What it does
This instrument, the Currency (Perth Mint) Determination 2004 (No. 4), is a statutory specification instrument made under subsection 13A(1) of the Currency Act 1965 (the Determination). It was signed and dated by Chris Pearce, Parliamentary Secretary to the Treasurer, on 17 November 2004. Section 2 provides that the Determination commences on the date of its notification in the Gazette. Section 3 states the legal purpose of the Schedule: for the purposes of subsection 13A(1) of the Currency Act 1965, each item in Schedule 1 specifies (a) the denomination; (b) the coin’s standard composition; (c) the coin’s standard weight and allowable variation; (d) the coin’s dimensions; and (e) the coin’s design. Section 4 clarifies that the specifications in Schedule 1 do not affect any other determination of the specifications of a coin.
Mechanically, the Determination functions as a catalogue of 60 coin specifications (Schedule 1, items 1-60). The catalogue records, in machine-readable legislative form, denominations ($50, $15, $5 and $1), metal purities (e.g. “at least 99.99% gold”, “at least 99.9% silver”, “at least 99.95% platinum”), standard weights with allowable tolerances (for example Item 1: 15.594 g ± 0.040 g), maximum diameters and thicknesses, the shape and edge treatment (all circular and “continuously milled” in the Schedule), and detailed obverse and reverse design inscriptions (for example the obverse bead ring and inscriptions ‘ELIZABETH II’, ‘AUSTRALIA’, and a specified effigy and monogram). Several items also record year and designer/initials and a mint mark (for example the reverse inscriptions including the year ‘2006’ or ‘2007’, initials such as ‘WR’, ‘RV’, ‘JR’, and the letter ‘P’).
The Determination therefore performs two concrete legal-technical tasks: it formalises, under the authority cited, specific technical standards for a bundle of coins; and it records, as part of the legislative record, the precise design and physical parameters that coins described in Schedule 1 must meet for the purposes of subsection 13A(1) (s 3). The instrument does not itself set out enforcement mechanisms, sanctions, or operational protocols; nor does it purport to repeal or supersede other determinations (s 4). The title and text identify these as Perth Mint specifications (title), and the signature shows the authorising delegate.
