Currency Determination No. 1 of 1994

This Determination operates as a technical standard-setting instrument. The core concepts in the instrument, each repeated with variations across denominations, are:

• Composition and minimum fineness: Each clause stipulates the standard metal composition in percentage terms (for example cl 4(1) "not less than 99.9% silver"; cl 10(1) "not less than 99.99 % gold"; cl 11(1) "not less than 99.95 % platinum"). These are absolute minimum purity thresholds for the "standard composition" of the coin as prescribed in that clause.

• Physical attributes and tolerances: For each denomination the Determination specifies (a) shape (all are circular: cl X(2)); (b) edge (all prescribed as milled: cl X(3)); (c) standard weight and permitted variation (numerical values and allowed deviations appear in each clause, e.g. cl 4(4)-(5)); (d) diameter (millimetres; e.g. cl 4(6)); and (e) thickness (millimetres; e.g. cl 4(7)). The instrument therefore establishes both nominal specifications and acceptable manufacturing tolerances.

• Obverse and reverse design elements: The obverse requirement is uniform: an effigy of the Queen with inscriptions "ELIZABETH II", "AUSTRALIA", and the denomination, encircled by raised beads inside the rim (see, for example, cl 4(8), cl 10(8), cl 12(8)). The reverse varies by issue: animal motifs (kookaburra, koala, kangaroo), legends indicating series ("THE AUSTRALIAN KOOKABURRA", "THE AUSTRALIAN KOALA", "THE AUSTRALIAN NUGGET"), weight/metal legends (for example "1 OZ. 999 SILVER", "1 OZ. 9999 GOLD", "1 KILO 999 SILVER"), and the year, which the Determination restricts to "1994" or "1995" (repeated in each reverse-inscription clause). Some reverse designs include additional portraits or representations of obverses of historic coins (for example cl 6(9)(b), cl 7(9)(b), cl 8(9)(b) include "a representation of the obverse of a coin bearing an effigy of King Edward VII", "King George V", "Queen Victoria" respectively).

• Series and denomination variants: The instrument provides multiple variants for specific denominations (notably several $2 variants and both gold and platinum versions for many denominations). Each variant is separately specified as a clause, which means the Determination functions as a schedule of authorised issues with discrete technical parameters.

• Temporal and identification constraints: The repeated specification that reverses bear "1994" or "1995" limits the authorised dated designs to those two years (e.g. cl 4(9)(b)(ii), cl 10(9)(b)(ii)). The citation and commencement clauses (cl 1-2) and the Gazette note identify the instrument’s enactment and notification.

These concepts combine to create a set of mandatory, clause-by-clause manufacturing and design rules that a mint or authorised manufacturer must meet to have a coin conform to this Determination. The instrument is a prescriptive technical standard rather than a policy statement; its text focuses narrowly on specifications, inscriptions and permissible manufacturing variance.

The Determination directly governs parties responsible for producing, authorising and issuing Commonwealth coins and any contractors or mints acting for them. The instrument itself does not name particular bodies beyond the Parliamentary Secretary to the Treasurer as maker (preamble) and does not list a mint or private entities. Practically, however, the affected actors are the persons or bodies who must ensure coins comply with the listed specifications if those coins are to be issued under Commonwealth authority. That group typically includes:

• The maker(s) of the coins or the mint contracted to strike coins. The Determination prescribes exact weights, dimensions, composition and designs (for example cl 4(4)-(7) for $1; cl 12(4)-(7) for $10). A mint must meet those specifications to produce coins that conform to the Determination’s legal standard.

• Designers, engravers and die-makers, who must translate the required obverse effigy text and reverse motifs into physical dies that precisely reproduce the inscriptions and the raised beads inside the rim (see recurring phrase "all encircled by raised beads inside the rim of the coin" in many clauses, for example cl 4(8)-(9)).

• Assayers, quality-control and compliance officers within the minting apparatus, who must measure and certify that each coin conforms to the clause-specific weight and variation tolerances (for example compare standard weight and variation in each clause: cl 4(4)-(5); cl 10(4)-(5); cl 12(4)-(5)). The Determination supplies numeric tolerances that are central to assay acceptance.

• Custodians of official insignia and intellectual property managers, insofar as obverse effigies and inscriptions ("ELIZABETH II", "AUSTRALIA") and representations of historic obverses (cl 6(9)(b), cl 7(9)(b), cl 8(9)(b)) may require rights clearance or official approval.

• Officials responsible for cataloguing and issuing coins, because the Determination prescribes denominations, dates and metal content that affect inventory, pricing (for bullion coins) and public sale descriptors (e.g. cl 20(9)(b)(i) "THE AUSTRALIAN NUGGET 1 OZ. 9999 GOLD"; cl 17(9)(b)(i) "THE AUSTRALIAN KOOKABURRA 1 KILO 999 SILVER").

Indirectly affected groups include sellers and purchasers of authorised coins (dealers, investors, collectors), because the Determination defines the authorised properties and date range of Commonwealth-issued bullion and collector coins, which affects their market description and provenance. The Determination also affects assay labs and customs officials who may need to verify that items offered as Commonwealth-authorised coins conform to government-prescribed standards (weight, diameter, fineness and inscriptions).

Clause 3 ("This Determination does not affect any other determination of the specifications or design of a coin") signals that other determinations remain relevant actors for affected parties to consult; issuers and manufacturers cannot treat this Determination as necessarily exhaustive for all legal standards governing coin design and specifications.

Finally, although the Determination contains no penalty provisions, any enforcement, counterfeit or legal tender questions would arise under the Currency Act 1965 or other laws; the Determination’s primary effect is to set the required specifications which downstream actors must meet to produce coins that, in practice, will be recognised as authorised Commonwealth coinage designs for the stated years and metals.

The Determination itself imposes mandatory design and technical standards rather than explicit administrative duties or private rights. Reading the instrument as a set of prescriptive legal norms yields the following practical duties and corresponding implied rights:

Duties imposed by the text (express or implied by mandatory phrasing)

• Duty to adhere to composition and fineness: For any coin produced under an identified clause, the standard composition must include at least the minimum stated fineness (for example cl 4(1) requires not less than 99.9% silver for the $1 coin; cl 10(1) requires not less than 99.99 % gold for the $5 gold coin). Compliance requires procurement and assay processes that confirm metal content.

• Duty to meet dimensional and weight specifications within permitted variation: Each clause sets a "standard weight" and allows a specific weight variation (for example cl 12(4)-(5): standard weight 312.347 g, variation 1.00 g). A manufacturer must ensure coins fall within those tolerances; otherwise the resulting item would fail to conform to the Determination’s specification.

• Duty to reproduce specified obverse and reverse devices and inscriptions: Obligations regarding the effigy and inscriptions are mandatory in the language used (for example cl 4(8)-(9), cl 10(8)-(9), cl 12(8)-(9)). The obverse must bear an effigy of the Queen and the required inscriptions; the reverse must bear the specified animal motif and precise inscriptions referencing series, weight and fineness, plus the year "1994" or "1995".

• Duty to adopt edge and rim features: All clauses prescribe a milled edge (cl X(3)) and that inscriptions and devices be "encircled by raised beads inside the rim" (recurring across clauses), so manufacturing must include those features.

• Duty to respect the clause-specific combinations of metal, motif and date: The Determination ties a specific reverse motif and bullion legend to a particular metal, weight and year range (for example cl 17(9)(b)(i) "THE AUSTRALIAN KOOKABURRA 1 KILO 999 SILVER"; cl 26(9)(b) "THE AUSTRALIAN NUGGET 1 KILO 9999 GOLD"). Compliance therefore requires strict matching of metal and legend.

Implied rights and entitlements

• Right to produce coins that conform to the Determination: If a coin is produced in accordance with the applicable clause, the maker will have produced a coin that matches an authorised design and specification under the Determination. That confers the practical right to describe the item as meeting the Determination’s prescribed features.

• Right to use the prescribed inscriptions and devices: The Determination authorises , by prescription , the use of specific effigies, animal motifs and inscriptions for coins conforming to its clauses. That is a limited usage right for the authorised designs as specified.

• Right to rely on the Determination alongside other determinations: Clause 3 explicitly preserves "other determination[s] of the specifications or design of a coin", which implies that makers and issuers retain the right to look to other determinations to support other authorised or alternative designs and specifications.

What the Determination does not do (absence of duties or rights in the text)

• It does not set minting quotas, sales terms, pricing, or legal tender status in the text. The instrument does not contain express administrative processes, nor does it contain penalty or enforcement clauses. It does not expressly delegate further discretions. It does not state who may or may not strike coins beyond the maker named in the preamble.

• It does not create express private rights of action or remedies for third parties who believe a coin is non‑conforming. Any remedy or enforcement relating to non‑compliance would need to be located in the Currency Act 1965 or other legislation; this Determination does not itself provide those mechanisms.

Because the Determination is a technical standard, implementers must read its specific numeric and textual requirements carefully. Obligations are granular (weights, diameters, thicknesses, inscriptions and bead encirclement) and form the operative duties for production and design. Rights are instrumental and arise from complying with the specified standards and being able therefore to claim that coins meet the Determination.

The instrument contains no express penalty clauses, enforcement mechanisms, or administrative sanctions. A careful reading shows:

• No penal provisions: Nowhere in the text are offences, fines, or enforcement processes prescribed. The Determination solely lists design and specification requirements clause by clause (cl 4-27) and contains administrative formalisms (citation, commencement, application: cl 1-3). There is no clause imposing penalties for non‑conforming coins or for wrongful use of the inscriptions or effigies.

• No procedural enforcement steps for determining compliance: The Determination does not set out inspection, certification, or assay procedures, nor does it require record-keeping or reporting by the issuer or the manufacturer.

• Interaction with enforcement will be by reference to other law: Clause 3 explicitly states the Determination "does not affect any other determination of the specifications or design of a coin", which implies that this instrument is part of a broader regulatory and legislative framework. Enforcement mechanisms, offences relating to counterfeiting, unlawful issuance, or misuse of Commonwealth insignia would, if they exist, be located in the Currency Act 1965 or other Commonwealth statutes. The Determination itself is silent on those matters.

Consequences and compliance risk for manufacturers and sellers

• Non‑conforming coins would not meet the Determination’s technical description. While the Determination does not say what legal consequence follows from a coin not meeting its specification, the practical consequence is that such a coin could not be described truthfully as complying with the Determination’s specified design and may therefore be excluded from being treated as an authorised issue under whatever broader statutory regime governs minting and legal tender. The Determination alone, however, does not state any remedy.

• Ambiguities in the instrument (see "Gotchas" below) create enforcement-risk and compliance uncertainty. Where inscriptions or dimensions are ambiguous because of typographical or textual anomalies, litigated disputes or administrative decisions about compliance could arise. The Determination provides no internal mechanism to resolve such ambiguities.

• Practical enforcement is therefore a matter for the statutory framework that empowered the Parliamentary Secretary to make the Determination (the preamble cites subsection 13A(1) of the Currency Act 1965), and for any contracts, minting agreements, procurement frameworks and criminal statutes that govern counterfeiting and unauthorised issuance. The Determination must be read in that statutory and contractual environment to identify actual legal penalties and enforcement processes.

In short, the Determination prescribes standards but does not itself specify penalties or enforcement procedures. Parties seeking to understand consequences for non‑compliance must therefore consult the Currency Act 1965 and any associated determinations, contracts or statutory penalty provisions, because this instrument is limited to technical specification.

The Determination is expressed as being made under subsection 13A(1) of the Currency Act 1965 (preamble). The instrument does not reproduce that subsection or other provisions of the Currency Act. The text includes an express non‑derogation clause: "This Determination does not affect any other determination of the specifications or design of a coin" (cl 3). From the instrument’s wording the following interactions and interpretive relations emerge:

• Primary statutory source of authority: The preamble states the Parliamentary Secretary to the Treasurer makes the Determination under subsection 13A(1) of the Currency Act 1965. The instrument therefore sits as an exercise of a delegated statutory power. The Determination’s legal force and scope derive from that enabling provision and any limitations or procedural requirements contained in the Currency Act 1965 (not included in the text provided).

• Coexistence with other determinations: Clause 3 expressly preserves other determinations; this is an internal limiting rule that prevents readers from assuming the 1994 Determination is exhaustive for all Commonwealth coin specifications. Implementers must therefore consult other determinations when assessing which designs and specifications are authorised at any given time. The Determination does not repeal or supersede other determinations.

• Technical standard as part of broader regulatory architecture: The Determination supplies technical manufacturing and design specifications. Questions about legal tender status, criminal liability (counterfeiting), trademark and emblem usage, customs classification, taxation and sale of bullion/collector items are not addressed in the text. Those issues are therefore matters of other laws and regulatory instruments; the Determination will interact with those laws by providing definitional content (e.g. what constitutes an authorised $1,000 gold coin of 1994 with a specific fineness).

• Federal Register and Gazette notification: The Determination includes a Federal Register of Legislative Instruments identifier (F2008B00102) and a Gazette notification note (NOTE 1). Those references indicate publication and registration steps that may be relevant for determining the Determination’s legal effect, commencement and discoverability. Whether other statutory disclosure or parliamentary scrutiny requirements applied is not stated in the instrument.

• Contractual and procurement interfaces: The Determination’s technical requirements will be referenced in contracts and procurement documents with mints or subcontractors; such commercial documents will need to reflect the numeric tolerances, inscriptions and motifs prescribed in the Determination, and to reconcile the Determination’s non-exhaustive statement (cl 3) with other determinations.

• Interpretive and evidentiary function: For disputes about whether a coin is an authorised Commonwealth issue or whether it meets an authorised specification, the Determination will be a primary piece of documentary evidence containing the formally issued design and specification requirements for the specified denominations and date range. That evidentiary role will be exercised alongside the Currency Act and any other determinations.

Because the Determination is technical and silent on enforcement, licence and minting procedures, any legal queries about criminal or civil consequences, or about the process to obtain authorisation to strike coins, must look to the Currency Act 1965 and other administrative instruments, regulations and contracts which this Determination does not reproduce.

The instrument as presented contains metatext indicating its publication: "Notified in the Commonwealth of Australia Gazette on 1994. 9401240" (NOTE 1) and includes a Federal Register of Legislative Instruments identifier (F2008B00102). Beyond those publication references, the text itself does not record any intra-document amendments or show tracked changes. The Determination contains multiple clauses introduced under separate clause numbers (cl 4-27), each prescribing specifications for particular denominations and variants.

Key observations about amendment and variation potential, grounded in the text provided:

• Standalone Determination form: The structure (citation, commencement, application, enumerated clause schedule of specifications) is consistent with a single Determination instrument intended to be applied in full from the stated commencement date (cl 1-2). The Determination does not include an express revocation or amendment clause nor any savings provisions.

• Clause 3 expressly preserves other determinations: That clause functions as a limiting provision rather than an amendment history note. It means this Determination neither supersedes nor invalidates other determinations of coin specifications. Any subsequent Determination altering specifications would likely coexist with or supplement the present Determination unless expressly repealed, but the present text itself does not amend or revoke other instruments.

• No in-text record of subsequent amendments: The copy of the Determination provided does not display marginal notes, inserted amendment markings, or textual annotation suggesting later changes. The inclusion of the Federal Register identifier F2008B00102 suggests at least that the Determination has been registered electronically or indexed with that identifier. The instrument does not state that it was later amended; the text we have should be treated as the original Determination text as notified in the Gazette in 1994.

• Practical relevance of later instruments: Because the Determination explicitly leaves other determinations unaffected (cl 3), later determinations, regulations or instruments could have amended the practical field of authorised coins. The document does not itself catalogue those changes. Users must therefore consult the Currency Act 1965's subordinate instruments register and the Federal Register of Legislative Instruments, using the identifier F2008B00102, to discover any subsequent amendments, revocations or related instruments. The Determination text itself contains no internal amendment history.

• Typographical anomalies that could prompt amendment: The Determination contains several textual irregularities (for example cl 16(7) thickness "1.9G millimetres", cl 21 refers to "S100" rather than "$100", some inscriptions include image placeholders inline). These anomalies create an argument for later corrigenda or amending notices; the text as provided, however, contains no corrigenda clause or amendment log.

In short, the Determination as supplied does not document a subsequent amendment history; its clause 3 preserves other determinations rather than recording changes. To establish an authoritative amendment record, users must consult Commonwealth legislative instruments registers and Gazette archives referenced in the instrument (F2008B00102; Gazette notice 9401240).

The Determination contains no references to legal proceedings, court decisions, or litigation outcomes. The text does not cite any case law nor record disputes or judicial interpretations. Given that the instrument is a technical standard, the absence of internal litigation references is to be expected. The document itself does, however, contain features that create interpretive and implementation risks which could be the subject of litigation or administrative challenge; those risks are identified below within the confines of the Determination’s text.

Potential areas of dispute that could give rise to litigation or administrative contest (text‑based, not claims of existing cases):

• Ambiguities and typographical errors: The Determination contains textual anomalies that may affect interpretation (examples catalogued in "Gotchas" below). Disputes could arise over the correct reading of particular numeric specifications (for example thickness "1.9G" in cl 16(7)), inscriptions containing inline image placeholders, or denomination typographical errors (cl 21 uses "S100"). Such ambiguities can generate litigation over whether a produced coin complies with the Determination.

• Multiple clauses for the same denomination: The instrument contains several clauses that purport to specify different $2 reverse designs (cl 5-9). A dispute could arise if a party asserts that only one of the clauses authorises issuance of a particular $2 design, while another party treats multiple clauses as independent authorisations. Clause 3 ("does not affect any other determination") further complicates the statutory map by leaving other determinations extant. Litigation could address whether the various clause‑by‑clause specifications are mutually exclusive, sequential, or concurrently operative.

• Interpretation of representations of other obverses: Several clauses require the reverse to include "a representation of the obverse of a coin bearing an effigy of" historic monarchs (e.g. cl 6(9)(b), cl 7(9)(b), cl 8(9)(b)). A dispute might arise about what constitutes an authorised or sufficiently faithful "representation", particularly where copyright or heraldic design rights are implicated. The Determination does not define "representation" or set tolerances for that element.

• Compliance and evidentiary disputes: Because the Determination prescribes precise weights and variations, factual disputes over whether a given coin meets the weight tolerance or fineness standard could generate litigation. The instrument does not specify assay procedures or the authoritative measurement method. Parties may contest assay methodology and sample selection, but such litigation would be about facts governed by external legal standards not provided in this Determination.

• Relationship with other determinations and subsequent instruments: Clause 3 preserves other determinations. Litigation could therefore arise about priority and applicability where this Determination and other determinations conflict. The instrument does not set rules for resolving conflicts among determinations; that would be a matter for the enabling statute and possibly judicial interpretation.

The Determination’s silence on enforcement mechanisms and the absence of an internal amendment log mean that any actual litigation history would be found only by checking court records and the enabling statute’s litigation record. The text itself contains no litigation history to report.

The Determination contains several textual characteristics and drafting features that create compliance, interpretation and implementation risks. These "gotchas" are literal textual points readers should note because they affect manufacture, compliance testing and legal clarity. Each item below cites the clause or relevant textual fragment.

1. Repeated and overlapping clauses for identical denominations: The Determination contains multiple stand-alone clauses that each purport to set out specifications for the same denomination, notably the $2 coin (cl 5, cl 6, cl 7, cl 8, cl 9 are all headed "Specifications and design of a $2 coin"). Each clause prescribes the same physical dimensions and weight tolerances, but differs in reverse device detail (different representations of monarchs or kookaburra groupings). This structure means implementers must read clause numbers, not headings, to determine the authorised reverse designs and metals. Failure to match the clause number to the intended reverse would lead to non‑conformity.

2. Inline image placeholders and corrupted inscriptions: Several reverse inscription lines include inline image placeholders such as "" or appear to have extraneous punctuation or characters (e.g. cl 10(9)(b)(i) "THE AUSTRALIAN NUGGET OZ. 9999 GOLD"). Those placeholders interrupt the text of the required inscriptions and create ambiguity about the exact typography to be struck on the coin. Designers and die-makers must seek authoritative source art because the text alone is not self-contained.

3. Typographical and punctuation errors in numerals and symbols: Examples include clause 21 which reads "This clause sets out the specifications and design of a coin of the denomination of S100" rather than "$100". Clause 16(7) specifies thickness "1.9G millimetres" (the letter "G" appears where a numeral or decimal point would be expected). Clause 23(9)(b) and others end with a missing closing quotation mark or semicolon in "1994"; these errors create interpretive uncertainty about the precise inscription punctuation and layout.

4. Inconsistent percentage formatting and spacing: The fineness percentages are inconsistently spaced and punctuated across clauses, for example "99.99 % gold" (cl 10(1)) vs "99.99% gold" elsewhere. While minor from a semantic perspective, the lack of uniformity could complicate transcription into die images and cause literal non‑conformity if a mint follows one rendering over another.

5. Weight tolerances vary by issue and sometimes appear numerically tight: The Determination uses a mix of absolute weight tolerances (for example cl 4(5) allows 0.500 g on a 31.635 g coin, cl 12(5) allows 1.00 g on a 312.347 g coin). Manufacturers must ensure production and assay methods can reliably meet those tolerances; small errors or measurement method differences could lead to a coin falling outside the specified tolerance.

6. Year restriction: Each reverse inscription contains the year "1994" or "1995" as the only options (recurrent across clauses). That constrains what dated coins are authorised under the clause. A coin struck with a different year inscription would not match the prescribed reverse text in the Determination.

7. Lack of procedural or assay guidance: The Determination prescribes numeric and visual standards, but provides no measurement method, sample size, statistical acceptance criteria or assay method. Where a manufacturer’s internal QA uses a different testing method, disputes could arise. The Determination gives no guidance on whether the weight variance is to be applied per-coin or as a manufacturing batch tolerance.

8. No cross-reference to effigy approval process: The obverse is required to bear "an effigy of the Queen" (recurrent). The Determination does not specify which effigy design (artist, portrait style) or whether modifications are permitted. In practice, the right effigy form may be governed by other administrative approvals; the Determination itself leaves that open.

9. Multiple metal versions of identical denominations may cause market confusion: Several denominations have both gold and platinum versions (e.g. $5 in cl 10 (gold) and cl 11 (platinum)). Each version uses the same denomination inscription ("5 DOLLARS") but different metal legends. Sellers and buyers must ensure correct labelling to avoid misrepresenting metal content; the Determination does not prescribe any consumer-facing disclosure beyond the reverse inscription.

10. Clause 3's non-exclusivity: The plain wording that the Determination "does not affect any other determination" means issuers and manufacturers must search for other determinations in force that might add, modify or authorise alternative specifications and designs. Relying solely on this Determination without checking for other determinations risks non‑compliance with broader or subsequent instruments.

These textual and structural issues generate concrete compliance tasks: manufacturers must obtain authoritative die art and official typographic guidance; assay labs must agree on measurement technique and sampling; legal advisers must check for other determinations and reconcile potential conflicts; and procurement contracts must specify which clause is being implemented. The Determination’s text therefore creates non-trivial operational and interpretive friction that must be resolved before coins can be reliably produced and sold as conforming.

Compliance requires translating the Determination’s clause-level technical prescriptions into manufacturing, quality assurance, legal and commercial processes. Because the Determination sets precise numeric and visual requirements but contains no procedural detail, implementers should adopt the following concrete, source‑grounded steps. Each step references the Determination text as the controlling specification.

1. Identify the correct clause for the intended coin issue

   • Each authorised design and specification is set out in a particular clause (cl 4-27). Do not rely on the heading alone, because multiple clauses use identical headings for the same denomination (notably cl 5-9 for $2). Instead, specify the clause number in procurement documentation to identify the exact reverse design, metal requirement, weight, diameter and thickness.

2. Procure and verify metal composition and fineness per clause

   • For the chosen clause, meet the minimum fineness stated (for example cl 4(1) "not less than 99.9% silver"; cl 10(1) "not less than 99.99 % gold"; cl 11(1) "not less than 99.95 % platinum"). Ensure metal suppliers provide assay certificates and chain-of-custody records. Consider third-party assay of incoming metal batches to confirm compliance.

3. Implement manufacturing tolerances and QA to match weight/size specs

   • Use the clause’s standard weight and permitted variation as acceptance criteria (for example cl 4(4)-(5) for $1; cl 12(4)-(5) for $10). Configure production controls (press force, blanking tolerances) and QA sampling such that the measured weight, diameter and thickness of finished coins conform. Because the Determination provides numeric tolerances but no testing methodology, record the measurement methods used and the devices’ calibration certificates to support conformity claims.

4. Obtain or reproduce authorised effigy and reverse artwork accurately

   • The obverse requirement is consistent: "an effigy of the Queen" and specific inscriptions (for example cl 4(8)). The reverse inscriptions must exactly match the clause text, including series legend, bullion weight and fineness legend, and year, which is limited to "1994" or "1995" (cl X(9)(b)(ii)). Given the instrument’s inline image placeholders and typographic anomalies, obtain authoritative design artwork and text specifications from the issuing authority or the official archives referenced by the Government Gazette/Federal Register entry (F2008B00102; Gazette notice 9401240) to ensure literal conformity to the authorised die art.

5. Ensure edge and bead features match the clause

   • All clauses prescribe a milled edge (cl X(3)) and that devices be "encircled by raised beads inside the rim". These are recurring mandatory features; include them in die specifications and inspection checklists.

6. Record and certify conformity in contract and documentation

   • Contracts with subcontractors, assayers and sale agents should reference the specific clause number and require warranty of conformity to the clause’s composition, weight, diameter, thickness, edge and inscription requirements. Given the Determination does not set out enforcement steps, contractual warranties and indemnities will be the primary commercial protection.

7. Keep accurate assay and production records for each production lot

   • Because the Determination sets precise technical standards but not testing regimes, preserve sample assay results, calibration records, weighing logs and photographic evidence of obverse/reverse inscriptions for each batch. These records will be the primary evidence of compliance in any administrative, civil or reputational dispute.

8. Cross-check other determinations and regulatory instruments

   • Clause 3 preserves other determinations. Before production or marketing, search the relevant Commonwealth legislative instruments registers (the instrument cites Federal Register identifier F2008B00102) and the Gazette archives (note 9401240) to confirm whether any other determinations constrain or supplement the specification in question, or whether later instruments amend or supersede any aspects.

9. Resolve textual anomalies through authoritative confirmation

   • Where the Determination text displays typographic anomalies (for example cl 16(7) "1.9G millimetres", cl 21 "S100", or inline image placeholders in inscriptions), obtain formal written confirmation from the issuing authority about the intended numeric or textual content. Do not rely on a literal reading of the corrupted text to design dies.

10. Plan for marketing and labelling that distinguishes metal variants

    • Many denominations have both gold and platinum variants. Ensure that packaging, sales literature and assay certificates explicitly state the metal, fineness and the specific clause number so that buyers understand whether they are purchasing the gold or the platinum variant (for example $5 gold per cl 10(1) vs $5 platinum per cl 11(1)).

11. Ensure year dating conforms to allowed years

    • Reverse inscriptions repeatedly limit the date to "1994" or "1995" (see, for example, cl 4(9)(b)(ii), cl 10(9)(b)(ii)). If a coin is to be dated differently, do not claim conformity with this Determination.

12. Legal and IP clearance

    • For reverse representations that include "a representation of the obverse of a coin bearing an effigy of" historic monarchs (cl 6(9)(b), cl 7(9)(b), cl 8(9)(b)), verify that use of such representations complies with any relevant heraldic, portrait rights or administrative approvals. The Determination authorises these representations as design elements, but practical use and reproduction may require retrieval of the authorised die art and any licensing or administrative consents that the issuing authority controls.

13. Plan for external assay and dispute resolution

    • Because the Determination does not provide test methodology, agree contractually with purchasers and assay labs about the authoritative measurement techniques (e.g. temperature, equipment, averaging method) that will be used in any dispute. Include dispute-resolution processes in manufacturing and sale contracts.

In short, compliance is a matter of translating clause-level numeric and visual requirements into engineering and administrative practices, and of resolving textual ambiguities by obtaining authoritative source art and clarification from the issuing authority or contract counterparty. The Determination provides the technical target; implementers must establish measurement methods, documentation trails and contractual protections to manage the absence of procedural detail in the instrument.
