52 Minister may dedicate public roads
> > (1) This clause applies to land under a Western lands lease granted or issued before 1 December 2002 (which is when section 35Q of the [Western Lands Act 1901](/view/html/repealed/current/act-1901-070) commenced), but does not apply to a lease granted on or after that date.
>
> > (2) The Minister may, by notice published in the Gazette, withdraw any land from a Western lands lease for the purpose of dedicating it as a public road if, in the Minister’s opinion, it is being used by the public as a road.
>
> > (3) After the land is withdrawn, the Minister may dedicate that land as a public road as provided by section 12 of the [Roads Act 1993](/view/html/inforce/current/act-1993-033).
>
> > (4) No compensation is payable with respect to any loss or damage arising because of the operation of this clause.
