Currency Determination No. 4 of 1999

The instrument rests on several interlocking concepts. The first is denomination: the face value of the coin, expressed in dollars. The coins carry face values of $30, $25 or $1. The face value does not reflect the market value of the precious metal content; it is a legally assigned value for the purposes of being legal tender. The second concept is standard composition: the minimum purity of the precious metal. For the $30 coin and all $1 coins, the composition is not less than 99.9 per cent silver. For the $25 coin, the composition is not less than 99.99 per cent gold. These are high purity standards typical of bullion coins. The third concept is standard weight and allowable variation: each coin has a target weight (the standard weight) and a permitted range of deviation. For example, the 1 kilogram silver coin (item 101) has a standard weight of 1002.502 grams and an allowable variation of plus or minus 1.500 grams. The gold coin (item 102) has a standard weight of 7.807 grams and an allowable variation of 0.030 grams. The $1 silver coins (items 103 to 115) each have a standard weight of 31.635 grams and an allowable variation of 0.500 grams. These tolerances are critical: they define the acceptable manufacturing tolerance and are the benchmark against which a coin is judged to conform to the determination. A coin falling outside the allowable variation in weight is technically not a coin specified by the determination and would not be legal tender. The fourth concept is dimensions: each coin has a specified diameter and thickness. For instance, the 1 kilogram coin has a diameter of 101.00 mm and a thickness of 14.60 mm. The gold coin has a diameter of 20.10 mm and a thickness of 2.00 mm. The $1 silver coins all have a diameter of 40.60 mm and a thickness of 4.00 mm. These dimensions ensure uniformity for handling, stacking and authentication. The fifth concept is design, broken into shape, edge, obverse and reverse. The shape for all coins is circular (symbol S1). The edge is either milled (E1) or, for the 1 kilogram coin, an eight segment edge with four milled and four plain segments (E2). The obverse (O1) is standard across all coins: an effigy of Queen Elizabeth II surrounded by inscriptions stating "ELIZABETH II", "AUSTRALIA", and the denomination in words. The reverse designs are unique to each coin and are described in detail in Part 2 of Schedule 1. These descriptions include the inscriptions, images, colours (for the dragon coin) and privy marks (for many of the Kookaburra series coins). The final concept is privy mark: a small distinguishing symbol added to a coin to denote a specific edition, mint or theme. Many of the Kookaburra coins carry privy marks representing months of the early Roman Republican calendar, including representations of deities, emperors and numerals. These marks are part of the official design specification and must be present for the coin to conform to the determination.

The primary entity directly affected by this instrument is the Royal Australian Mint, which is the body responsible for producing Australian circulating and commemorative coins. The Mint must ensure that every coin struck under the authority of this determination meets the exact specifications for weight, composition, dimensions and design. This imposes a manufacturing discipline and quality control obligation. Any deviation beyond the allowable variation would render the coin non compliant and would expose the Mint to potential legal challenge or refusal of the coin as legal tender. The instrument also affects the Treasury and the Minister for Financial Services and Regulation (now the Treasurer or Assistant Treasurer), who has the power to make and amend such determinations. The instrument governs the issuance of coins that are legal tender, and therefore affects the Commonwealth's monetary arrangements, albeit in a minor way given these are bullion and commemorative coins rather than circulating coinage.

A second category of affected parties is bullion dealers and precious metal traders. These entities buy, sell and trade in Australian bullion coins. The specifications set out in the determination provide the legal definition of what constitutes an authentic Australian $1 silver bullion coin, a $25 gold nugget coin, or a $30 kilogram silver coin. Dealers rely on these specifications when authenticating coins and when pricing them. A coin that does not conform to the weight or dimension tolerances is not a coin issued under the determination and may trade at a discount or be rejected by the market. The instrument thus creates a de facto quality standard that underpins the secondary market for these coins.

A third group is collectors and investors. The determination matters to them because it defines the exact physical characteristics of the coins they buy. The presence of detailed design descriptions, including privy marks, means that variations in design are legally prescribed. A coin missing a privy mark that is part of the specification (for instance, the "Basler Stab" on the gold nugget coin or the monthly privy marks on the Kookaburra series) would not fit the specification. This can affect collector value and resale. Collectors may also use the determination to verify that a coin is genuine and matches the official issue.

A fourth, more diffuse group is exporters and customs authorities. Australian bullion coins are exported internationally. The determination provides a reliable reference for customs declarations, valuation and tariff classification. It also serves as an anti counterfeiting tool: the precise specifications allow authorities and buyers to test coins against the official standard.

The instrument does not impose duties on ordinary consumers or businesses that merely hold or spend these coins as legal tender. However, if a business accepts a coin as payment, it may need to verify that the coin conforms to the determination if there is any doubt about authenticity.

The instrument imposes one principal duty: the duty on the Royal Australian Mint to produce coins that conform to the specifications in Schedule 1. Section 3 of the instrument states that it "specifies, for a coin having the denomination and standard composition specified in columns 2 and 3 of Part 1 of Schedule 1, the standard weight, the allowable variation from that weight, the dimensions and the design specified in columns 4, 5 and 6 of that Part." This is a directive to the Mint. If the Mint issues a coin that does not meet those specifications, the coin would not be a coin "specified" by the determination and would not have the legal status of a coin issued under the Currency Act 1965. The practical consequence is that the Mint must maintain strict quality control procedures to ensure that each coin falls within the allowable variation for weight, matches the diameter and thickness, and bears the correct obverse and reverse designs.

A corollary duty, though not expressed in the instrument, is the duty of the Mint not to issue coins that deviate from the specifications, even if the deviation is minor. The allowable variation provides a tolerance, but any coin outside that tolerance fails.

For private parties, the instrument creates no direct duties. There is no obligation on a person to accept these coins as legal tender; the Currency Act 1965 governs the legal tender status of coins, and that Act sets limits on the amount of coins that must be accepted in payment. The determination does not alter those limits.

The rights created are largely implicit. The instrument confers a right on the Mint to produce and issue coins with these specifications as legal tender, subject to the Currency Act 1965. It also confers a right on holders of such coins to use them as legal tender up to the limits set by the Currency Act. Furthermore, the instrument creates a right of reliance: a person who acquires a coin that matches the specifications can be confident that it is an official Australian coin. Conversely, if a coin does not match the specifications, the holder has no right to treat it as an official coin, and the Mint would have no obligation to redeem it or treat it as legal tender.

In terms of enforcement, the determination is not self enforcing. If a dispute arises over whether a coin conforms, the determination provides the objective standard. A court or tribunal could refer to this instrument to decide the issue. But the instrument itself does not create a private right of action. Any enforcement would be under the broader Currency Act (for counterfeiting, for example) or under contract or consumer law if a trader misrepresents a coin as conforming when it does not.

The Currency Determination 1999 (No. 4) does not itself prescribe any penalties. It is a specification instrument, not a penal instrument. Enforcement and penalties arise under the parent Act, the Currency Act 1965, and under other Commonwealth laws such as the Criminal Code (Cth) for counterfeiting or fraud. The determination is relevant to enforcement because it provides the authoritative benchmark for what constitutes an authentic Australian coin of the types it covers. If a person counterfeits a coin that purports to be one of these specified coins, the prosecution must prove that the counterfeit coin does not meet the specifications set out in this determination. The determination is thus evidence of the standard.

The key penalties that could be relevant are those for counterfeiting currency under the Criminal Code, which carries significant custodial sentences. A person who makes a false coin that resembles a coin specified in this determination with the intention that it be used as genuine commits an offence. The determination would be used to establish the genuine specifications against which the counterfeit is compared. Similarly, a person who alters a genuine coin (for example, by removing metal to reduce its weight below the allowable variation) would be dealing with a coin that no longer meets the specification. That could constitute an offence of interfering with currency.

Another area is fraud in the bullion market. If a seller misrepresents a coin as conforming to the determination (for example, selling a coin that is underweight or of lower purity), the seller may face charges under the Australian Consumer Law for false or misleading representations. The determination provides the objective standard for truthfulness of the representation.

For the Mint itself, there is no direct penalty for issuing a non conforming coin. However, if the Mint issued a coin that did not meet the specification and that coin was later found to be defective, the Commonwealth could face civil liability for issuing a product that was not as specified. The instrument also acts as a constraint on the Mint's discretion: it cannot change the specifications without a new or amending determination.

The instrument also creates a potential compliance burden for importers and exporters. If a trader imports a coin that is represented as an Australian coin of a type covered by this determination, but the coin does not meet the specifications, the trader may be in breach of customs regulations or trade practices law. The Australian Border Force could detain such coins and require proof of compliance.

Overall, the enforcement architecture relies on the determination as a reference point. The actual punishment and enforcement mechanisms are located in other statutes, but the determination is a necessary evidentiary component.

The instrument is made under subsection 13A(1) of the Currency Act 1965 and must be read as part of that Act. The Currency Act 1965 is the primary law governing Australian coins and currency. Section 13A specifically empowers the Minister to determine specifications for coins. This determination is one of a series of such determinations; section 4 of the instrument states that it does not affect any other determination of the specifications of a coin. This means that different determinations can coexist for different coin types. For example, there may be a separate determination for circulating coins (such as $1 and $2 coins) and for other bullion or commemorative issues. The instrument operates independently but in parallel.

The instrument also interacts with the Australian Consumer Law (ACL), contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth). If a coin is sold with a representation that it conforms to this determination, the ACL imposes a guarantee that the goods correspond with their description. If a coin does not match the weight, purity or design specifications, the seller may be liable for a breach of the consumer guarantees. The determination provides the objective standard for what "conforms" means.

The instrument interacts with tax laws, particularly the A New Tax System (Goods and Services Tax) Act 1999. The GST treatment of precious metal coins depends on whether they are legal tender and their purity. Coins that are legal tender and of a purity of at least 99.9 per cent (for silver) or 99.5 per cent (for gold) are generally input taxed or GST free when supplied by an approved refiner or dealer. This determination helps establish that these coins meet the legal tender requirement. The determination's specifications of purity (99.9 per cent for silver coins, 99.99 per cent for the gold coin) are directly relevant to GST treatment.

The instrument also interacts with anti money laundering and counter terrorism financing laws under the Anti Money Laundering and Counter Terrorism Financing Act 2006 (Cth). Bullion dealers and entities dealing in these coins may be subject to reporting requirements and due diligence obligations. The determination helps identify the coins as Australian legal tender, which can affect the regulatory classification.

There may be interactions with state and territory stamp duties, though these have been largely phased out for precious metals. The determination can help establish that a coin is legal tender, which may affect duty treatment.

Finally, the instrument sits alongside other Commonwealth determinations and standards for coinage. None of them are displaced by this instrument. It is a narrow, additive piece of delegated legislation.

The source text provided for this deep dive is the determination as made on 7 September 1999. The text does not record any subsequent amendments. However, it is important to note that as a legislative instrument made under the Currency Act 1965, it may have been amended or superseded by later determinations. The Currency Act 1965 allows for multiple determinations to be made over time, and later determinations could specify new coins or new specifications for existing coin types. The fact that this determination is numbered "(No. 4)" indicates that it was one of a series of at least four determinations made in 1999. There may have been subsequent determinations in later years that specified similar or different coins. Without access to the Federal Register of Legislation or the official legislative history, it is not possible to confirm whether this particular determination remains in force or has been repealed or varied. The instrument states that it commences on gazettal, but does not include a sunset clause. Under the Legislation Act 2003, legislative instruments are subject to automatic repeal after 10 years unless they are exempted or remade. Given that this instrument was made in 1999, it would have been repealed automatically on 1 April 2005 or similar date under the sunsetting provisions that applied at the time, unless it was specifically exempted or remade. The user should check the current status on the Federal Register of Legislation. The key point for a practitioner is that this instrument may no longer be in force. The specifications it contains may have been superseded by later determinations. Relying on this determination without verifying its current status would be risky. The determination itself does not provide any amendment history because it is the original instrument. The source text includes no footnotes, amending instruments or explanatory statement. This is a limitation that the user must address by conducting a current search.

The source text provided for this deep dive does not record any litigation history. There are no cases mentioned, no references to court proceedings, and no legal challenges referenced in the instrument or its schedules. Given the narrow technical nature of the determination, this is unsurprising. Litigation over coin specifications is rare. Disputes could theoretically arise if a coin was alleged to fall outside the allowable weight variation or to have an incorrect design. A buyer might sue a seller for misrepresentation if a coin did not match the specification. A counterfeiting prosecution would necessarily rely on the specification as evidence. But there is no indication in the source of any decided case involving this particular determination. The user should conduct a search of case law databases (such as AustLII or Westlaw) for references to "Currency Determination 1999 (No. 4)" or "Currency Act 1965 s 13A" to see if any cases have cited this instrument. It is possible that the determination has been cited in passing in cases about coin authenticity or in taxation rulings, but no such citation appears in the source. The absence of litigation history may indicate that the coins covered by this determination have not been the subject of significant legal disputes. This could be because the Mint's quality control has been effective, because disputes are resolved privately, or because the coins are low volume and rarely contested. It could also mean that the determination has been superseded and is no longer operative, so disputes are now governed by later determinations. In any event, the source provides no litigation data. A careful analyst would note this as a gap and advise the user to conduct independent research.

Several aspects of this instrument could catch out the unwary. The first is the weight tolerance. The allowable variations are narrow: 1.500 grams on a 1 kilogram coin, 0.030 grams on a 7.807 gram gold coin, and 0.500 grams on a 31.635 gram silver coin. A coin that is slightly underweight due to wear, cleaning or a manufacturing defect could fall outside the tolerance and would not be a coin specified by the determination. A buyer who acquires such a coin may find it is not accepted as legal tender or may trade at a discount. Dealers should weigh coins precisely and compare to the standard.

The second gotcha is the privy marks. Many of the Kookaburra coins (items 105 to 115) have privy marks that are part of the official design. The privy marks for this series are all based on the early Roman Republican calendar, with representations of deities, emperors and month symbols. A coin that is missing its privy mark or has a different privy mark is not a coin specified by this determination. This is significant because the determination names 12 distinct Kookaburra coins (R187 to R198), one for each month of the year 2000. A collector who acquires a coin purporting to be one of these issues must verify that the privy mark matches the description. For example, the reverse R187 includes a circular privy mark of the God Janus; R188 includes an oval privy mark representing Februa. A mix up would mean the coin does not conform.

The third gotcha is that the determination may no longer be in force due to sunsetting. As noted under amendment history, legislative instruments made before 2005 were subject to automatic repeal after 10 years unless exempted. The user must check the current status.

The fourth gotcha is the face value versus metal value. The $1 silver coin has a face value of $1 but contains one troy ounce of 99.9 per cent silver, which has a market value far above $1. This does not affect the instrument's operation, but it means the coins are not used as circulating currency. They are bullion investment products. The legal tender status is mainly relevant for GST and regulatory purposes. A business that accepts these coins at face value would be making a poor trade.

The fifth gotcha is the design descriptions are legally binding. The reverse designs are described in detail, including colours for the dragon coin ("pad printed in yellow" and "pad printed in purple"). If the Mint produced a coin with a different colour or without the specified colouring, it would not conform. This is a high level of specificity that could cause compliance problems if the Mint changed its printing process.

The sixth gotcha is that section 4 says this determination does not affect any other determination. This means that if a later determination specifies the same coin with different tolerances, the later determination would control for new issues, but this determination would remain in force for coins issued under it. The interaction can be confusing.

The seventh gotcha is the edge specification for the 1 kilogram coin: it is E2, meaning eight segments with four milled and four plain. This is an unusual edge type. A buyer expecting a standard milled edge might think the coin is defective. The specification confirms it is correct.

Compliance with the Currency Determination 1999 (No. 4) falls primarily on the Royal Australian Mint, but secondary compliance obligations affect dealers, collectors and importers.

For the Royal Australian Mint, compliance means establishing manufacturing processes that ensure every coin struck matches the specifications in Schedule 1. This requires quality control checks for weight, diameter, thickness and design. The Mint must weigh each coin or a statistically significant sample against the standard weight and ensure it falls within the allowable variation. It must verify that the silver purity is at least 99.9 per cent and the gold purity at least 99.99 per cent. It must ensure that the obverse and reverse designs match the descriptions in Part 2 exactly, including the colour pad printing on the dragon coin and the privy marks on the Kookaburra series. Any deviation means the coin is not compliant and should not be issued. The Mint should also keep records of production batches and test results to demonstrate compliance in the event of a dispute.

For bullion dealers and precious metal traders, compliance means only buying and selling coins that meet the specification. When acquiring coins from the Mint or from other sources, dealers should verify the weight, dimensions and purity. This is particularly important for the Kookaburra privy mark series: each month's coin has a distinct privy mark, and a dealer should ensure that a coin described as a "January 2000 Kookaburra" actually bears the Janus privy mark (R187). A simple visual check of the reverse design against the determination's description is prudent. Dealers should also weigh coins, especially if they are circulated or handled, to confirm they remain within the allowable variation. A coin that has been clipped or worn below the minimum weight is no longer compliant.

For collectors and investors, compliance means knowing the specifications and using them to authenticate coins. A collector purchasing a $1 silver coin dated 2000 should verify that its weight is between 31.135 g and 32.135 g, its diameter is 40.60 mm, and its design matches the relevant reverse from R186 to R198. The determination provides the authoritative reference. A collector who suspects a coin is non compliant can refer to this instrument and may have grounds to reject the coin or seek a refund from the seller.

For importers and exporters, compliance means ensuring that any coin described as an Australian coin of the types covered by this determination actually meets the specifications. Customs declarations should accurately reflect the coin's specifications. If a coin does not meet the weight or purity standard, it may not qualify for preferential tariff treatment or GST free status. Importers should obtain certificates of authenticity from the Mint or from reputable dealers confirming that the coins conform to this determination.

Finally, legal practitioners advising clients on coin related matters should verify the current status of this determination on the Federal Register of Legislation. If it has been repealed or superseded, the applicable instrument will be different. They should also consult the Currency Act 1965 and any relevant taxation rulings. The determination alone is insufficient to give complete advice; it must be read alongside the parent Act and other laws.
