Currency Determination 1999 (No. 1)

The instrument rests on a small set of interlocking concepts that determine how to read and apply the schedule.

• Ministerial source of authority. The determination is framed as being made by the Minister for Financial Services and Regulation under subsection 13A(1) of the Currency Act 1965. The text at the head of the instrument identifies the Minister as the decision maker. That is the institutional node that issues the technical specifications.

• Applicability by matching denomination and composition. Section 3 explains the matching rule: the specification applies “for a coin having the denomination and standard composition specified in columns 2 and 3 of Part 1 of Schedule 1” and then prescribes weight, variation, dimensions and design in the later columns. The operative trigger is the combination of denomination and composition, not just denomination alone.

• Technical specification elements. Each listed coin is specified across several discrete technical fields in the table: standard composition (column 3), standard weight and allowable variation in grams (column 4), diameter in millimetres and thickness in millimetres (column 5), and design attributes defined by codes for shape, edge, obverse and reverse (column 6). The codes are shorthand; Part 2 maps each code to a textual description. For instance, S1 is “Circular” (item 201); E1 is “Continuously milled” (item 202); O3 is an effigy of Queen Elizabeth II with inscriptions “ELIZABETH II” and “AUSTRALIA 2000” (item 207); R135 is a specific Olympic‑themed reverse featuring wattle and emus and the letter P or C (item 218).

• Design coding and modularity. The use of discrete codes (S1, E1, O3, R128 etc) creates a modular way to describe many coin variants without repeating long descriptions in the main schedule. Part 2 is integral; the codes do not stand alone. Any assessment of compliance or manufacture requires reference to both Part 1 and Part 2.

• Tolerances and metrological certainty. Specified weights are accompanied by an allowable variation in grams. For example items 101-107 ($5 copper alloy) each specify 20.000 ± 0.500 g. High‑value items have smaller relative tolerances, for example item 112 ($100 gold) at 10.021 ± 0.020 g. The table therefore establishes both nominal targets and acceptable production tolerances.

• Multiple variants for the same denomination. The Schedule contains multiple entries for the same face value with different compositions and designs. For example, items 101-107 are $5 in a copper alloy; items 108-111 are $5 in 99.9% silver with different reverse codes (R135-R138). There are many $1 1 oz silver items (121-141) that share the same composition and dimensions but differ by reverse code. The instrument therefore anticipates multiple coexisting variants for single denominations distinguished by composition and design.

• Interaction with imagery and inscriptions. The obverse descriptions reference the effigy of Queen Elizabeth II and different surrounding inscriptions including year markers (1999, 2000) and monograms such as ‘IRB’ and ‘VP’. Reverse imagery ranges from sport and Olympic themes (R128-R140), historic reverse reproductions (R141-R145), bullion series designs (R148-R169) to city or regional privy marks. Several reverse descriptions include the letter P or C, and some include representations in Olympic colours or gold cameo. These are part of the required design features under the determination.

• Scope limitation. Section 4 limits the instrument to the specifications contained in the Schedule and preserves other determinations; it does not purport to be exhaustive of all coin law or administrative arrangements regarding issue, legal tender status or minting authority.

Taken together, those concepts establish the determination as a technical catalogue for a defined set of coin issues, each precisely described so as to guide manufacture, identification and, implicitly, legal recognition of those specific designs and metrological properties.

The determination identifies, by specification rather than by named entities, the set of coins that are subject to these technical requirements. The practical audiences and actors affected by the instrument include the following categories as implied by its content.

• The maker of coinage. The instrument is a specification for production. Any entity called upon to manufacture coins that meet the listed denomination and composition must follow the weights, tolerances, dimensions and designs set out in the Schedule. The determination itself is silent as to the identity of the minting authority or contractor; the instrument presumes that the relevant manufacturing function operates under the authority conferred by the Currency Act 1965 and Ministerial determinations.

• Holders and users of currency. The listed items include small‑value circulating denominations (5c, 10c, 20c, 50c, $1, $2) and a wide array of commemorative, bullion and high‑value pieces ($5, $30, $100, 1 oz and 1 kg silver). Entities that accept, handle, store or process coins will be affected in the sense that the appearance, weight and dimensions of accepted coins are defined by this instrument. For example, coin sorting, vending machine calibration, banking and cash‑handling equipment must accommodate the specified dimensions and weights for the enumerated variants.

• Dealers, collectors and secondary markets. The schedule distinguishes many variants by design code and composition. Coin dealers, numismatists and auction houses need to reference the Schedule to identify particular strike variants, composition, privy marks and commemorative inscriptions. The determination embeds details such as privy marks (for example R148-R169 privy marks P100 and place names) that will determine collector grading and identification.

• Reference and compliance officers. Compliance officers or lawyers advising on currency specifications will rely on the Schedule to confirm design and metrology for legal, audit, insurance and valuation purposes. The instrument is the official text that defines what constitutes those particular forms of coin.

• Public procurement and supply chains. Any procurement contract for coin blanks, dies, or minting services must incorporate the specifications in Schedule 1. The table is granular: for instance the $30 1 kg silver coin (item 142) is specified at 1002.502 ± 1.500 g with diameter 101.00 mm and thickness 14.60 mm. Such exact figures must be met by suppliers.

• Entities affected indirectly. Although the determination does not create tax, customs, trademark or licensing provisions, the presence of imagery such as “Sydney 2000” and the Olympic rings, plus references to national symbols, may have indirect implications for licensing, event sponsorship, or intellectual property management for institutions that use similar motifs. The instrument itself does not regulate those outside matters.

The instrument does not itself name the administrative entity responsible for enforcing compliance with the specifications, nor does it allocate costs for production or distribution. Section 4 explicitly disclaims any effect on other determinations of coin specifications, which preserves the possibility that other instruments or parts of the Currency Act address issue, authentication, legal tender status and enforcement. The immediate decision maker is the Minister identified in the instrument; the parties who physically act on the determination are the persons or agencies that manufacture, issue or handle the listed coins.

The determination is primarily prescriptive rather than rights‑conferring. It creates specific, technical duties by imposing clear measurable requirements; it does not articulate remedial rights, penalties, or procedural rights within its text.

Key duties created by the instrument

• Duty to adopt the listed specifications where a coin is issued in the denomination and composition identified. Section 3 states the operative rule: the determination “specifies, for a coin having the denomination and standard composition specified in columns 2 and 3 of Part 1 of Schedule 1, the standard weight, the allowable variation from that weight, the dimensions and the design specified in columns 4, 5 and 6.” That establishes a duty, for the issuer or manufacturer, to conform to the tabulated specifications for any coin matching the denomination and composition.

• Duty to apply the design codes as explained. The design entries in Part 1 are expressed as codes (S1, E1, O3 etc). Part 2 explains each coded element in textual terms. Conformity requires that the obverse, reverse, edge and shape match the textual descriptions in Part 2 corresponding to each code. For instance O3 must include “An effigy of Queen Elizabeth II, surrounded by the inscriptions ‘ELIZABETH II’ and ‘AUSTRALIA 2000’” (Part 2 item 207).

• Duty to respect tolerances and dimensions. The weight tolerances and dimensional measures are precise. Production must achieve the standard weight within the allowable variation listed. Example: item 112 ($100 gold) requires 10.021 ± 0.020 g. Item 142 requires 1002.502 ± 1.500 g. The maker must ensure final pieces conform to those tolerances.

• Duty to observe composition descriptions. Each entry identifies a “standard composition” (for instance “99.9% silver”, “Copper, zinc, aluminium, tin”, “99.9% gold”). Where composition is part of the matching rule in s 3, manufacture and assay must correspond to the composition declared in column 3.

Express rights or procedural entitlements

• No rights or procedures are created in this text. The instrument contains no clause granting private persons any entitlement to require production, minting, replacement, redemption, compensation or dispute resolution. It does not specify who may challenge non‑conforming coins or how to seek relief. Those procedural and remedial matters are outside this instrument and would need to be found in the Currency Act 1965 or other instruments.

Implicit operational expectations (not rights)

• The Schedule’s structure presumes the authority to produce coins in accordance with Ministerial direction and that those producing coins will have access to the appropriate dies, privy marks and minting technology to reproduce the obverse and reverse imagery described. The instrument does not itself allocate dies or production runs.

Limits and caveats in the instrument

• Section 4: “This determination does not affect any other determination of the specifications of a coin.” That means the document is not intended to displace other determinations. Where another determination overlaps or differs, that other instrument remains in force. The determination therefore sits alongside, rather than supplanting, other specification law.

• Absence of enforcement or certification. The instrument contains no certification, inspection, or enforcement procedure within its text. Any duty of proof or method to establish a coin’s compliance with the specification is not set out here.

In short, the determination creates technical duties of specification and conformity concerning composition, weight, dimension and imagery for enumerated coins. It does not set out procedural rights, enforcement processes or remedies; those would have to be sourced elsewhere.

The determination contains no express penalties, sanctions or enforcement procedures. The text is silent on who inspects coins, who certifies conformity, and what remedies are available for non‑compliance. Section 4 states the determination “does not affect any other determination of the specifications of a coin,” but does not itself provide enforcement mechanisms.

What the instrument contains

• No criminal or civil penalty clauses. Nowhere in the four operative sections (ss 1-4) or in Schedule 1 are offences, fines, or enforcement procedures specified.

• No administrative machinery. The instrument does not appoint inspectors, specify inspection regimes, or create administrative powers to seize non‑conforming coinage. It likewise does not provide an administrative appeal pathway against ministerial choices in the Schedule.

Implications that follow from that silence

• Enforcement must rely on other legal sources. Because this determination is made under the Currency Act 1965, any enforcement, penalty or criminal sanction concerning non‑compliant coins would have to be located in the Currency Act itself or in related subordinate instruments that the Act authorises. This determination does not itself create those powers or describe how they are to be exercised.

• Evidentiary and dispute issues. The absence of certification procedures means that, for litigated disputes or commercial disagreements about the conformity of a particular piece to the Schedule, parties must rely on external evidence (expert assay, provenance, mint records) and any statutory provisions elsewhere that establish presumptions of authenticity or legal tender status. The Schedule provides the textual benchmark against which such evidence will be judged, but it does not itself prescribe evidentiary presumptions.

• Practical enforcement and market consequences. In practice, compliance with the specification is necessary for production and for market acceptance. Cash‑handling businesses, vending or coin‑mechanism manufacturers will require certainty about dimensions and weights. However, the instrument does not specify who monitors production quality or certifies compliance. Those operational responsibilities will be borne by the producing authority or entity under separate arrangements not contained in this instrument.

• Section 4 preserves other determinations. If another determination sets enforcement or testing protocols for certain coins, that instrument remains effective. This determination therefore does not negate any existing enforcement regime contained in other determinations.

For users and advisers, the key point is that the Schedule is an authoritative specification to be used as the technical standard, but that the legal remedies and enforcement powers that make specifications meaningful in practice are not included in this text. Any enforcement pathways or penalties must be located in the Currency Act 1965 itself or in other subsidiary instruments not contained in this determination.

The instrument expressly situates itself within the Currency Act 1965 regime: the document’s header states it is “made under subsection 13A(1) of the Currency Act 1965.” The only internal cross‑reference in the text is to that enabling provision and to “other determination[s] of the specifications of a coin” in section 4. The determination therefore functions as a subordinate instrument under the Currency Act but does not attempt to restate or replace other statutory or regulatory material.

Documented interactions

• Enabling statute: Currency Act 1965. The determination is an exercise of a power granted by the Currency Act 1965 (s 13A(1) is cited). The instrument does not reproduce the enabling provision, but it plainly derives its force from that statutory authority. Any limits or conditions on the Minister’s power to make these determinations must therefore be found in the Currency Act. This text does not restate those limits.

• Other determinations of coin specifications. Section 4 states the instrument “does not affect any other determination of the specifications of a coin.” That preserves parallel or prior determinations. The practical consequence is that this instrument operates alongside other determinations; where overlap exists, the legal effect must be resolved by reference to the Currency Act and the ordering of subordinate instruments under administrative law principles.

Potential but undocumented interactions

• Intellectual property, emblem protection and external legislation. The Schedule reproduces or references protected imagery such as the Olympic rings and the wording “Sydney 2000” in many reverse descriptions (for example R128-R140). The determination itself does not address licensing, authorisation, or trademark matters connected to those marks. Any legal requirement to licence or obtain permission to use protected emblems is not contained in this instrument; those obligations would arise under other legislation or contract that are not part of this text.

• Coin legal tender and monetary law. The instrument specifies physical properties; it does not declare legal tender status or the monetary application of the coins (for instance whether a $5 or $30 coin is legal tender in general circulation or only commemorative). Legal tender status and monetary value issues are matters for the Currency Act and potentially other proclamations or determinations, not for this Schedule itself.

• Customs, taxation and bullion regulation. Several entries specify high‑value precious metal coins (99.9% silver, 99.9% gold) and a 1 kg silver piece. The instrument does not address customs classification, value‑for‑duty, GST or other tax treatments of bullion or collector coins. Those matters remain governed by tax and customs law, not by this determination.

• Administrative law. The instrument is a subordinate legislative instrument. Its validity, intra vires status, and any challenge would be governed by the Currency Act and general administrative law principles. The determination itself does not include procedural protections or explanation of the Minister’s decision making.

In summary, this determination is a narrow, technical piece that sits under the Currency Act 1965. It defines physical and design specifications but intentionally leaves substantive legal matters such as enforcement, legal tender status, intellectual property permissions, and fiscal treatment to other laws or instruments. Where questions of interaction arise, readers must consult the Currency Act 1965 and any other relevant statutory or regulatory instruments, since this document contains no cross‑referencing detail beyond its enabling power and its preservation of other determinations.

The instrument presents itself as Currency Determination 1999 (No. 1). The published Note at the end records the making of the determination by the Minister on 4 February 1999. The text of the determination does not include any amendment provisions, revocation clauses or transitional arrangements. It does not carry marginal notes identifying previous instruments replaced, nor does it list subsequent amendments.

What the document records

• Date of making. The Note records the instrument as “Made by the Minister for Financial Services and Regulation on 4 February 1999.” That is the only date stamped on the instrument.

• Instrument numbering. The title and s 1 identify the instrument as “Currency Determination 1999 (No. 1).” The numbering implies the possibility of other determinations in 1999; this instrument does not itself list them.

What the instrument does not show

• No amending instrument text. The determination does not include any historical trail of amendments or indicate whether it has been amended, superseded, or revoked since the date of making. It does not include a consolidated or annotated history within the text.

• No revocation of prior determinations. Section 4 states the determination does not affect any other determination of the specifications of a coin. That language indicates the instrument was not intended to revoke or replace earlier specification instruments. It therefore preserves the continuity of prior specifications, but it does not document what those other determinations are.

How to treat the absence of amendment history

• Reliance on external registers. To establish whether this instrument has been amended or superseded since 4 February 1999, one must consult the official legislative instrument registers, the Government Gazette, and any consolidation or amendment registers maintained by the relevant legislation office or parliamentary counsel. This text contains no internal amendment trail.

• Interpretive caution. Because the Schedule coexists with other determinations (s 4), understanding the effective, current specifications applicable at any given time requires cross‑checking this instrument against other determinations, later instruments, and the Currency Act itself. The absence of an internal amendment history means this document should not be relied on alone as a current consolidated statement without verifying whether later instruments have modified or superseded parts of it.

In short, the instrument records a single date of making and contains no internal amendment or revocation history. Determining its subsequent lifecycle requires external validation against official legislative databases and the registers of subordinate instruments.

The determination contains no references to litigation, court decisions, or legal proceedings. There are no cases cited in the text and no mention of legal disputes or judicial interpretation. The instrument is purely a technical Ministerial specification.

What the document discloses

• No judicial or tribunal references. The text of the determination and its Schedule include no citations to case law, no references to litigation, and no mention of litigation risk or contested interpretation.

• No procedural challenge information. There is no information about contested issues arising from the making of the instrument, such as judicial review applications, statutory appeals or administrative inquiries.

Implications for research

• External searches required. To discover whether this determination has been the subject of litigation, interpretation, or dispute, one must search court and tribunal databases, law reports and legal research platforms for references to “Currency Determination 1999 (No. 1)”, the specific item numbers (for example the $30 1 kg silver coin), or to litigation arising from alleged non‑conforming coinage. The instrument itself does not supply any litigation history.

• Practical likelihood of litigation. The Schedule governs technical features of coins. Typical litigation that might touch such a determination (not recorded in this text) could include challenges to ministerial power, disputes about counterfeit or non‑conforming coins, contractual disputes with minting contractors, or intellectual property litigation over emblem use. None of these are referenced in the determination itself.

For users and advisers, the absence of litigation references means the instrument should be treated as a primary source for specification alone. Any case law that interprets the instrument, applies it in context, or challenges its validity must be located through external judicial records. The instrument does not provide a litigation trail.

The Schedule is precise, but its structure and some textual choices create a number of practical issues and potential traps for operators, advisers and market participants. The following are concrete “gotchas” that follow from the instrument as written.

• Matching rule requires both denomination and composition. Section 3 specifies that the determination applies to coins “having the denomination and standard composition specified in columns 2 and 3.” That matching rule means two coins with the same denomination but different composition are treated as distinct specifications. Operators tempted to rely on denomination alone will misapply the Schedule. Example: items 101-107 and items 108-111 are both $5 coins but have different compositions and dimensions.

• Multiple entries with the same nominal weight but different descriptions. The table repeats identical weights, diameters and thicknesses across many numerically sequential items that differ only by reverse codes. For example there are many $1 (1 oz) coins (items 121-141) with identical weight 31.635 ± 0.500 g and identical dimensions, but varying reverse privy marks. Manufacturers and verifiers must use reverse codes in addition to weight/dimension to identify specific variants.

• Variation in phrasing of metal purity. Some entries use “99.9% silver” while others use “Not less than 99.9% silver” (for example items 114-119). The textual difference can have assay and compliance consequences since “not less than 99.9%” permits compositions above the stated threshold, whereas “99.9%” may be read as requiring that exact purity. The instrument does not explicate the intended interpretive distinction.

• Privy marks and small‑field colours. Several reverse descriptions include privy marks and colour representations (for example R135 includes the Olympic rings in Olympic colours; R169 includes a gold cameo). The determination specifies appearance but does not set production tolerances for colour application, nor does it specify who authorises the use of protected symbols such as the Olympic rings. That creates potential downstream licensing or IP issues not addressed by this text.

• Use of monograms and multiple obverse types. Obverse codes O1, O3, O4, O11 and O12 have overlapping elements: effigy of Queen Elizabeth II plus different surrounding inscriptions and monograms (IRB, VP). Coins with O11 or O12 state “AUSTRALIA 1999”; O3 and O4 use “AUSTRALIA 2000”. The Schedule therefore includes obverses that refer to differing years and monograms. Identifying the correct obverse for a particular minting run requires precise cross‑referencing of the item number.

• Edge descriptions with text. Edge code E5 specifies a plain edge “with the inscription ‘GAMES OF THE XXVII OLYMPIAD’ (twice appearing) evenly spaced around the edge to read with the reverse of the coin facing up.” The determination thus imposes specific edge lettering orientation. Manufacturing and quality control must ensure the edge legend is present and correctly oriented; failure to do so produces non‑conforming pieces.

• Large coin dimensions and handling. Item 142 lists a $30 (1 kg) silver piece at 1002.502 ± 1.500 g and 101.00 mm diameter by 14.60 mm thickness. That coin is exceptionally large. Practical issues include die pressures, minting equipment capacity, storage, insurance, and transport. The instrument specifies the coin but does not address operational or logistical implications for manufacture and distribution.

• Coexistence with other determinations. Section 4 preserves other coin specifications. That means a manufacturer or verifier must confirm the relevant determination applicable to any given issue; assuming this instrument is exhaustive risks missing overlapping specifications from other determinations.

• Lack of enforcement and certification procedures. The Schedule sets standards but does not describe how compliance will be certified or how disputes about conformity will be resolved. That gap produces evidentiary uncertainty in commercial disputes; parties must rely on assay reports, mint certificates or other documentary proof outside the instrument.

• Duplication of denomination labelling. Several items for bullion pieces use non‑standard monetary denominations (for instance item 142: $30 for a 1 kg silver coin). The instrument does not clarify whether such denominations are intended as legal tender face values or merely nominal labels for bullion coins. That distinction is legally significant for taxation, customs, and consumer protection but is not spelled out here.

Each of these gotchas arises from language that is precise in parts but silent on adjacent legal and operational questions. Users should not assume that the Schedule resolves licensing, quality assurance, assay interpretation, legal tender status, or enforcement; those matters lie beyond its four corners.

Compliance with this determination is a practical, manufacturing and documentation exercise. The instrument sets defined technical targets; parties who manufacture, inspect or handle the enumerated coins should implement systems and documentation that map directly to the specification fields in Part 1 and the design text in Part 2.

Concrete steps for compliance

• Match denomination and composition. Before applying any specification in the Schedule, verify both the denomination (column 2) and the standard composition (column 3). Section 3 makes clear the matching condition. A production order, assay certificate or procurement specification should quote the exact item number from Schedule 1, Part 1.

• Implement metrological controls. The standard weight and allowable variation are mandatory production tolerances. For each listed item, establish calibrated weighing and measurement processes to ensure finished coins fall within the stated tolerance band. For precious metal pieces with narrow tolerances (for example item 112: 10.021 ± 0.020 g), use calibrated scales traceable to national metrology standards and maintain records of batch weights and variances.

• Calibrate tooling to diameter and thickness. Die design and blanking processes must be set to the diameter and thickness values in column 5. For vending machines or automated handling, confirm that external partners and customers are informed of the precise dimensions and any variant sizing within the same denomination.

• Implement composition verification and assay. The composition field is part of the matching rule. Ensure metal procurement contracts, assay certificates and supplier documentation specify the composition to the same language as the instrument (for example “99.9% silver” or “Not less than 99.9% silver”). Retain assay reports and supplier declarations as documentary evidence.

• Follow the Part 2 design texts exactly. The codes in column 6 must be translated into the textual descriptions in Part 2. For example, if column 6 lists O3, the obverse must be “An effigy of Queen Elizabeth II, surrounded by the inscriptions ‘ELIZABETH II’ and ‘AUSTRALIA 2000’” (Part 2 item 207). For reverse codes that require the Olympic rings “in Olympic colours”, ensure the dies or colour application accurately reproduce those colours to the client or licensing standard.

• Edge inscription and orientation. Edge treatments such as E5 require inscriptions and specific reading orientation (“to read with the reverse of the coin facing up”). Production and inspection processes must include checks that the edge legend appears and is properly oriented.

• Privy marks and colour work. Several reverses call for privy marks or gold cameo features. These are fine details requiring tooling or enamel/colour application. Confirm tooling drawings and proofs with the minting authority to ensure the privy marks are included exactly as set out (for example “PERTH”, “GOLD COAST”, or the Australia 2000 logo).

• Documentation and traceability. Create a compliance dossier for each coin type that contains: the Schedule item number, die proofs, metal procurement invoices, assay certificates, production batch weight records, sample photographs, and quality control logs demonstrating adherence to tolerances and design elements. Because the determination contains no certification procedure, documentary evidence will be essential in any subsequent dispute.

• Communicate with downstream users. Because the Schedule affects coin dimensions and weight, vending machine operators, commercial banks, and cash‑handling equipment suppliers should be notified of specifications before circulation. Include technical data sheets publicly or to relevant industry partners.

• Cross‑check against other determinations and statutes. Section 4 preserves other specifications. Before finalising production, check whether other relevant determinations or the Currency Act include additional requirements relating to legal tender status, issuance limits, or labelling that affect the intended coin. Ensure that any use of protected emblems (for example, Olympic rings or “Sydney 2000”) is authorised by the appropriate rights holder; obtain licences or permissions as necessary, since this determination does not grant licensing rights.

• Maintain governance and approvals. Because the determination is issued by the Minister under the Currency Act 1965, ensure that internal approvals and ministerial or departmental authorisations required by administrative procedures are secured before production. Keep records of ministerial instructions, procurement approvals, and any terms of engagement with external suppliers.

• Insurance, packaging and logistical planning for large pieces. For unusual items such as the 1 kg silver coin, plan special handling, insurance, and packaging solutions. Verify that production and distribution partners have the technical capacity to strike large planchets and manage the manufacturing stresses involved.

In summary, compliance is a detail‑driven exercise of matching the Schedule’s item number to the physical and design outputs and creating documentary proof that the produced coins conform to the precise language in Part 1 and Part 2. Because the determination does not set out certification or enforcement pathways, maintain rigorous internal and external documentation to demonstrate conformance if questions arise.
