part 2 items 2 and 3). These non-circular coins will require special handling by vending machines, counting machines and custodial equipment. The instrument does not address interoperability or recognition by commercial machinery.

9. Hallmark letters and artist initials. Part 2 mentions initials such as "JC", "IRB", "WR", "JM", "AH", "SD", "LB", "NM" and "TV". The instrument treats them as fixed textual elements of design codes. Where artistic credit or hallmark letters are altered, the coin may cease to correspond to the exact schedule description.

10. Administrative coexistence with other determinations. Because ss5(3) and 6(4) preserve other determinations, practitioners must check the whole body of determinations and the Currency Act’s Schedule. Relying on this instrument alone may miss other operative entries.

For issuers, producers, custodians, dealers and enforcement agencies, compliance is a matter of matching production, assay and identification workflows to the instrument’s technical content.

1. Use the Schedule as the authoritative spec. Treat Part 1 of Schedule 1 as the operative list of denominations and technical characteristics to be matched. For any coin presented as one of the listed denominations, identify the corresponding item by matching these attributes in combination: standard composition text, standard weight within allowable variation, maximum diameter or other dimension, maximum thickness, shape code, edge code and obverse and reverse design codes (see Part 1 table).

2. Maintain measurement and assay infrastructure. Because weights and tolerances are tight (for example ±0.015 g, ±0.020 g, ±0.050 g), issuers must have calibrated scales and reproducible assay methodology. Document procedures for weighing (environmental conditions, tare handling), and maintain traceable calibration records. Where purity is stated as "At least 99.99% gold", maintain assay certificates from accredited laboratories demonstrating compliance.

3. Design control and master patterns. Create master artwork and die templates that reproduce the obverse and reverse elements described in Part 2 exactly, including wording, year numerals and hallmark letters. For design codes requiring a microscopic "P" or other tiny feature, ensure die-making tolerances capture those elements and preserve records showing reproduction fidelity. Keep a version-controlled library mapping the instrument’s code (for example O1, R1) to specific die and artwork IDs.

4. Hallmark and inscription checklist. For obverse and reverse design compliance use a checklist that includes each textual element prescribed in Part 2. Examples: O1 requires "ELIZABETH II", "AUSTRALIA", the Arabic numerals for the amount and the initials "JC" (see O1); R1 requires "AUSTRALIAN KANGAROO", a "2019 Xoz 9999 GOLD" inscription template and the letters "AH" and "P" (see R1). Cross-reference the checklist against production samples.

5. Quality assurance at multiple stages. Implement inspection at blanking, striking, finishing and post-production stages. Include visual inspection, microscopic inspection for small marks, and mass/dimension checks on statistically significant samples. Record acceptance criteria in manufacturing records and maintain retained samples for comparison.

6. Product labelling and disclosure. When supplying coins to customers, provide documentation that links the coin to the specific item in the Schedule (for example "Perth Mint 2019 Australian Kookaburra 1oz silver coin, conforms to Item 8 of Schedule 1, Currency (Perth Mint) Determination (No.5) 2018"). Include assay certificates where available and accurate descriptions of purity and weight.

7. For intermediaries: authentication protocols. Banks, bullion dealers and vault operators should implement authentication protocols that combine weight check, dimension check, obverse/reverse inscription verification, edge type confirmation and hallmark presence. For coins with overlapping attributes, authentication must use the complete specification. Train staff to recognise non-circular shapes (S2 rectangle, S3 figure 8) and to use magnification to confirm microscopic marks.

8. Documentation for transactions. Maintain records of provenance, assay, sale/purchase records and any correspondence that links a coin to the Schedule item. Because the instrument imports the specification into the Currency Act "as if" included in the Schedule, documentary evidence linking a physical piece to the Schedule item will assist where legal status or treatment under the Act is relevant.

9. Check for other determinations. Because ss5(3) and 6(4) preserve other determinations, before relying on this instrument as the sole standard check the legislative instruments register and the Currency Act’s Schedule for further determinations or amendments that may affect particular denominations or designs.

10. Seek statutory guidance for enforcement or disputes. The instrument does not set penalties. If non-conformity is suspected or discovered, consult the Currency Act 1965 and relevant enforcement agencies to determine the legal consequences and reporting obligations. Keep ready contact details for assay laboratories, the issuing mint’s compliance office and currency regulatory bodies.

11. Machine compatibility assessment. If coins will be handled by commercial machinery, test machine recognition and handling for each shape/size/thickness combination listed. Non-circular or large-diameter coins may require special packaging, handling and customer notice.

12. Monitor published editorial notes. Remember section 2(2) disclaims that certain published notes (column 3 of the commencement table) are not operative. Ensure procurement and compliance teams use the operative text and not only published explanatory materials.

Following these steps aligns manufacturing, authentication and commercial processes with the technical baseline set by the instrument and reduces the risk of misidentification, non-conformity and subsequent disputes.
