456 Transitional provisions—Justice Legislation Amendment (System Enhancements and Other Matters) Act 2021 (1) Subject to subsection (2), this Act as amended by Part 5 of the **Justice Legislation Amendment (System Enhancements and Other Matters) Act 2021**, applies, on and from the commencement of a relevant amendment in relation to a criminal proceeding irrespective of when— (a) the criminal proceeding commenced; or (b) the offence to which the criminal proceeding relates is alleged to have been committed. (2) Section 201, as in force immediately before its amendment by Part 5 of the **Justice Legislation Amendment (System Enhancements and Other Matters) Act 2021** continues to apply in relation to the determination of an issue that a court— (a) before the commencement of Part 5, was notified of under section 200(1) at least 14 days before the day on which the trial of the accused was listed to commence; and (b) at that commencement, has not yet decided.
