What it does
This Determination, titled Currency (Perth Mint) Determination 2004 (No. 3), is a legislative instrument made under subsection 13A(1) of the Currency Act 1965. It prescribes precise specifications for a set of coins by listing, in Schedule 1, for each item the denomination, standard composition, standard weight and allowable variation, maximum diameter, maximum thickness, shape, edge and obverse and reverse design elements (see s 3 and Schedule 1). The instrument commences on notification in the Gazette (s 2). Section 4 expressly states that the specifications in Schedule 1 do not affect any other determination of the specifications of a coin.
Mechanically, the Determination converts a range of numismatic and bullion coins into items formally specified under s 13A(1) of the Currency Act 1965. The Schedule lists multiple $1 silver coins (Items 1-12 and 14) each specified as at least 99.9% silver, with a standard weight of 31.635 g and an allowable variation of ±0.500 g, a maximum diameter of 40.60 mm and maximum thickness of 4.00 mm; these coins are circular with a continuously milled edge and a standard obverse bearing inscriptions and an effigy of Queen Elizabeth II and the monogram "IRB" (see Schedule 1, Items 1-12 and 14). Item 13 is a $25 coin specified as at least 91.67% gold and 8.33% silver, with a standard weight of 8.001 g ± 0.013 g, maximum diameter 22.15 mm and maximum thickness 1.90 mm; it too is circular with a continuously milled edge and its own obverse and reverse inscriptions (see Schedule 1, Item 13).
The instrument therefore operationalises precise technical tolerances and design requirements for those coins. It does not itself set out criminal penalties, administrative sanctions, minting procedure, distribution arrangements, or payment mechanics. The Notes appended to the compilation state the instrument’s notification date and a later amendment (Currency (Perth Mint) Determination 2004 (No. 3) Amendment Determination 2005 (No. 1)) together with the Legislative Instruments Act 2003 requirement that non‑exempt legislative instruments be registered on the Federal Register of Legislative Instruments (Notes, Table of Instruments; Notes).
