What it does
This instrument, titled the Currency (Perth Mint) Determination (No. 1) 2018, is a statutory determination made under the Currency Act 1965. The instrument expressly invokes paragraph 13(2)(b) and subsection 13A(1) of the Act (see s 3). Its operative effect is to add a set of coin specifications to the Schedule of the Currency Act, by specifying denominations and the "standard composition" for each (see s 5(2)), and by specifying, for each such coin, the standard weight, allowable weight variation, design and dimensions (see s 6(2)). Part 1 of Schedule 1 in the instrument contains a table of coin specifications (denomination; standard composition; standard weight and allowable variation; maximum dimensions; shape; edge; obverse; reverse), and Part 2 explains the symbols used to describe shape, edge, obverse and reverse in Part 1.
Mechanically, the measure does two things in the language of the instrument. First, s 5(2)(a) and (b) provide that, on and after commencement, the Act "has effect as if" the references to the denominations in Part 1 were included in the Schedule to the Act and that the standard compositions specified in Part 1 are to be treated as the standard compositions opposite each denomination in the Act's Schedule. Second, s 6(2) makes each item in Part 1 "specify" the standard weight, allowable variation, design and dimensions of the coin whose denomination and composition are specified in that item. In short, the instrument amends the practical detail of the Schedule to the Currency Act by providing a set of Perth Mint coin denominations and technical specifications.
The instrument does not itself contain separate provisions creating offences, penalties or administrative processes; it is confined to specification of denominations, compositions, and physical characteristics. It also contains express saving wording: s 5(3) and s 6(4) state that the instrument "does not affect any other provision of a determination made for paragraph 13(2)(b) of the Act" and "for subsection 13A(1) of the Act" respectively. That signals the drafters intended this determination to sit alongside any other determinations under the same Act without displacing them beyond the explicit insertions. The table in Part 1 is the operative technical schedule; Part 2 provides the legend of symbol explanations used in that table.
