254 Right of appeal S. 254(1) amended by No. 3/2016 s. 61(1). (1) Subject to subsection (2), a person convicted of an offence by the Magistrates' Court in a criminal proceeding conducted in accordance with Part 3.3 may appeal to the County Court against— (a) the conviction and sentence imposed by the court; or (b) sentence alone. See the definitions of ***conviction*** and ***sentence*** in section 3. S. 254(2) inserted by No. 3/2016 s. 61(2), amended by No. 1/2022 s. 63. (2) If the Magistrates' Court was constituted by the Chief Magistrate who is a dual commission holder, the appeal is to be made to the Court of Appeal.
