#### 148 Court may waive requirements 148 Court may waive requirements > > (1) A court may, by order, waive any of the pre-trial disclosure requirements that apply under this Division, but only if the court is of the opinion that it would be in the interests of the administration of justice to do so. > > > (2) The court may make such an order on its own initiative or on the application of the prosecutor or the accused person. > > > (3) An order may be made subject to such conditions (if any) as the court thinks fit. > > > (4) The court is to take into account whether the accused person is represented by an Australian legal practitioner when considering whether to make an order under this section. > > > (5) The court is to give reasons for the making of an order under this section. > > **s 148 (previously s 47O):** Renumbered 2001 No 119, Sch 1 \[61\].
