31 Water Industry Act 1994 31.1 Indictable offences under the **Water Industry Act 1994**. Sch. 3 item 4 substituted by No. 38/2022 s. 74, amended by No. 5/2025 s. 37(1). 4 A staff member, within the meaning of the Australian Securities and Investments Commission Act 2001 of the Commonwealth, at ASIC level 4 or higher (or an equivalent classification) in the Enforcement and Compliance area or the Markets Enforcement area of the Australian Securities and Investments Commission. Sch. 3 item 8 substituted by No. 31/2024 s. 26. 8 A person who is an authorised officer within the meaning of section 7 of the National Anti‑Corruption Commission Act 2022 of the Commonwealth. 9 A person who is an inspector appointed under section 267(1)(a) or (b) of the Radiocommunications Act 1992 of the Commonwealth. 10 A person appointed under regulation 42 of the Radiocommunications Regulations 1993 of the Commonwealth as an authorised person for those Regulations. 11 A person who is an inspector for the purposes of a provision of the Telecommunications Act 1997 of the Commonwealth by force of section 533(1)(a) or (b) of that Act. Sch. 3 item 16 amended by No. 68/2009 s. 57(f). 16 An Investigation Officer or a Senior Investigation Officer or the Manager, Investigations in Medicare Australia. 17 An officer at Australian Public Service level 5 or higher or an equivalent level who is a Fraud Investigator or Fraud Investigator Manager in the Commonwealth Services Delivery Agency (Centrelink).
