442 Transitional provisions—Criminal Procedure Amendment Act 2012 (1) This Act as amended by Division 1 of Part 2 of the **Criminal Procedure Amendment Act 2012** applies to an application for leave to appeal against sentence that is determined on or after the day on which Division 1 of Part 2 of that Act comes into operation, irrespective of when the application was commenced. (2) Division 5 of Part 8.2 as amended by sections 22 and 23 of the **Criminal Procedure Amendment Act 2012** applies irrespective of whether the recording is made before, on or after the commencement of those sections. (3) Division 6 of Part 8.2 as amended by sections 24, 25, 26, 27, 28 and 29 of the **Criminal Procedure Amendment Act 2012** applies to a proceeding in which a special hearing is held on or after the commencement of those sections.
