Currency Determination No. 7 of 1996

The Determination revolves around a small set of technical and symbolic concepts expressed in a Schedule. The principal legal/technical elements are:

• The legal basis: the instrument is made under subsection 13A(1) of the Currency Act 1965 and is expressed to be a Determination by the Assistant Treasurer (preamble and cl 1). The instrument therefore sits in the statutory architecture created by the Currency Act; the Determination itself spells out discrete technical requirements.

• Standard composition: for each listed denomination the Schedule names a "standard composition" (for example "Copper, aluminium and nickel", "Not less than 99.9% silver", "Austenitic stainless steel, copper, aluminium and nickel") (Schedule, Part 1, Column 2). These are the metallic specifications to which the listed coin variant is tied.

• Standard weight and allowable variation: the Schedule provides the standard weight in grams and a permissible tolerance expressed as ± grams (for example "9.00 ± 0.28" for a particular $1 copper/aluminium/nickel coin; "11.49 ± 0.23" for a particular $1 silver coin; "31.635+0.50" for a heavier $1 silver issue; "10.60 ± 0.50" for a $5 coin; "20.77 ± 0.50" for a $10 silver coin) (Schedule, Part 1, Column 3). These entries define the acceptable mass range for production quality control.

• Dimensions: the Schedule provides diameter (in millimetres) and thickness (in millimetres) (Schedule, Part 1, Columns 4(1) and 4(2)). The Determination adds an interpretative rule: for a coin that is not circular, diameter means the distance between two parallel faces of the edge (cl 3(2)).

• Shape and edge codes: the Schedule uses symbol codes for shape (S1, S2) and edge (E1, E3, E4). Part 2 explains these: S1 = circular; S2 = regular 24-sided polygon. Edge codes are defined as E1 = milled; E3 = 14 segments, of which 7 are milled and 7 are plain; E4 = plain (Schedule, Part 2).

• Obverse and reverse design codes: the Schedule uses codes O2 (obverse) and R24-R31 (reverse). Part 2 provides exact descriptions for O2 and each R-code included in this Determination. For example O2 = an effigy of the Queen surrounded by inscriptions "ELIZABETH H", "AUSTRALIA", "1997". R24-R31 are long-form descriptions of motifs: R24 and R26 are variants showing Sir Charles Kingsford Smith superimposed on an aeroplane and flight path plus monogram "WP" and listed inscriptions; R27 is a kangaroo drinking reflected in a waterhole and includes "C", "1 OUNCE FINE SILVER", "ONE DOLLAR" and monogram "HH"; R28 concerns Old Parliament House and the reverse of a 1927 Australian Florin, and so on (Schedule, Part 2).

• Cross-references to other determinations: the Schedule includes notes indicating that some symbols (for example O1, E2, R1-R23) are defined in Currency Determination No. 6 of 1996; the present instrument therefore operates in tandem with earlier determinations (Schedule, Part 2, notes).

• Non-derogation: the instrument expressly states it does not affect other determinations of coin specifications (cl 4). That positions the Determination as an additive update to an existing set of determinations rather than a comprehensive replacement.

These concepts are the mechanics by which the Determination translates statutory authority into machine-readable and manufacturable coin specifications: composition, mass tolerance, geometry, rim/edge treatment, and specific obverse/reverse imagery described in words and encoded by reference codes.

The Determination identifies the Assistant Treasurer as the decision-maker (preamble and signature block) and is made under subsection 13A(1) of the Currency Act 1965, so the issuing authority is explicit (cl 1). Beyond the issuing officer, the primary practical audience and affected parties implied by the instrument are the persons and organisations involved in producing, approving, issuing, handling and cataloguing coins that meet Australian specifications. The source itself does not name particular agencies or manufacturers, but the parties with a direct operational interest include:

• Persons and bodies responsible for producing coins to the specified physical and design parameters, who must ensure production tolerances match the standard weights and allowable variations, diameters, thicknesses, shape and edge codes and that the obverse and reverse designs conform to the descriptions in the Schedule (cl 3(1) and Schedule Part 1).

• Organisations or officials who approve or maintain catalogues or registers of authorised coin designs, since the Schedule adds or defines the authorised design descriptors O2 and R24-R31 (Schedule, Part 2).

• Persons involved in quality control and metrology who measure coins against the tolerances expressed in the Schedule, including the interpretative rule about diameter for non-circular coins (cl 3(2)).

• Persons whose operations depend on recognition of coin types for transactional or automated processes. The Determination defines multiple variants of the same denomination (for example multiple $1 variants, and multiple $10 variants), so operators that rely on physical recognition of coins will be affected by the existence of those variants and their specified shapes/edges/dimensions (Schedule, Part 1).

• Entities responsible for maintaining legal/regulatory coherence among multiple determinations. The instrument explicitly preserves other determinations (cl 4) and cross-references Currency Determination No. 6 of 1996 in the Schedule notes. Any body charged with compilation or consolidation of the determinations must account for this instrument alongside prior instruments.

• Collectors and recipients of commemorative or precious-metal issues. The Schedule includes coins described as "Not less than 99.9% silver" and a description (R27) that explicitly states "1 OUNCE FINE SILVER" and "ONE DOLLAR". That signals the existence of non-circulating or collectible commemorative issues among the items specified in this Determination (Schedule, Part 1; R27).

The Determination itself does not set tax, compensation or distribution mechanisms, nor does it create express obligations for banks, retailers or payment-system operators. It does not, within its four corners, declare legal tender status or define acceptance rules; those matters are addressed elsewhere in statute or policy. The immediate effect is to determine the technical manufacturing and design parameters that manufacturers and issuing authorities must meet when producing the listed coins (cl 3(1), Schedule).

The Determination imposes a set of affirmative technical requirements and leaves an administrative framework in place for other determinations. While it does not use the language "duty" or "right", the instrument creates operational requirements implicit in its manufacturing specifications and procedural statements. The principal duties and rights derived from the instrument are:

• Duty to adhere to the specified parameters for particular coins: Clause 3(1) specifies that the Determination “specifies … the standard weights, the allowable variations from those standard weights, the dimensions and the designs respectively set out in columns 3, 4 and 5 of that Part”. Practically, any person or body producing a coin that corresponds to an entry in the Schedule must meet the listed standard composition, standard weight ± allowable variation, diameter and thickness and design code. The Schedule provides the concrete numerical tolerances and design descriptions (Schedule, Part 1; Schedule Part 2 provides definitions of codes).

• Duty to apply the interpretative rule for diameter: Clause 3(2) imposes a specific measurement rule: for coins that are not circular, the "diameter" in the Schedule is to be read as the distance between two parallel faces of the edge. That sets a measurement convention which producers, metrologists and compliance auditors must use when verifying conformity.

• Duty to take into account other determinations: Clause 4 states “This Determination does not affect any other determination of the specifications of a coin.” This is an operational duty on officials and manufacturers to consider this Determination alongside existing Determination No. 6 of 1996 and other instruments, because the Schedule itself references symbols and designs defined in Currency Determination No. 6 of 1996 (Schedule Part 2 notes). Implementers must therefore reconcile potentially overlapping or complementary specifications across instruments.

• Right to rely on the Schedule’s definitions for production and identification: The Schedule’s Part 2 is a right-bearing practical tool; persons can refer to the shorthand codes S1/S2, E1/E3/E4, O2 and R24-R31 and rely on the written explanations for what those codes mean in terms of shape, edge, obverse and reverse design.

• Right to co-exist with other determinations: Clause 4 also functions as a legal assurance that the changes or specifications in this Determination are not intended to invalidate or supersede other determinations; affected parties retain the right to continue relying on specifications set in other instruments unless and until those instruments are otherwise amended.

• Implicit duty to ensure design fidelity: The descriptive entries for obverse O2 and each reverse R24-R31 are detailed in textual form (for example O2 describes inscriptions "ELIZABETH H", "AUSTRALIA", "1997") (Schedule Part 2). The implication is that authorized coin designs must reflect those precise inscriptions and motifs; those charged with die-making, engraving and design approval must ensure the textual and representational elements are present and correct.

• Implied duty to manage variants: The Schedule lists multiple variants for the same monetary denomination (for example more than one $1 coin with differing compositions, weights, dimensions and reverse designs). Entities that manage production runs, distribution and public guidance must distinguish between those variants operationally.

The Determination does not itself create criminal penalties or administrative sanctions (no penalty clauses appear in cl 1-4 or the Schedule). It therefore imposes technical manufacturing and design obligations without specifying standalone enforcement mechanisms within the instrument; enforcement, if any, must be addressed elsewhere in the Currency Act or other legal instruments.

Currency Determination No. 7 of 1996 does not contain express penalty or enforcement provisions within its text. The instrument is a technical specification of coin attributes and designs (cl 3(1); Schedule) and concludes with a non-derogation clause (cl 4), but it does not specify offences, fines, confiscation powers, or administrative enforcement mechanisms.

Because the Determination is made under subsection 13A(1) of the Currency Act 1965 (preamble), any enforcement, penalties or compliance mechanisms directed at contraventions of currency laws, or at the improper manufacture, alteration or circulation of coins, would be found in the parent statute or other subordinate instruments enacted under the Currency Act. The Determination itself does not reproduce or restate those enforcement provisions. Readers wishing to identify the sanctions that attach to failure to comply with coin specifications must therefore consult the Currency Act 1965 and any other relevant regulations or determinations made under it; those texts are outside this instrument’s four corners.

Operationally, the absence of embedded penalty clauses in this Determination means that the instrument functions primarily as a technical and descriptive standard. In regulatory practice this typically results in two immediate consequences, both implicit in the source but not addressed as enforcement in the text:

• Compliance monitoring and quality assurance fall to the administrative bodies with responsibility for coin production and issuance, and any non-compliance would be addressed under the statutory and administrative procedures provided elsewhere (cl 4 and the instrument’s statutory basis). The Determination provides the objective measurement and design criteria (weights, dimensions, edges, inscriptions) used by those monitoring and quality-audit processes.

• Any third-party legal disputes alleging non-compliance with coin specifications would require reference to the Currency Act or other instruments to determine enforceable remedies or sanctions; this Determination supplies the factual baseline for such disputes (for example, did the coin fall within the stated weight tolerance?). The Determination therefore plays evidentiary and normative roles without itself prescribing penalties.

In short, enforcement and penalties are not set out in this Determination. The instrument must be read alongside the Currency Act 1965 to identify the legal consequences of non-compliance.

The Determination is expressly made under the Currency Act 1965 (subsection 13A(1) referenced in the preamble) and thus forms part of the statutory regulatory framework governing currency specification in Australia. There are two explicit inter-actions with other legal instruments highlighted within the text:

• Cohabitation with other determinations: Clause 4 provides an express non-derogation statement , “This Determination does not affect any other determination of the specifications of a coin.” That places this Determination within a suite of determinations, each of which addresses particular coin specifications. The practical effect is that the Determination is additive; it must be interpreted together with earlier and later determinations that also specify coin properties.

• Cross-reference to Currency Determination No. 6 of 1996: The Schedule contains multiple notes stating that certain symbols or design codes (for example O1, E2, and R1-R23) are referred to in Currency Determination No. 6 of 1996 (Schedule Part 2, notes). That signals that the set of authorised symbols and designs is split across instruments and that a full understanding of the authorised coin design space requires consulting at least Currency Determination No. 7 of 1996 together with Currency Determination No. 6 of 1996 (Schedule Part 2, notes). Practitioners compiling compliance matrices or design catalogues must therefore reconcile this Determination with the referenced Determination No. 6 of 1996.

Other interactions that may be practically relevant but are not spelled out in this Determination include the relationship between coin-specification determinations and other bodies of law such as criminal law (counterfeiting, unlawful possession or defacement), customs and trade controls on precious metals, procurement and contract law for minting contracts, and tax law. None of those interactions are specified in this instrument. The Determination provides the technical baselines , metal composition, mass tolerances, dimensions, shapes, and design descriptions , that other legal frameworks may adopt as the standard against which compliance is measured. For example, a criminal prosecution for producing non-conforming coins would need to plead the statutory offence (if any) in the relevant Act and then tender the Determination as the technical standard by which non-conformity is assessed.

Finally, the Determination’s identification of obverse O2 (the Queen’s effigy with the inscriptions "ELIZABETH H", "AUSTRALIA", "1997") creates an interaction with any legal or administrative rules governing use of the sovereign’s effigy and inscriptions. Those governance rules are not in the Determination itself; they are external. The Determination supplies the content of the effigy and inscriptions to which such governance rules would apply.

In summary, Currency Determination No. 7 of 1996 is an instrument that sits within a larger statutory and administrative ecosystem. It expressly preserves other determinations and cross-references them; it supplies the technical standards that other legal and administrative frameworks will use for enforcement, procurement and cataloguing; and it must be read alongside the Currency Act 1965 and the referenced Currency Determination No. 6 of 1996.

Currency Determination No. 7 of 1996 itself contains no recorded amendments within the document provided. The instrument is dated 1996, is signed by the Assistant Treasurer, and explicitly notes commencement on 1 January 1997 (cl 1 and cl 2). The citation line identifies it as Currency Determination No. 7 of 1996, which indicates it is part of a numerical series of determinations issued in 1996.

The Schedule also contains cross-references to Currency Determination No. 6 of 1996, which shows contemporaneous activity in the same year and suggests a series of related determinations (Schedule Part 2 notes). Clause 4 states that this Determination does not affect any other determination of the specifications of a coin, which indicates that change management among determinations was intended to be incremental rather than supersessive.

This document, as presented, does not show any amending instrument, save that it sits in a sequence (No. 7) that presupposes the existence of earlier instruments (for example No. 6). No express revocation, repeal or modification clauses appear in the text. If one needs to establish the status of this Determination at a later date or determine whether it has been amended or repealed, the appropriate method is to consult the consolidated legislative database or the issuing authority’s instrument register for any subsequent determinations, amendments, or instruments that explicitly revoke or replace it.

The Schedule contains textual idiosyncrasies (for example the $10 entry reads "Not less man 99.9% silver") that appear to be typographical errors in the printed instrument; such errors do not, of themselves, evidence amendment but they can affect interpretation and may have been corrected in later reprints or consolidated versions. Because the instrument cross-references Currency Determination No. 6 of 1996 for certain symbols (O1, E2, R1-R23), any later amendments to those referenced determinations will also affect the combined, operational design space.

To summarise the amendment-history facts present in the instrument: it is made and dated 1996, commences 1 January 1997, is No. 7 in the 1996 series, and contains cross-references to No. 6 of 1996. The document does not itself contain subsequent amending text or a history trail of later modifications within its pages.

The Determination text does not identify any litigation connected to it. No cases, proceedings or judicial interpretations are cited or named in the instrument itself. The Schedule and the body of the Determination include only specifications, definitions and cross-references to other determinations; they do not record judicial review, challenges, or litigation outcomes.

Because the instrument is an administrative specification made under a statutory power, litigation could, in principle, occur later , for example, disputes over manufacturing conformity, the validity of a design, or the adequacy of cross-referenced determinations. However, the Determination itself contains no litigation history and names no cases. The Schedule does cross-reference other determinations (Currency Determination No. 6 of 1996), and any litigation concerning symbols defined only in those other determinations would appear in the record connected to those instruments, not in the present document.

Practitioners seeking litigation histories that involve this Determination must therefore consult court databases, authorised legislative histories and consolidated legislative instruments outside this Determination to determine whether any disputes have arisen involving these specifications, whether any judicial pronouncements have clarified ambiguous items (for example nomenclature or typographical errors), or whether any challenge has been brought to the Assistant Treasurer’s exercise of the power under subsection 13A(1) of the Currency Act 1965. None of that material, if it exists, is contained in this Determination.

The Schedule and the instrument contain several features and drafting particulars that can be the source of operational or interpretative pitfalls. These are matters of textual detail and cross-reference; they do not require external factual claims but identify where implementers should take care:

• Multiple variants per denomination: The Schedule lists several distinct coin variants under the same face-value denomination. For $1 there are at least three different composition/weight variants: a copper/aluminium/nickel $1 (9.00 ± 0.28 g, diameter 25.12 mm, thickness 2.80 mm, S1, E3, O2, R24/R25), a silver $1 (not less than 99.9% silver, 11.49 ± 0.23 g, same diameter/thickness, S1, E3, O2, R26), and a heavier silver $1 listed with weight "31.635+0.50" and diameter 40.60 mm thickness 4.00 mm S1 E1 O2 R27/R28 (Schedule Part 1). Operators must take care to treat these as distinct coin types even though they share the $1 face value.

• Variation in formatting or typographical errors: The $10 entry reads "Not less man 99.9% silver" (Schedule Part 1). That appears to be a typographical error for "Not less than 99.9% silver". Practitioners should be aware that typographical errors exist in the printed Schedule and should check authoritative consolidated sources or the instrument as gazetted if precision is required in a legal or procurement context.

• Alphanumeric reverse codes with embedded choices: R24 lists the inscriptions "(iv) "C", "S", "M", "B" or "A"." The meaning or operational significance of those letters is not explained in this Determination; implementers will need to refer to minting records, production orders or the cross-referenced Currency Determination No. 6 of 1996 (if relevant) to see how those letters are applied. The instrument itself does not define those letters further, creating potential ambiguity if the letters are significant (Schedule Part 2, R24).

• Cross-references to other determinations that contain required definitions: The Schedule notes that E2 and O1 and R1-R23 are defined in Currency Determination No. 6 of 1996. If any omitted or partially specified designs are relied upon in manufacture, the implementer must consult Determination No. 6 to get a complete specification. Failure to do so risks producing a coin that is non-conforming to the authorised combined set of determinations (Schedule Part 2 notes).

• Measurement convention for non-circular coins: Clause 3(2) defines diameter for non-circular coins as the distance between two parallel faces of the edge. Where shapes are polygons (S2 = a regular 24-sided polygon for the $5 coin), implementers must measure diameter using this rule; confusion could arise if a circular-diameter convention is mistakenly used (cl 3(2); Schedule Part 2). This matters where physical acceptance or automated sorting equipment relies on diameter.

• The distinction between mass tolerances: Some entries use a ± tolerance format (for example 9.00 ± 0.28 g) while one entry for a larger silver $1 uses the notation "31.635+0.50" rather than the ± form. The latter appears to indicate a tolerance or an arithmetic convention but is not in strictly parallel format; implementers and auditors should clarify whether the notation implies a one-sided allowance or is simply a typesetting variant of ± (Schedule Part 1).

• Obverse dating and inscription specificity: O2 specifies the obverse includes the inscription "1997" (Schedule Part 2, O2). Manufacturers must therefore ensure the dateline and inscriptions exactly match the text in the Schedule where O2 is used.

• The instrument contains commemorative and precious-metal descriptions (for example R27 explicitly states "1 OUNCE FINE SILVER" and other reverse descriptions mention historic motifs and monograms). These descriptive elements suggest the coins could be collector or bullion-style issues; practitioners should ensure contractual and operational arrangements for manufacture and distribution reflect the higher commodity value and possible segmentation of these products. The Determination itself does not discuss distribution or sales channels; that must be addressed administratively.

• No enforcement text in the Determination: The instrument sets standards but does not specify penalties or enforcement mechanisms (cl 1-4 and Schedule). Implementers who find non-conforming coins will need to consult the Currency Act 1965 and related instruments for remedies and enforcement procedures.

These "gotchas" are concrete textual features of the Determination that will affect procurement, manufacturing, measurement and archival tasks. They require attention because the Schedule mixes denominations, multiple variants, typographical irregularities and cross-references to other determinations.

Compliance with Currency Determination No. 7 of 1996 requires treating the instrument as an operative technical standard and applying its numerical tolerances and textual design descriptions when producing, approving, cataloguing or accepting the listed coins. The following steps set out concrete measures that parties affected by the Determination should take, grounded solely on the provisions and descriptions in the instrument:

1. Confirm applicability and consult related determinations:

   • Begin with the instrument’s legal basis: it is made under subsection 13A(1) of the Currency Act 1965 and commences 1 January 1997 (preamble, cl 2). Ensure the operative date is applicable to the production run.
   • Review other determinations, especially Currency Determination No. 6 of 1996, because the Schedule explicitly references symbols defined there (Schedule Part 2 notes). Clause 4 states the Determination does not affect other determinations; therefore compliance requires reading the suite of determinations together.

2. Map schedule entries to production orders precisely:

   • For each coin variant intended for production, extract the standard composition, standard weight and allowable variation, diameter, thickness, shape code, edge code, obverse and reverse codes as set out in the Schedule (Part 1).
   • Do not conflate distinct variants that share face value. For example, do not treat the 9.00 g copper/aluminium/nickel $1 coin as interchangeable with the 11.49 g silver $1 coin or the 31.635 g silver $1 ounce coin; each has distinct specifications (Schedule Part 1).

3. Implement measurement and quality-control procedures that use the Determination’s conventions:

   • Use the measurement rule in clause 3(2) for non-circular coins: interpret "diameter" as the distance between two parallel faces of the edge when measuring S2 coins or other polygonal shapes (cl 3(2); Schedule Part 2).
   • Apply the stated mass tolerances exactly as listed (for example 9.00 ± 0.28 g). Where the notation differs (for example "31.635+0.50"), clarify internally whether that is intended as ±0.50 or whether a one-sided tolerance is specified; consult the issuing authority if necessary (Schedule Part 1).

4. Ensure die design and inscriptions conform exactly to the textual descriptions:

   • For obverse O2, ensure the effigy and inscriptions appear exactly as described ("ELIZABETH H", "AUSTRALIA", "1997") (Schedule Part 2, O2).
   • For each reverse code R24-R31, match the motifs and inscriptions in the Schedule (Schedule Part 2). For items that include letters or variations (for example R24(iv) listing "C", "S", "M", "B" or "A"), record which variant is to be produced and confirm whether the letters represent mint marks, issue identifiers or other attributes with the issuing authority.

5. Maintain traceable production records:

   • Record the composition batch certificates, weight measurements, diameter and thickness checks, and photographic records of obverse/reverse dies for each production run. The Determination provides objective criteria that these records will be tested against; accurate records support compliance reviews and any future audit.

6. Address typographical or interpretative ambiguities proactively:

   • Where the printed text appears to contain typographical errors (for example "Not less man 99.9% silver"), seek guidance from the issuing authority or a consolidated instrument to confirm the intended wording before committing to production language (Schedule Part 1).
   • For ambiguous tolerance notations or unexplained letter codes in reverse descriptions, request authoritative clarification to avoid producing non-conforming pieces.

7. Reconcile product labelling, marketing and sales channels for precious-metal variants:

   • For coins described as "Not less than 99.9% silver" and coins explicitly labelled "1 OUNCE FINE SILVER", ensure that packaging, marketing and sale documentation accurately state composition and declared fineness as per the Schedule (Schedule Part 1; R27). While the Determination does not regulate advertising or sales channels, conformity between what is produced and what is advertised reduces legal and reputational risk.

8. Coordinate with administrative authorities for cross-determination issues:

   • Because clause 4 preserves other determinations, coordinate with the administrative authority that maintains the determinations to ensure the full set of applicable specifications is assembled when producing a coin that references symbols defined elsewhere.

9. Prepare for acceptance in downstream systems:

   • Operations that accept and process coins (for example cash handling equipment, vending operators) should be notified of the existence of multiple physical variants for the same denomination and provided with the dimensional and edge codes specified in the Schedule to update coin validators or sorting machines where necessary.

10. Keep the authoritative instrument on hand for disputes:

• Where a coin’s conformity is questioned (for example, weight outside the tolerance or missing inscription), rely on the text of this Determination (including cl 3(2) for measurement conventions and the Schedule’s descriptive text) as the primary specification. Maintain a link to the Currency Act 1965 to determine the legal consequences of non-conformity, since the Determination contains no enforcement provisions (cl 4; preamble referencing subsection 13A(1)).

Following these steps ensures that production and design work aligns with the textual and numerical standards set by Currency Determination No. 7 of 1996. Where the text is ambiguous or where the production process encounters variants not fully explained in this instrument (for example letter codes in R24 or cross-referenced symbols in No. 6 of 1996), the compliant course is to seek authoritative clarification from the issuing authority or to consult the consolidated legislative register.
