Currency (Perth Mint) Determination (No. 2) 2018

The determination uses three legal mechanisms to operate. First, it is an exercise of delegated legislative power under paragraph 13(2)(b) and subsection 13A(1) of the Currency Act 1965 (s 3). Second, it amends the practical content of the Act by causing the Act to “have effect as if” particular entries were included in its Schedule (s 5(2)). Third, it provides precise technical specifications , composition, weight and tolerances, physical dimensions, edge and shape, and defined obverse and reverse designs , which form the statutory standard for the listed coins (s 6(2) and Schedule 1 Part 1).

Key definitional and interpretive features in the instrument:

• "Act" is defined in s 4 as the Currency Act 1965; the determination operates always by reference to that Act (s 4). The determination therefore functions within the existing statutory architecture of that Act rather than as an autonomous regulatory code.

• Commencement is by reference to registration: the whole instrument commences the day after registration (s 2(1) table). The table contains a statutory note that the table relates only to the provisions as originally made.

• Section 5 is explicit about effect: on and after commencement the Act “has effect… as if” the denominations and standard compositions listed in Part 1 of Schedule 1 were included in the Schedule to the Act (s 5(2)(a)-(b)). This is a legal fiction commonly used to insert technical specifications directly into the operation of a parent Act without formally amending the Act by primary legislation.

• Section 6 specifies that the items in Part 1 of Schedule 1 detail the “standard weight, the allowable variation from that standard weight, the design and the dimensions” of each coin (s 6(2)). Part 2 explains symbols used to describe the design elements (s 6(3)).

The Schedule is split into two parts. Part 1 is a tabular specification. It lists three items, each a coin denomination with an associated “standard composition” string, a precise standard weight and allowable variation (grams), maximum diameter or other maximum dimension (mm), maximum thickness (mm), shape symbol (S1), edge symbol (E1), obverse symbol (O1-O3), and reverse symbol (R1 or R2). Part 2 decodes symbols: S1 = Circular; E1 = Continuously milled; O1-O3 set out required obverse inscriptions and effigy of Queen Elizabeth II and the relevant inscriptions including metal and purity marks; R1 and R2 set out required reverse designs and inscriptions, notably R1 describing wedding bells, myrtle sprig and the inscriptions “H.R.H.”, “PRINCE HENRY”, “OF WALES”, “&”, “MS MEGHAN”, “MARKLE”, “19 MAY”, “2018”, and R2 describing a partial circular border, filigree and a coloured representation of Prince Henry and Ms Meghan Markle superimposed on St George’s Chapel and Windsor Castle together with the full inscription string “H.R.H. PRINCE HENRY OF WALES & MS MEGHAN MARKLE” and date items (Schedule 1 Part 2 items 3-8).

The instrument is technical and prescriptive: it does not describe processes for authorising minting runs, distribution, pricing, sale channels or legal tender status beyond embedding the specifications into the statutory Schedule by the “as if included” device (s 5(2)). The determination expressly leaves unaffected any other provision of prior determinations made under the same Act sections (ss 5(3), 6(4)). The Schedule’s literal inscriptions and graphical elements must be reproduced as specified for the design descriptions to match the statutory standard.

The immediate legal effect of the determination is to impose binding technical standards on coins referenced in the Schedule by incorporating those standards into the operation of the Currency Act 1965 (s 5(2), s 6(2)). The parties for whom that change is directly relevant include:

• The Perth Mint (or any entity authorised under the Currency Act to mint coins that conform to the Act’s Schedule). The instrument is titled “Currency (Perth Mint) Determination (No. 2) 2018”, and the Schedule specifies compositions and designs that are customary for Perth Mint commemorative issues, but the instrument itself operates by creating statutory specifications rather than by naming operational actors beyond the Assistant Minister who makes it (title and ss 3, 5). The Mint, if it mints coins under the authority of the Currency Act, is the practical actor required to produce coins that conform to the statutory specifications.

• Coin manufacturers and quality control personnel who prepare dies, striking equipment and finishing processes. They must ensure each coin meets the precise metal purity language (“At least 99.99% gold” and “At least 99.99% silver” in items 1 and 2), the stated standard weight and allowable variation (for example 7.807 g ±0.030 g for the $25 gold coin), maximum diameter and thickness values, the specified shape and edge treatment (S1 and E1 respectively), and the obverse and reverse design inscriptions and graphical elements as decoded in Part 2.

• Distributors, retailers and secondary market operators dealing with these coins. The Schedule creates two distinct $1 denominated coins (one silver, one aluminium-and-bronze) with different dimensions and intrinsic metal compositions (Schedule 1 Part 1 items 2 and 3). Those who accept, sell or advise on these coins will need to manage the operational reality that the same face value appears on different-sized objects with materially different metal content and potential intrinsic value, and must be aware of the statutory specifications when assessing authenticity and conformity.

• Collectors and purchasers of commemorative coins. The designs specified in Part 2 (R1 and R2) clearly reference a particular event and specific individuals and include a coloured representation on R2. Buyers will receive coins that bear the inscriptions and design elements mandated by the instrument. The instrument does not prescribe sales terms or pricing, but it does create a statutory standard for the physical items those buyers receive.

• Regulators and enforcement agencies administering the Currency Act. Although the instrument does not itself create or change penalty provisions, it creates the standards against which coins will be measured when the Currency Act or other applicable provisions are applied. The instrument also expressly notes it does not affect other provisions of determinations made under the same sections (ss 5(3) and 6(4)).

Indirectly affected parties include financial institutions, businesses accepting cash payments and consumers at large if any of these coins enter circulation. The determination does not itself state whether the coins are intended for circulation or collector sale; however, the high precious-metal purity and the commemorative designs are features that typically characterise collector or bullion issues. The instrument does not set out retail or exchange procedures, nor does it delineate whether these issues will be marketed for investment, collection or general circulation.

The determination is primarily prescriptive about physical coin attributes; it imposes duties in the form of technical standards rather than express obligations framed as offences in this instrument. Key operative duties and statutory effects are:

• Adherence to the Schedule’s standard composition strings: For the $25 denomination the standard composition is specified as “At least 99.99% gold”; for the $1 silver coin the string is “At least 99.99% silver”; and for the $1 aluminium-and-bronze coin it is “Aluminium and Bronze” (Schedule 1 Part 1, Items 1-3). Those manufacturing or issuing coins under the Act must ensure the coins meet these definitions insofar as the Act is made to have effect “as if” those entries were included in its Schedule (s 5(2)).

• Conformity with standard weight and allowed variation: Each item gives a precise standard weight and an allowable variation in grams. Example: the $25 gold coin is 7.807 g ±0.030 g; the $1 silver coin is 31.607 g ±0.500 g; the aluminium-and-bronze $1 coin is 13.500 g ±1.00 g (Schedule 1 Part 1). Those responsible for production must ensure weight control processes deliver coins within these tolerances.

• Physical dimension limits: The table lists a “Maximum diameter or other dimension (mm)” and “Maximum thickness (mm)” for each item. Complying coins must not exceed those maxima and must conform to the declared shape symbol S1 = Circular (Schedule 1 Part 1; Part 2 item 1).

• Edge and shape features: Each listed coin must be circular and have a continuously milled edge (S1 and E1 as decoded in Part 2). Metalworking and finishing processes must implement these tactile and visual features.

• Reproduction of obverse and reverse design elements exactly as specified: Part 2 sets out precise inscriptions and design constituents. For example, Obverse O1 requires “an effigy of Queen Elizabeth II” and the inscriptions “ELIZABETH II”, “AUSTRALIA”, “25 DOLLARS”, “2018”, “1/4oz 9999 GOLD”, and “IRB” (Schedule 1 Part 2 item 3). Reverse R2 requires a coloured representation of Prince Henry of Wales and Ms Meghan Markle superimposed on St George’s Chapel and Windsor Castle together with the text string “H.R.H. PRINCE HENRY OF WALES & MS MEGHAN MARKLE” and the date items (Schedule 1 Part 2 item 8). Manufacturing must reproduce these elements in the prescribed combination.

• The instrument’s legal effect inserts these standards into the Act’s operation (s 5(2)). Any rights or duties derived from the Currency Act that attach to coins specified in the Act’s Schedule will, from commencement, attach to coins that conform to these new entries.

What the instrument does not do in terms of duties and rights (also important to record):

• It does not itself specify offences, penalties or enforcement mechanisms (no penalty clauses appear in the text). Enforcement and penal consequences, if any, depend on the Currency Act and other applicable laws, and the instrument explicitly refrains from affecting any other provision of a determination made for the same Act sections (ss 5(3), 6(4)).

• It does not grant or withhold authorisation to mint; it provides technical specifications that apply if coins are minted under the Currency Act framework. The instrument does not set sales, distribution or legal tender deployment rules for these coins.

• It does not define or explain some abbreviations used in the design decodings such as “IRB”, “NM” or “P”. The Schedule prescribes these letter strings as part of the design, but does not elaborate their meanings or legal consequences.

In practice, the primary operational duty for an issuer or manufacturer is to ensure that every minted specimen conforms to the listed composition, weight tolerances, dimensions, shape, edge and the exact obverse/reverse design text and imagery as decoded in Part 2. Records and quality assurance protocols that demonstrate conformance will be material if the statutory standard is queried.

The determination itself contains no express penalty or enforcement provisions. Sections 5(3) and 6(4) explicitly state that this instrument “does not affect any other provision of a determination made for paragraph 13(2)(b) of the Act” and “does not affect any other provision of a determination made for subsection 13A(1) of the Act” respectively. In substantive terms this leaves the instrument as a standards-setting device within the statutory architecture of the Currency Act, with enforcement mechanisms to be found in the Act and any other relevant statutes or determinations.

What is actionable from the determination is the creation of a statutory benchmark: coins that are claimed to conform to the Currency Act Schedule will be measured against the exact standards set out in this instrument (s 5(2), s 6(2) and Schedule 1). If a coin presented as complying with the Act does not meet the listed composition, weight/variation, dimensions, shape, edge or design inscriptions and imagery, then relevant provisions of the Currency Act or other applicable laws may be engaged. The instrument itself, however, does not list particular sanctions, regulatory steps or inspection regimes.

Practical enforcement implications to note (all based on the instrument’s structure rather than any new disciplinary rules within it):

• Evidence standard: The determination’s prescriptive values (exact strings of lettering, purity statements “At least 99.99% gold”, precise weights and tolerances) create objective criteria for measuring conformity. If a dispute arises about a coin’s compliance, objective measurement (assays, weights, caliper measurements) and visual comparison to the design descriptions in Part 2 will be the principal evidentiary bases.

• Delegated administrative action: Because the instrument is made under statutory delegation (ss 3, 5, 6), administrative bodies enforcing compliance will act under the enforcement powers and offences contained in the Currency Act and any complementary legislation. The determination expressly leaves other determination provisions intact (ss 5(3), 6(4)), which suggests that enforcement mechanisms remain as previously established under the Act.

• Reliance on design inscriptions: The Schedule includes inscriptions that refer to purity and weight (for example, the $25 coin must carry the legend “1/4oz 9999 GOLD” on the obverse). Those inscriptions form part of the statutory design standard and may be a factor in enforcement or consumer-protection considerations where inscriptions misrepresent composition or mass.

Because this instrument contains no new penalty clauses, practitioners must consult the Currency Act 1965 and any other statutory instruments or regulations that define offences, penalties, investigative powers, and administrative remedies to determine the precise enforcement consequences that apply if an issued coin does not meet the standards now included in the statutory Schedule by effect of this determination.

This determination is explicitly tied to the Currency Act 1965. Section 3 states it is made under paragraph 13(2)(b) and subsection 13A(1) of that Act; sections 5 and 6 operate to cause the Act to have effect as if the Schedule entries were included and to specify standard weights, allowable variations, design and dimensions (ss 5(2), 6(2)). The instrument therefore functions as an instrument of the Currency Act rather than as a freestanding statute. The key interaction is that the determination becomes the source of the technical specifications that will be applied under the Currency Act.

Specific points of interaction and limitations:

• Incorporation into the Act’s Schedule: The instrument’s mechanism is to make the Act “have effect… as if” the listed denominations and compositions were included in the Schedule to the Act (s 5(2)). That is the primary legal interaction: the Act’s legal consequences for coins listed in its Schedule will attach to coins meeting these specifications.

• Preservation of other determinations and provisions: Sections 5(3) and 6(4) both state the instrument does not affect any other provision of a determination made for the same sections of the Currency Act. This preserves the existing web of determinations and the Act’s other operative provisions. It signals that the instrument supplements rather than replaces prior determinations.

• No creation of separate offences or regulatory powers: The instrument does not amend or create offence provisions within itself; any criminal or civil enforcement must look to the Currency Act and other applicable laws. Practitioners should therefore read this determination alongside the parent Act to understand the full legal regime governing the coins and any enforcement mechanisms.

• Design inscriptions and potential intellectual property or personality-rights interaction: The determination requires the depiction of named and identifiable living individuals (for example, “PRINCE HENRY OF WALES & MS MEGHAN MARKLE”) and a coloured representation of them on reverse R2 (Schedule 1 Part 2 item 8). The instrument itself authorises those design elements for the statutory coin standard. The instrument does not address defamation, privacy, publicity rights or third-party intellectual property; whether other laws intersect will depend on those other laws rather than anything in this determination. The determination does not create or extinguish rights beyond the design standard; it simply requires that the statutory coin include the prescribed representations.

• Purity and metal-labelling interaction with trade and consumer laws: The Schedule prescribes literal purity statements such as “1/4oz 9999 GOLD” and “1oz 9999 Ag” on respective obverses (Part 2 items 3-4). These inscriptions are part of the statutory design; any claim under consumer protection or trade descriptions legislation regarding mislabelling would be tested against whether the deployed coin conforms to the statutory design and composition. The instrument does not replace or modify consumer protection or fair-trading obligations.

• Interaction with currency and legal tender rules: The determination inserts specifications into the Currency Act framework; any question about legal tender status, circulation rules, or exchangeability that depends on an Act-listed denomination would need to be resolved under the Currency Act and any associated instruments. This instrument provides the physical standards but does not itself create separate legal tender status beyond being incorporated into the Act’s regulatory framework.

In sum, the instrument is a technical insert into an existing statutory regime; it must be read and applied in conjunction with the Currency Act 1965 and any other subordinate instruments or statutes that establish offences, legal tender rules, distribution procedures and related obligations. The determination preserves prior determinations and does not on its face alter other legislative rights or obligations except by making the specified coin standards effective for the purposes of the Act (ss 5(3), 6(4)).

The instrument contains its own commencement table and a note emphasising that the table “relates only to the provisions of this instrument as originally made” (s 2 and the related table note). The table records that the whole instrument commences “The day after this instrument is registered” (s 2(1) table). The instrument bears a date in the signature block, 26 April 2018, which indicates when the Assistant Minister signed the determination; the legal commencement, however, is triggered by registration and the text does not state the precise registration date in the copied material (s 2).

There are no amendment provisions, amending schedules or later-date modifications recorded in the text provided. The Schedule itself contains a note at the head “Note: See sections 5 and 6” which cross-references the operative sections. Beyond that, there is no material in this instrument that records prior or subsequent amendments. The instrument explicitly cautions that the commencement table “relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.” That is a standard notice in instruments of this form and indicates that any future amendments would be recorded in a new instrument or an amending instrument rather than by altering the original commencement table text.

Practical observations relevant to amendment history:

• The instrument is self-contained and final in the text provided. Any subsequent changes to the coins’ specifications, additional denominations, or corrections to inscriptions would require a further determination or amendment instrument made under the same statutory powers in the Currency Act.

• Because the instrument preserves the effect of “any other provision of a determination made for paragraph 13(2)(b) of the Act” and “any other provision of a determination made for subsection 13A(1) of the Act” (ss 5(3), 6(4)), future amendments could either add to the Schedule or adjust particular items, but those would be effected by subsequent instruments rather than retrospective modification of the current text.

• The instrument itself does not contain historical notes of prior determinations or compare the current specifications to earlier issues. The tabular format lists three items only, and no chronology or prior-version cross-reference is present.

For a practitioner needing the authoritative amendment trail, the instrument as provided gives the original specification state dated April 2018; further research in the legislative instruments register or the Currency Act consolidated material would be required to identify any subsequent amending determinations, revocations or reissues.

The instrument includes no litigation history. It contains no references to cases, judicial interpretations or past adjudications. The text records only the ministerial signature, the date of signature, the operative provisions and the Schedule containing the coin specifications.

Because the instrument is a delegated statutory determination providing technical specifications, any litigation relevant to its application would arise under the Currency Act 1965 or other laws where a dispute turns on whether a given coin conformed to the statutory standard. The instrument itself does not record such disputes, nor does it summarise any judicial treatment. Accordingly:

• There is no litigation history recited in this instrument.

• If a dispute were to arise about a coin’s conformity to these specifications, the relevant enquiries would be fact-based (chemical assay, weight measurement, dimension measurement, visual comparison to the specified inscriptions and imagery) and would involve application of the Currency Act and any enforcement provisions that apply to coins within the Act’s Schedule.

• The instrument’s absence of litigation history does not preclude subsequent proceedings; it simply records that none are embedded within the instrument’s text.

Practitioners seeking caselaw or judicial treatment of issues arising from this determination must consult the Currency Act 1965 case history and any administrative decisions or prosecutions that post-date this instrument. The instrument as provided contains no judicial commentary.

This instrument is tightly prescriptive and several features are potential operational or legal pitfalls for manufacturers, collectors, distributors and advisers. The following are specific items to note, each grounded in the text of the determination and its Schedule.

• Multiple coins with identical face value: The Schedule lists two distinct $1 denominations, one made of “At least 99.99% silver” (Item 2) and one “Aluminium and Bronze” (Item 3) (Schedule 1 Part 1). They have different weights (31.607 g ±0.500 g versus 13.500 g ±1.00 g) and different diameters (40.60 mm versus 30.60 mm). This creates a legal and practical reality where coins bearing the same face value will be materially different in size and metal content. That multiplicity can cause confusion in circulation and for point-of-sale acceptance if retail or cash-handling systems do not recognise both standards; the instrument does not address distribution plans or circulation policy.

• Very tight weight tolerances for one item: The $25 gold coin’s allowable weight variation is ±0.030 g on a standard weight of 7.807 g (Schedule 1 Part 1 Item 1). That is a narrow manufacturing tolerance; minting operations must be able to control output with precision to meet the statutory maximum deviation. By contrast, the $1 aluminium-and-bronze coin tolerates ±1.00 g; practitioners should not assume uniform tolerances across coin types.

• Literal inscription and punctuation requirements: Part 2 decodes obverse and reverse designs into exact inscription strings and characters. For example, Obverse O3 requires “· ELIZABETH II” and “· AUSTRALIA 2018 ·” with interpunct characters. Those punctuation marks and spacing appear in the statutory description and must be replicated insofar as the design specification requires those literal elements. Likewise, obverses O1 and O2 include metal-purity legends (“1/4oz 9999 GOLD” and “1oz 9999 Ag”). Manufacturing die work must reflect these specific strings; deviations in spelling, punctuation or letter-case could cause a coin to depart from the statutory design.

• Use of initials and short codes left undefined: The reverse and obverse specifications require the inclusion of “IRB” on obverses and “NM” and “P” on reverses (Schedule 1 Part 2 items 3-8). The instrument prescribes the presence of these letter groups but does not define them. A strict compliance reading requires the letters to appear exactly as stated, but the instrument does not identify whether they are mint marks, artist initials or other signifiers. Practitioners must reproduce them exactly and may need internal confirmation of intended placement and appearance.

• Coloured imagery specified on R2: Reverse R2 requires “a coloured representation of Prince Henry of Wales and Ms Meghan Markle superimposed on a representation of St George’s Chapel and Windsor Castle” (Schedule 1 Part 2 item 8). Coloured elements on struck coins introduce manufacturing complexity (pad printing, enamel, or inlay processes) and may raise different durability, quality assurance and authenticity-verification considerations compared to monochrome struck surfaces. The instrument permits the coloured representation but does not specify colour tolerances or processes.

• Metal purity statements versus practical assays: The obverse inscriptions for precious-metal coins include explicit purity and mass statements (“1/4oz 9999 GOLD” and “1oz 9999 Ag” in O1 and O2). The Schedule’s separate column sets a precise standard weight and allowable variation (for example 31.607 g ±0.500 g for the silver coin). Practitioners must ensure that the literal inscription on the coin accurately reflects the metal content and that actual assay and weight conform to the statutory standard; otherwise there is a risk that the coin’s inscriptions will be misleading relative to the physical fact, with any attendant legal consequences lying outside this instrument.

• “Maximum diameter or other dimension” and “Maximum thickness” as constraints: The table fields specify maxima rather than nominal dimensions (Schedule 1 Part 1). Manufacturers should therefore ensure that produced coins do not exceed the specified maxima. The wording “or other dimension” suggests the table accommodates non-circular shapes, but in all three items S1 = Circular is required, so diameter is the operative measure for these items.

• No direct statement on legal tender or circulation intent: The instrument incorporates the specifications into the Currency Act’s Schedule but does not itself state whether the coins are legal tender or intended for circulation. Users may assume commemorative precious-metal issues are collector items rather than circulating coinage; the instrument does not make that distinction and a practitioner should verify legal tender status and distribution intent under the Currency Act or accompanying administrative documents.

• “As if included” legal fiction: Section 5(2) makes the Act have effect as if the Schedule items were included. That means the technical standards have statutory force through an interpretive device rather than through direct textual amendment of the Act. This can have drafting consequences if later legal readers search for the entries in the Currency Act text and do not find them; practitioners should reference this determination when identifying the statutory standard.

• Absence of enforcement detail within the instrument: There are no penalty clauses here. Any enforcement action will depend upon the Currency Act and other laws, so compliance obligations must be considered in that broader legal context rather than assuming the determination itself contains enforcement rules.

Compliance with this determination requires translating the Schedule’s textual specifications into practical minting, quality assurance and record-keeping processes. The following steps flow directly from the instrument’s requirements and the operative sections that make the Schedule legally effective (ss 5 and 6).

1. Read and map the statutory specifications into production checklists:

   • For each listed coin, create a checklist that includes the standard composition string, the standard weight and allowable variation (in grams), maximum diameter and thickness (in mm), shape (S1 = Circular), edge (E1 = Continuously milled), and the obverse and reverse design text and imagery as decoded in Part 2 (Schedule 1 Part 1 and Part 2). This is the baseline compliance document because s 5(2) causes the Act to have effect “as if” these items were in its Schedule.

2. Material and purity control:

   • For the precious-metal items, institute assay procedures capable of verifying compliance with “At least 99.99% gold” and “At least 99.99% silver”. The statutory language is a floor (“At least”) and must be demonstrably met for each production batch. Document assays and retain certificates for audit or dispute resolution.
   • For the aluminium-and-bronze item, establish an internal alloy specification consistent with the descriptor “Aluminium and Bronze”. Since the instrument does not specify exact alloy percentages, internal documentation must define the alloy composition used and why it is consistent with the Schedule wording, together with test records.

3. Weight and dimensional control:

   • Establish weight-control procedures and calibration schedules. For example, the gold $25 coin’s tolerance is ±0.030 g on 7.807 g , manufacturing controls and inspection sampling must be able to demonstrate this tight tolerance is met. Use precise scales with traceable calibration certificates.
   • Ensure diameter and thickness do not exceed the maxima specified (20.60 mm and 2.00 mm for the $25 coin; 40.60 mm and 3.21 mm for the $1 silver coin; 30.60 mm and 3.00 mm for the $1 aluminium-and-bronze coin). Calipers and micrometres should be used with documented measurement processes.

4. Die and design implementation:

   • Create obverse and reverse dies that reproduce exactly the literal inscriptions and elements specified in Part 2. For obverses O1-O3 this includes the effigy of Queen Elizabeth II and precise letter strings (for example “ELIZABETH II”, “AUSTRALIA”, denomination, year, and purity legends). For reverses R1 and R2 replicate the textual elements and graphical elements including the required coloured representation for R2 where specified.
   • Ensure punctuation, interpuncts, spacing and letter-case match the statutory descriptions (e.g. O3’s dots “· ELIZABETH II” and “· AUSTRALIA 2018 ·”). Reproductions that omit required punctuation or alter the textual strings risk non-conformity with the statutory design.

5. Edge and shape compliance:

   • All three items are S1 Circular with E1 Continuously milled edges. The milling process must be applied uniformly and inspected to confirm it meets the “continuously milled” requirement without breaks or irregularities beyond manufacturing tolerances.

6. Colour application and durability (for R2):

   • For the coloured reverse R2, select a production method (pad printing, enamel fill, ceramic inlay or similar) capable of producing durable coloured imagery that conforms to the design specifications. Establish adhesion, wear and colour consistency tests and keep records.

7. Quality assurance and sampling plan:

   • Implement a QA sampling regime that reflects the specified tolerances. For items with tighter tolerances (notably the $25 gold coin), increase sampling frequency and tighten process capability indices. Record batch numbers, assay results, weight and dimension checks and die proofs.

8. Proofs and documentation retention:

   • Keep master die proofs, pre-production strike proofs, assay certificates, weight and dimensional test results, and production logs. Because the instrument provides objective statutory standards, these records will be the primary evidence of statutory compliance in any regulatory scrutiny or commercial dispute.

9. Labelling and sales materials:

   • Ensure any marketing or sales materials align with the statutory inscriptions. For example, if the coin obverse must carry the legend “1/4oz 9999 GOLD”, avoid external packaging or marketing claims that contradict the physical inscriptions or statutory composition.

10. Regulatory and legal alignment:

    • Because this determination does not set out enforcement mechanisms, check the Currency Act 1965 and any related subordinate instruments for obligations concerning issuance, legal tender status and any notification or registration processes. The determination leaves such matters to the parent Act (ss 5(3), 6(4)). If in doubt, seek confirmation from the relevant Commonwealth authority about whether additional administrative steps are required before commercial release.

11. Risk management:

    • Anticipate potential issues stemming from coexisting $1 coins with different compositions and sizes when distributing to cash-handling environments. Produce guidance for banks, retailers and cash-handling services about the two $1 types so acceptance and validation systems are not disrupted.

12. Expert sign-off:

    • Before release, have legal compliance, assay and production leads sign off on batch conformity to the statutory schedule. Maintain a compliance certificate template that references the determination and identifies the specific Schedule item and batch numbers covered.

Following these steps will map the statutory requirements in the determination to operational procedures that demonstrate and document conformity. The instrument itself creates the standards; it does not set out administrative approval steps or sales regimes, so compliance also requires alignment with any procedural requirements in the Currency Act 1965 and any other relevant instruments or departmental guidelines.
