What it does
These Regulations operate as subordinate legislation under the Criminal Law (High Risk Offenders) Act 2015, supplying definitions, cross-references and jurisdictional adjustments necessary for the parent Act to operate in particular contexts. They do three discrete things, each by prescription.
First, they prescribe particular offences as falling within the Act’s definition of "terrorist offence" for the purposes of the Act. The Regulations list South Australian offences (an offence against s 83CA of the Criminal Law Consolidation Act 1935, any offence against Part 3D of the Criminal Law Consolidation Act 1935, and an offence against s 37 of the Summary Offences Act 1953) (r 3A(1)). They also list specified offences from other Australian jurisdictions prescribed to the same end, namely: s 310J of the Crimes Act 1900 (NSW); certain Schedule 1 offences in the Northern Territory Criminal Code Act 1983 (ss 51, 53, 54 and 55, with ss 51 and 53 qualified by the unlawful organisation being a terrorist organisation); and s 4B of the Terrorism (Community Protection) Act 2003 (Vic) (r 3A(2)). The Regulations define "terrorist organisation" for this purpose by reference to paragraph (b) of the definition in Division 102 of the Commonwealth Criminal Code (r 3A(3)).
Second, the Regulations prescribe modifications to how the Act’s statutory language should be read when the Act is applied in the youth justice context. For the purposes of section 6(2) of the Act, the Regulations direct that labels such as CE, community corrections officer, custody, prison, Parole Board, presiding member, deputy presiding member and magistrate read instead as specific youth-system offices or concepts, for example the chief executive responsible for assisting the Minister in the administration of the Youth Justice Administration Act 2016, community youth justice officer, detention, training centre, Youth Parole Board, members of the Training Centre Review Board and a magistrate or Judge of the Youth Court (r 3B(1)). The Attorney-General has an express written-designation power to appoint a Training Centre Review Board member to act in the absence of a designated member (r 3B(2)).
