Currency (Perth Mint) Determination (No. 3) 2018

The instrument operates through a compact technical vocabulary. The core concepts are: "denomination", "standard composition", "standard weight" and "allowable variation", "design", "dimensions", and symbol codes for shape, edge, obverse and reverse. The definition section is minimal: the instrument defines only the Act as the Currency Act 1965 (s 4). The detailed definitions of design and other features are contained in Schedule 1 Part 2.

Denomination and standard composition. Each item in the Schedule lists a face value in Australian dollars or cents and a required metal content described as the "standard composition". Most items specify precious metal purity in the form "At least 99.99% gold" or "At least 99.99% silver", while one item specifies "Aluminium and Bronze" composition and one item is bi-metallic with separate minimum purities for centre and surround (see Schedule 1 Part 1 items 1-50). The language "At least" sets a minimum purity standard rather than an exact composition.

Standard weight and allowable variation. For each coin the Schedule gives a "standard weight" in grams and an "allowable variation" (in grams), for example item 1 $3,000 gold coin 1000.200 ± 0.100 grams (Schedule 1 Part 1). Some items are very large, for example item 19, a $300 silver coin with standard weight 10010.500 grams and allowable variation ± 9.500 grams. These numeric tolerances are the statutory manufacturing tolerances for the coin issued under the Act.

Design and dimensions. The Schedule specifies the maximum diameter or other dimension and maximum thickness in millimetres. It also uses symbol codes for shape (S1 means circular), edge (E1 means continuously milled), obverse and reverse design codes (O1-O9 and R1-R18). Part 2 decodes each obverse and reverse symbol into required inscriptions, motifs and finishes. For example, obverse O1 requires an effigy of Queen Elizabeth II and inscriptions including "ELIZABETH II", "AUSTRALIA", a denomination string "3000 DOLLARS", the year "2019", weight/purity "1KG 9999 GOLD", and the letters "IRB" (Schedule 1 Part 2 items 3 and 4).

Special features. The Schedule includes variations in finish (frosted, proof), colour (coloured representation; gilded), inset gems (R10), microscopic marks, and bi-metallic structure (item 50). The instrument therefore encodes not only mass and purity but also aesthetic and technical production features that affect manufacturing process, cost and authentication.

Legal form. The instrument is a determination under specific powers in the Currency Act. Section 5 explicitly states it is made for paragraph 13(2)(b) and s 6 for subsection 13A(1) of the Currency Act. The instrument’s table is described as specifying the standard composition, weight, allowable variation, design and dimensions on and after commencement (ss 5-6).

The primary entity immediately affected is the Perth Mint as the issuer and producer of the coins specified, because the instrument prescribes the physical, compositional and design standards that apply to Perth Mint coin issues listed in Schedule 1 (see ss 5-6 and Schedule 1 Part 1). The Assistant Minister to the Treasurer made the determination, but operational compliance and production obligations fall on the Mint and any subcontractors involved in manufacturing, finishing, assaying, packing and distribution.

Secondary affected parties include dealers and traders in coins, numismatists, bullion investors, refiners, transport and secure logistics providers, customs officials, insurers and storage providers. The Schedule prescribes precise weights, dimensions and inscription text for particular face values and compositions. For example, collectors and dealers who market coins by reference to weight, purity and design must use the Schedule item numbers to describe the product if they are representing a coin as one of the official Perth Mint issues now operating as standards under the Currency Act (Schedule 1 Part 1 items and Part 2 descriptions). Because the instrument sets minimum purity thresholds and exact inscription requirements, assayers and laboratories that verify compliance, and regulators who rely on the Currency Act framework, may use these specifications as reference points.

Manufacturers and subcontractors who supply materials and services to the Mint are affected by the production demands inherent in specific entries. Several items require extremely high purity (at least 99.99% gold or silver), coloured or gilded finishes, gem insets, proof or frosted finishes, large diameters and substantial thickness. For example, item 19 ($300 silver coin) has a mass of 10,010.500 g and a diameter of up to 221.00 mm; producing, transporting and insuring a coin of that size has logistical and cost consequences for any supplier, secure courier and insurer.

Market participants in secondary markets are also affected by the existence of multiple entries with the same face value but different physical attributes. The Schedule lists several distinct $100 gold items (items 4, 9, 12, 13, 18, 46), and multiple $1 silver items (items 24, 28, 30, 35, 40, 41, 43, 44, 47, 49), some with differing diameters or thicknesses. Sellers, brokers and contract drafters must therefore specify which Schedule item is being transacted to avoid ambiguity about coin identity.

Finally, the instrument affects legal and compliance advisors who must interpret how these specifications interact with the Currency Act and other regulatory frameworks. The instrument does not itself create offences or penalties; it operates as a determination that changes the Schedule to the Act and supplies technical standards that other statutory provisions may reference. Any regulatory or enforcement consequences would derive from the Currency Act or other laws, so affected parties should link the determination to those regimes when advising clients.

The determination itself imposes technical obligations by specifying the standards to be applied to particular Perth Mint coins. Sections 5 and 6 effect these duties by making the Act operate "as if" the Schedule to the Act included the denominations and standard compositions and by specifying standard weight, allowable variation, design and dimensions (s 5(2); s 6(2)). The Schedule's entries therefore function as statutory standards that govern how the listed denominations are to be manufactured and described.

Duties on the issuer. The practical duty created by the instrument is that any coin issued as one of the listed items must conform to the listed standard composition, standard weight within the allowable variation, specified maximum diameter or other dimension, specified maximum thickness, specified shape and edge, and the prescribed obverse and reverse inscriptions and design features as decoded in Part 2. For example, an item described in the Schedule as "At least 99.99% gold 31.157 ± 0.050 g" with obverse O2 and reverse R1 must have the inscriptions and motifs precisely as set out in O2 and R1, and its mass must fall within the tolerance stated (Schedule 1 Part 1 items and Part 2 definitions).

Recordkeeping and production duties implied. While the instrument does not specify recordkeeping procedures, the detailed specification of mass, diameter, inscriptions and finishes implies a practical duty on the producer to measure, assay and document compliance with those specifications at production. The bi-metallic item in item 50 breaks down the required masses of centre and surround separately, requiring separate measurement and quality control of each component, including their tolerances (Schedule 1 Part 1 item 50).

Rights conferred by the instrument. The instrument confers a statutory character on the listed specifications by making them operate as if published in the Schedule to the Currency Act. That creates the right for purchasers, dealers and regulators to reference those specifications as authoritative for the identification of official Perth Mint issues listed in the instrument. For example, when a person asserts they hold a Perth Mint $1 coin of a particular design listed in the Schedule, the Schedule provides the statutory description against which authenticity and compliance can be tested.

Limitations and non-effects. The instrument expressly states that section 5 "does not affect any other provision of a determination made for paragraph 13(2)(b) of the Act" and that section 6 "does not affect any other provision of a determination made for subsection 13A(1) of the Act" (s 5(3); s 6(4)). Those clauses indicate the determination is intended to sit alongside other determinations under the same powers rather than to displace unrelated instrument provisions. The instrument itself contains no penalty clauses and does not amend other parts of the Currency Act on its face; therefore duties and rights concerning enforcement, contraventions, or criminality must be located in the Act or other legislation.

Specific design requirements. Part 2 lists precise textual inscriptions and motifs for obverse and reverse. Some obverse specifications require the inclusion of year numerals (for example "2019" or "2018"), denomination strings in words and numerals, weight and fineness statements (for example "1KG 9999 GOLD" or "Xoz 9999 Ag"), and the letters "IRB" or other marks. Reverse specifications prescribe finishes (frosted, proof), colouring, gilding, gem insets and tiny marks. Compliance therefore means meeting both metallurgical standards and detailed visual and marking features.

The determination itself is silent on specific penalties or enforcement mechanisms. The instrument does not include penalty clauses, fines or enforcement procedure. It is made under powers in the Currency Act 1965 (s 3), and it states that it gives effect as if the Schedule to the Act included the listed denominations and specifications (s 5(2)) and that Part 1 of Schedule 1 specifies the standard weight, allowable variation, design and dimensions (s 6(2)). Therefore any penalties for non-compliance with standards, and the enforcement authorities and mechanisms that may apply, are matters for the Currency Act or other statutes, not for this instrument. The instrument expressly notes that it does not affect other provisions of a determination made for the relevant paragraphs and subsections of the Act, which suggests enforcement should be read in the context of existing statutory machinery (s 5(3); s 6(4)).

Practical enforcement implications. Because the Schedule becomes de facto the authoritative description of Perth Mint coin issues listed, enforcement bodies relying on the Currency Act may use these specifications as the benchmark for determining whether a coin is a valid issue or whether a person has represented a coin as an official issue. For example, when authenticating coins for customs, law enforcement or consumer protection investigations, officials would compare a specimen to the Schedule entry for weight, purity, inscriptions and motif. The instrument provides the objective metrics that can ground prosecutions or administrative actions that rely on the Currency Act or other consumer protection, trade or fraud laws.

Who would enforce. The instrument does not name enforcement agencies. Under the Currency Act, enforcement powers and offences are set out in the Act; therefore whether a contravention of these specifications gives rise to a statutory offence, or whether contraventions are actionable under other laws such as the Australian Consumer Law, trademark or criminal fraud provisions, is a matter to be determined by reference to those statutes and any relevant delegated instruments. Practitioners should therefore consult the Currency Act 1965 and related instruments to identify the enforcement pathways and applicable penalties.

Evidential and procedural issues. The detailed weights, dimensions and inscription texts in the Schedule provide strong evidential benchmarks for civil or criminal proceedings. An expert assay, measurement or photographic comparison can be deployed to show conformity or lack of conformity to the statutory standard. However the instrument does not set evidentiary presumptions or procedural rules; it relies on general civil and criminal evidentiary regimes to admit and test expert evidence.

Administrative review. The instrument does not state any administrative review rights specific to these determinations. Challenges to the validity of the determination, its interpretation, or enforcement actions that rely on it would proceed under general administrative law mechanisms, statutory review procedures in the Currency Act if any exist, or judicial review in the courts. Because the instrument is a statutory determination, questions of validity would centre on the delegated power under the Currency Act and whether the determination falls within that power; practitioners must consult the Act and case law on delegated legislation for any contestation.

This determination is explicitly made under the Currency Act 1965 (s 3). Its primary legal interaction is therefore with the Currency Act. Sections 5 and 6 enact the Schedule additions and technical specifications by operation of that Act: s 5(2) states the Act has effect "as if" the Schedule included the references and standard compositions specified in Part 1 of Schedule 1, and s 6(2) declares the items of Part 1 specify weight, variation, design and dimensions "on and after" commencement. The instrument therefore modifies the statutory baseline under the Currency Act concerning which coins are recognised and what their standard compositions and physical characteristics are.

Limitations on displacement. The instrument contains express non-displacement clauses: s 5(3) "does not affect any other provision of a determination made for paragraph 13(2)(b) of the Act", and s 6(4) "does not affect any other provision of a determination made for subsection 13A(1) of the Act". Those clauses indicate the determination is not intended to override other determinations made under the same powers and should be read alongside existing determinations.

Other possible legal interactions. The instrument sets technical and textual features that meshing with other regulatory frameworks may rely on the Schedule as an authoritative description of official Perth Mint issues. This can affect, for example, intellectual property or trade mark claims where the use of state insignia, portraiture of the monarch and inscriptions such as "AUSTRALIA" or "ELIZABETH II" interact with laws governing protected emblems and state symbols. The instrument itself, however, does not address the legal status of the inscriptions or state emblems; it prescribes their use as part of obverse and reverse designs (see Schedule 1 Part 2 obverse and reverse descriptions).

Consumer protection and commercial law. The determination provides measuring benchmarks that may be relied on in consumer protection, sale of goods disputes, or misrepresentation claims. A seller who markets a coin as matching a particular Schedule item can be tested against the Schedule's mass, purity and inscriptions. The instrument does not alter contract law principles; it supplies an objective standard that contracting parties can incorporate or rely upon. Practitioners should recognise that the instrument does not create an automatic consumer guarantee; any remedies would follow from ordinary contract, warranty and statutory consumer law frameworks.

Customs, import/export and tax. The instrument does not address border, customs, currency control or taxation matters. However the detailed material composition and weights can be relevant to customs classification, duty and GST treatment. Authorities and advisors will need to reference the Schedule when establishing the commodity classification and to determine how other regimes apply. The instrument does not itself change those external regimes; it supplies technical data that those regimes might use.

Criminal and fraud law. If a person falsely represents a coin as conforming to a Schedule item, prosecution under general fraud, theft or related criminal provisions might follow, depending on the factual matrix and the statutory offence elements. The instrument does not create a bespoke criminal offence for counterfeiting these coins; whether particular conduct constitutes an offence will depend on other statutes and on whether the Currency Act contains specific offences referencing Schedule content.

Regulatory interplay caution. Because the instrument inserts specific coin standards into the Schedule to the Currency Act, users should treat it as creating an authoritative specification for those coins in any regulatory regime that references the Currency Act. Legal advice on cross-regulatory effects should therefore begin with the Currency Act 1965 and any related proclamations or regulations that draw on the Act’s Schedule.

This determination is titled Currency (Perth Mint) Determination (No. 3) 2018 and is dated 27 April 2018 in the heading. Section 1 names the instrument (s 1). Section 2 sets out commencement: the instrument commences the day after it is registered, as stated in the commencement table (s 2(1)). The table is described as relating only to the provisions of the instrument "as originally made" and not to be amended for later amendments (s 2(1) note). The instrument itself contains no internal amendments to earlier determinations; it modifies the operation of the Currency Act by inserting the Schedule entries as if included in the Schedule to the Act (s 5(2); s 6(2)).

The instrument includes an internal note indicating that column 3 of the commencement table is not part of the instrument and may be edited in any published version (s 2(2)). There is no express transitional or savings provision in the instrument to deal with previously issued coins, stock on hand, or contracts already formed before commencement. Sections 5(3) and 6(4) state the instrument "does not affect any other provision of a determination made for" the corresponding paragraphs and subsections of the Act, which suggests it is additive rather than displacing prior determinations.

The Schedule itself contains date references within the inscriptions required on coins, such as "2018" and "2019" appearing in obverse descriptions O1-O9 and in various reverse inscriptions (Schedule 1 Part 2). Those year numerals are design features required to appear on certain items; they do not necessarily indicate amendment dates of the instrument. The instrument does not contain a schedule of prior determinations it replaces or updates, nor does it list earlier versions of Perth Mint determinations for direct comparison.

No subsequent amending instruments are recorded in this text. To determine whether later instruments superseded, amended or replicated these specifications, one must consult the Federal Register of Legislation or the Currency Act Schedule as in force at a later date. The instrument’s own metadata note warns that the commencement table relates only to the instrument "as originally made" and will not be amended in the instrument text to reflect later amendments (s 2(1) note). Practitioners advising on historical issues should therefore check the consolidated legislative history on the official register to capture any subsequent determinations or revocations.

The instrument itself does not record any litigation. There are no judicial or administrative decisions cited in the text, nor any internal notes describing disputes or clarifications arising from prior determinations. This instrument is a technical determination and not an adjudicative instrument, so its text focuses on specifications rather than dispute records.

A search for litigation or administrative appeals concerning the content, validity or enforcement of this determination is necessary to establish any recorded cases. Because the instrument is made under the Currency Act 1965, any litigation that touches on the validity of the delegated power, the interpretation of the Schedule entries, or enforcement actions relying on these specifications would appear in court records, tribunal decisions or administrative review files outside the text of this determination. The instrument itself provides no information about such proceedings.

In practice, challenges could, in principle, concern issues such as whether the delegated power was correctly exercised, whether a particular coin conforms to the statutory specification, or whether a person made false representations regarding a coin’s conformity. Any such challenges would be litigated under relevant procedural and substantive law , for example judicial review of administrative action, civil claims for misrepresentation or fraud, or criminal prosecutions under applicable statutes , but identifying actual cases requires external case-law research.

Given the instrument’s absence of litigation references, counsel must not assume there has been no court or tribunal activity; they should perform targeted searches in federal court databases, tribunal records and the consolidated Federal Register of Legislation for subsequent instruments, judicial review applications or enforcement proceedings that mention this determination or the specific Schedule items.

There are several concrete pitfalls and points of operational friction identifiable directly from the instrument’s text.

Multiple items share identical face values but differ materially. The Schedule lists the same monetary denominations multiple times with different compositions, dimensions, or designs. For example, $100 gold coins appear at items 4, 9, 12, 13, 18 and 46 with differing diameters, thicknesses and reverse designs (Schedule 1 Part 1 items cited). Similarly, $1 silver coins appear in many items with differing dimensions and reverse designs (items 24, 28, 30, 35, 40, 41, 43, 44, 47, 49). A contract, catalogue or title document that refers simply to "Perth Mint $100 coin" without specifying the Schedule item, year, obverse O-code and reverse R-code risks ambiguity. The Schedule therefore requires precise cross-referencing in commercial descriptions to avoid disputes.

Extremely large items. Several items have very large masses and dimensions. Item 19 is a $300 silver coin weighing 10,010.500 grams with a maximum diameter of 221.00 mm and thickness up to 34.81 mm. Item 20 is a $30 silver coin at 1002.100 grams and diameter 100.60 mm. These sizes have real logistical consequences for manufacturing, shipping, insurance and storage. Practitioners advising purchasers, insurers or logistics providers should note the explicit mass and size limits and ensure operational plans account for them.

Tight tolerances. Many items specify weights with small allowable variations. For example, item 4 $100 gold coin standard weight 31.157 ± 0.050 g. Small tolerances require precision assaying and measurement at production and on any verification, affecting production yields and rejection rates. The Schedule does not specify measurement methods or sampling regimes; those operational decisions are left to the producer and any verifying laboratory.

Undeclared marks and abbreviations. Obverse and reverse inscriptions require marks such as "IRB", "AH", "JM", "NH", "P" and "microscopic 'P'". The instrument does not define the letters or initials or their legal significance; they appear simply as required inscriptions (Schedule 1 Part 2 items). A buyer or examiner must not assume the letters mean any particular thing absent external documentation. The presence of "IRB" on multiple obverses and "P" on many reverses is a required design element, but the instrument does not explain the provenance or legal effect of these devices.

Finish, colour and gem insets. Some reverse descriptions demand coloured representations, gilt finishes, or a gem inset into the eye of a motif (R3, R4, R10). These create further production complexity and valuation quirks. For example, a coloured or gem-inset coin may command a premium in the market; however, the instrument sets only the design requirement and not a market valuation. From a compliance perspective, the inclusion or absence of colour or gem must be checked against the specific R-code.

Bi-metallic and component weights. Item 50 is bi-metallic with specific separate weights and tolerances for centre piece and surround: gold 23.380 g ± 0.050 and platinum 23.390 g ± 0.050. Compliance requires separate control and documentation for each component and for the assembled coin. Mistakes in component weights may still result in total mass conformity while failing to meet component tolerances; the Schedule requires conformity at the component level for that item.

Year numerals in inscriptions. Several obverse design codes require a specific year numeral, for example "2019" or "2018" in O1-O9. If a coin is produced in a different year but bears an inscription year specified in the Schedule, careful cross-referencing is needed to ensure conformity to the relevant Schedule item; the instrument does not specify whether inscription year must match the production year. Practitioners should check which Schedule item a coin matches by inscription and numeric features.

"Maximum" dimensions only. The Schedule uses "Maximum diameter or other dimension (mm)" and "Maximum thickness (mm)". It does not list minimum dimensions. In practice manufacturing might produce slight undersize pieces that still meet mass and composition tolerances but fall below maximum dimensions. How such variance affects conformity is not clarified in the instrument; producers should document that diameters do not exceed listed maxima and should adopt internal minimums to avoid ambiguity.

Absence of procedural detail. The determination prescribes standards but does not set out assay methods, sampling plans, lab accreditation requirements or dispute resolution mechanisms for contested conformity. Those procedural gaps must be bridged by operational protocols at the Mint or by agreement between private parties.

To comply with this determination, a producing mint and any party representing the listed coins should take these concrete steps grounded in the instrument.

1. Identify the correct Schedule item. For each coin design or issue, identify the exact Schedule 1 Part 1 item number that describes it. Do not rely on denomination alone because several denominations appear multiple times with different compositions, dimensions or designs (Schedule 1 Part 1 items).

2. Assay and document composition to the stated minimum. For coins specified as "At least 99.99% gold" or "At least 99.99% silver" ensure metallurgical assays demonstrate the coin meets or exceeds the minimum purity. Maintain assay certificates and internal records linking each production batch to the assay results. For bi-metallic item 50, obtain separate assay documentation for each component (centre gold piece and platinum surround) showing compliance with the component purities and masses listed (Schedule 1 Part 1 item 50).

3. Weigh and measure to specifications and tolerances. Use calibrated balances and measurement devices to confirm the standard weight and allowable variation stated in the item. For example the $3,000 gold (item 1) must be 1000.200 g ± 0.100 g. Ensure measurement records are kept for batches and retained as part of quality control to demonstrate statutory conformity (Schedule 1 Part 1).

4. Verify dimensions do not exceed maxima. Measure diameter/other dimension and thickness to ensure they do not exceed the "Maximum" dimensions in mm provided. Because the instrument specifies maxima but not minima, adopt internal minimum thresholds and tolerances consistent with design and function for quality assurance.

5. Implement design control to match obverse and reverse codes. Translate the obverse O-code and reverse R-code from Part 2 into production templates. Confirm that required inscriptions appear exactly as stated, including year numerals, denomination strings, weight and fineness inscriptions (for example "1KG 9999 GOLD"), and required initials such as "IRB", "JM", "AH", "NH" and "P" (Schedule 1 Part 2).

6. Control finish, colouring and ornamentation. Where Part 2 requires a proof finish, frosted finish, coloured representations, gilding, or gem insets, ensure production processes and suppliers are capable of satisfying these requirements and that inspection verifies compliance. For gem insets ensure gem sourcing and setting records are kept and that the gem is the feature called for by R10.

7. Component-level control for bi-metallic coins. For bi-metallic coins, document separate weighing, composition and assembly records for centre and surround components. The instrument specifies component weights and tolerances (item 50), so compliance must be demonstrated at the component and assembled coin stages.

8. Implement quality assurance and record retention. Retain production records, assay certificates, measurement logs, master dies and templates, and photographs showing obverse/reverse inscriptions and finishes. These records constitute the practical evidence that coins were produced in conformity with statutory specifications and will be necessary in any regulatory, civil or criminal inquiry that uses the Schedule as a benchmark.

9. Describe coins in contracts and marketing by reference to Schedule item. In sales contracts, invoices, certificates of authenticity and marketing materials, reference the specific Schedule item number and the relevant obverse and reverse codes to avoid ambiguity. Because the Schedule lists similar denominations multiple times, precise references reduce contractual dispute risk.

10. Coordinate with custodians, transport and insurance. Given some coins are large and heavy, engage logistics and insurance providers that understand the size, mass and value characteristics derived from the Schedule (for example item 19 at 10,010.500 g and 221.00 mm diameter). Use the Schedule data to obtain accurate insurance valuations and handling protocols.

11. Seek legal advice on enforcement and representations. The instrument does not itself state enforcement processes or penalties. Where disputes or potential regulatory issues may arise, align action with the Currency Act and other applicable laws. Before making legal claims about a coin’s statutory status, confirm whether the Schedule item is the operative reference in the current consolidated Schedule to the Currency Act as published on the Federal Register.

12. Maintain version control and watch for amendments. The instrument commencement is the day after registration (s 2(1)). Practitioners should monitor the Federal Register of Legislation and other official publishing channels for any subsequent determinations, revocations or amendments affecting the Schedule entries to ensure ongoing compliance.

Following these concrete steps aligns production, marketing and transactional behaviour with the technical and descriptive standards the instrument incorporates into the Currency Act framework.
