Currency Determination No. 5 of 1997

At its core the Determination is a technical specification instrument. The principal legal concept present in the text is the power to “specify” coin characteristics by administrative determination under statutory authority (the instrument is described as made “under subsection 13A(1) of the Currency Act 1965”). Clause 3 sets out a two-part mechanics: if a coin has the denomination and composition in columns 1 and 2, then the Determination “specifies” the standard weight (and variation) and the dimensions as set out in the Schedule. The Schedule is structured by columns that map denomination (Column 1), composition (Column 2), weight and allowable variation (Column 3), dimensions (Column 4) and design identifiers (Column 5). Part 2 of the Schedule decodes the design symbols (S1, E1, O3, R49-R52).

Conceptual elements and their legal functions in the text include:

• Prescriptive technical standard: the Determination prescribes numeric tolerances for weight (20.00 ± 0.50 g), and fixed linear dimensions for diameter (38.90 mm) and thickness (2.65 mm). These tolerances function as the authoritative manufacturing standard for that coin “kind” (clause 3 and Schedule Part 1).
• Composition specification: the coin’s “standard composition” is identified as the mix of copper, zinc, aluminium and tin. That composition is a mandatory identifier in the Schedule (Column 2).
• Design coding and descriptive obligations: the Schedule uses standardised codes (S1, E1, O3, R49-R52) with a textual key in Part 2 explaining each code. The obverse is described as “An effigy of the Queen, surrounded by the inscriptions: (a) ‘ELIZABETH II’; and (b) ‘AUSTRALIA 2000’” (Part 2, O3). Reverse codes R49-R52 are each described in text and include the inscription “Sydney 2000,” “5 DOLLARS,” and “a representation of the Olympic rings.”
• Non-displacement clause: clause 4 makes explicit that this Determination “does not affect any other determination of the specifications of a coin,” which is a legal limiter that keeps this instrument supplementary to existing determinations rather than exclusive.
• Commencement and citation mechanics: clause 1 gives the citation name, and clause 2 gives the commencement date, standard device for statutory instruments.

The instrument therefore combines the legal form of an administrative determination with the content of a minting specification and a symbolic design authorisation. It is not drafted as a policy exposition; instead it sets binding technical characteristics for a named coin kind and records who made the determination and when it commences.

The Determination’s immediate effect is on parties who produce, certify, accept, process, calibrate for, analyse or contest physical coins that match the denomination and composition entries in the Schedule. The instrument itself does not list stakeholders, but the text-driven implications are tractable from what is specified.

• Coin producers and designers: the Royal Australian Mint or any entity operating under contract to produce Commonwealth coinage must produce coins to the weights, tolerances, dimensions and designs given by clause 3 and the Schedule. The design descriptions in Part 2 (O3, R49-R52) fix the obverse effigy and the reverse commemorative motifs that manufacturers must reproduce.
• Designers, die-makers, engravers and suppliers: firms that supply dies, master tools, blanks and production services must work to the diameter 38.90 mm, thickness 2.65 mm and weight tolerance ±0.50 g. The composition “Copper, zinc, aluminium and tin” will affect alloy procurement and blank production.
• Cash handlers and financial institutions: banks, cash-in-transit firms and central depository operations that receive or process coin will need to recognise and accept the new $5 coin type and could need to adjust counting machines, sorting equipment and calibration parameters to the prescribed dimensions and weight tolerance.
• Operators of coin-accepting machinery: vending machine operators, parking metres, arcade and public transport equipment, and other coin validators that discriminate coin types by weight, diameter and edge style will need to ensure validators accept the new 38.90 mm, 20 g ±0.5 coin where intended.
• Retail and hospitality businesses: front-line staff handling cash must be familiar with the new design variants and with any distinguishing features (shape, edge, obverse/reverse imagery). This affects change-giving, acceptance, and counterfeit detection practices.
• Collectors and numismatic traders: the Schedule’s four reverse designs (R49-R52) mark distinct variants within the same denomination and composition; the Determination therefore creates collectible variants to be manufactured and distributed. The text’s explicit design descriptions (including Olympic rings and Sydney 2000 markings) define the official authorised imagery.
• Government agencies administering currency policy and legal instruments: agencies responsible for currency distribution, archival copies, and compliance with the Currency Act will act within the framework established by this Determination. Clause 4’s statement that it “does not affect any other determination” is relevant to administrators reconciling multiple determinations.
• Customs and trade regulators, and metal processors: the composition and size could be material to classification, stamping, recycling and metallurgical treatment operations.

The Determination itself does not create obligations on private persons to accept the coins as legal tender; the instrument simply specifies the physical and design characteristics. Whether acceptance is mandatory under other provisions of the Currency Act or other law is not stated in the Determination. The practical upshot is that those who manufacture, validate, distribute and process coin will bear the direct operational impact of the Determination’s specifications.

The Determination is a specification instrument rather than a rights-and-liabilities code. It does, however, produce de facto regulatory duties and authorisations that will shape behaviour.

Duties and operational requirements implicit in the text

• Manufacture to specification: where a coin “is of a kind having the denomination and standard composition specified in columns 1 and 2,” clause 3 makes clear the Determination “specifies” the standard weight, allowable variation and the dimensions for that coin kind. For manufacturers and anyone producing coins purporting to match that kind, the duty is to conform to the prescribed weight (20.00 ± 0.50 g), diameter (38.90 mm) and thickness (2.65 mm). The Schedule also requires shape S1 (circular) and edge E1 (milled).
• Reproduction of authorised designs: Part 2 of the Schedule identifies the obverse and reverse imagery (O3 and R49-R52). Anyone authorised to strike or issue this coin must reproduce those obverse and reverse elements as described , specifically, an effigy of the Queen with inscriptions “ELIZABETH II” and “AUSTRALIA 2000” on the obverse, and one of the four reverse motifs each using the inscriptions “Sydney 2000” and “5 DOLLARS” together with the Olympic rings.
• Non-interference with other determinations: clause 4 asserts this Determination “does not affect any other determination of the specifications of a coin.” The practical duty for administrators and manufacturers is to treat this Determination as additional to the body of determinations; it does not implicitly revoke or override other specification determinations.

Express rights and authorities in the instrument

• Administrative authorisation to specify: the Assistant Treasurer, acting for the Treasurer, exercises the statutory authority under subsection 13A(1) of the Currency Act 1965 to make specifications by determination. The instrument records that delegated administrative power has been exercised.
• Authorisation to use specified imagery: by setting obverse and reverse design requirements in the Schedule, the Determination functions as an authorisation to use the represented images and inscriptions on coins of the specified kind.

What the Determination does not do (explicit absences)

• It does not set criminal penalties, enforcement mechanisms or compliance sanctions. No penalty provisions are included in the text of this Determination itself. Any sanctions for non-compliance would need to be located in the Currency Act or other law, but the Determination does not specify them.
• It does not purport to modify or revoke other determinations. Clause 4 explicitly insulates other determinations from alteration by this instrument.

Because the Determination is narrowly drafted, the principal legal duties it creates are manufacturing and design conformity obligations for the specific coin kind. The rights it confers are administrative authorisation and formal recognition of a particular set of specifications and images for the $5 coin.

The Determination contains no express penalty, infringement or enforcement provisions. It is a statutory instrument that prescribes technical standards and descriptive approvals; it relies on the Currency Act 1965 and any other relevant statutes for enforcement and penalty mechanisms. The text records only the making authority , the Assistant Treasurer acting for the Treasurer under subsection 13A(1) , and the technical specifications in the Schedule.

Implications from the absence of penalties in the Determination

• Enforcement must be sourced elsewhere: because the Determination does not state sanctions, any legal consequences for failure to comply with the specifications would depend on other provisions of the Currency Act 1965 or other Commonwealth law. The Determination itself does not identify which statutory offences (if any) apply to the making or misuse of coin that does not conform.
• Administrative compliance likely handled by currency administrators: in practice, compliance with coin specifications is usually managed administratively by the agency responsible for minting and distribution. The Determination therefore functions as an internal or external specification that the mint or issuing authority will implement without prescribing penalties in the instrument itself.
• Private-sector non-conformity consequences are operational rather than criminal: businesses and operators of coin-accepting machines that fail to accept or correctly process the new coin would face operational or commercial disruption rather than an explicit statutory sanction supplied by this Determination. Conversely, the Determination does not create an express private right to sue for defective coin unless other law provides such remedies.

What the Determination does state about its legal operation

• Commencement: clause 2 sets the commencement date as 29 September 1997. From that date the specifications take effect for the purposes of the Determination.
• Non-effect on other determinations: clause 4 clarifies the instrument does not displace other determinations, which is relevant where enforcement or interpretation depends on reconciling multiple specification instruments.

Because the Determination does not offer enforcement detail, anyone needing to take enforcement action, bring prosecutions, or impose sanctions would need to consult the Currency Act 1965 and other relevant legislation or administrative rules outside this Determination to locate the applicable penalties and enforcement procedures.

The Determination is framed as an instrument under the Currency Act 1965, made pursuant to subsection 13A(1) as recorded at the heading. The Determination itself contains an explicit interaction clause: clause 4 states it “does not affect any other determination of the specifications of a coin.” This is the only express cross-reference or limitation within the instrument. No other statutes or regulatory instruments are cited in the text.

Interactions that follow from what the Determination does include the following structural relationships:

• Relationship with the Currency Act 1965: the Determination is exercisable under subsection 13A(1) of the Currency Act 1965. The Determination’s legal force is therefore derivative of the statutory grant in that Act. The Determination does not reproduce the statutory text and does not attempt to restate the Act’s enforcement or legal tender provisions; any such operative legal effects must be sourced to the Currency Act itself.
• Complementarity with other determinations: clause 4 makes clear this is additive to existing determinations. Administrators and users must reconcile this specification with prior determinations when determining the full set of authorised coin specifications.
• Interaction with intellectual-property, emblem or emblem-protection regimes: the Schedule expressly requires the “representation of the Olympic rings” on the reverse designs (R49-R52). The Determination itself does not address intellectual-property clearance, emblem protection, or rights to use the Olympic rings; it simply mandates the image on the coin. Any statutory protections concerning use of Olympic symbols would exist outside this Determination and would need separate clearance, licensing or statutory authority. The Determination does not record that such clearance has been obtained.
• Manufacturing and trade regulation: specifying composition and dimensions engages regimes that govern material sourcing, metal treatment, and potentially customs classification. The Determination provides the technical attributes that are inputs to those other regulatory regimes but does not directly regulate trade, taxation, import/export or industrial standards.
• Administrative law relationships: the Determination is an exercise of administrative power. Judicial review, procedural fairness, or other administrative law doctrines relevant to executive action under the Currency Act would interact with the instrument through the underlying statutory scheme, not through the Determination’s text. The Determination does not set out review pathways or appeal mechanisms.

Because the Determination is narrowly drafted and makes no express cross-references beyond the Currency Act authority and its non-effect clause, users seeking the full legal effect of producing, issuing, handling or refusing the coin must consult the Currency Act and any other potentially relevant Commonwealth laws for criminal, civil or administrative consequences, emblem or trademark restrictions, and procurement or licensing conditions.

The face of the instrument records the following chronological facts that constitute its amendment and provenance history within the document itself:

• Made date and authorising official: the Determination is dated 28 July 1997 and signed by C.R. Kemp, Assistant Treasurer, acting for the Treasurer. The text records the instrument as “Currency Determination No. 5 of 1997.”
• Citation and commencement: clause 1 gives the citation as “Currency Determination No. 5 of 1997” and clause 2 fixes the commencement date as 29 September 1997.
• No amendment clauses, savings or repeal: the Determination contains no internal amendment, transitional provisions, saving clauses or repeal words. It does include clause 4 stating it “does not affect any other determination of the specifications of a coin,” which is a non-displacement provision rather than an amendment or repeal. The Determination therefore appears, on its face, to be a standalone specification added to the body of determinations in 1997.
• Schedule content stability: the Schedule records multiple lines for the same denomination and composition, each with the same weight and dimensions but differing reverse code (R49-R52). This pattern indicates the Determination was intended to authorise multiple distinct reverse designs for a coin series rather than to record changes across time.

The instrument does not record any subsequent amendments, revocations or consolidations. It does not include an editorial history or note of prior determinations that it modifies. Given clause 4’s express non-effect on other determinations, any later changes to the same coin specifications would be recorded in subsequent determinations or amendments published separately under the Currency Act framework. To determine whether later instruments have amended, superseded or revoked this Determination a user must consult the official legislative instrument registers, the Currency Act legislative history and any subsequent determinations numbered after 1997. The Determination on its face gives no further amendment history.

The Determination contains no references to litigation, court decisions, judicial interpretation, or legal disputes. The text is a technical prescribing instrument and does not cite cases or judicial authorities. There is no record in the instrument itself of any legal challenge, declaratory proceedings or administrative appeals relating to the Determination.

Because the Determination is silent on litigation, any judicial treatment, review applications, or case law discussing or interpreting this Determination would need to be located by searching external court and tribunal databases for proceedings that reference “Currency Determination No. 5 of 1997,” the specific coin specifications, the design codes O3, R49-R52, or subsection 13A(1) of the Currency Act 1965. The Determination itself does not list parties, registries, or proceedings, and does not summarise any prior disputes.

For practical purposes, advisers researching litigation consequences should use this Determination as the primary source for what was specified in 1997 and then search administrative and judicial databases for any disputes about manufacturing, issuance, intellectual-property claims over the Olympic symbols used on the reverse designs, or enforcement actions under the Currency Act that reference these exact coin specifications.

The Determination is short and technical, but several practical pitfalls and interpretive risks arise from its language and structure.

1. The Determination does not state whether the coins are legal tender or prescribe acceptance obligations. The instrument “specifies” physical characteristics and design elements (clause 3 and Schedule). It does not state acceptance rules. Users who interpret the specification as automatically conferring a right to demand acceptance should instead check the Currency Act 1965 for legal tender provisions. The Determination alone does not answer legal-tender questions.

2. Clause 4’s “does not affect any other determination” can create apparent overlap rather than clarity. Multiple determinations can coexist. Where a practitioner is reconciling coin specifications across instruments, clause 4 requires attention: this Determination does not displace prior specifications, so conflicting dimensions or composition requirements may persist in other determinations. The safe approach is to compile all relevant determinations to determine the complete authorised specification set for any denomination.

3. Multiple identical rows for the $5 entry mask that the schedule authorises several reverse variants. The Schedule presents several $5 rows with identical composition and weight/dimensions but distinct reverse codes (R49-R52). A reader scanning the table might assume duplication or error. In fact the instrument intends to authorise a suite of reverse designs for the same denomination and composition. Practically, manufacturers and collectors will need to distinguish the variants by R-code and by the detailed text in Part 2.

4. The composition description is generic: “Copper, zinc, aluminium and tin.” The Schedule does not specify percentages or an alloy name. That leaves an implementation gap: manufacturing tolerances for elemental composition and specification of acceptable blanks are not set in this Determination. Producers must therefore rely on internal minting standards or other technical guidance for precise alloy formulations.

5. The obverse inscription includes “AUSTRALIA 2000.” The Determination was made in 1997 and the obverse inscription contains the year 2000 in the obverse inscription. Practitioners should note that the dated inscription is a design choice and will affect collectors’ dating perceptions and legal descriptions. The text explicitly records that O3 includes the inscription “AUSTRALIA 2000” (Schedule Part 2).

6. Use of protected symbols is not discussed. The reverse designs require the Olympic rings to be “a representation of the Olympic rings.” The Determination does not address licensing, trademark clearance or statutory protections for Olympic emblems. Anyone responsible for issuing or distributing the coins should be alert to separate legal regimes that may govern the use of Olympic symbols even though the Determination itself mandates their presence on the coin.

7. No enforcement or penalty detail in the Determination. As discussed above, the Determination does not state which statutory offences (if any) apply to manufacturing, reproducing, mutilating or counterfeiting coins that purport to be of the specified kind. Users must consult the Currency Act and other Commonwealth laws for enforcement mechanisms.

8. Precision needed for validators and coin-operated devices. The specified diameter (38.90 mm), thickness (2.65 mm) and weight tolerance (±0.50 g) are precise. Coin validation systems that use thresholds must be adjusted to accept the new coin without accepting counterfeits or rejecting acceptable specimens. Because composition affects electromagnetic signature and density, validators tuned only to diameter and weight may still reject a coin if they rely on composition-based sensing.

9. No production volumes or distribution policy. The Determination authorises the specification and design elements but does not set minting quantities, issue dates, packaging, sale price to collectors, or distribution channels. These commercial and administrative decisions lie outside this instrument.

10. The Determination does not revoke prior portraits or effigies. The obverse O3 is one of many potential effigies. Clause 4 means that other obverse designs authorised elsewhere remain in place. For record-keeping and cataloguing, it is necessary to map O3 to other O-codes authorised in other determinations to avoid mislabelling coins.

These “gotchas” are interpretive and operational risks that arise from what the Determination includes and what it leaves to external statutes, administrative practice, or technical standards.

Compliance obligations fall into two categories: (1) obligations for coin issuers and producers to ensure manufactured coins conform to the Determination, and (2) practical compliance steps for downstream users (banks, cash handlers, machine operators, retailers and collectors) who must accept, handle or process the coins.

For issuers, minting authorities and manufacturers

• Follow the Schedule’s numeric tolerances: manufacture blanks and strike coins that meet the standard weight and allowable variation, 20.00 ± 0.50 g, a diameter of 38.90 mm and a thickness of 2.65 mm, as specified in Part 1 of the Schedule and required by clause 3.
• Use the prescribed composition: ensure alloy formulations reflect the Schedule’s stated “Copper, zinc, aluminium and tin” composition. Because the Determination does not specify exact percentages, adopters must refer to internal mint specifications, procurement contracts or other technical guidance to determine exact alloy ratios acceptable for production quality and stability.
• Reproduce the specified obverse and reverse designs: ensure the obverse is “An effigy of the Queen, surrounded by the inscriptions: (a) ‘ELIZABETH II’; and (b) ‘AUSTRALIA 2000’” (Part 2, O3). For reverse variants R49-R52, reproduce the motifs and inscriptions verbatim as described in Part 2, including the Olympic rings and the inscription “Sydney 2000” and the denomination inscription “5 DOLLARS.”
• Ensure tooling and dies match codes: ensure dies and master tooling are annotated with the relevant code (S1, E1, O3, and R49-R52) to track production batches and to provide specimens for validators and testers.
• Maintain quality control within ±0.50 g weight tolerance: coin blanks and struck coins must be tested in production to demonstrate weight and dimensional conformity. Keep records and measurement logs because the Determination defines exact tolerances but not enforcement procedures.
• Coordinate emblem clearances where necessary: although the Determination requires Olympic imagery, the instrument does not address any separate emblem or trademark clearances. The mint or issuer should ensure any necessary approvals for use of Olympic symbols have been obtained before wide distribution.

For banks, cash handlers and coin processors

• Obtain official specimens and technical data sheets: request specimen coins and technical measurement details from the issuing authority to recalibrate coin-sorting and counting equipment. The Determination provides dimensions and weight but not electromagnetic signatures; a specimen will enable accurate calibration.
• Calibrate validators and sorting equipment: update validator software and mechanical gates to accept diameter 38.90 mm, thickness 2.65 mm and weight 20 g ±0.5, and to recognise the milled edge E1 and circular shape S1.
• Update internal reference catalogues and recognition guides: ensure front-line staff, counterfeit detection teams and automated handlers have images and descriptions of O3 and R49-R52 variants to reduce rejection of genuine specimens and to prevent the acceptance of visually similar counterfeits.
• Revise cash handling procedures and acceptance training: train tellers and retail staff to identify the new $5 pieces, including their reverse variants. Provide guidance for suspicious specimens that fall outside the tolerance or appear to be unauthorised reproductions.

For vending, parking and other machine operators

• Test machines with specimen coins: physical testing with authorised specimens is necessary because composition affects a coin’s electromagnetic response as well as density. Adjust validators to the Determination’s parameters and confirm that coins are accepted reliably while minimising counterfeit acceptance.
• Review firmware and settings: where coin validators have firmware thresholds or software libraries for coin IDs, add entries that match the numeric and electromagnetic profile associated with the specified composition and dimensions.

For retailers and the public

• Recognise multiple reverse variants: be aware that the $5 coin will appear in several reverse designs (R49-R52). Treat each as the same denomination if they match the dimensions and inscriptions in the Schedule.
• Maintain suspicion protocols for coins outside tolerances: if a coin materially deviates from weight or dimension tolerances set in the Schedule, handle it according to existing policies for suspected counterfeit or foreign coin.

For legal and procurement teams

• Document authorisations and statutory basis: keep a copy of the Determination and record the subsection 13A(1) authority for audit and legal compliance purposes. Clause 1 and 2 provide citation and commencement details for record-keeping.
• Reconcile with other determinations: because clause 4 affirms non-effect on other determinations, compile any other Currency Determinations relevant to the $5 denomination to confirm whether multiple specifications apply and to determine if there are conflicting provisions requiring administrative clarification.

Record-keeping and quality assurance

• Keep manufacturing and distribution records proving conformity to weight and dimensional tolerances and to design reproduction requirements.
• Retain samples of struck coins and die proofs tied to the R-code for provenance and to support future verification requests.
• Maintain correspondence or licences related to the use of the Olympic rings if such approvals were required, even though the Determination does not itself discuss those procedural clearances.

In short, compliance means reproducing the coin within the numerical and descriptive parameters set out in clause 3 and the Schedule, managing the operational impacts on downstream coin handling systems, and ensuring any separate emblem or intellectual-property obligations associated with the use of Olympic imagery have been addressed outside the Determination.
