Currency (Perth Mint) Determination (No. 2) 2017

The instrument establishes four interlocking technical legal concepts that change how the Currency Act is to be read in relation to Perth Mint coins.

Section 5(2) directs that the Act is to have effect as if the denominations listed in Part 1 of Schedule 1 and their "standard composition" entries were included in the Schedule to the Act. Section 6(2) makes the table in Part 1 of Schedule 1 the statutory source for standard weight, allowable weight variation, design and dimensions of each listed coin. The table pairs each denomination/composition with measurable limits: a standard weight expressed in grams and an allowable variation in grams, a maximum diameter or other dimension in millimetres, and a maximum thickness in millimetres. Those numerical parameters are binding as the instrument takes effect for subsection 13A(1) of the Act (s 6(1)-(2)).

3. Symbolic shorthand mapped to detailed design text. Part 1 uses coded symbols for shape, edge, obverse and reverse (columns Sx, Ex, Ox, Rx). Part 2 provides the textual expansion of those symbols (for example, S1 = Circular; E1 = Continuously milled; O1 describes a specified effigy and inscriptions including "· ELIZABETH II", "AUSTRALIA ·", Arabic numerals for the denomination and the letters "IRB"; R1 describes two bounding kangaroos with the wording "AUSTRALIAN KANGAROO" and specific fineness, year and mint letters). The instrument therefore couples concise table entries with formal textual obligations about inscriptions and imagery.

4. Variants across the same face value. The instrument contemplates multiple distinct statutory specifications for the same monetary denomination. The Part 1 table contains numerous items with the same face value but different metals, weights and designs (for example, multiple $100 entries, multiple $1 and 50 cent entries). That mechanism creates a set of legally recognised coin types sharing denomination but differing in composition and design.

Ancillary concepts apparent in the text that practitioners should note: explicit use of minimum purities (e.g. "At least 99.99% gold", "At least 99.95% platinum", "At least 91.70% gold" for certain items), the inclusion of non-precious metal composition ("Aluminium and Bronze" for certain $1 items), and specified edge inscriptions or sequential edge numbering (E3, E4, E5 in Part 2). The obverse and reverse descriptions frequently specify particular years (for example, multiple obverse or reverse descriptions include the year "2018" or "2017") and include mint identifiers and designer initials such as "IRB" and mint symbols "P", "NM", "NH", "JM", "TV", "IJ", "LB", "WR", "AH", "JR", "NH" etc, all explained in Part 2.

Mechanically, the instrument converts design, physical and inscription specifications into statutory text that must be used when identifying or verifying the coins to which the Currency Act’s Schedule will now refer. The specification is granular: many items specify ounces notation to appear on the coin inscriptions in the form "Xoz 9999 Ag" or similar, with "X" treated as the nominal weight in ounces expressed as an Arabic numeral or common fraction (see multiple obverse and reverse entries in Part 2).

The determination primarily affects those who mint, market, trade in, handle, verify or otherwise interact with Perth Mint coins and the statutory framework that recognises certain coins under the Currency Act 1965.

• The Perth Mint and coin producers: The instrument prescribes exact physical, compositional and design specifications for the coins described in Schedule 1 (see s 5(2) and s 6(2) and Schedule 1, Part 1). Entities responsible for producing coins to be recognised under the Act must ensure the minted coins conform to the statutory standard weight (and allowable variation), dimensions, metal composition and the obverse and reverse inscriptions and imagery described in Part 2.

• Dealers, refiners and assayers: Market participants who buy, sell, certify or assay Perth Mint coins will need to test coins against the numeric tolerances (weights and dimensions) and design elements in Schedule 1, Part 1, and reconcile the obverse/reverse inscriptions and mint marks against the Part 2 descriptions. For example, an $8 silver coin specified at 156.533 g ±1.000 g with obverse O1 and reverse R2 must be identifiable by weight, purity and the specified design elements (see Schedule 1, items such as 8 & 25 and Part 2 R2/O1 definitions).

• Collectors and secondary-market participants: Collectors rely on statutory specifications for authentication, grading and valuation. The instrument’s numerous variants for the same face denominations mean that a single denomination (for example, $100, $1 or 50c) may exist in multiple statutory forms with differing weights, compositions and designs, so provenance and matching to the correct Schedule item will be relevant to valuation and authenticity.

• Financial institutions and custodians: Where institutions accept such coins as part of holdings or offer custodial services in bullion/numismatic products, they must incorporate the instrument’s specifications into acceptance, storage and insurance protocols because the instrument defines the statutory standard compositions and physical parameters (see s 5 and s 6).

• Regulators and legal advisers: Lawyers and compliance professionals advising on legal tender questions, sale contracts, consumer protection issues, customs classification, tax treatment (where relevant) or anti-counterfeiting policy will need to refer to the instrument when addressing which Perth Mint coins are recognised as meeting the statutory descriptions in the Currency Act (s 5(2)).

• End users and purchasers: Private purchasers of Perth Mint coins (including investors buying bullion coins) face the practical effect that coins conforming to the instrument’s Part 1 and Part 2 specifications are the forms treated, for the Currency Act’s purposes, as the listed denominations with the listed standard composition and design elements. Purchasers and recipients who rely on the Act’s Schedule for legal or contractual reasons will need to ensure the coins they obtain match an applicable Schedule item.

The instrument does not itself create obligations for persons other than to the extent they produce or handle coins that the Act will recognise. It provides no separate consumer-rights provisions; it is a technical specification instrument. Who "decides" is explicit: the determination is made by the Minister under the specified Currency Act powers (s 3). The instrument does not, on its face, allocate costs or specify compensation for compliance; the costs of meeting the physical and design specs will fall to producers and ultimately to purchasers in ordinary market terms.

The determination is primarily prescriptive rather than permissive: it creates statutory standards that must be met for a coin to be the denomination and composition to which the Currency Act’s Schedule will be treated as referring. The instrument itself does not phrase obligations in active "duties" language such as "must" owed by a named private party, but by operation of s 5 and s 6 it imposes legal effect on the Schedule elements. From a practical compliance perspective the following points set out the operative duties and the rights the instrument embodies.

Duties implied for producers and issuers

• Comply with the listed standard composition and minimum fineness. Each item in Part 1 indicates a "Standard composition" such as "At least 99.99% gold" or "At least 99.95% platinum" or "Aluminium and Bronze" (see Schedule 1, Part 1, Standard composition column). Coins intended to match a Schedule entry will need to be manufactured using metals meeting the specified minimum purity.
• Produce coins within the stated standard weight tolerance. For each item the table gives a standard weight and an allowable variation, for example item 1 ($100 gold) 31.157 ± 0.050 g (Schedule 1, Part 1). Production processes must be controlled to keep individual pieces within these tolerances.
• Match the physical dimensions and shape. The table lists maximum diameter (or other dimension) and maximum thickness, and a shape code (S1-S4). For instance, a 50c silver item is specified with a maximum diameter 32.60 mm and maximum thickness 2.60 mm, shape S1 (circular) (see items such as 13 and Part 2 S1). Producers therefore must meet the dimensional limits and shape requirements.
• Apply the specified edge treatment and inscriptions. Part 2 explains each edge code: E1 is "Continuously milled", E2 "Plain", E3/E4 include specific edge inscriptions such as "PRIDE • RESPECT • GRATITUDE •" and E5 requires sequential edge numbering (see Part 2 Edge entries). Production must implement these edge specifications where the Part 1 table requires them.

Rights and statutory recognition

• Statutory recognition of specified coins. Section 5(2) declares that the Act is to have effect as if the referenced denominations and standard compositions were included in the Schedule to the Act. That creates a statutory reference point against which a coin's denomination/composition is to be measured. In practice, a producer or holder of coins matching a Schedule item can point to the instrument as the statutory specification for that coin type.
• Protected design features as part of the statutory standard. The detailed obverse and reverse inscriptions and imagery described in Part 2 (for example, the effigy and the requirement to include "IRB" on the obverse for many items, and the presence of mint letters like "P" or initials like "NM", "NH", "JM") are included in the statutory descriptions. This means the visual features are part of the statutory identification of the coin type.

What the instrument does not do in this text

• The instrument does not, on its face, prescribe civil remedies, criminal penalties or enforcement mechanisms for non-conforming coins; those matters (if provided) remain within the Currency Act framework or other statutes (the instrument is explicitly made under powers in the Currency Act; see s 3). The determination also does not create affirmative rights to mint , it sets specifications for coins the Act is to be read as containing.
• The instrument does not directly regulate commercial pricing, taxation, import/export licensing or customs classification. Those interactions may exist in other laws but are not created by this determination.

Practically, the duty to meet the listed specifications falls to the issuer/producer (the Perth Mint or any authorised minter acting under relevant arrangements), and the right to rely on the instrument for legal recognition of the coin’s denomination and composition is available to holders and market participants, subject to any other legal provisions in the Currency Act or elsewhere.

The determination itself contains no provisions that create or specify penalties or enforcement procedures. Its role is to supply technical specifications to be read into the Schedule to the Currency Act 1965 (see s 5 and s 6). The instrument was expressly made under paragraph 13(2)(b) and subsection 13A(1) of the Currency Act 1965 (s 3), but the instrument does not reproduce or restate any enforcement provisions that may be found in that Act.

Immediate implications from the instrument’s text

• Absence of penalty clauses. Nowhere in the determination text or the Schedule is there a provision stating that failure to comply with a specified weight, composition, design or inscription attracts a criminal or civil penalty in the instrument itself. The instrument sets mandatory standards only by making them part of the Act’s Schedule as explained in s 5(2) and s 6(2). If the Currency Act contains offences or enforcement mechanisms for non-conforming coins, those mechanisms will apply. The instrument itself is silent on enforcement mechanics and sanctions.
• Enforcement therefore depends on the parent statute. Because the instrument is an exercise of powers in the Currency Act, any enforcement, inspection or sanction powers relevant to coin specifications, counterfeiting, false descriptions, or other coin-related offences would need to be sought in the Currency Act 1965 or other legislation rather than in this determination. Practitioners should consult the Currency Act for the specific legal consequences of producing, offering, or circulating coins that do not conform to the statutory descriptions.

Practical enforcement considerations

• Verification and technical testing. Enforcement of these specifications in practice would hinge on measurement and assay. The Schedule provides precise numeric tolerances (standard weight with allowable variation, maximum diameters/other dimensions, maximum thickness), and textual descriptions of inscriptions and mint marks (Schedule 1, Part 1 and Part 2). Enforcement bodies would thus require scales calibrated to the gram tolerances stated and dimension-measuring tools to check conformance.
• Identification by design and mint marks. Part 2 contains precise obverse and reverse text and imagery requirements, including the presence of mint marks and designer initials. These visual elements are part of the statutory description and would be among the first points of inspection in any enforcement procedure.
• Edge inscriptions and sequential numbering. Some edge specifications require inscriptions (E3, E4) or sequential edge numbering (E5). Enforcement agencies checking compliance would need to assess edge inscriptions and, where E5 applies, the presence and correctness of sequential edge numbering as specified in the Schedule.

Recommendation for practitioners

• Refer to the Currency Act to determine applicable offences and enforcement processes. Because the determination is silent on penalties, practitioners must look to the powers and sanctions in the Currency Act 1965 referenced in s 3 for any regulatory or criminal consequences. The instrument’s specification function means enforcement will operate by measuring a coin against the Schedule entries the Act is to be treated as containing.

The determination explicitly interacts with the Currency Act 1965 by operation of the statutory powers cited. It does not purport to amend other Acts directly, nor does it set out interactions with administrative law, customs, tax, trademark or criminal statutes in its text. The instrument’s own cross-references and structure show the following legal interfaces.

Primary interaction: the Currency Act 1965

• Instrument made under the Act. Section 3 confirms the instrument is made under paragraph 13(2)(b) and subsection 13A(1) of the Currency Act 1965. Sections 5 and 6 operate to give those Act provisions effect by treating the Schedule material as part of the Act’s Schedule for the purposes specified. Therefore, the instrument’s legal effect is achieved only by reference to the Currency Act; the instrument is not freestanding law but a determination made under the Act’s delegation of power.

• Schedule incorporation. Section 5(2) says the Act "has effect, on and after the day on which this instrument commences, as if" the denominations and standard compositions in Part 1 were included in the Schedule to the Act. Section 6(2) extends that approach to standard weight, allowable variation, design and dimensions. Thus, the determination operates by modifying, in effect, the statutory Schedule via a delegated instrument under the Act’s grant of power.

Potential but unexpressed interactions

• Enforcement, offences and ancillary powers reside in the Act or other legislation. The determination does not itself create offences or enforcement regimes; it relies on the Currency Act for normative force. Any criminal offences (for example, counterfeiting, misdescription, using non-conforming coins in commerce) and enforcement powers such as seizure, inspection, or proof requirements would need to be sourced in the Currency Act or other applicable statutes. The instrument gives no text on these matters and therefore must be read alongside the parent Act to understand legal consequences.

• Intellectual property, trade marks and design protection. Part 2 prescribes specific artistic and textual elements (for example, effigy descriptions including "IRB", year inscriptions, mint initials "P", and named imagery such as "AUSTRALIAN KANGAROO", "AUSTRALIAN KOALA" and "PERTH MINT"). The instrument does not mention copyright, design rights, or trade mark protection; it merely records the statutory design specification. If IP or trade mark law applies to coin designs, those rights and remedies would be determined under the relevant intellectual property statutes, not by this instrument.

• Commercial and consumer laws. The instrument does not address warranty, sale-by-description, consumer guarantees or contractual disclaimers. Parties trading in these coins must still comply with consumer protection, fair trading and contract law regimes applicable elsewhere. The instrument provides the statutory benchmark for what the Currency Act recognises as a coin of a given denomination and composition; it does not displace other legal requirements.

• Customs, customs valuation and taxation. The instrument contains the metal composition and the weights of coins. Those facts commonly inform customs classification, valuation and tax treatment. The determination does not itself specify customs or taxation consequences; any interaction with those regimes will be governed by the relevant statutes and administrative law. Practitioners advising clients on import/export or tax consequences need to cross-reference those regimes with the technical specifications in this instrument.

Read together approach required

• Because the instrument’s effect is to alter how the Currency Act is to be read (s 5 and s 6), legal questions relating to legal tender, offences, or administrative action must be answered by reading the Currency Act with the instrument’s Schedule material treated as part of the Act’s Schedule. The instrument therefore must be considered in tandem with the parent statute to determine broader regulatory effects or sanctions.

The determination contains limited internal material about amendment history. The instrument was made and dated 9 August 2017 by the Minister for Small Business (Michael McCormack) and, in the commencement table, the whole instrument is stated to commence "The day after this instrument is registered" with a date detail recorded as 15 August 2017 (see s 2(1) and the commencement table). The instrument’s own Note to the commencement table expressly states: "This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument" (s 2 Note). That indicates the table records the original commencement and will not be edited in the instrument text to reflect later amendments.

Within the instrument text there are no later amendment entries, saved variations or transitional provisions. Sections 5(3) and 6(4) include the statement that those sections "do not affect any other provision of a determination made for paragraph 13(2)(b) of the Act" or "for subsection 13A(1) of the Act" respectively, which is a saving-style statement but not itself an amendment record. No amending instrument texts are included.

Practical consequences for research and compliance

• Rely on primary instrument text and check external registers for amendments. Because the instrument’s internal note says the commencement table will not be updated within the instrument to reflect later amendments, practitioners must consult the Federal Register of Legislation or the consolidated legislative database to determine whether subsequent determinations or amending instruments have been made that alter the Schedule or replace this determination. The instrument as provided contains only the original text.

• No within-document amendments. This determination as provided does not include schedules listing later amendments, revocations, or expiry. The Schedule itself defines the list of 92 items and the Part 2 symbol explanations as originally made. Any later changes would appear in amending determinations or instruments under the Currency Act and not in an updated copy of this original instrument’s commencement table, per the instrument’s editorial note.

In short, the instrument’s own amendment history as recorded in the text is simply the date of signing (9 August 2017) and the commencement treatment recorded in s 2 and the table, with an explicit statement that the table pertains only to the original making and will not itself be edited to reflect future amendments. • Absence of administrative determinations or disputes recorded. The instrument does not mention any administrative tribunal decisions or internal review cases about its making. Challenges to the making of the instrument, if any, are not recorded in the instrument and would need to be sourced from external repositories if they exist.

Recommended action for advisors

• If litigation risk or precedent is material to a matter (for example, dispute about whether a coin conforms to a Schedule entry, or enforcement action under the Currency Act), obtain a targeted search of case law and tribunal records referring to the Currency Act and any judicial consideration of determinations under s 13(2)(b) or s 13A(1). The instrument itself supplies only the operative specifications for coins; it contains no litigation history or interpretative guidance.

This instrument is detailed and technical; several features may create practical pitfalls for producers, dealers, custodians and lawyers if they are not noticed and matched carefully to coins in question.

Many distinct statutory variants share the same face denomination

• Multiple entries for identical denominations. The Part 1 table contains numerous separate items for the same face value but with differing compositions, weights, sizes and designs. For example, the face value "$100" appears in many items (items 1, 7, 16, 23, 40, 48, 50, 62 and others) each with different weights, thicknesses, obverse/reverse codes and sometimes different metals (gold or platinum) (see Schedule 1, Part 1). Practically, a $100 coin is not a single statutory object under this determination: the specific Schedule item must be identified and matched. Failure to match the correct item will lead to misclassification.

Year inscriptions and future-dated years within a 2017 instrument

• The design text frequently specifies "2018" (and some reverses have "2017") in the obverse and reverse descriptions (see numerous Part 2 Obverse and Reverse entries). The instrument was made on 9 August 2017 but many design descriptions anticipate a 2018 yearmark. Users must not assume the instrument’s date ties to the year inscribed on coins; the statutory specification can prescribe a year marking that differs from the instrument’s date. That matters for authentication and catalogue descriptions.

"Xoz" placeholders and numeric inscription requirements

• Several obverse/reverse descriptions require the inscription "Xoz 9999 Ag" or similar where "X" is the nominal weight in ounces expressed as a whole number or common fraction. The instrument treats this as a required textual element (Part 2 obverse/reverse entries). Producers must convert the metric standard weight into the appropriate ounce notation for the inscription, and any mismatch between inscription and actual nominal weight could be material to conformity.

Edge specifications that change production complexity

• Edge codes E3 and E4 require the inscription "PRIDE • RESPECT • GRATITUDE •" appearing evenly spaced around the edge, while E5 requires sequential edge numbering. These are non-standard production features relative to simple milled or plain edges (E1, E2) and will require specific tooling, quality-control systems, and numbering procedures. Sequential edge numbering (E5) implies traceability at the individual coin level and increases production and record-keeping complexity.

Large allowable variations for some non-precious compositions

• Aluminium and Bronze entries for certain $1 coins show a standard weight of 13.500 ± 1.000 g (items 78, 86-88). The allowable variation is comparatively large relative to some small tolerance values for precious metal coins (for example ±0.020 g for small gold coins). Practitioners should note that allowable variation is part of the statutory standard and that large tolerances can affect authentication thresholds and assay procedures.

Non-circular shapes and multi-dimension specifications

• Some items specify non-circular shapes and multiple dimensions. For example, item 90 shows dimensions "47.60 x 27.60" with shape S2 "Figure Eight"; item 91 is 40.50 x 70.00 and shape S3 "Rectangle". Those entries mean coins are not simple discs and will require different measuring protocols. Measurement checks must be adapted to multi-axis dimensions rather than a single diameter.

Mint marks and designer initials are part of the statutory description

• Many obverse entries require inclusion of "IRB" and many reverse entries require mint letters or initials like "P", "NM", "NH", "JM", "TV", "IJ", "LB", and the instrument lists microscopic "P" in some reverses. These are not incidental artistic features; they are required elements of the statutory description in Part 2. Absence of a required mint mark or initial can affect whether a coin matches the Schedule entry.

Minimum purity variations

• While most precious metal coins are specified "At least 99.99%" for gold or silver, certain items specify other minima such as "At least 99.95% platinum" (items 16, 47) or "At least 91.70% gold" (items 60 and 61). These differing minimum purities mean that assays and certificates must compare to the correct Schedule entry for a given coin.

Sequential edge numbering and traceability expectations

• E5 requires sequential edge numbering for the relevant item (item 29). Sequential edge numbering on a coin implies an expectation of numbered series. That introduces a chain-of-custody or traceability expectation that will affect issuance, inventory and secondary-market practices.

Ambiguities to watch when matching coins

• Many items have very similar weights and identical obverse codes but differ only in reverse code or diameter. For example, multiple $1 silver coins use the same weight 31.607 ± 0.500 g and similar obverse codes, but differ in reverse code (R2, R3, R4, R11 etc). Authentication therefore requires checking both obverse and reverse designs and dimensions, not only weight and obverse inscription.

In sum, the "gotchas" are practical: multiple statutory variants for the same denomination; year inscriptions that do not track instrument date; precise inscription formatting requirements including weight-in-ounces placeholders; edge inscriptions and sequential numbering; non-circular shapes and multi-axis dimensions; and a mix of minimum purities. Practitioners should use the Part 1 itemisation and the Part 2 symbol explanations together to avoid misclassification.

Compliance with the determination is operational: ensure that any Perth Mint coin intended to correspond to a Schedule item conforms to the detailed composition, weight, dimensional, shape, edge, obverse and reverse specifications in Schedule 1, Part 1 and Part 2. The instrument itself gives the technical checklist; the steps below set out a practical compliance approach drawn from the instrument’s mechanics.

Step 1 , Identify the target Schedule item precisely

• Use the Part 1 table. Locate the exact item number in Schedule 1, Part 1 that matches the intended denomination and target design. Because multiple entries exist for the same face value, do not rely on denomination alone; confirm weight, metal composition, diameter/other dimension and the code entries for shape, edge, obverse and reverse (see Schedule 1, Part 1).

Step 2 , Confirm metal composition and fineness

• The "Standard composition" column is the statutory baseline. For example, many items require "At least 99.99% gold" or "At least 99.99% silver", while some items specify "At least 99.95% platinum" or "At least 91.70% gold". Ensure raw metal purchases and refining processes yield metal meeting or exceeding the specified minimum purity. Assay certificates and quality-control records should reference the applicable Schedule item.

Step 3 , Control and verify weight within allowable variation

• The standard weight and allowable variation in grams are mandatory design tolerances (Schedule 1, Part 1). For production, establish calibrated weighing stations and statistical quality-control methods to keep the mass of individual coins within the stated tolerance (for example item 1: 31.157 ± 0.050 g). Record-keeping should capture manufacturing run data and non-conforming piece handling.

Step 4 , Verify dimensions and shape

• For circular coins measure the diameter and maximum thickness as stated in the table. For non-circular shapes measure the specified "other dimension" axes (for example 47.60 x 27.60 mm for figure-eight shapes). Maintain calibrated callipers, profile gauges and templates for shape compliance.

Step 5 , Apply correct obverse and reverse inscriptions and mint marks

• Use Part 2 to expand obverse and reverse codes. The obverse entries specify required effigies, inscriptions (for example "· ELIZABETH II", "AUSTRALIA ·"), numerals for the denomination, designer initials ("IRB"), and often a year or an "Xoz 9999 Ag" style weight inscription. Reverse entries specify imagery and inscriptions like "AUSTRALIAN KANGAROO", weight in ounces and fineness inscriptions (for example "2018 Xoz 9999 GOLD") and mint or artist initials ("P", "NH", "NM", etc). Die designs and quality-checks must reproduce precisely the required text and imagery.

Step 6 , Implement edge treatments and numbering where required

• For edges coded E1 to E5, E1 requires continuous milling, E2 plain edge, E3/E4 require specified words "PRIDE • RESPECT • GRATITUDE •" spaced around the edge, and E5 calls for sequential edge numbering. Production tooling must support the relevant edge processes. For sequential edge numbering, build secure workflows for numbering sequences and record assignment logs to each produced coin.
