Key legal constructs and how the Bill defines them are concentrated in the main body of the Bill and the Schedule. The Bill distinguishes between functions, powers, authorisations, declarations and reporting obligations.

• Queensland Crocodile Authority and director. The authority is established as an entity comprised of the director and staff, with the director having control (s5(1)-(3)). The director is a statutory appointee selected by resolution of the Legislative Assembly on the Minister’s recommendation (s9(2)), and the director has an extensive statutory list of functions (s10(1)) and the statutory power to do "all things necessary or convenient" to perform those functions (s11(2)). The director’s appointment is not under the Public Sector Act 2022; staff are employed under that Act (s8; s9(4)).
• Authorisation. The Schedule defines "authorise" as issuing a licence, permit or other authority under the Nature Conservation Act 1992 or another Act prescribed by regulation, and includes cancelling, suspending, amending and imposing conditions (Schedule, definition of authorise). That links director decisions under this Bill to the existing statutory instrument frameworks used in Queensland.
• Crocodile, crocodile farm, crocodile sanctuary, populated waterway and zero-tolerance zone. Crocodile is defined as Crocodylus porosus (Schedule). "Crocodile farm" means a farm operated by a person authorised by the director for the purposes of this Act (Schedule). "Crocodile sanctuary" and "populated waterway" are statutory categories created by gazette notice under s18 and s19 respectively; such declarations must state the duration (s18(3); s19(3)). The zero-tolerance zone is to be identified in the Queensland Crocodile Management Plan and must include populated waterways (s21(1)-(2); Schedule).
• Powers versus functions. The director’s functions are a prescriptive list in s10(1)(a)-(t). The powers are twofold: an express provision that the director has the powers given under this Act or another Act (s11(1)), and a general statutory power to carry out anything necessary or convenient to perform the functions (s11(2)). Delegation of those powers to suitably qualified staff is permitted (s12).
• Indigenous consultation and traditional practice. Section 20 mandates consultation when a director considers that performing a function or power may affect Aboriginal land, Torres Strait Islander land, Aboriginal tradition or Island custom. The Schedule defines "traditional practice" for killing crocodiles for Aboriginal and Torres Strait Islander persons and links consultation to cultural sensitivities and potential social or economic benefits (s20(1)-(3); Schedule).
• Reporting and transparency. The director must produce both quarterly reports (published within four weeks of the quarter end) and a detailed annual report tabled and published, each with enumerated content (s16; s17). The content lists are granular, for example requiring particulars of each crocodile lawfully killed, how carcasses were dealt with, numbers and locations of eggs harvested and authorised for harvest, and details of relocations, attacks and injuries (s16(2)(d)-(l); s17(3)(b)-(i)).
• Transitional implementation. Section 23 requires the Minister to table proposed subordinate legislation within two months after commencement to enact essential operational rules; the section enumerates a long list of objectives to be implemented by subordinate legislation, including who may harvest eggs, methods for killing, timelines for action in zero-tolerance zones, and restricting new farm authorities to Australian entities (s23(1)-(3)).

Conceptually the Bill centralises crocodile management authority in a single director with delegated operational discretion, binds that authority into existing licensing regimes via the authorise definition, and mandates public reporting and Indigenous consultation while reserving many operational specifics to subordinate legislation and administrative practice.

The Bill creates direct obligations and confers rights on a defined set of actors; the practical effect will fall on multiple categories of public and private stakeholders.

• The director and authority staff. The director is the central decision-maker with statutory functions and powers (s5; s9; s10). The director and all staff must reside in, and operate from, Cairns (s6(1)-(2); s9(5)). Staff are employed under the Public Sector Act 2022 (s8). The director is appointed by Parliament on the Minister’s recommendation and the Minister must be satisfied as to qualifications, character and residency (s9(2)-(3)). Appointment terms otherwise are set by the Minister and, unless the Minister decides otherwise, the director receives no remuneration or retirement benefits (s13(1)-(2)).
• Minister and Legislative Assembly. The Minister recommends the director to the Legislative Assembly, and must table subordinate legislation proposals under s23 within specified timelines (s9(2); s23(1)). The Minister also appoints advisory committee members and the chairperson (s14(2); s14(5)).
• Advisory committee members. The advisory committee will be appointed by the Minister and must include prescribed categories of members (s14(2)-(4)). Members hold office on terms the Minister decides, and, unless the Minister decides otherwise, are not entitled to remuneration (s14(6)-(8)). The committee advises the director on strategy, policy and goals (s14(1)).
• Licence and permit holders or applicants. People or entities who operate crocodile farms or sanctuaries, harvest eggs, or seek to display, interact with, keep or use crocodiles will need authorisation from the director; "authorise" is defined to mean issuing a licence, permit or other authority under the Nature Conservation Act 1992 or another Act prescribed by regulation (Schedule, definition of authorise; s10(1)(b), (d), (j)). The transitional objectives anticipate the director issuing, cancelling, suspending and imposing conditions on licences under the Nature Conservation Act (s23(2)(a)).
• Crocodile farmers and sanctuary operators. The Bill vests in the director the authority to authorise operators, to promote farming and egg harvesting (s10(1)(b), (o)), to investigate use of State land for farms or sanctuaries (s10(1)(p)), and via transitional provisions to limit post-commencement farming authorities to Australian entities only (s23(2)(k); s23(3)). These provisions affect ownership structures and investment eligibility for farming licences.
• Aboriginal and Torres Strait Islander land owners and traditional custodians. The Bill specifically addresses Aboriginal land and Torres Strait Islander land, giving owners powers to be authorised to kill or relocate crocodiles or harvest eggs on their land, and requires the director to consult when functions or powers may affect those lands or traditions (s10(1)(h); s20(1)-(3)). The Schedule lists the Acts under which such land is held (Schedule, definition of Aboriginal land or Torres Strait Islander land).
• Owners of State leasehold land and other private land. The director may authorise persons to enter State leasehold land, or other land that is not State land, to kill, relocate or harvest eggs with the owner’s consent (s10(1)(i)). For sanctuaries, the director must not include land in a crocodile sanctuary where a person has an interest in the land unless the person consents (s18(2)). Landowners may therefore be asked to consent to inclusion in a sanctuary or to permit authorised persons to enter their land.
• Recreational and commercial waterway users and the general public. Populated waterway declarations are directed at protecting public safety and will affect people who use waterways for recreational activities such as fishing, kayaking and powerboating and commercial activities (s19(1)-(2); s14(3)(c)-(d) examples). The director must consider public recreational and commercial use when declaring populated waterways (s19(2)).
• Police and enforcement agencies. The director is required to refer suspected offences relating to crocodiles or crocodile eggs to the police service (s10(1)(m)). The Bill itself contains no comprehensive enforcement apparatus but anticipates the involvement of police where offences are suspected.
• The department and Parliament. The director must supply annual and quarterly reports for public and parliamentary oversight. The Minister must table the annual report within 14 days after receipt (s16(1), (3)-(4); s17(1)-(3)).
• Investors and foreign entities. The transitional objectives propose that authorities to farm crocodiles issued after commencement are restricted to Australian entities (s23(2)(k); s23(3)). That provision directly affects eligibility for farming licences and will impose structural ownership constraints on prospective operators.

Who pays. The Act itself does not establish fees or levies for its core functions, but it contemplates payments in specific contexts. For example, the director may authorise owners of Aboriginal or Torres Strait Islander land to allow others to kill crocodiles on the land "for payment of a fee or free of charge" (s10(1)(h)). The requirement that licences and permits under the Nature Conservation Act be issued and conditioned by the director implies ongoing administrative costs that will be borne by applicants and the department, but the Act does not set fees (s23(2)(a)).

Overall the Bill reallocates operational control, imposes residency and workplace location requirements for the director and staff, creates authorisation pathways for a spectrum of crocodile-related activities, and constrains who may receive certain licences, particularly for farming.

The Bill sets out specific statutory duties for the director, minimum decision-making procedures, and rights and protections for particular parties. Below are the primary duties, rights and statutory constraints drawn from the Bill.

Director’s duties and statutory obligations

• Minimise injuries and deaths. The director must take measures to minimise injuries and deaths caused by crocodiles in the State (s10(1)(a)). That is the express public-safety objective placed at the head of the director’s function list.
• Authorisation responsibilities. The director must authorise persons to operate crocodile farms and sanctuaries, to harvest eggs and to cull, kill or relocate crocodiles across the State (s10(1)(b)-(g), (j)). Authorisations are implemented through licences, permits or other authorities under the Nature Conservation Act 1992 or another Act prescribed by regulation (Schedule, definition of authorise).
• Limits on population harm. The director is expressly barred from doing anything the director reasonably believes will cause or is likely to cause crocodile populations to decline to such an extent that crocodiles are in danger of extinction (s10(2)). This statutory constraint limits exercise of control functions in the interests of species conservation.
• Indigenous land duties. For Aboriginal or Torres Strait Islander land, the director may authorise the owner of the land to kill, allow others to kill, relocate crocodiles, harvest eggs or otherwise manage crocodiles on the land (s10(1)(h)). The director must consult where a function or power may affect Aboriginal land, Torres Strait Islander land, Aboriginal tradition or Island custom (s20(1)-(3)).
• Reporting and accountability. The director must prepare an annual report within four months after the end of the financial year and must publish quarterly reports within four weeks of each quarter’s end (s16(1); s17(1)-(2)). The annual report content is detailed and includes particulars of licensed activities, kills, relocations, attacks and injuries (s16(2)(a)-(m)). The Minister must table the annual report in the Legislative Assembly within 14 days of receipt and publish it online (s16(3)-(4)).
• Management of carcasses. The director must ensure carcasses of crocodiles killed under an authorisation are dealt with so that, as far as practicable, no part is wasted (s10(1)(l); s23(2)(j)). The Bill also requires reporting of how carcasses were handled (s16(2)(d); s17(3)(b)).
• Research coordination. The director is tasked with coordinating research and routine surveying of crocodile and crocodile egg numbers and distribution in the State (s10(1)(n)).

Rights conferred and limits on third parties

• Authorisations to act. Persons authorised by the director may harvest eggs, kill, cull or relocate crocodiles, operate farms and sanctuaries, display, interact with, keep or use crocodiles or eggs (s10(1)(b)-(g), (j)).
• Landowner consent protections. The director must not include private land in a crocodile sanctuary without the land interest holder’s consent (s18(2)). For State leasehold land or other non-State land the director may authorise entry only with the owner’s consent (s10(1)(i)). These provisions preserve a property owner’s ability to refuse inclusion in a sanctuary or entry to their land.
• Indigenous owners’ rights. Aboriginal and Torres Strait Islander landowners can be authorised to manage crocodiles on their land and to permit others to do so, for fee or without payment (s10(1)(h)). The Schedule defines the relevant land-holding Acts (Schedule).
• Killing methods. The transitional objectives anticipate that crocodiles required to be killed will be killed only by shooting, harpooning or, for Aboriginal or Torres Strait Islander persons, traditional practices (s23(2)(i)). That will constrain the methods available to authorised killers once subordinate legislation is enacted.
• Procedural reporting rights. The Act provides for public disclosure of licences and lists of authorised operators in quarterly and annual reports (s16(2)(k); s17(3)(i)). That creates a transparency right for the public to know who is authorised.

Decision-making and limits

• Delegation. The director may delegate powers under this Act or another Act to an appropriately qualified member of the authority’s staff (s12). That permits the director to authorise operational decisions to staff.
• Reasonableness constraint in extinction risk. The director must not act in a way that the director reasonably believes will risk extinction (s10(2)). That introduces an objective reasonableness constraint on exercises of discretion affecting population size.
• Consultation obligations. Consultation is mandatory where actions may affect Aboriginal or Torres Strait Islander land or traditions, and the consultation must have regard to cultural sensitivities and potential economic or social benefits for the Indigenous peoples (s20(2)-(3)).

Statutory gaps and anticipated subordinate legislation

• Authorisations are defined to occur under pre-existing Acts and permit use of conditions, suspensions and cancellations (Schedule). The Bill does not itself set licence formats, fees, enforcement penalties or application processes. Section 23 explicitly requires proposed subordinate legislation to implement core operational elements such as who may harvest eggs, who may kill crocodiles, timelines for dealing with crocodiles in zero-tolerance zones, and restrictions on farm ownership (s23). That indicates an intended reliance on delegated legislation to fill in procedural and enforcement details.

In short, the Bill imposes on the director a wide-ranging set of duties centred on public safety and species management, gives the director rights to authorise and manage crocodile-related activities across the State, requires reporting and Indigenous consultation, and leaves numerous operational specifics to be supplied through regulation and subordinate legislation.

The Bill is primarily a framework statute that allocates powers and responsibilities and requires reporting. It contains very limited direct enforcement or penalty provisions. The following points summarise enforcement-related mechanics and notable omissions in the Bill.

What the Bill expressly provides

• Referral to police. The director is required to refer suspected commission of offences relating to crocodiles or crocodile eggs to the police service (s10(1)(m)). That provision creates a statutory duty to notify police where an offence is suspected, but it does not create a set of penalties within this Act.
• Termination of director for conviction. The Minister may terminate the director’s appointment if the director is convicted of an indictable offence (s13(3)(b)). The section defines "indictable offence" broadly to include indictable offences dealt with summarily (s13(5)).
• Regulation-making head of power. The Governor in Council may make regulations under the Act (s22). The regulations can be used to create offences, penalties or compliance mechanisms if the regulations so provide, subject to Parliamentary oversight.
• Delegation and operational powers. The director may delegate powers to staff (s12) and "may do all things necessary or convenient" to perform functions (s11(2)). Those provisions enable operational enforcement activity through authorised staff once the director provides the authorisations and implements procedures.

What the Bill does not itself provide

• No express civil or criminal sanctions for contraventions of the Bill are included. The Act does not create specific offences, monetary penalties, infringement notices, seizure powers, inspection powers or administrative penalties within its text. Enforcement therefore relies on the identification of relevant offences under other statutes (for example the Nature Conservation Act 1992) and on police action where the director refers suspected offences (s10(1)(m); Schedule, definition of authorise).
• No administrative penalty scheme is set out. The Bill anticipates the director will control licences and impose conditions (Schedule; s23(2)(a)), but the process for enforcing licence conditions, suspensions, cancellations or appeals of administrative decisions is not given in the Bill and would need to be supplied by subordinate legislation or by reliance on existing Acts.
• Absence of specified inspection or seizure powers. The Bill does not include express powers for authorised officers to enter land to inspect or seize crocodiles, eggs or evidence. Entry onto land for operational actions is constrained by owner consent where the land is private or State leasehold (s10(1)(i); s18(2)).

Practical enforcement pathway under the Bill

• Operational enforcement and compliance will likely be implemented through a mix of the director’s authorisations under this Bill, licensing powers under the Nature Conservation Act 1992 or other prescribed Acts (Schedule; s23(2)(a)), and police action when offences are suspected (s10(1)(m)). The Bill’s s23 transitional list anticipates subordinate legislation to operationalise who may harvest eggs and kill crocodiles and the permitted methods, and those subordinate instruments can create enforceable offences and penalties if drafted accordingly (s23(2)(b)-(j), (f)-(g)).
• The Bill’s transparency and reporting provisions create reputational and administrative enforcement pressure. The public lists of authorised operators and published particulars of kills, relocations and injuries (s16(2)(c), (d), (h), (i), (k); s17(3)(a)-(i)) will enable public and parliamentary scrutiny, which provides an indirect enforcement lever.

Implementation risks and enforcement uncertainty

• Because the Bill does not itself set out offences, penalties or inspection powers, there is an implementation risk that enforcement will be fragmented until subordinate legislation and administrative instruments are in place as required by s23. The Minister must table proposed subordinate legislation within two months of commencement (s23(1)), but the Bill sets no timeline for when that subordinate legislation must be made or commence beyond proposed dates to be tabled (s23(1)(b)). Until the subordinate legislation is enacted, authorised activity, compliance expectations and enforcement procedures may be unclear.
• The absence of explicit entry and seizure powers and the requirement for landowner consent to enter State leasehold land or private land (s10(1)(i); s18(2)) may constrain rapid operational responses unless specific powers are provided in regulations or other Acts.

In short, the Bill establishes referral pathways to police and confers broad administrative authority on the director, but it leaves most of the direct enforcement architecture, specific offences, penalties, inspections and administrative enforcement mechanisms,to subordinate legislation and other existing Acts. That creates a transitional period of enforcement uncertainty that the Bill’s s23 anticipates should be addressed rapidly by the Minister tabling proposed subordinate legislation.

The Bill is integrative by design and links its authorisations and land definitions to pre-existing statutory regimes. The textual interactions and the consequences for governance and legal operation are as follows.

Direct link to the Nature Conservation Act and other Acts

• Authorisations under this Bill are defined to be licences, permits or other authorities issued under the Nature Conservation Act 1992 or another Act prescribed by regulation (Schedule, definition of authorise). That means the director will exercise many functions through the existing licensing frameworks of the Nature Conservation Act or chosen prescribed Acts.
• The Bill’s transitional objectives specifically envisage amendments or subordinate instruments that make licences, permits and other authorities under the Nature Conservation Act subject to issuance, cancellation, suspension and conditions by the director (s23(2)(a)). Operational practice will therefore rely on, or modify by regulation, the way the Nature Conservation Act is applied to crocodile matters.

Precedence and inconsistency

• The Bill contains a supremacy clause: if there is an inconsistency between this Act and another Act, this Act prevails to the extent of the inconsistency (s4). That clause alters the statutory hierarchy to the extent of conflict and gives the director’s functions statutory primacy in crocodile management where conflicts arise.

Public sector employment law

• Staff of the authority are employed under the Public Sector Act 2022 (s8), but the director is appointed under this Act, not under the Public Sector Act 2022, and certain employment protections, entitlements or procedures that would apply under the Public Sector Act may not apply to the director unless the Minister decides otherwise (s9(4); s13(1)-(2)). This separation creates a distinct employment/legal regime for the director compared with the staff.

Financial legislation and accountability

• The Bill expressly preserves the operation of the Financial Accountability Act 2009 in relation to the department (s16(5); s17(4)). The annual and quarterly reporting obligations (s16; s17) will sit alongside financial-accountability reporting and expectations imposed by existing financial management legislation.

Land law and Indigenous land-holding Acts

• The Schedule defines "Aboriginal land or Torres Strait Islander land" by reference to a list of Acts including the Aboriginal and Torres Strait Islander Land Holding Act 2013, the Aboriginal Land Act 1991, the Land Act 1994 and the Torres Strait Islander Land Act 1991. The director’s powers with respect to Aboriginal or Torres Strait Islander land, authorising owners to kill, permit killing, harvest eggs, or relocate crocodiles, must therefore be exercised in the context of these land-holding regimes (s10(1)(h); Schedule).
• For State leasehold land the owner includes the lessee under the Land Act 1994 (Schedule). The director may authorise people to enter State leasehold land with the consent of the owner to kill, harvest or relocate crocodiles (s10(1)(i)). Those interactions are therefore mediated by leasehold instruments and the Land Act.

Criminal law and policing

• The Bill does not create many new offences, but it requires the director to refer suspected offences relating to crocodiles or crocodile eggs to the police (s10(1)(m)). That ties enforcement of illegal activity to the criminal justice system under existing criminal statutes.

Regulatory and delegated instruments

• The Bill gives the Governor in Council power to make regulations (s22). Section 23 explicitly requires the Minister to table proposed subordinate legislation to implement crucial operational rules including who may harvest eggs and kill crocodiles, methods for killing, timelines for zero-tolerance responses, and restrictions on farming ownership to Australian entities (s23(1)-(3)). This indicates the Bill’s architects intend the operational detail to be supplied by subordinate legislation which will interact with, and may amend by regulation, the application of existing Acts such as the Nature Conservation Act.

Administrative law and judicial review (procedural interaction)

• The Bill vests broad discretion in the director to authorise activities, make declarations of sanctuaries and populated waterways, and to issue licences under existing statutes. Those discretionary administrative decisions will be subject to the usual judicial review principles and procedural law, although the Bill itself does not set out an appeal or merits review mechanism. The administrative exercise will therefore interact with general administrative law doctrines and any appeal or review paths in the Nature Conservation Act or other prescribed Acts.

In summary, the Bill is designed to operate in tandem with existing Commonwealth or State statutes by using the mechanics of licensing under the Nature Conservation Act and other prescribed Acts, by respecting existing landholding legislation, and by relying on subordinate legislation to fill operational detail. The Bill also establishes its own primacy in the event of statutory inconsistency (s4).

The document supplied is the Crocodile Control and Conservation Bill 2025 as enacted text provided in this Bill. The Bill contains internal transitional and commencement provisions but does not contain any express amendment schedule altering prior Acts within its text beyond the intended use of subordinate legislation to give effect to policy objectives (s23). The only temporal and amendment-relevant elements present in the Bill are the following.

• Commencement timing. The Bill provides that it will commence four months after the day of assent (s2). That sets the operative date for the new statutory regime.
• Transitional and subordinate legislation obligations. The Bill requires the Minister, within two months after commencement, to table in the Legislative Assembly a document containing proposed subordinate legislation to implement a series of detailed policy objectives (s23(1)-(2)). The objectives listed specifically anticipate that directorial powers will operate over licences, permits and other authorities under the Nature Conservation Act 1992, and that the director will be empowered to authorise harvesters and killers subject to training and skill requirements, among other matters (s23(2)(a)-(l)).
• No historical amendments recorded. The Bill’s text does not contain any notation of prior amendments to this Act, nor does it contain repeals of other Acts. Section 4 addresses inconsistency, stating that in the event of inconsistency this Act prevails to the extent of the inconsistency (s4), but that is a general supremacy clause rather than an amendment to other enactments.

Because the supplied Bill is a stand-alone enactment with a forward-looking transitional schedule, the operational amendment history will be created by subsequent subordinate legislation made under s22 and by any amendments to the Nature Conservation Act 1992 or other prescribed Acts to accept the director’s primacy on crocodile matters, as signalled by the transitional objectives in s23. The text of the Bill itself records no prior amendment history or prior versions; all amendment work is anticipated to follow commencement through regulation and subordinate legislation.

The Bill, as supplied, contains no reference to judicial decisions, prior litigation or existing case law. It does not cite any cases and the Schedule and sections do not indicate judicial interpretation guidance within the Bill’s text. Therefore, there is no litigation history embedded in this Bill to report.

Potential sources of future litigation or review

While the Bill does not record any litigation history, its structure creates predictable subject-matter for possible future legal challenges or judicial review, namely:

• Administrative decisions by the director. The Bill vests broad discretionary powers in the director to authorise killing, relocation, egg harvests, farming and sanctuary declarations (s10(1)(b)-(j), (q)). Those discretionary decisions, once made, will be amenable to judicial review under general administrative law principles for jurisdictional error, procedural fairness or unreasonableness, subject to any appeal or review regime in subordinate legislation or existing Acts referenced by the Bill.
• Consistency with other Acts. Section 4 gives the Act precedence to the extent of inconsistency, but where operationalisation depends on subordinate legislation which interacts with the Nature Conservation Act 1992 and land-holding Acts, disputes could arise about statutory interpretation, the scope of directorial powers, and whether delegated legislation adheres to the parent Act. Litigation could focus on whether subordinate instruments exceed the powers granted in s22 or s23.
• Indigenous consultation obligations. Section 20 requires the director to consult Aboriginal or Torres Strait Islander owners and custodians where functions may affect their land or traditions. Litigation could arise where affected parties contend consultation was inadequate, or where decisions are challenged on the basis of failure to properly have regard to cultural sensitivities or potential economic or social benefits.
• Property rights and sanctuaries. The requirement for consent before land with an interest may be included in a crocodile sanctuary (s18(2)) mitigates immediate property-claim litigation, but other property-impacting decisions (for example, authorisations to enter State leasehold land with owner consent, s10(1)(i)) or the practical management of relocations and culls may provoke disputes.

Those potential litigation pathways are predictable consequences of a statute that centralises discretionary control in an administrative decision-maker and relies on subordinate instruments for operational detail. The Bill itself contains no recorded litigation history.

The Bill contains several provisions and drafting choices that create implementation frictions, allocational consequences and compliance traps that users should be aware of. These items are drawn from the Bill’s text and the concrete legal mechanisms it establishes.

Residency and location constraints narrow candidate pools and impose mobility burdens

• The director and the authority’s staff must reside in Cairns, and the authority’s business premises must be located in Cairns (s6(1)-(2); s9(5)). That limits where the director and staff can be sourced from and may increase recruitment and relocation costs. It also centralises day-to-day operations in Cairns, which may affect response times to incidents elsewhere in the State and will create travel and logistics obligations for staff.

Appointment and remuneration are ministerial prerogative by default

• The director is appointed by Legislative Assembly resolution on the Minister’s recommendation, and the Minister must be satisfied as to qualifications, character and Cairns residency (s9(2)-(3)). Appointment terms are determined by the Minister for matters not provided for in the Act (s13(1)), and by default the director receives no remuneration or retirement benefit unless the Minister decides otherwise (s13(2)). That creates a discretionary remuneration regime that could complicate recruitment and raise questions about the director’s employment status, entitlements and protections given the director is not appointed under the Public Sector Act 2022 (s9(4)).

Extensive discretion concentrated in a single statutory officer

• The director’s functions are broad and encompass public safety, licensing, population-level decisions about egg harvest and culling, authorisations to kill and relocate, declarations of sanctuaries and populated waterways, promotion of farming, and making recommendations to Parliament (s10(1)(a)-(s)). The Bill grants the director wide operational scope via s11(2) and permits delegation to staff (s12). Concentration of discretion increases the importance of process and the risk that inconsistent or opaque exercise of powers could be challenged or criticised.

Subordinate legislation dependency creates a transitional vacuum

• The Bill deliberately leaves many operational details to subordinate legislation, and s23 requires the Minister to table proposed subordinate legislation within two months of commencement that provides detailed operational rules (s23(1)-(2)). Until subordinate legislation is enacted and commenced, licence formats, offences, enforcement processes, application criteria, methods of killing, and training and safety standards for egg harvesters and cullers will be uncertain. The Bill’s operational intent is clear but the practical implementation will depend on how rapidly and comprehensively s23 is actioned.

Limited enforcement architecture in the Act itself

• The Act does not provide explicit penalty provisions, inspection powers, or enforcement officers’ powers. It requires referral of suspected offences to police (s10(1)(m)) but otherwise expects enforcement to be implemented through other Acts or by subordinate legislation. Practically, this means compliance and enforcement will rely on parallel statutes and forthcoming regulations, and there will be a period where tools available to the director and staff are constrained.

Landowner consent and property impacts

• The director must obtain a land interest holder’s consent before including land in a crocodile sanctuary (s18(2)). For State leasehold or other non-State land, entry and action must be with owner consent (s10(1)(i)). That preserves property rights but may limit operational responses in time-critical situations, unless subordinate legislation provides alternative urgent powers. There is no express compensation mechanism for owners whose land is affected by declarations or operations.

Indigenous consultation mandatory but outcomes not prescribed

• Section 20 requires consultation with Aboriginal or Torres Strait Islander landowners or with traditional custodians where the exercise of a power may affect land or tradition (s20(1)-(3)). The Bill requires that consultation have regard to cultural sensitivities and potential benefits, but it does not prescribe outcomes or a dispute resolution process where consultation does not result in agreement. That leaves open the scope of consultation obligations and the legal standard for adequacy.

Ownership restrictions for farming authorities

• Transitional objectives require that crocodile farming authorities issued after commencement be issued only to "Australian entities" as defined in s23(3) (s23(2)(k); s23(3)). That is an ownership restriction that will impact foreign investment and corporate structuring, and may require business reorganisations or joint-venture arrangements to meet the definition of an Australian entity.

Required methods for killing and carcass use

• Transitional objectives propose that crocodiles required to be killed should be killed only by shooting or harpooning, or by traditional practice for Aboriginal or Torres Strait Islander persons (s23(2)(i)). The director must ensure carcasses are used so that "no part of a carcass is wasted, so far as practicable" (s10(1)(l); s23(2)(j)). Those constraints will affect operational practice for authorised killers and the supply chain for carcass products, and will require coordination with processors and markets.

Reporting obligations and data demands

• Quarterly and annual reports require granular data, including particulars of each crocodile lawfully killed, how carcasses were dealt with, number and location of eggs harvested and authorised for harvest, relocations and attacks (s16(2)(d)-(i); s17(3)(b)-(f)). Operators and authorised persons will need robust record-keeping to support these disclosures, and the director will need administrative systems to aggregate and publish the data.

No express appeal or merits-review procedure

• The Bill does not provide an internal appeal or merits-review process for persons aggrieved by directorial authorisations, licence conditions or declarations. Affected persons may have to rely on review rights under existing Acts or on judicial review remedies. The lack of a statutory internal review mechanism in this Act could increase litigation risk and delay resolution of disputes.

In short, the Bill centralises discretion, requires rapid subordinate legislation to operationalise the regime, constrains ownership of new farming authorities, imposes detailed reporting obligations, and preserves property consent rights while mandating Indigenous consultation. These design choices have clear operational consequences and produce windowed periods of legal and enforcement uncertainty unless the Minister and the director implement the required subordinate instruments and administrative systems promptly.

This section sets out concrete, source-based steps for the principal actors identified in the Bill. Compliance will be a combination of statutory requirements set out in the Bill and the subordinate legislation and licensing regimes the Bill anticipates. The steps below follow directly from the Bill’s operative provisions.

For prospective applicants to operate a crocodile farm or sanctuary

• Seek authorisation from the director. Under s10(1)(b) and the Schedule definition of "authorise", operating a crocodile farm or sanctuary requires a licence, permit or other authority issued under the Nature Conservation Act 1992 or another Act prescribed by regulation. Prepare to make an application to the director under the forms and procedures that will be set out by the director and by subordinate legislation expected under s23(2)(a).
• Ensure ownership eligibility. If seeking a new farming authority after commencement, structure ownership to meet the Australian entity test if subordinate legislation implements s23(2)(k)-(3). That may require Australian citizenship, permanent residency, listed-corporation majority ownership, or ensuring ultimate ownership is by an Australian entity as defined in s23(3).
• Prepare record-keeping systems. The director must publish quarterly and annual reports with detailed particulars of licences and activities (s16(2)(c); s17(3)(a)). Maintain records of crocodiles kept, displays, relocations, kills, carcass disposal and egg harvests so the director can comply with reporting demands.

For persons seeking authorisation to harvest crocodile eggs

• Complete any required safety training. Section 23(2)(b) anticipates that the director will authorise adults who have completed a crocodile egg harvesting safety course approved by the authority to harvest eggs. Enrol in and complete authorised training programs as required by the director.
• Apply to the director for a harvest authorisation. The director decides the number of eggs that may be harvested each year and who may harvest (s10(1)(c)-(d)). Applications will need to include training and safety credentials, and details required by subordinate legislation.

For persons seeking authorisation to kill, cull or relocate crocodiles

• Satisfy skill and training standards. Transitional objectives indicate the director will authorise adults who the director reasonably believes have skills and training to safely kill crocodiles or cull crocodiles (s23(2)(c), (f)). Obtain recognised training and document competence.
• Respect prescribed killing methods. The intended subordinate legislation will require shooting or harpooning as the permitted methods, unless the killer is an Aboriginal or Torres Strait Islander person using a defined traditional practice (s23(2)(i)). Ensure methods comply with the director’s directions and any regulations.
• Observe carcass-use obligations. The director must ensure carcasses killed under authorisation are dealt with so that no part is wasted so far as practicable (s10(1)(l); s23(2)(j)). Arrange appropriate processing and disposal channels and record how carcasses are used to support reporting obligations.

For landowners and leaseholders

• Consent requirements for sanctuaries and entry. The director must not include land within a crocodile sanctuary unless a person with an interest in land consents (s18(2)). For State leasehold or other non-State land, the director may authorise entry to kill, relocate or harvest only with the owner’s consent (s10(1)(i)). Landowners should document any consent or refusal, and consider negotiating terms or seeking compensation where appropriate, noting the Bill does not provide a compensation mechanism.
• Aboriginal and Torres Strait Islander land. If you are an owner of Aboriginal land or Torres Strait Islander land, the director may authorise you to kill or relocate crocodiles, allow others to do so, or harvest eggs on the land (s10(1)(h)). Be prepared to engage in consultation processes required by s20 and to negotiate terms for authorised activity.

For the director and authority staff

• Residency and premises compliance. Ensure the director and staff are resident in Cairns and the business premises are located in Cairns as required by s6(1)-(2) and s9(5).
• Establish delegation and qualifications. Use s12 to delegate powers to appropriately qualified staff; make and document delegation instruments consistent with statutory requirements.
• Develop administrative guidance and subordinate instruments. Prepare for s23 obligations by drafting subordinate legislation and administrative instruments implementing the transitional objectives, including training standards for harvesters and cullers, permitted methods of killing, timeframes for zero-tolerance responses (48 hours for a notified crocodile in a zero-tolerance zone is envisaged by s23(2)(d)), licensing conditions for farms and sanctuaries, and ownership eligibility criteria.
• Reporting systems. Build data collection systems to capture all matters required by quarterly and annual reports (s16(2); s17(3)). This includes numbers and locations of eggs harvested and authorised, particulars of kills and carcass disposal, relocations and their reasons, attacks and injuries, and a register of authorised operators.
• Indigenous consultation processes. Implement clear consultation protocols that comply with s20(2)-(3) when decisions may affect Aboriginal or Torres Strait Islander land or tradition. Ensure documentation of consultations and how cultural sensitivities and potential economic or social benefits were considered.

For the Minister and policy-makers

• Timetable subordinate legislation. The Minister must table proposed subordinate legislation within two months after commencement setting out measures listed in s23(2). Develop a timetable and draft instruments to give operational effect to the Bill’s objectives.
• Appointments and committee composition. When appointing the director and advisory committee members, ensure that statutory eligibility requirements are satisfied, including residency, qualifications and representations for Aboriginal and Torres Strait Islander members and members from the crocodile farming industry and community organisations (s9(3); s14(2)-(4)).

For private operators and community organisations

• Monitor public lists and authorisations. The director will publish lists of authorised operators in quarterly and annual reports (s16(2)(k); s17(3)(i)). Use those lists to verify authorised operators and to ensure due diligence in commercial arrangements.
• Understand populated-waterway implications. If a waterway is declared as a populated waterway, the director may authorise killing or relocation of crocodiles from that waterway, taking account of public recreational and commercial use (s19(1)-(3)). Recreational and commercial operators should monitor declarations and be prepared to adjust operations.

Record-keeping and evidence

• Maintain detailed records for reporting. Given the high degree of reporting required, authorised persons and operators should log every authorised activity, including dates, locations, methods used (for kills, culls and relocations), training certificates, carcass disposal or processing records, and any interactions with the director or staff. This information will be required for quarterly and annual reporting, and may be the basis for compliance reviews.

In all cases, compliance requires monitoring subordinate legislation and any licensing rules the director issues under the Nature Conservation Act or other prescribed Acts, because the Bill itself delegates much operational detail to those instruments. The Act establishes statutory duties, residency and reporting obligations that must be operationalised by administrative practice and secondary instruments; timely attention to those instruments will be essential to effective compliance.
