What it does
These Regulations prescribe the mandatory documentary forms and the manner of completing them for investigations under the Criminal Investigation (Extra‑territorial Offences) Act 1987 (the Act). Regulation 2(1) requires use of the forms set out in the Schedule for the purposes to which each is applicable, and regulation 2(2) requires that each prescribed form be completed in accordance with the directions specified in it. The Schedule is headed "Forms" and contains three templates: Form 1, an Application for a Search Warrant (expressly linked to s 4 of the Act); Form 2, the Search Warrant itself (also linked to s 4); and Form 3, the Notice to Occupier of Premises (linked to s 5(6) of the Act and reg 2).
Mechanically, the Regulations do not create new substantive offences, powers, or penalties. They operate as a procedural overlay to the Act by fixing the shape and mandatory fields for the documents that activate and record certain investigative steps: the sworn application for a search warrant, the instrument of authority to enter and search premises, and the post‑search notice to the occupier identifying objects seized. The forms include prescribed insertions and directions: for example, Form 1 requires sworn grounds to be inserted (the applicant must swear before a Justice of the Peace that there are reasonable grounds to believe an offence to which the Act applies has been, or is intended to be, committed and that an object relevant to the investigation is at specified premises), and Form 2 contains the text a Justice of the Peace is to use when authorising police entry under s 4(1) of the Act. Form 3 is the vehicle for the notification obligation in s 5(6) of the Act, requiring identification of the presiding Justice of the Peace and a list of seized items.
The Regulations are narrowly instrumental. They identify who must complete particular fields (for example, the applicant’s name, rank and address; description and address of premises; grounds relied upon; and, in the search warrant, directions for night execution if any). The Schedule bears amendment histories (notably amendments in 2005 and 2007), and the Compilation table in the Notes records the gazettal and commencement dates of the Regulations and subsequent amending instruments. The Regulations do not address ancillary topics such as retention periods for seized items, appeal or review procedures for warrant refusals, or penalties for non‑compliance with the form‑prescription; they confine themselves to specifying the forms to be used and how to complete them.
