16 Governor in Council may by Order direct that reserved land vest in municipality S. 16(1) amended by Nos 12/1989 s. 4(1)(Sch. 2 item 21.11), 58/2010 s. 47. (1) Subject to subsection (5) the Governor in Council may on the recommendation of the Minister by Order notified in the Government Gazette direct that any land reserved under section 4 shall vest in any Council on trust for the purposes for which the land has been reserved. S. 16(2) amended by Nos 12/1989 s. 4(1)(Sch. 2 item 21.11), 58/2010 s. 47. (2) By the same or any subsequent Order the Governor in Council may empower the Council to grant leases or licences for a term not exceeding 21 years of any such vested land for the purposes of the reservation. S. 16(3) amended by Nos 12/1989 s. 4(1)(Sch. 2 item 21.11), 58/2010 s. 47. (3) A Council shall not grant any lease or licence of land vested in it under this section other than in accordance with an Order under this section. S. 16(4) amended by Nos 12/1989 s. 4(1)(Sch. 2 item 21.11), 58/2010 s. 47. (4) Land shall not be vested in a Council under this section unless the Minister is of the opinion that the land is used principally for the recreation convenience health or enjoyment of the inhabitants of the area in which the land is situated. S. 16(5) amended by Nos 12/1989 s. 4(1)(Sch. 2 item 21.11), 58/2010 s. 47. (5) Land reserved for the purpose of the protection of the coastline shall not be vested in a Council under this section. (6) Any lease or licence granted by a Council under this section may be subject to such covenants conditions reservations and exceptions as the Council thinks fit. (7) A lease granted by a Council under this section shall be of no force and effect until it is approved by the Governor in Council.
