Currency (Perth Mint) Determination (No. 1) 2017

The instrument rests on a small set of legislative concepts and mechanisms. First, it is a delegated determination made under the Currency Act 1965 (s 3). The core legal concept is schedule substitution or supplementation: s 5(2) provides that the Act “has effect, on and after the day on which this instrument commences, as if” the Schedule to the Act included the denominational references and their “standard composition” set out in Part 1 of Schedule 1. In practical terms, the determination does not itself declare what the Currency Act does with those entries; rather it prescribes the content that the Act is to be treated as containing for the denominational entries concerned. The instrument therefore functions as a technical addendum to the statutory Schedule under the parent Act.

Second, the instrument differentiates composition, weight, dimension and design. Section 5 focuses on “denominations of money” and their “standard composition” (metal and minimum fineness). Section 6 addresses “standard weight, the allowable variation from that standard weight, the design and the dimensions” (s 6(2)). The Schedule separates composition and denomination from physical and visual specifications: Part 1 lists composition and weights/dimensions, Part 2 decodes the shorthand used to describe shape, edges and obverse/reverse designs.

Third, the instrument adopts a symbolic cross-referencing structure. Part 1 uses compact codes S1-S3 for shape, E1-E2 for edge, O1-O15 (and beyond) for obverse layouts and R1-R41 (and beyond) for reverse designs. Part 2 then supplies the full text descriptions for each symbol. Those descriptions specify not only imagery (for example, “representation of a bounding kangaroo”) but also inscriptions and mint/device marks (for example, the letter “P”, “IRB”, year numerals, and formulaic stampings such as “Xoz 9999 GOLD” where X is the nominal weight). The use of placeholders (eg “X” for nominal weight) shows the instrument sets templates for inscriptions rather than fixing every letter-string for every possible variant.

Fourth, tolerances are central. The Schedule gives precise standard weights and explicit allowable variations in grams. Some items impose very tight tolerances (for example, item 8, $100 gold: 31.165 ± 0.053 g), others permit larger absolute tolerances (eg item 1, 1002.100 ± 2.000 g). Dimensions are given as “maximum diameter or other dimension (mm)” and “maximum thickness (mm)”. Edge treatment is prescribed (eg E1 “Continuously milled”, E2 “Plain”).

Fifth, the determination repeatedly uses the phrasing “At least” and “Not less than” before purity figures (eg “At least 99.99% silver”, “Not less than 99.95% platinum”, “Not less than 91.67% rose gold”). That phrasing sets minimum metal-content standards rather than absolute exact purities. The Schedule therefore affords some metallurgical latitude above the minimum standard but requires minimum fineness.

Finally, the instrument is explicit about its own limits. Sections 5(3) and 6(4) state that the instrument “does not affect any other provision of a determination made” for the same Act provisions. The commencement table (s 2) notes the instrument commenced the day after registration and that the table relates only to provisions as originally made. The determination is therefore formal and narrowly scoped: it supplies technical entries that the Currency Act will be taken to include in its Schedule and explains the symbols used in those entries.

The instrument’s immediate legal and practical addressees are entities that mint, issue, handle, assay, buy, sell or otherwise use the coins whose specifications it records. The title and internal conventions make clear it is concerned with Perth Mint coins: the instrument is titled “Currency (Perth Mint) Determination (No. 1) 2017”, and many reverse designs expressly include the mint mark “P” (see multiple R-coded entries in Part 2, for example R1-R4, etc.). The instrument is therefore directed at the mint as the issuer or producer, and at market participants who manufacture, validate or trade those specific coins.

Who pays: production costs are borne by the issuing authority (the Perth Mint) and ultimately by buyers (collectors, investors and distributors) who pay minting and distribution margins above bullion content. The determination raises production requirements that affect who must supply materials and testing equipment: for metals with very high minimum purities (eg “At least 99.99% silver” or “Not less than 99.95% platinum”), suppliers and assayers must provide feedstock and assays that meet those minimums. Items for different metals and sizes will require different production processes, dies, blanks and finishing steps; these are production costs for the mint and, on a cost-plus or market pricing basis, flow through to buyers.

Who decides: the Minister for Small Business made the instrument (front page). The instrument sets design and technical parameters that the mint must meet to produce coins that conform to the Schedule. It also controls visual elements of coins (obverse and reverse designs per Part 2), including required inscriptions such as “ELIZABETH II”, “AUSTRALIA”, the denomination string, the year, the fineness and weight inscriptions and the initials/marks (for example “IRB”, “P”, designer initials such as “NH”, “NM”, “IJ”, “JM”, “WR”, “AH” and so on). Those design requirements determine the mint’s die design, labelling, packaging and compliance checks.

Secondary affected parties: coin dealers, bullion traders, retail distributors, customs officers, insurers and assay labs. Dealers and traders must distinguish between coins of identical face value but different metal or design. The Schedule shows multiple entries for the same denomination but with differing compositions and dimensions , for example, $1 appears in silver, aluminium-bronze, and different sizes and shapes (see items 2, 12, 19, 42, 51, 61, 63, 66, 67, 68, 78, 80, 85, 88). Those market participants must be able to identify which specified coin they hold, because the Schedule treats each item as a distinct standard entry under the Act.

Regulators and legal advisers: because the instrument supplies technical standards that the Currency Act is to be treated as containing for those denominations (s 5(2)), legal advisers, compliance officers and regulators with responsibilities under the Currency Act must interpret and apply the Schedule entries when assessing whether a coin is within the statutory standard. The instrument itself does not set out enforcement provisions; it operates to supply the content that will be used under the parent Act’s enforcement framework.

Members of the public: purchasers and holders of coins for legal-tender purposes, investment or collection are affected in that the instrument specifies what constitutes the standard composition, weight, design and dimensions that will be associated with these denominations under the Act. For public-facing design elements (year, effigy, denomination labelling), the instrument fixes what must appear on registered coins.

The determination does not use duty-right language directly, but by prescribing the technical standards and design requirements it imposes operational duties on the issuer (and any person producing coins purporting to be of these specifications) to ensure compliance with the Schedule’s descriptions. Section 5(2) makes the Schedule entries operate as if included in the Currency Act Schedule; section 6(2) specifies that each item prescribes “the standard weight, the allowable variation from that standard weight, the design and the dimensions” for the specified group of coins. Those two provisions create the core duties: produce coins that meet the listed standard composition, weight (including tolerance), shape, edge, obverse and reverse designs, and dimensions.

Specific duties implied by the instrument include:

• Assure metal content: meet the minimum purity stated for each item , for example, “At least 99.99% silver”, “Not less than 99.95% platinum”, or “Not less than 91.67% rose gold” (Part 1 table entries). The language “At least” and “Not less than” sets a minimum metallurgical duty.

• Meet weight and tolerance: manufacture coins whose weight falls within the stated standard weight plus or minus the allowable variation (s 6(2) and the table entries). Examples include tight tolerances (eg ±0.053 g at item 8) and larger tolerances for very large coins (eg item 44: 10010.50 ± 9.500 g).

• Conform to dimensions: ensure diameter or other maximum dimension and maximum thickness do not exceed the stated values in millimetres.

• Apply prescribed design features: use the obverse and reverse designs as defined by the O- and R- symbol definitions in Part 2. That includes required inscriptions (for example, “ELIZABETH II”, “AUSTRALIA”, denomination numerals and words, year dates such as “2017” or “2018”), effigy placement, decorative elements (wavy lines, dots, borders) and the presence of mint marks or designer initials (for example “IRB”, “P”, “NH”, “NM”).

• Use prescribed shape and edge: conform to shape symbols S1-S3 and edge symbols E1-E2 (for instance S1 is Circular, E1 is Continuously milled).

Rights that follow from the Schedule are implicit: a coin produced in compliance with the Schedule is a coin that the Act will be taken to have scheduled under the Act’s scheme (s 5(2)). If the Currency Act attaches legal consequences (for example, legal tender status or protected coin status) to Schedule entries, coins manufactured to the prescribed standards will, as a factual matter, match the statutory specification. The instrument itself, however, does not state what rights or privileges attach under the Currency Act to coins included in the Act’s Schedule; it merely supplies the descriptive content the Act is to be taken to include.

Two procedural rights and constraints appear: the instrument’s Part 2 specifies certain inscriptions that include the year “2017” or “2018” in many obverse templates (for example O10, O11, O12, O13, O15) and reverse templates (several R-codes). That creates a duty to update dies and to ensure the correct year appears where required. The Schedule also contains variable placeholders in inscriptions (for example, “Xoz 9999 GOLD” with X the nominal weight). The mint has a procedural duty to calculate and apply the correct nominal weight inscription for each produced variant.

Finally, the instrument contains two saving clauses (s 5(3) and s 6(4)) that preserve other determinations made for the same Act provisions. This imposes a duty on implementers to consider pre-existing determinations alongside this instrument: the determination “does not affect any other provision of a determination made for paragraph 13(2)(b) of the Act” (s 5(3)) and similarly for subsection 13A(1) (s 6(4)).

The determination itself does not create or specify penalties, fines or enforcement procedures. It is a technical instrument that inserts specified standards into the operation of the Currency Act (s 5(2), s 6(2)). The determination therefore must be read alongside the enforcement provisions of the Currency Act 1965, including paragraph 13(2)(b) and subsection 13A(1) under which it was made (s 3). Because those provisions of the Currency Act and any offence or enforcement clauses are not included in the text provided, this instrument does not, by its terms, set out what penalties apply where a coin does not meet the standards set out in the Schedule.

The instrument does include two provisions that limit its own scope relative to other determinations: s 5(3) and s 6(4) state that these sections “do not affect any other provision of a determination made for paragraph 13(2)(b) [or subsection 13A(1)] of the Act.” Those saving clauses may be relevant in enforcement contexts where multiple determinations exist: enforcement action under the Act may need to consider the body of determinations together.

Operationally, enforcement would require identifying a coin and assessing it against the Schedule’s entries. The Schedule is structured so that a single denomination may have multiple Schedule entries (different metals, weights and designs). That means an enforcement/inspection process cannot simply check “is this a $1 coin?”; it must match the coin to a specific Schedule item and then verify composition, weight (within allowable variation), dimensions and design features (shape, edge, obverse and reverse inscriptions). The Part 2 symbol explanations provide the criteria for design conformity (for example, O1 requires “a pattern of wavy lines immediately inside the rim that surrounds an effigy of Queen Elizabeth II” and the inclusion of “IRB”).

Because the instrument does not specify enforcement agencies, it is silent on which body will carry out assays, weighings and visual inspections, and on evidence standards (for example, who bears the evidentiary burden to show a coin falls outside the tolerances). Those procedural matters would be governed by the Currency Act and any applicable regulations or administrative practice established under it. Practitioners should therefore consult the Currency Act and relevant administrative guidance to determine the applicable offences, penalties and enforcement processes for non-compliance with these standards.

Finally, the precision of tolerances in the Schedule has enforcement implications: small per-coin tolerances (for example ±0.022 g or ±0.053 g for some gold coins) require laboratory-grade scales and calibrated measurement procedures. Enforcement bodies and producers will need metrological capabilities to confirm compliance within the tolerances stated.

This determination expressly interacts with the Currency Act 1965. Section 3 states it is made under paragraph 13(2)(b) and subsection 13A(1) of that Act. Section 5(2) provides that from commencement the Act “has effect ... as if” the Schedule to the Act included the denominations and standard compositions set out in Part 1 of Schedule 1. Section 6(2) provides that, on and after commencement, each item in Part 1 of Schedule 1 specifies the standard weight, allowable variation, design and dimensions for the coin whose denomination and composition are specified.

Beyond that explicit linkage, the determination contains two non-substantive cross-interaction clauses. Sections 5(3) and 6(4) state that the respective sections do not affect any other provision of a determination made for paragraph 13(2)(b) and subsection 13A(1) of the Act. Those clauses require readers to consider this instrument together with any prior or subsequent determinations made under the same Act provisions; they preserve the potential coexistence of multiple determinations in the regulatory framework.

Because the Currency Act is not reproduced in full here, the determination does not itself state whether Schedule entries confer legal-tender status, protect the appearance of specified coins from counterfeit, or create specific registration or licensing obligations for private mints or distributors. Those matter-of-rights and regulatory interactions are matters for the Currency Act. The instrument’s approach , adding design and physical standards to the Act’s Schedule , suggests it will be used by authorities to determine whether a coin meets the statutory standard that the parent Act recognises. Users must therefore look to the Currency Act and its enforcement and administrative regime to understand criminal offences, civil liabilities, customs treatment, import/export restrictions, and other statutory rights and duties tied to coins scheduled under the Act.

Other legal regimes potentially implicated include consumer protection and trade descriptions laws, export-control obligations on precious metals, Valuation/Customs duties, anti-money laundering regulations and intellectual property law for designer signatures or artwork. The instrument, however, does not address those fields and contains no cross-references to them; any interaction between those laws and the standards set by this instrument will arise in standard operational or commercial ways rather than by express statutory cross-linkage in this instrument.

Finally, the instrument’s Part 2 inserts required textual elements onto coins , including the monarch’s effigy, country name, the denomination string, year and fineness statements , and therefore interacts in a practical sense with any laws that regulate imagery or inscriptions on currency (for example, rules about depiction of the sovereign). The instrument itself prescribes the inscriptions and imagery to be used for the listed coins (Part 2 entries such as O1-O15 and R1-R41), and therefore sets the design template that must be used for compliance under the Currency Act.

The determination includes a commencement table (s 2) that records the instrument's start date but does not contain any subsequent amendment notes in the text provided. Section 2(1) states that “The whole of this instrument” commences “The day after this instrument is registered.” A note below the table states that “This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.” That indicates the printed commencement table is intended to record the instrument’s original commencement only; later amendments, if any, would not be reflected in that table.

Within the instrument itself the only historical markers are the year numerals that appear in many obverse and reverse templates in Part 2 (for example, O10 and O11 require “2017”; O5 and O6 require “2018” and some reverse designs also show “2017” or “2018”). Those year inscriptions show how the instrument fixes particular years on certain designs, but they do not constitute an instrument amendment history.

No amendment schedules, variation clauses or repeals are included in the provided text. The instrument contains a savings clause in respect of other determinations (s 5(3) and s 6(4)), but it does not itself record prior versions of this determination or list prior determinations being replaced or repealed.

For a complete amendment history in practice, a user must consult the Commonwealth Register of Legislation or similar official repository to inspect the instrument’s registration entry, any successive instruments amending it, and any revocations. The instrument as provided contains no further historical or amendment information beyond the single commencement entry and the text of the original determination.

The text of the instrument contains no references to any litigation, judicial decisions, or court challenges concerning this determination. There are no citations to cases, no mention of judicial review, and no recorded disputes provided in the document. The instrument is a technical specification made under the Currency Act and, as supplied, does not include or summarise any litigation history.

Because the instrument modifies how the Currency Act has effect in relation to specified denominations (s 5(2)), any litigation involving compliance, enforcement or interpretation of these entries would appear in courts considering the Currency Act and the instrument together. The instrument itself does not identify a body of administrative decisions or judicial determinations interpreting its entries; therefore, there is nothing in the provided text to report as litigation history.

Practitioners who need information about any cases or administrative disputes that have arisen under this determination must search court databases and the Commonwealth Register of Legislation for subsequent judicial or administrative rulings that cite this instrument. The instrument’s own text contains no such citations.

There are several concrete issues in the instrument that create traps for implementers, market participants and advisers. These are not value judgments but point-form practical pitfalls grounded in the instrument’s text.

1. Multiple Schedule entries for the same face value: The Schedule repeatedly lists the same denomination more than once, with differing compositions, sizes and designs. Examples: the $1 denomination appears under many items with different compositions (silver and aluminium‑bronze), different diameters, thicknesses and different O- and R-codes (see items 2, 12, 19, 42, 51, 61, 63, 66-68, 78, 80, 85, 88). That requires anyone inspecting a coin to match it to a specific Schedule item, not merely to the denomination. Failure to do so risks misclassification and error in compliance or valuation.

2. Same denomination, same metal, different dimensions: Some coins carry identical stated composition and denomination but differ in maximum dimension or thickness and in obverse/reverse codes (for example compare item 2 ($1 silver 40.60 mm, O1 R2) with item 51 ($1 silver 32.60 mm, O1 R17) and item 80 ($1 silver 32.60 mm, O12 R39)). The multitude of near-identical textual entries increases the chance of confusion in cataloguing, stockkeeping, customs classification and legal analysis.

3. Tight tolerances for small coins: Several gold coins have extremely narrow weight tolerances measured in hundredths of a gram (for example item 11 $15 gold 3.133 ± 0.022 g; item 8 $100 gold 31.165 ± 0.053 g). These tolerances require precise metrology. Without appropriate calibrated scales and documented measurement protocols, a small measurement variance could show a coin out of tolerance even if the mint’s production is within commercial expectations.

4. Very large items: Some entries specify very large coins (for example item 44 $300 silver listed with weight 10010.50 ± 9.500 g and diameter 221.00 mm, thickness 33.00 mm). Handling, transport, storage, insurance and assay for such pieces present practical logistical and risk-management issues that differ from standard bullion coins.

5. Year and variable inscriptions: Many obverse and reverse symbol definitions require year numerals (“2017”, “2018”) and template inscriptions using “X” as the nominal weight (for example “Xoz 9999 GOLD” or “XKG 9999 Ag”). The mint must ensure correct substitution of the nominal weight and correct year on each die. Errors here may render a coin non-conforming to the Schedule’s textual requirements.

6. Minimum-purity phrasing: The determination uses “At least” and “Not less than” for purity statements. While that establishes a minimum standard it also permits higher purity. Practically, assay and documentation need to demonstrate compliance with the minimum; however, different assays that show purity above the minimum will be compliant but may materially affect the coin’s market value beyond face value.

7. Symbol decoding requirement: Part 1 relies on shorthand (S1, E1, O1, R1 etc) that can be misread or misapplied. Part 2 decodes the symbols but is lengthy and complex; mistakes transposing symbol meanings may produce mis-stated die engraving.

8. Unstated enforcement and evidential standards: The instrument does not specify who conducts assays, what testing methods are acceptable, or the evidentiary standard for showing a coin falls outside weight or composition tolerances. Those operational matters must be determined under the Currency Act and administrative practice.

9. Overlap with other determinations: The savings clauses (s 5(3) and s 6(4)) require consideration of other determinations. Without reviewing them, implementers may miss earlier or contemporaneous determinations that also apply.

10. Market confusion: The combination of multiple distinct coins with identical face values and different intrinsic metal value may cause confusion among purchasers and intermediaries. The instrument makes no provision for labelling or public education; operators must ensure packaging and documentation clearly identify the specific Schedule item the coin corresponds to.

Compliance under this instrument is principally operational and technical: produce, label and document coins so that each produced coin matches a specific Schedule item in Part 1 and the corresponding design description in Part 2. The following concrete steps, grounded in the instrument’s text, are the basis for practical compliance.

1. Map production to Schedule items: For each coin design planned, identify the exact item number in Part 1 of Schedule 1 that corresponds to the coin’s denomination, composition and intended design. Do not assume a denomination maps to a single Schedule entry; the Schedule contains multiple item rows for the same denomination with differing parameters (see Part 1 table).

2. Meet metal-content minima: Ensure feedstock and production processes meet the minimum metal purities specified in the relevant item (eg “At least 99.99% silver”, “Not less than 99.95% platinum”, “Not less than 91.67% rose gold”). Maintain assay certificates for each lot of blanks or minted coins to demonstrate minimum composition. Because the instrument uses “At least” and “Not less than”, assays showing higher purity will still comply, but documentation must show the minimum is satisfied.

3. Conform to the standard weight and tolerance: For each batch, measure produced coins’ weights and ensure they fall within the standard weight plus or minus the allowable variation specified in the relevant Part 1 item. Implement calibrated metrology equipment (traceable calibration certificates) and batch sampling plans that reflect the coin’s tolerance. Tight tolerances for certain coins (e.g. ±0.022 g) require smaller measurement uncertainty budgets; document measurement uncertainty and ensure it is substantially smaller than the allowable variation so pass/fail determinations are reliable.

4. Respect maximum dimensions and thickness: Measure diameters/other dimension and thickness and confirm compliance with the “Maximum diameter or other dimension (mm)” and “Maximum thickness (mm)” columns. For non-circular shapes (S2 square with rounded corners, S3 star), ensure the “other dimension” is defined in the production plan and measured consistently.

5. Apply correct edge treatment and shape: Produce coins with the edge and shape as specified (edge codes E1 Continuously milled, E2 Plain; shapes S1 Circular, S2 Square with rounded corners, S3 Star). Ensure stamping and coining processes produce the specified edge profile and that quality control includes edge inspection.

6. Match obverse and reverse inscriptions and elements exactly: Use Part 2 to implement obverse and reverse designs. For each O-code and R-code used in the Part 1 table, reproduce the exact inscription strings and design elements required. For templates that include placeholders (eg “Xoz 9999 GOLD”), substitute the correct nominal weight numeral X for the produced variant. Ensure that year inscriptions are correct where specified (eg “2017” or “2018” in many O- and R- entries).

7. Record designer initials and mint mark: Part 2 specifies initials or marks (“IRB”, “P”, “NH”, “NM”, “IJ”, “JM”, “WR”, etc.) as part of the obverse or reverse design. Ensure die designs include these marks where required. Keep documentary records of artwork approvals and die proofs demonstrating that the physical product matches the Part 2 description.

8. Maintain documentation and traceability: Keep an auditable record linking each production batch to the corresponding Schedule item, with assay certificates, weight measurement records, dimensional measurement records, die proofs and photographs. Because enforcement under the Currency Act will involve matching a coin to a Schedule item, documentary trail is crucial.

9. Consider packaging and consumer disclosure: Given multiple coins share denominations with different intrinsic values and compositions, provide clear labelling and product information identifying the relevant Schedule item number (or a clear description that maps to the Part 1 entry), the metal content and nominal weight inscription used. This will reduce market confusion among purchasers, dealers and customs.

10. Coordinate with regulatory/legal advisers: The instrument does not set out enforcement mechanisms or penalties; consult the Currency Act 1965 and any related administrative guidance to confirm legal obligations and enforcement processes attached to Schedule entries. Also check for other determinations made under the same Act provisions (s 5(3), s 6(4)) that may apply concurrently.

11. Quality control and metrology procedures: Implement measurement protocols that account for instrument-specified tolerances, including calibration frequency, instrument uncertainty budgets, sampling plans and acceptance criteria. For coins with particularly narrow tolerances, consider 100% weight control or very tight sampling intervals.

12. Review other determinations and administrative practice: The savings clauses mean other determinations remain relevant. Before introducing a new coin product it is prudent to review other determinations under paragraph 13(2)(b) and subsection 13A(1) of the Currency Act to ensure no conflicting or complementary obligations apply.

13. Logistics, insurance and handling for large/heavy items: For very large coins (for example the item 44 $300 weight 10010.50 g and 221.00 mm diameter), prepare handling, transport and storage plans that reflect non-standard size/weight risks. Ensure insurers and carriers are informed of the dimensions and precious-metal content.

14. Training and labelling for distributors: Provide training materials to dealers and distributors to enable them to identify the correct Schedule item for each product. Ensure stock-keeping units and product codes map unambiguously to Schedule items.

Implementing these steps will align production operations with the record of legal standards contained in this determination. For any legal questions about offences, enforcement, or the precise legal consequences under the Currency Act that attach to conformity or non-conformity with the Schedule, consult the Currency Act 1965 and associated administrative guidance and legal counsel.
