Currency (Perth Mint) Determination 2015 (No. 3)

The instrument uses a compact set of legal mechanics and recurring conceptual building blocks. The key legal mechanism is the delegated legislative determination under the Currency Act which supplants or stands in as if part of the Act’s Schedule. The conceptual building blocks are:

• Specification-by-reference: section 5 inserts the Schedule 1 Part 1 denominations and compositions into the Currency Act’s Schedule “as if” included there. The instrument therefore does not amend the Act text itself but causes the Act to have effect with those Schedule entries (s 5(2)). This is a typical statutory technique for delegating technical specification to instrument form.

• Standard composition: each listed denomination has an associated “standard composition” expressed as a minimum fineness and metal type. Most gold coins are described as “At least 99.99% gold”; most silver coins are “At least 99.9% silver”; one item is “At least 91.67% gold” (Schedule 1 Part 1, Standard composition column). The wording sets a floor rather than an exact alloy formula, giving the drafter/issuer latitude to meet or exceed the specified purity.

• Standard weight and allowable variation: each coin entry specifies a standard weight in grams together with a permitted variation (for example 31.162 ± 0.055 g). The instrument therefore provides a mechanical tolerance band for manufacture and quality control (Schedule 1 Part 1).

• Design and dimension specification: the instrument maps coins to shape symbols (S1-S5), edge symbols (E1-E3), obverse designs (O1-O17) and reverse designs (R1-R45). Part 2 decodes these symbols into textual descriptions that prescribe inscriptions, motifs (for example kangaroo, koala, kookaburra, ANZAC imagery), dates (2015-2018 on many obverses), mintmarks and other inscriptions including weight and fineness notations such as “Xoz 9999 GOLD” or “1KG 9999 GOLD” (Schedule 1 Part 2).

• Reuse and multiplicity: the Schedule contains multiple items with the same face value but different compositions, weights and designs (for example many entries for $1 coins, and several $100 and $25 items). The instrument therefore contemplates parallel coin types sharing the same denomination but differing in intrinsic metal content, size and artistic design. This is achieved by listing them as separate items in the table.

• Preservation clause: both s 5(3) and s 6(4) state that the sections do not affect other determinations made under the corresponding provisions of the Currency Act, which preserves existing determinations or future ones made under the same Act subsections.

• Administrative metadata: the commencement table in s 2 makes the instrument effective “the day after this instrument is registered” and notes the table is only for the original instrument text (s 2(1)-(2)). The instrument is dated and signed by the Parliamentary Secretary to the Treasurer (text preceding the Contents and s 1).

Conceptually, the instrument treats coin specification as a technical regulatory function separable from policy: denominations, fineness, weight tolerances and artistic content are converted into a table of machine-readable and human-decodable entries so the Currency Act can operate with those defined items. The obverse and reverse descriptions also prescribe text that must appear on the face and reverse, including the effigy of Queen Elizabeth II and maker marks, which standardise the visual and textual content.

From a compliance perspective, the main parameters to be met by any issuer (the Perth Mint) are composition, weight tolerance, diameter/other dimension and thickness, shape, edge treatment and precise inscriptional content as decoded in Part 2. From an administrative law perspective, the instrument demonstrates the statutory allocation of specification power to delegated instrument form rather than primary legislation.

This instrument directly and immediately affects three classes of parties, as can be read from its text and structure.

1. The Perth Mint (and the Commonwealth body or contractor responsible for minting operations). The instrument title and the content of Schedule 1 identify Perth Mint designs, mintmarks and sovereign-type denominations. The Schedule’s design codes and “P” mintmark on reverse designs (see numerous entries in Part 2, Reverse descriptions) are manufacturing prescriptions for coins the Perth Mint will produce. The Parliamentary Secretary to the Treasurer made the determination for the Currency Act’s Schedule that governs coin specifications, so the practical effect is to enable the Perth Mint to issue and sell the types of coins listed, as if those denominations and standards were part of the Act (s 5(2), s 6(2)).

2. Assayers, quality control and compliance personnel involved in coin production. The instrument prescribes standard weights, allowable variations, diameters, maximum thicknesses, shapes and metal fineness for each listed coin (Schedule 1 Part 1). Metallurgists, assayers and production engineers must meet those numeric tolerances, ensure inscriptions match the obverse/reverse symbol decoding, and verify the presence of required mintmarks and inscriptions such as “Xoz 9999 GOLD”, “IRB” and the year numerals that appear in obverse codes (Schedule 1 Part 2). Quality control systems must be designed to measure to the ± gram tolerances specified.

3. Dealers, purchasers, custodians, insurers, handlers and anyone transacting in these coins. The instrument defines denominations and physical standards which will affect how these coins are identified, described in contracts, insured, stored and transported. Because several items share the same face value but differ in composition, weight and design (for example multiple $1 coins, and multiple high-value gold and silver denominations), intermediaries in the metal, bullion and numismatic markets must adjust product descriptions, contracts and inventory systems to the multiple item codes. The Schedule’s explicit dimensions and weight tolerances are the authoritative specification for description and authentication.

Indirectly affected parties include:

• Regulatory and enforcement agencies whose functions under the Currency Act interact with coin specification (s 3,authority under the Currency Act 1965). While no enforcement or penalty provisions are in this instrument, other parts of the Currency Act and related criminal or customs law may apply to misuse, counterfeiting or false representation of coins designed under this instrument.

• Market participants for precious metals: the Schedule specifies coins with significant intrinsic metal content and high nominal denominations (for example $3,000 gold items, multi-kilogram silver pieces). That will affect bullion markets, storage logistics, shipping, and pricing where face value and metal intrinsic value diverge.

• Designers and intellectual-property stakeholders: many reverse designs incorporate trade names, images, and trademark-style notations (for example “Gumnut Babies™”, “Snugglepot & Cuddlepie™”, copyright notations) appearing in reverse descriptions (R30-R31). Entities that own or license those marks will be affected by use and by any commercial exploitation of coin images.

The instrument does not create duties for private persons to accept the coins in ordinary retail transactions; it does not, within its text, define legal-tender limits, nor does it provide for circulation mechanics. Its immediate legal effect is to put the specified denominations and standards into the operation of the Currency Act Schedule as if included there (s 5(2)). Who ultimately “uses” these coins in commerce will therefore depend on other statutory provisions in the Currency Act and market practice, not on this instrument alone.

The instrument itself is primarily descriptive and prescriptive of technical standards; it creates no standalone statutory offences or explicit civil rights. Nonetheless, reading the instrument together with its source authority yields practical duties and entitlements.

Duties (as imposed or implied by the instrument’s content)

• To manufacture to the specification: the issuer (implicitly the Perth Mint) must ensure any coin matching an item in Schedule 1 Part 1 conforms to the specified standard composition (minimum fineness), the standard weight and allowable variation in grams, the maximum diameter/other dimension, maximum thickness, shape symbol and edge symbol, and the obverse and reverse designs as decoded in Part 2 (s 6(2); Schedule 1 Part 1 & Part 2). The specification sets objective manufacturing tolerances; adherence will be required to treat the coins as those authorised by the Act.

• To include prescribed inscriptions and marks: obverse and reverse design descriptions require specific inscriptions (for example “ELIZABETH II”, “AUSTRALIA”, year numerals, denominations in words, weight/fineness inscriptions such as “Xoz 9999 GOLD”, and the mark “IRB” on many obverses; many reverses include the mintmark “P”) (Schedule 1 Part 2). The duty is to include these elements on the physical coin.

• To maintain quality control within allowable variation: the listed ± tolerances impose a de facto duty on assay and measurement processes to test and verify weight and dimensions within the permitted range.

• To preserve other determinations: sections 5(3) and 6(4) state the instrument does not affect other determinations made for those provision(s) of the Currency Act. Practically, this imposes a duty on administrators to maintain coexistence with other determinations.

Rights and entitlements (direct or implicit)

• Entitlement to specification-backed issuance: by prescribing the denominations, standard compositions and physical parameters as if included in the Currency Act Schedule (s 5(2)), the instrument confers the legal standing necessary for the issuing authority to produce coins that will be recognised under the Currency Act’s Schedule. That confers an entitlement to use the statutory framework underpinning coinage standards.

• Predictability of coin identity for market participants: dealers, insurers, custodians and purchasers gain a clear, government-published reference for coin attributes that may be relied on in contracts, sales descriptions and authentication processes.

• Design and intellectual-property usage: the instrument authorises particular reverse and obverse designs, some of which include copyrighted works and trademarks. The Schedule therefore formalises the authorised use of those design elements on identified denomination items.

Matters the instrument does not do in terms of duties/rights

• It does not itself create legal-tender acceptance rules, payment obligations, or limits for transactions. The instrument operates “as if” entries were included in the Currency Act Schedule (s 5(2)), but the instrument text does not restate or expand the broader legal-tender regime in the Currency Act. Any rights or duties flowing from legal-tender status remain in the Act and elsewhere, not in this determination.

• It contains no explicit administrative reporting, registration, record-keeping or audit duties for private third parties. Any such requirements would derive from other statutory provisions not incorporated into this instrument’s text.

In short, the instrument creates precise technical obligations for coin specification and confers the statutory platform for minting and recognising those coin types under the Currency Act framework. It leaves broader transactional rights and enforcement mechanisms to the Currency Act itself and other law.

The determination contains no penalty provisions, sanctioning language, inspection powers or enforcement procedures. The instrument is a specification instrument; its own sections are limited to naming, commencement, authority, definitions and the two substantive operative sections (s 5 and s 6) that integrate the Schedule into the Act’s operation. There are several practical implications from that silence.

• No penalties in this instrument: the text of the Currency (Perth Mint) Determination 2015 (No. 3) does not create or specify offences, fines or criminal or civil penalties for non-compliance with the Schedule’s entries. Consequently, there is no standalone enforcement process set out within this instrument itself.

• Enforcement remains with the Currency Act and other laws: the instrument is made under paragraph 13(2)(b) and subsection 13A(1) of the Currency Act 1965 (s 3). Any penalties, criminalisation of counterfeiting, misrepresentation, unlawful coin production, seizure powers, administrative penalties or enforcement mechanisms must be found in the Currency Act or other statutes and are not reproduced in the instrument. Readers must therefore consult the Currency Act for the enforcement framework that would apply to wrongful manufacture, counterfeiting, or misuse of coins specified by this instrument.

• Quality and standards compliance: although the instrument prescribes weights, dimensions and design features, it does not itself set out sanctions for deviating from those tolerances or mislabelling coins. In practice, regulated entities (assayers, mint) will likely be subject to contractual, commercial, licensing or administrative obligations under statutes or agreements that do carry enforcement consequences, but those are external to this determination.

• Administrative discretion and audit: the instrument’s preservation clauses (s 5(3), s 6(4)) indicate coexistence with other determinations made under the same Act provisions. That implies an administrative regime where regulators or treasury may maintain a portfolio of determinations, and enforcement will therefore be managed within that portfolio. However, the instrument does not itself define the processes for review, variation, revocation or administrative oversight of the determinations it contains.

• Potential civil claims: the specification can be relied upon in civil disputes relating to authentication, sale, misdescription or warranty of coins. Although the instrument does not create penalties, the technical standards it sets will be evidence of expectation in commercial disputes. For example, a purchaser alleging a coin fails to meet published government specifications would rely on this instrument as the authoritative description.

Implementation risk and evidence chain

• Authentication and testing will require measurement protocols and accredited assay procedures outside the instrument. In the absence of enforcement text, the practical means of proving non-compliance in a tribunal or court will rest on assay reports, accredited laboratory evidence and documentary chain-of-custody. The instrument supplies the baseline specification but not the procedural rules for measuring or the identity of competent measuring authorities.

In short, enforcement of the standards set out in this instrument must be pursued under the broader enforcement framework of the Currency Act and other applicable statutes or contractual regimes. The instrument itself is silent on sanctions.

The instrument is an exercise of delegated legislative power deriving from the Currency Act 1965 and therefore interacts with that Act as its parent statutory basis. The instrument refers specifically to paragraph 13(2)(b) and subsection 13A(1) of the Currency Act 1965 as the authority for its operation (s 3). That parent-child relationship frames interaction with other legal areas as follows.

• Interaction with the Currency Act 1965: sections 5 and 6 explicitly state that, upon commencement, the Currency Act will have effect “as if” the Schedule to the Act included the denominations and standard compositions and as if the standard weight, allowable variation, design and dimensions were specified opposite those denominations (s 5(2), s 6(2)). This means the instrument does not amend the Currency Act text directly but modifies how the Act should be read in practice by importing the instrument’s Schedule into operation. Any legal questions about legal-tender status, limits, or offences will therefore be resolved by reading the Currency Act together with the incorporated Schedule.

• Coexistence with other determinations: the instrument expressly preserves other determinations made under the same Currency Act provisions (s 5(3), s 6(4)). That means multiple determinations can coexist, and administrators must treat them as part of the overall regulatory scheme. Where there is overlap, the relevant administrative practice or Currency Act interpretation rules will determine primacy.

• Intellectual property and contracted design usage: many reverse descriptions in Part 2 reference trademarked or copyrighted material (for example “Gumnut Babies™”, “Snugglepot & Cuddlepie™”, copyright notations such as “©TNS & CPA”). The instrument authorises the use of those images on the specified coins. The legal interaction here is that intellectual-property permissions, licensing agreements and rights clearances must exist for the mint to lawfully use those designs; the instrument itself does not create copyright ownership or licensing rights but indicates authorised use on coin items. Parties involved in creation or licensing will need to manage contractual rights and clearances outside the instrument’s text.

• Customs, export/import and precious metals regulation: the Schedule specifies coins with high intrinsic value and substantial metal mass (for example multi‑kilogram silver coins and kilogram gold pieces). The instrument does not address customs, export controls, precious-metals trading licences, or anti-money laundering obligations. Those regulatory overlays will apply according to separate statutory regimes and will interact operationally with coins produced under this instrument. Commercial handlers will need to consult customs, tax and anti-money laundering laws when moving or selling these coins.

• Consumer law and contract law: the instrument provides authoritative specifications for coin attributes that contracting parties can reference. Consumer protection statutes, sale of goods legislation and contract law will apply to disputes involving coins issued under this instrument; the instrument supplies technical benchmarks (composition, weight tolerances, design) that would inform warranty, misdescription or fraud claims.

• Criminal law: counterfeiting, fraud and misconduct related to coinage are governed by criminal statutes, principally the Currency Act and related criminal law provisions not included in this instrument. The instrument’s specifications will be relevant evidence in prosecutions or defences but the substantive offences and penalties are located in other laws.

• Administrative law: because the instrument is a legislative instrument, it is subject to the usual rules about disallowance, registration and publication for legislative instruments. The commencement clause (s 2) and the notation that the table relates only to provisions as originally made indicate the instrument is intended to be used and referenced in published forms which might be relied upon by courts or administrators when construing duties or rights.

Overall, the instrument does not displace other regulatory regimes; instead, it supplies detailed technical content that will be read together with the Currency Act and a range of other legal domains (IP, customs, tax, criminal law, contract and consumer law). Users should treat it as a technical annex to a broader legal environment.

This instrument carries its own metadata that records its identity and commencement. The document is titled Currency (Perth Mint) Determination 2015 (No. 3) (s 1). It is signed and dated by Kelly O’Dwyer, Parliamentary Secretary to the Treasurer, on 24 July 2015 (front matter). Section 2 contains a commencement table specifying that “the whole of this instrument” commences the day after registration (s 2(1)). The table also includes the standard drafting note that it relates only to the provisions of the instrument as originally made and will not be amended to reflect later amendments (s 2(2) and its accompanying note).

Important structural amendment notes in the instrument itself:

• Non-affectation clauses: sections 5(3) and 6(4) explicitly state that the sections “do not affect any other provision of a determination made for paragraph 13(2)(b) of the Act” and “do not affect any other provision of a determination made for subsection 13A(1) of the Act” respectively. Those clauses preserve prior or subsequent determinations under the same Currency Act provisions.

• Schedule as operative content: sections 5(2) and 6(2) set out the mechanism by which the instrument’s Schedule becomes operative in relation to the Currency Act. They convert the Schedule entries into statutory effect “as if” included in the Act’s Schedule. This is the core amendment technique used by the instrument.

The instrument does not contain any internal amendment history beyond those clauses and the commencement metadata. It does not itself list prior versions or show tracked changes. The note in s 2(2) that any information in column 3 of the commencement table is not part of the instrument signals the usual register practice.

Because the instrument is a legislative instrument, any later changes to coin specifications would be effected by subsequent determinations under the Currency Act. The instrument’s preservation clauses mean that later determinations could coexist rather than implicitly repeal this instrument. Therefore, to establish the current operative specification at any time, a researcher should examine the Currency Act Schedule as affected by all relevant determinations and possible revocations. The instrument itself makes no provision for revocation, amendment, or expiry; any such action would be implemented via a later legislative instrument or amendment to the Currency Act.

In sum, the instrument’s amendment history as contained in its face is limited to: its making date (24 July 2015); its commencement (day after registration); and explicit preservation of other determinations. It does not record prior versions or subsequent amendments within its text.

The instrument’s text contains no reference to any litigation, judicial decisions, or disputes. It does not cite any cases, does not note any legal interpretations and does not record challenges to its validity. The instrument is a specification order under the Currency Act and the absence of litigation references in its text is unsurprising because determining authorities normally publish such determinations as technical instruments, with any legal disputes occurring externally.

Practical consequences of that silence:

• No recorded judicial construction within the instrument: there is no content in the instrument that indicates how courts have interpreted its clauses, the Schedule, or the mechanism by which it integrates into the Act. Any judicial interpretation of ambiguity in design descriptions, weight tolerances, or the “as if” incorporation into the Currency Act would therefore be found in case reports, not in this instrument.

• Potential for future litigation: given the presence of high-value coins, multiple different coins sharing a face value, and detailed design prescriptions (including copyrighted or trademarked imagery), legal disputes could conceivably arise over authentication, misdescription, false representation, counterfeiting, licensing of designs, or contractual obligations between issuer and purchasers. The instrument supplies the specification that would be the starting point for such litigation, but no cases are named in the instrument itself.

• Evidence value: where litigation does occur about whether a coin meets governmental standards, this instrument would serve as primary documentary evidence of the official standards the coin was meant to satisfy (composition, weight tolerances, inscriptions, mintmarks and design elements). Any civil or criminal proceeding on coin authenticity or misrepresentation should therefore reference the exact Schedule entry and the Part 2 decoding of obverse and reverse codes.

For present purposes, the instrument shows no litigation history within its own text. Researchers or litigators requiring authoritative judicial treatment of the instrument’s provisions must look to external case law concerning the Currency Act, coin specification disputes, or any prosecutions for coin-related offences; those are beyond the content of this instrument.

This instrument contains several technical features and drafting choices that can produce implementation friction, misinterpretation or unintended consequences. The following points are concrete, source-grounded gotchas drawn from reading the Schedule and operative clauses.

1. Multiple items with identical face value but different composition and physical parameters. The Schedule lists numerous separate items that share the same denomination (for example multiple $1 coins: items 7, 10-12, 20, 30-32, 63, 69, 71, 73, 75-76, 78-84, 86, 88 among others) yet specify differing metal composition, weight, diameter and designs. The instrument therefore authorises multiple distinct coin types bearing the same nominal denomination. That can create real-world confusion in identification, accounting entries, contractual descriptions and evidence if parties refer only to denomination rather than to the specific Schedule item and its design code.

2. Large variances in mass and dimensions across like denominations. Some same-named coins have radically different masses and forms , for example $1 coins with weights ranging from 13.5 g (aluminium and bronze) to over 31.6 g (silver), and $30 or $300 items that are kilogram-scale. Descriptions such as “Maximum diameter (mm) or other dimension” and entries giving non-circular dimensions (for instance 47.60 x 27.60 mm in item 67) mean that not all coins are simply round. Contracts and storage systems must therefore be explicit about which item and design code is intended.

3. Non-circular and non-standard shapes. Several entries use S2 (rectangular), S3 (stylised map) and S4 (star) shapes (Schedule 1 Part 2 items 2-4). These shapes raise handling, packaging, vending machine compatibility and authentication issues. The instrument supplies dimensions but not handling protocols; market participants must consider physical logistics when dealing with non-circular items.

4. Specifications provide minimum fineness, not exact alloy recipes. Terms such as “At least 99.99% gold” or “At least 99.9% silver” set a lower bound. Manufacturers could produce coins with higher purities or slightly differing trace alloys, so long as the minimum is met. If downstream statutory or commercial rules require an exact alloy composition (for example solderability or mechanical hardness), those rules are not provided in this instrument.

5. Extensive use of symbol coding for obverse/reverse designs and inscriptions. The instrument uses compact codes (O1-O17 and R1-R45) that decode into multi-element inscriptions and images (Schedule 1 Part 2). Misalignment between code use in Part 1 and decoding in Part 2 can lead to disputes over the intended inscriptions, particularly where wording includes variables (e.g. “Xoz 9999 GOLD” where X is nominal weight). Manufacture must ensure the correct substitution of the X value and the correct year numerals required by the obverse code.

6. Mintmark and assayer marks specified. Many obverse descriptions mandate “IRB” and many reverses display “P” and other initials. The instrument does not discuss who controls those initials or the process for changing them. If a different effigy or mintmaster mark were to be adopted later, a separate determination would likely be needed. The instrument therefore fixes particular maker identifiers.

7. Presence of copyright and trademark indications. Some reverse designs explicitly include “™” or “©” notations. The instrument authorises the design usage on specified coins, but it does not substitute for the licensing documentation that would be necessary under intellectual property law. Rights-holders and the mint must ensure licences are in place; the instrument does not record them.

8. Absence of enforcement or legal-tender detail in this instrument. The instrument does not describe circulation rules or legal-tender limits. Where face value is small but metallic content is high, market actors need to know whether the coin is intended for circulation, bullion sale or numismatic sale. The instrument’s silence on that point can lead to differing expectations in the market.

9. Weight tolerances and measurement precision. Many items specify weight tolerances of ±0.030 g or similar fine tolerances. Achieving and proving compliance to those tolerances requires accredited scales and documented measurement procedures. The instrument does not prescribe measurement methodology or accredited bodies to certify compliance, leaving potential evidentiary disputes about whether a coin meets the listed tolerance.

10. Multiple years and year-specific inscriptions embedded in obverse codes. Obverse decodings include specific years (for example “2015”, “2016”, “2017”, “2018” in various O codes). That binds specific coin types to a specific year inscription. If later minting in a different year is intended for an otherwise identical coin, a mismatch could arise between the Schedule’s obverse description and the physical coin’s year date, potentially requiring a new determination.

11. Very large and very small coins coexist. The Schedule ranges from small fractional coins to multi-kilogram silver coins (for example item 54 lists a $300 coin with standard weight 10015.000 g ± 5.000). Issues around storage security, transport, insurance and customs become material operational considerations that the instrument does not address.

For practitioners and compliance officers, the practical implication is clear: rely on the Schedule item number and the Part 2 decoding when specifying or contracting for coins, and do not describe coins solely by denomination. The instrument’s detailed technical content is binding on specification, but it does not relieve manufacturers, licence holders, dealers and custodians from parallel obligations under IP, customs, taxation and criminal law.

Compliance is primarily technical and documentary. The instrument supplies the authoritative reference for composition, weight, dimension, shape, edge, obverse and reverse inscriptions. A practical compliance checklist, drawn from the instrument text, follows for manufacturers, assayers, dealers and anyone contracting in these coins.

1. Identify the correct Schedule item. Always refer to the specific item number in Schedule 1 Part 1 rather than relying on denomination alone. Many denominations appear multiple times with different specifications (Schedule 1 Part 1, Items 1-88). Contracts, purchase orders and quality certificates should cite the exact item number and the obverse/reverse code (for example Item 21, S1 E1 O3 R10).

2. Verify metal composition meets or exceeds the stated minimum. The “standard composition” column sets minimum fineness, e.g. “At least 99.99% gold” or “At least 99.9% silver” (Schedule 1 Part 1). Use accredited assay tests to demonstrate compliance. Retain assay certificates and batch records that clearly show the measured purity and how it compares to the minimum specified.

3. Conform to standard weight and allowable variation. For each coin, measure sample coins and provide documented weight records showing they fall within the stated standard weight ± allowable variation (e.g. 31.162 ± 0.055 g). Maintain quality-control charts and calibration records for weighing equipment. The instrument’s numeric tolerances are the compliance benchmark (Schedule 1 Part 1, Standard weight and allowable variation).

4. Ensure dimensional compliance. Confirm diameter, other dimensions and thickness do not exceed the maximum dimensions in the Schedule. For non-circular shapes the “other dimension” field and any listed width x height values are the authoritative reference (Schedule 1 Part 1, Maximum diameter or other dimension). Maintain measurement reports and photographic documentation.

5. Apply correct shape and edge treatments. Follow the Part 2 decoding for shape symbols (S1-S5) and edge symbols (E1-E3). Edge inscriptions that are specific must be reproduced verbatim where specified (e.g. E2 requires the inscription “PRIDE • RESPECT • GRATITUDE” evenly spaced around the edge) (Schedule 1 Part 2 items 1-8).

6. Reproduce obverse and reverse inscriptions and imagery exactly. Use the Part 2 decoding to place required inscriptions and effigies. Pay attention to year numerals, the “IRB” initials required on many obverses, and variable fields such as “Xoz 9999 GOLD” where X must equal the nominal weight expressed correctly (Schedule 1 Part 2, Obverse & Reverse decodings). Document proofengraving and pre-production approvals to evidence conformance.

7. Preserve mintmarks and assayer marks. Many reverse designs require the mintmark “P” and obverses require “IRB” or other initials. Ensure dies or production tooling include these marks in the correct locations and forms (Schedule 1 Part 2).

8. Maintain licensing and IP documentation. Where reverse designs include trademark or copyright notations (e.g. “Gumnut Babies™”, “©TNS & CPA”), keep copies of licences, permissions and rights assignments authorising use on the specified coin items. The instrument itself authorises the design on the coin but does not substitute for IP licences.

9. Create and retain a compliance file for each coin issue. For each coin item manufactured, maintain a file that includes: item number, production run dates, assay certificates, weight/dimension measurement logs, die proofs, photographic records, IP licences, and shipping/chain-of-custody records. Those files will be the primary evidence of conformity in commercial or enforcement disputes.

10. Label and describe coins with precision in commercial documents. Sales contracts, product catalogues and certificates of authenticity should specify the Schedule item number, composition minimum, declared weight and whether tolerance bands may apply. Avoid describing coins only by face value or colloquial names.

11. Anticipate storage, transport and insurance needs for large or heavy pieces. For coins with large mass (kilogram or multi-kilogram items), coordinate logistics for secure storage, specialist packaging and insurance that recognises the coin’s actual metal value and physical attributes.

12. Monitor subsequent determinations and the Currency Act Schedule. Because the instrument preserves other determinations (s 5(3), s 6(4)) and because later determinations may add or vary items, ensure that compliance teams regularly check the register of legislative instruments and the Currency Act Schedule for new or amended determinations affecting authorised coin specifications.

13. Engage accredited conformity assessment bodies. Rely on accredited labs for fineness and mass verification and on accredited metrology labs for dimension and thickness verification. Maintain calibration certificates for measurement devices used in production.

14. Document substitution rules for variable inscriptions. Where obverse/reverse decodings contain placeholders (for example “Xoz”, or a year), establish an internal protocol documenting how the placeholder is to be represented (numeric format, use of fractions for ounces where called for) and obtain sign-off from an authorised official prior to die manufacturing.

15. Consider ancillary regulatory compliance. Although the instrument does not impose taxation, customs or AML obligations, coins of high intrinsic value may trigger obligations under separate regimes. Coordinate with tax, customs and compliance advisers to ensure these obligations are met when selling, transporting or exporting coins.

Following the instrument as a technical specification requires discipline in measurement, document retention and precise product definition. The Schedule supplies the legal baseline for what a coin “is” for the purposes of the Currency Act, and rigorous internal controls are necessary to ensure that minted coins match that baseline.
