Criminal Investigation (Extra-territorial Offences) Act 1987

This section isolates the statute’s principal legal constructs and their statutory anchors, and sets out the decision thresholds embedded in the text.

Reciprocating State and corresponding law. Part 2 operates only in relation to offences against the law of a "reciprocating State". That term means a State or Territory in which (a) a corresponding law is in force and (b) arrangements are in force under s 7 (s 3(1)(c)). A "corresponding law" is a law of another State or Territory declared by proclamation to be such (s 3(1)). The Governor’s power to declare or revoke a corresponding law is at s 3(3). That structure makes Part 2 contingent on executive declarations plus ministerial arrangements under s 7.

Objects relevant to investigation. For Part 2 purposes, "object relevant to the investigation" is defined broadly at s 3(2) and includes: things obtained by the commission of an offence, things used for the purpose of committing an offence, things in respect of which an offence has been committed, things that may afford evidence of the commission of an offence, and things intended to be used for committing an offence. The definition is therefore evidentiary and property-focused, not limited to proceeds of crime or weapons.

Search warrant threshold and process. A justice may issue a search warrant where, on a police application, the justice is satisfied there are reasonable grounds to believe that (a) an offence to which Part 2 applies has been or is intended to be committed; and (b) an object relevant to the investigation is on the premises (s 4(1)). The applicant must verify grounds by written evidence under oath (s 4(2)). Filing of warrant and verifying evidence in the Perth Magistrates Court is mandated (s 4(3)). The warrant permits entry and search, seizure of relevant objects where police believe on reasonable grounds the objects are relevant (s 5(1), (4)). A search warrant expires one month after issue if not executed (s 5(7)). Execution at night is excluded unless a justice authorises night execution or specifies night hours (s 5(2)). Police may use such force as is reasonably necessary (s 5(3)). Required post-execution procedural steps include preparing a prescribed form notice and giving or leaving it with the occupier (s 5(6)).

Transmission and return of seized objects. Section 7 empowers the Minister to enter arrangements with the Minister of the corresponding law jurisdiction about transmitting objects seized under this Part to the appropriate authority in the other jurisdiction for investigative or prosecutorial purposes, and about the return of objects to the Commissioner of Police when no longer required, unless court order directs otherwise (s 7(1)(a)(i)-(ii)). Symmetrical arrangements for objects seized under the corresponding law and transmitted to WA are included (s 7(1)(b)). The owner of an object returned to the Commissioner of Police is entitled to its return, and that right is enforceable by action in detinue (s 7(2)-(3)). The statutory text therefore contemplates bilateral ministerial agreements as the vehicle for movement and custodial arrangements for evidentiary material, subject to judicial disposal powers.

Vehicle powers. Section 8 defines "vehicle" expansively (s 8(1)). If a member of the Police Force reasonably suspects a vehicle in WA is being or may be used on a journey outside WA for the purpose of doing or attempting to do an act which, if done in WA, would be an element of an offence, the officer may stop, detain, enter and search the vehicle and search any person on board (s 8(2)(a)-(b)). While suspicion persists the officer may take charge of the vehicle and detain it at any place the officer thinks fit or take reasonably necessary steps to prevent the vehicle commencing or continuing its journey (s 8(2)(c)(i)-(ii)). Sections 18 and 19 of the Criminal Investigation Act 2006 apply to the stopping power (s 8(3)). A detainee or the officer may seek court review of detention and seek orders for release, conditions, detention period, payment of expenses, and costs (s 8(4)-(5)). Expenses ordered are recoverable as a judgment debt (s 8(7)).

Arrest power for "foreign offences". Section 8A introduces "foreign offence" defined by statutory penalty equivalence: offences against Commonwealth law or laws of places outside WA, whether in or outside Australia, that would attract statutory imprisonment of 12 months or more or life if committed in WA (s 8A(1)). Police may arrest on reasonable suspicion of commission or ongoing commission (s 8A(2)). The arrested person must be taken as soon as practicable to the Magistrates Court or the Children’s Court for under-18s (s 8A(3)). The court can discharge or keep the person in custody until a return date not less than seven days after arrest unless a warrant under Commonwealth law is executed earlier (s 8A(4)). If the court grants bail, the Bail Act 1982 applies (s 8A(5)-(8)). The statutory scheme provides a short-term custodial regime pending Commonwealth action or further court directions.

Procedural and external overlays. Section 3A makes the Act subject to Criminal Appeals Act 2004 s 46C, so some investigations require authority under that Commonwealth-linked provision. Section 3B applies Part 2 of the Courts and Tribunals (Electronic Processes Facilitation) Act 2013, bringing the Act within that Act’s electronic-process framework. The compilation note 1M requires the Act to be applied with modifications needed to give effect to the Cross-border Justice Act 2008 pursuant to the Cross-border Justice Regulations 2009; those modifications were applied from 1 November 2009.

Decision thresholds. The statute repeatedly sets the decision standards as "reasonable grounds" or "reasonably suspects" for searches, seizure, stoppings and arrests (s 4(1); s 5(4); s 8(2); s 8A(2)). Judicial authorisation is required for search warrants and for night execution exceptions, while executive action through ministerial arrangements and Governor proclamations is central to operationalising cross-jurisdictional reach (s 3(3); s 7(1)). Courts retain supervisory functions over detention of vehicles and custody following arrest.

Together, these concepts create a statutory architecture that balances police investigatory reach within WA for off-shore or extra-territorial offences against procedural safeguards administered by justices and courts, and against the need for formal inter-jurisdictional arrangements to move physical evidence between jurisdictions.

Identify in practice who has powers, who faces obligations, who bears costs and who can seek remedies under the Act.

Police. Members of the Western Australian Police Force are the primary actors who may apply for search warrants (s 4(1)), execute search warrants and seize objects (s 5(1), (4)), stop, detain, enter and search vehicles and persons under s 8(2), and arrest persons for foreign offences under s 8A(2). Police thus decide when to invoke Part 2, Part 3 and Part 4 powers within the statutory standards of reasonable grounds and reasonable suspicion.

Justices and courts. A justice issues search warrants under s 4 and must file the warrant and verifying evidence in the Magistrates Court at Perth (s 4(3)). A justice can authorise execution at night or during specified hours of the night (s 5(2)). The Magistrates Court has jurisdiction to receive filed warrants, to hear applications challenging vehicle detention and to make orders about release, conditions, detention periods, payment of Police expenses and costs under s 8(4)-(5). The Magistrates Court and Children’s Court supervise custody following arrest under s 8A(3)-(6), including setting return dates and bail where applicable. Courts thus play procedural oversight and remedy roles.

Ministers and the Governor. The Minister may enter into arrangements with the Minister of a corresponding law jurisdiction for transmission and return of objects seized (s 7(1)). The Governor may declare by proclamation that a law of another State or Territory is a "corresponding law" for the purposes of Part 2 (s 3(3)). These executive actors determine whether and how cross-jurisdictional cooperation is enabled. The power to make regulations (s 9) is vested in the Governor, implying administrative rule-making that can affect implementation details.

Owners and occupiers. Owners or persons entitled to possession of seized objects are directly affected by s 7(2)-(3). An owner of an object returned to the Commissioner of Police pursuant to arrangements is entitled to the return of the object and may sue in detinue to enforce that right. Occupiers of premises searched must be given or left a prescribed notice identifying the police who executed the warrant, the issuing justice and a description of seized objects (s 5(6)). Occupiers and owners therefore have notification and property-return protections.

Persons in or travelling by vehicle. Passengers and drivers of vehicles in WA who are reasonably suspected of being connected to a prospective journey outside WA for the purpose of committing an act that would be an element of an offence face stop, search and detention powers under s 8(2). They may be subject to seizure of the vehicle, to detention of themselves pending police action, and to subsequent court processes including applications for release or recovery of expenses.

Persons arrested for foreign offences. Individuals who are reasonably suspected of committing "foreign offences" as defined in s 8A(1) are subject to arrest without a warrant under s 8A(2). They must be taken to the Magistrates Court or Children’s Court as soon as practicable (s 8A(3)), and are subject to short term custody pending court determination or execution of a Commonwealth warrant. Bail considerations are governed by the Bail Act 1982 as applied in s 8A(7)-(8).

Appropriate authorities in other jurisdictions. The statutory architecture presupposes counterpart agencies in other States and Territories designated as "appropriate authority" per s 3(1). For the Australian Capital Territory the appropriate authority is the Commissioner of the Australian Federal Police (s 3(1)(b)). Those bodies will receive transmitted objects under s 7 arrangements and may return objects to the Commissioner of Police in WA when no longer required.

Courts and tribunals as procedural partners. The application of Part 2 of the Courts and Tribunals (Electronic Processes Facilitation) Act 2013 to this Act (s 3B) affects how certain filings and notices may be processed electronically by courts and tribunals, altering procedure for all participants who use the Act.

Who pays. The statutory text allocates potential financial burdens. Section 8(5)(c) enables the Magistrates Court to order payment of expenses incurred or to be incurred by the Police Force in relation to stopping, detaining or safekeeping a vehicle, and s 8(7) enables recovery of those amounts as a judgment debt. The penalty for hindering a search warrant is a fine of $2 000 (s 6). In practice, owners, occupiers, drivers or passengers may face liability for expenses ordered by a court for vehicle detention and for fines under s 6; Police and the State bear the immediate implementation costs of searches and initial detention.

Other public bodies. The Commonwealth has a potential role, given s 8A(4)(b) contemplates a warrant executed under a law of the Commonwealth; and s 3A links the Act to the Criminal Appeals Act 2004 s 46C. Those cross-references mean Commonwealth agencies and federal courts can affect outcomes under this statute.

In sum, the Act affects police, justices, Ministers, the Governor, owners and occupiers of property, drivers and passengers of vehicles, persons arrested for foreign offences, interstate counterpart authorities and courts. It couples state-level policing discretion with executive-level interstate cooperation and judicial supervision, while assigning certain costs and remedies to private persons who are the object of police action.

This section sets out the principal statutory duties imposed on public officers and the principal rights and remedies available to private persons, with precise section references.

Duties and procedural obligations of police and officers

• Verify grounds for search warrants by evidence in writing under oath. The applicant member of the Police Force must supply written sworn evidence verifying the grounds for the warrant application (s 4(2)). That is a mandatory documentary requirement for issuance of a search warrant under Part 2.

• File warrants and verifying evidence. A justice who issues a search warrant must file the warrant or a copy and the evidence verifying the grounds in the Magistrates Court at Perth (s 4(3)). This imposes an administrative filing obligation on the issuing justice and creates a public record.

• Execute search warrants within statutory limits. A search warrant must not be executed at night unless a justice directs execution at night or during specified night hours (s 5(2)). Police must also prepare and serve or leave a notice in the prescribed form as soon as practicable after executing a warrant, containing the executing officer’s name and rank, the justice who issued the warrant and the date and time of issue, and a description of seized objects (s 5(6)).

• Use force only as reasonably necessary. A member of the Police Force or assisting person may use only such force as is reasonably necessary to execute a search warrant (s 5(3)). This limits the degree of force to a reasonableness standard.

• Seize only objects believed to be relevant. A police officer may seize and remove any object that the officer believes on reasonable grounds to be relevant to the investigation (s 5(4)). The standard is belief on reasonable grounds, not mere suspicion.

• Deal with seized objects in accordance with ministerial arrangements. Objects seized under Part 2 must be dealt with in accordance with arrangements entered under s 7 (s 5(5)). That creates a duty to follow ministerial arrangements regarding transmission and return.

Duties and powers of justices and courts

• Authorise issuance and night execution of warrants. Justices are tasked with evaluating warrant applications under the reasonable grounds threshold (s 4(1)) and may authorise execution at night (s 5(2)).

• File warrants and verifying evidence. As noted, justices must file the warrant and verification in the Magistrates Court at Perth (s 4(3)).

• Make orders in vehicle detention matters. The Magistrates Court may order release of a detained vehicle unconditionally or subject to conditions, order detention for a period, order payment of Police expenses and make orders as to costs (s 8(5)). The court may also impose conditions relating to future use of the vehicle and require undertakings with or without sureties (s 8(6)).

• Supervise custody following arrest. Under s 8A(4)-(6), the Magistrates Court or the Children’s Court must decide whether to discharge the arrested person or keep the person in custody until and brought before the court on a return date. The court may grant bail under s 8A(5) and will apply the Bail Act 1982 (s 8A(7)-(8)).

Executive powers and duties

• Make arrangements for transmission and return. The Minister may enter into arrangements with the counterpart Minister of the corresponding law jurisdiction for transmission and return of seized objects (s 7(1)). There is no mandatory obligation to make such arrangements; the provision is permissive.

• Declare corresponding laws. The Governor may by proclamation declare a law of another State or Territory to be a corresponding law and may vary or revoke such declarations (s 3(3)). That is an executive function that determines the geographical and legal reach of Part 2.

Rights and remedies of private persons

• Notice of seizure. Occupiers must be given or left a prescribed form notice with prescribed particulars following execution of a search warrant (s 5(6)). This right ensures notice and a written record of what was seized and who conducted the search.

• Owner’s entitlement to return of seized objects. Where objects are returned to the Commissioner of Police pursuant to arrangements under s 7, the owner of the object is entitled to the return of the object (s 7(2)). The owner’s right is enforceable by action in detinue in any court of competent jurisdiction (s 7(3)). The right to sue in detinue is a private legal remedy against wrongful withholding following the statutorily mandated return.

• Right to challenge vehicle detention. A person aggrieved by vehicle detention may apply to the Magistrates Court for release or other orders under s 8(4). That provides prompt judicial review of administrative detention.

• Bail and court process protections for arrested persons. Arrested persons must be taken as soon as practicable to the Magistrates Court or Children’s Court (s 8A(3)). The court must discharge or remand with return-date limitations and can grant bail, with the Bail Act 1982 applying (s 8A(4)-(8)). These provisions create procedural protections and avenues to avoid indefinite custody.

• Limits on night execution. The presumption against night execution of warrants (s 5(2)) offers privacy and circadian protections to occupants and curtails intrusive late-night searches unless a justice authorises it.

Enforceable penalties

• Hindering execution. A person who, without lawful excuse, hinders execution of a search warrant is guilty of a summary offence carrying a penalty of $2 000 (s 6). This is a statutory criminal prohibition and monetary penalty linked to the search warrant regime.

Regulatory powers

• The Governor may make regulations necessary or expedient for the purposes of the Act (s 9). That provides a subordinate rule-making capacity to fill procedural details, including the "prescribed form" of the notice required by s 5(6).

Other rights and qualifications

• The Act is subject to provisions of other statutes. Section 3A makes it subject to Criminal Appeals Act 2004 s 46C where applicable, and s 3B applies the Courts and Tribunals (Electronic Processes Facilitation) Act 2013 Pt 2. Those cross-references can alter authority requirements and filing/processing methods, respectively.

In practical terms, police have duties to justify and document intrusive steps, justices and courts exercise authorising and supervisory functions, owners and occupiers obtain notice and property return rights, and vehicle occupants and arrestees have court review paths and bail rights. Procedural compliance obligations on police and judicial filing obligations are express, and private parties have both statutory and common law remedies provided by the text.

This section describes the Act’s explicit penalties, mechanisms for enforcement of rights and orders, and the practical enforcement instruments available to police and courts under the statute.

Express criminal penalty

• Hindering execution of a search warrant. The only express criminal offence created in the Act is at s 6. A person who, without lawful excuse, hinders a member of the Police Force or a person assisting in the execution of a search warrant is guilty of a summary offence. The penalty set is $2 000. That is the statutory criminal sanction directly tied to obstruction of warrant execution under Part 2.

Civil enforcement and recovery mechanisms

• Recovery of expenses for vehicle detention. Section 8(5)(c) authorises the Magistrates Court, when hearing an application under s 8(4) about detained vehicles, to make orders for payment of expenses incurred or to be incurred by the Police Force in relation to the stopping, detaining or safekeeping of the vehicle. Section 8(7) makes any such expenses or costs ordered to be paid recoverable as a judgment debt in a court of competent jurisdiction. Section 8(8) contemplates certification by the registrar of the Magistrates Court and registration of the order in a competent court to enable enforcement. Thus, financial enforcement of Police expenses is effected via civil process, not by a bespoke criminal penalty.

• Action in detinue for return of seized objects. Section 7(2)-(3) confers a statutory right for an owner of an object returned to the Commissioner of Police to the return of the object, and expressly makes that right enforceable by action in detinue. That is a civil property action enabling owners to recover possession when the statutory transmission/return process has produced custody by the Commissioner.

Judicial enforcement and remedies

• Court orders for vehicle release and conditions. The Magistrates Court may order release of a detained vehicle unconditionally or on conditions, detain the vehicle for set periods or until further order, and impose conditions relating to the vehicle’s future use including undertakings and sureties (s 8(5)-(6)). These are judicial remedies to restrain police detention powers and to impose obligations on persons seeking the vehicle’s return.

• Court supervision of custody following arrest. Under s 8A(4)-(6) the Magistrates Court or Children’s Court exercises supervisory control over the custody of persons arrested for foreign offences, with the power to discharge, detain until a return date, or grant bail. These are immediate judicial controls that constrain police custody.

Police enforcement powers

• Search, seizure and use of force. Police may enter and search premises and seize objects relevant to investigation where a search warrant issues (s 5(1) and (4)). Police may use such force as is reasonably necessary for execution of a search warrant (s 5(3)). For vehicle matters, police may stop, detain, enter and search vehicles and persons on board under s 8(2), and may take charge of and detain vehicles or take reasonably necessary action to prevent commencement or continuation of journeys. Those are the principal operational enforcement tools the Act confers.

Administrative and executive enforcement mechanisms

• Ministerial arrangements. Section 7 gives the Minister power to enter into bilateral arrangements with counterpart Ministers in other jurisdictions to transmit seized objects for investigative or prosecutorial purposes and to return objects when no longer required. Those arrangements operationalise enforcement across borders and can determine custodial chains and evidentiary handling, which are essential for cross-border prosecutions.

• Filing requirements. The duty to file warrants and verifying evidence in the Magistrates Court at Perth (s 4(3)) creates an administrative record enabling subsequent judicial review or forensic scrutiny, which in turn supports enforcement of statutory requirements.

Limitations and interplay with Commonwealth law

• Interaction with Commonwealth warrants. Section 8A(4)(b) contemplates that the court’s remand order remains subject to the execution of a warrant for the person’s arrest under a law of the Commonwealth. If a Commonwealth warrant is executed before the court’s return date, the court’s detention order ceases to have effect in the sense of the return date limitation. That creates a supervening Commonwealth enforcement mechanism that can shorten or change the course of WA-initiated custody.

• Procedural overlays and authority checks. Section 3A makes the Act subject to s 46C of the Criminal Appeals Act 2004 in relation to authority required for some investigations. This can impose additional conditions on the lawfulness of investigatory steps and therefore on the validity of enforcement actions.

Practical enforcement implications and friction points

• Monetary penalty versus civil cost recovery. The statute uses a relatively modest criminal penalty for obstruction of search warrants ($2 000), while financial responsibility for police expenses in vehicle detention is allocated to the vehicle’s owner or other persons by civil court order rather than by penalty. That creates an enforcement mix of criminal sanction for direct interference and civil liability for ancillary costs.

• Dependence on ministerial arrangements. The practical enforceability of seizure transmission and return depends on ministerial agreements under s 7. Absent such arrangements the statute’s cross-border sharing mechanisms are not self-executing, potentially complicating evidence movement.

• Judicial oversight required for prolonged detention. Vehicle detention and custody following arrest are both subject to court processes and timelines (s 8(4)-(7); s 8A(3)-(6)). That judicial oversight operates as an intra-state enforcement check on police exercise of the Act’s powers.

In short, the Act centralises enforcement in police operational powers backed by judicial authorisation for warrants, coupled with civil remedies for property return and cost recovery, and a single express criminal offence for hindering warrant execution. The Act also anticipates entrustment of certain enforcement outcomes to Commonwealth procedures where applicable.

The statute explicitly cross-references and is subject to other legislative instruments. This section summarises those links and lays out practical interaction pathways.

Criminal Investigation Act 2006. Section 8(3) of this Act applies ss 18 and 19 of the Criminal Investigation Act 2006, with any necessary changes, to and in respect of the power to stop a vehicle under s 8(2)(a). That means the legal limits, safeguards and procedures that govern vehicle stops in the Criminal Investigation Act 2006, including possibly requirements concerning identification, reasonableness of stop, search powers and record-keeping, apply to stops executed under this Act. Practitioners must consult the Criminal Investigation Act 2006 for the precise operational constraints and evidentiary rules that apply to stopped vehicles.

Bail Act 1982. Section 8A(7)-(8) brings the Bail Act 1982 into play for persons granted bail under s 8A(5). Subsection 8A(8) explicitly states that the Bail Act applies to the arrested person as if charged with an offence against WA law. That imports WA bail processes and conditions into what starts as a foreign-offence arrest context.

Criminal Appeals Act 2004. Section 3A states that this Act is subject to s 46C of the Criminal Appeals Act 2004. That provision in the Criminal Appeals Act may require certain authorisations for investigations; s 3A therefore imposes an additional statutory constraint on some investigative steps under this Act. Practitioners must examine s 46C to determine which investigative activities require prior authority and how that authority is obtained.

Courts and Tribunals (Electronic Processes Facilitation) Act 2013. Section 3B applies Part 2 of that Act to this Act. Part 2 of the Electronic Processes Facilitation Act addresses the manner in which courts and tribunals accept and process electronic documents and communications. Its application affects filing, notice, and hearing procedures under the present Act, including potentially how warrants, filings and other court processes may be conducted electronically.

Cross-border Justice Act 2008 and Cross-border Justice Regulations 2009. The compilation note 1M indicates that, under the Cross-border Justice Act 2008 s 14, this Act must be applied with the modifications prescribed by the Cross-border Justice Regulations 2009 Part 3 Division 7, as if this Act had been altered in those ways. The note records that modifications were applied from 1 November 2009. Practitioners must account for those regulatory modifications when applying the statutory text, since they may alter procedural aspects to give effect to broader cross-border justice arrangements.

Commonwealth laws. Section 8A(4)(b) contemplates that if a warrant for the arrested person’s arrest is executed under a law of the Commonwealth before the return date, the effect on custody changes. That means Commonwealth arrest powers, extradition or transfer warrants, and other federal procedures can supersede or alter the course of custody set under s 8A. The Act therefore sits alongside Commonwealth enforcement mechanisms and may be displaced or modified by operation of federal law.

Interstate and Territory laws. Part 2 is specifically designed to cooperate with other State and Territory laws that are declared corresponding laws. The Governor’s proclamation power to declare corresponding laws (s 3(3)) and the Minister’s power to make arrangements (s 7) mean the Act is deliberately hybrid: its cross-border reach is operationally seamless only when corresponding laws are declared and bilateral arrangements are in force. Practitioners must review proclamations and ministerial arrangements to determine whether a particular State or Territory is a "reciprocating State" for Part 2 purposes.

Procedural overlaps. Filing obligations under s 4(3) require the issuing justice to file warrants and verifying evidence in the Magistrates Court at Perth, integrating Part 2 with court filing systems. The prescribed-form notice required after execution of a warrant (s 5(6)) and potential regulations made under s 9 interact with rule-making at the court level and with any electronic filing standards under the Courts and Tribunals (Electronic Processes Facilitation) Act.

Common law remedies. The Act preserves access to civil remedies such as detinue for return of property (s 7(3)). Common law principles of trespass, false imprisonment and civil liability for use of excessive force remain relevant if police action falls outside the statutory standards such as "reasonably necessary" force in s 5(3).

Regulations. The Governor may make regulations contemplated by the Act or necessary for its purposes (s 9). Regulations may flesh out procedural, evidential or form-related matters, including the "prescribed form" of notices required by s 5(6). Regulations could therefore materially affect compliance obligations and should be checked.

In summary, the Act is integrated into a network of state and federal laws. Practitioners must treat it as an instrument that imports procedural and substantive elements from the Criminal Investigation Act 2006, the Bail Act 1982, the Criminal Appeals Act 2004 and the Courts and Tribunals (Electronic Processes Facilitation) Act 2013, while also relying on proclamations, ministerial arrangements and Cross-border Justice modifications. Cross-jurisdictional cooperation depends on executive declarations and arrangements, and Commonwealth procedures can change custody dynamics under s 8A.

Use the compilation table and inserted notes to trace legislative amendments and operational commencement dates relevant to the Act.

Original enactment and commencement. The Criminal Investigation (Extra‑territorial Offences) Act 1987 was assented to on 22 November 1987. Section 1 and 2 came into operation on 22 November 1987, while the remainder of the Act came into operation on 5 May 1989 (see compilation table entries).

Key amending Acts and material changes recorded in the compilation table

• Sentencing Legislation Amendment and Repeal Act 2003 (No. 50 of 2003) s 52: Amended s 6 (penalty for hindering execution) as recorded; commencement 15 May 2004.

• Courts Legislation Amendment and Repeal Act 2004 (No. 59 of 2004) s 141 and Criminal Procedure and Appeals (Consequential and Other Provisions) Act 2004 (No. 84 of 2004) s 80: These Acts effected amendments to the statute with commencement in 2005 as specified in the compilation table entries and corrections. The 2004 Acts included various consequential changes; see reprint and compilation entries for details.

• Criminal Investigation (Consequential Provisions) Act 2006 (No. 59 of 2006) Pt 6: This amending legislation introduced several changes, including the insertion of Part headings, and is the source for multiple textual insertions in the current reprint including the insertion of Part 3 and Part 4 in their current forms. Commenced 1 July 2007.

• Statutes (Repeals and Minor Amendments) Act 2011 (No. 47 of 2011) s 27: Minor amendments commenced 26 October 2011.

• Criminal Appeals Amendment (Double Jeopardy) Act 2012 (No. 9 of 2012) s 8: Inserted s 3A "Authority required for some investigations", making the Act subject to Criminal Appeals Act 2004 s 46C. Commencement recorded as 26 September 2012.

• COVID‑19 Response and Economic Recovery Omnibus Act 2020 (No. 34 of 2020) s 57: Inserted s 3B applying the Courts and Tribunals (Electronic Processes Facilitation) Act 2013 Part 2 to this Act. Commenced 12 September 2020.

Insertion of s 8A. Section 8A, providing an arrest power for foreign offences, was inserted by the 2006 legislation and later amended by the Statutes (Repeals and Minor Amendments) Act 2011 (No. 47 of 2011) s 27, with commencement dates recorded in the compilation table. The compilation table notes the insertion and subsequent amendment chronology.

Cross-border Justice Act 2008 modifications. The compilation notes include endnote 1M. Under the Cross-border Justice Act 2008 s 14, this Act is to be applied with modifications prescribed in the Cross-border Justice Regulations 2009 Part 3 Division 7 as if altered accordingly. The compilation notes record that modifications to give effect to that Act were applied from 1 November 2009. The Cross-border Justice regulatory modifications therefore form part of the Act’s operational effect since 2009, though the primary text here shows the base Act supplemented by those modifications.

Reprints and reprints dates. The compilation table records reprints as at 23 August 2002 and 24 August 2007 incorporating prior amendments. The reprint dates indicate the consolidated text at those points.

Other amendments and editorial insertions. The long title was inserted by No. 59 of 2006 s 31. Headings for parts were inserted by No. 59 of 2006 s 32. Section numbering and cross-references were adjusted across the amending Acts. The insertion of s 3A occurred in 2012 to align some investigative authority with Criminal Appeals Act 2004 s 46C. Section 3B was added in 2020 to apply electronic process facilitation.

Practical note on commencement and applicability. For any historical question about whether a specific power was available at a particular date, practitioners must check the Act versions and commencement entries in the compilation table. For example, the main operative provisions of the Act other than s 1 and s 2 commenced on 5 May 1989; substantial operational changes came in 2006 and later insertions in 2011, 2012 and 2020 affect current practice.

What the amendment history does not show. The compilation table and notes do not include case law construing the provisions or administrative arrangements made under s 7. They record statutory amendments and commencement dates only. For content of Cross-border Justice Regulations and the exact modifications they impose, practitioners must consult those regulations directly. Likewise, for any proclamations declaring corresponding laws under s 3(3), the practitioner must search the Gazette for the specific proclamation entries.

In sum, the Act has been subject to periodic amendment and insertion of cross-references to other Acts, with key operational insertions in 2006 (including s 8A), authority-related adjustments in 2012, and electronic-procedure linkage in 2020. The Cross-border Justice Act 2008 required regulatory modifications that have been applied since 1 November 2009.

The statutory text provided contains no reported judicial decisions or litigation history. The Act itself does not list cases or judicial interpretations. The compilation, amendment and notes record amending legislation, commencement dates and regulatory modification requirements, but do not supply judicial authorities construing any of the provisions.

Consequently, within the source you supplied there are no cases named or extracts of judicial reasoning to cite. Practitioners who require adjudicative history will need to consult case law databases, the consolidated legislation with annotations, and the judicial registry of the Magistrates Court, District Court and higher courts for decisions that have interpreted:

• the reasonable grounds and reasonably suspects standards in ss 4, 5, 8 and 8A;

• the scope of a "reciprocating State" and "corresponding law" under s 3, including any litigation about whether a particular foreign statute is a corresponding law or whether ministerial arrangements under s 7 exist or have been complied with;

• the proper scope of "reasonably necessary" force under s 5(3);

• application of ss 18 and 19 of the Criminal Investigation Act 2006 to vehicle stops under s 8(3);

• the interplay between s 8A custodial timelines and Commonwealth warrants referenced in s 8A(4)(b);

• enforcement of orders for payment of Police expenses in vehicle detention cases under s 8(5)(c) and s 8(7);

• actions for detinue brought under s 7(3) when objects returned to the Commissioner are not restored to their owners.

Absent entries in the statutory text, the dataset here does not reveal whether such decisions exist or their holdings. For litigation history, search the Westlaw AU, LexisNexis AU or AustLII databases, and the judgments lists of relevant courts. Also check administrative materials such as promulgated ministerial arrangements and Governor’s proclamations for any contested applications that reached judicial review.

If you would like, I can search AustLII and other public databases for cases that cite this Act and produce a separate case-law synthesis, limited to decisions available in public repositories.

This section collates practical pitfalls, operational constraints and statutory friction points that arise from the text and its structure. Citations to the relevant sections are provided for each point.

1. Part 2 is not self-executing across all jurisdictions. It applies only in relation to a "reciprocating State", defined to require both (a) a corresponding law in force and (b) arrangements under s 7 in force (s 3(1)(c)). The Governor’s proclamation power to declare corresponding laws (s 3(3)) and the Minister’s discretion to enter into arrangements (s 7(1)) mean that police powers under Part 2 depend on executive acts. Do not assume cross-border search-warrant powers exist as of right; check proclamations and ministerial arrangements.

2. Narrow definition of "offence to which this Part applies". The Part 2 threshold is an "indictable offence against the law of a reciprocating State" that arises from an act, omission or state of affairs that, if done or occurring in WA, would attract criminal liability under WA law (s 3(1)). Differences in elements, statutory defences or modes of liability across jurisdictions may complicate whether a given trans-state conduct qualifies. Practitioners should map the foreign offence elements to WA equivalents before relying on Part 2.

3. Warrant applications require sworn written evidence and filings at Perth. Section 4(2) mandates verification by written evidence under oath. Section 4(3) requires filing the warrant and verifying evidence in the Magistrates Court at Perth. In urgent or remote contexts the need for an oath and filing at Perth can be practically burdensome unless electronic processes under s 3B apply and the court accepts electronic filings.

4. One-month expiry of search warrants. Warrants expire if not executed within one month of issue (s 5(7)). Practitioners must manage execution timelines and consider re-application where necessary.

5. Night execution restrictions. Warrants cannot be executed at night unless a justice specifically authorises night execution or during specified hours (s 5(2)). This can constrain operational timing of searches and requires prior judicial authorisation when nocturnal execution is needed.

6. Broad and potentially ambiguous "objects relevant to the investigation". The definition in s 3(2) is wide and includes intended-use items and things that "may afford evidence". That breadth can raise disputes about scope of seizure, particularly for items on the border between relevance and privacy, and may invite litigation over proportionality.

7. Seizure and handling depend on ministerial arrangements. Section 5(5) requires that seized objects be dealt with in accordance with arrangements under s 7. If no such arrangements exist or if they are inadequate, practical problems arise for evidential transmission, chain of custody and custody disputes. Check whether arrangements exist and their terms.

8. Owner’s remedy limited to detinue after return to Commissioner. Section 7(2) grants a right of return where an object is returned to the Commissioner pursuant to arrangements. That right is enforceable by detinue (s 7(3)). If objects are transmitted overseas or disposed of under court order, owners’ practical ability to recover items may be limited. The remedy presupposes return to the Commissioner in WA; it may not help if objects have been lost, destroyed or lawfully disposed of abroad.

9. Vehicle stop power is tied to a specific suspicion about an intended journey outside WA. Section 8(2) requires reasonable suspicion that the vehicle is being or may be used for a journey to a place outside WA for the purpose of doing or attempting to do an act that would be an element of an offence if done in WA. That is a precise factual nexus; absent reasonable suspicion of an outward journey for an unlawful purpose, the broader stop/search powers do not apply. Mistaken reliance may render the stop unlawful.

10. Stopping power references other legislation. Section 8(3) applies ss 18 and 19 of the Criminal Investigation Act 2006 to the power to stop a vehicle. Users must consult that Act for the full policing constraints that apply to stops, including potential statutory warnings, recording obligations and officer identification rules.

11. The arrest power for "foreign offences" has a defined payload. Section 8A(1) defines a foreign offence by reference to the statutory penalty that would apply if the conduct occurred in WA. That means many foreign offences will not meet the 12-month imprisonment threshold, so police cannot arrest under s 8A in those cases. Practitioners must check the penal equivalence test.

12. Short-term custody but with a seven-day minimum return-date cap. The Magistrates Court may keep a person in custody until a return date not less than seven days after arrest unless a Commonwealth warrant is executed before then (s 8A(4)). The provision creates a floor rather than a maximum, which may be misunderstood. The court must set a return date not less than seven days hence, therefore potentially permitting substantial short-term custody, subject to judicial discretion and Commonwealth warrant effects.

13. Commonwealth warrants can pre-empt state custody. Section 8A(4)(b) expressly recognises that execution of a Commonwealth arrest warrant before the return date affects custody. Practitioners must be alert to concurrent Commonwealth procedures which may supersede state custody decisions.

14. Modifications required by Cross-border Justice Act 2008 may alter the text. The compilation note 1M records that the Act is to be applied with prescribed modifications. Those modifications may change terms in practice. Always check the Cross-border Justice Regulations 2009 Part 3 Division 7 for the operative modifications.

15. Limited express criminal penalties. Aside from s 6’s $2 000 penalty for hindering execution, the statute relies on civil processes or external criminal laws for enforcement. This might surprise users expecting broader statutory sanctions against obstructive behaviour or misuse of powers.

16. Electronic filing overlay. Section 3B applies Part 2 of the Courts and Tribunals (Electronic Processes Facilitation) Act 2013. Implementing e-processes may change where and how filings are made, but electronic procedures may not yet have been fully operationalised in some courts. Check current court practice directions.

17. Discretionary ministerial arrangements produce uneven coverage. The Minister’s discretion to enter into arrangements under s 7 means that the availability of cross-border transmission and return varies by interlocutor and time. That variability can complicate planning for investigations that anticipate evidence transfer abroad.

In short, the principal practical risks are: assuming Part 2 applies uniformly across jurisdictions; failing to secure or locate ministerial arrangements; misapplying vehicle stop or arrest thresholds; overlooking the one-month warrant expiry, night-execution restriction, and the documentary and filing requirements; and failing to account for Commonwealth interactions and Cross-border Justice modifications. Each of these is grounded directly in the statutory text cited above.

This section sets out concrete compliance steps for the key actors under the Act: police practitioners, prosecuting authorities, owners and businesses that may be affected, and Ministers responsible for arrangements. It focuses on immediate, statute-grounded actions and records to avoid procedural invalidity.

For police officers and investigators

• Verify statutory coverage. Before invoking Part 2 powers, confirm the target jurisdiction is a "reciprocating State". Check whether a corresponding law has been declared by Governor’s proclamation under s 3(3) and whether arrangements under s 7 are in force with that jurisdiction. Do not assume automatic reciprocity.

• Prepare sworn written evidence for warrant applications. For search warrants under s 4, ensure that the grounds are set out and verified by evidence in writing under oath as required by s 4(2). Attach the affidavit or sworn statement to the application and ensure the applicant is identified in the documents.

• Seek judicial authorisation for night execution where necessary. If execution is likely to fall at night (7 p.m. to 7 a.m. per s 3(1)), obtain a justice’s direction authorising night execution before conducting the search (s 5(2)). Record the decision and the justification in the file.

• File warrant and verification in the Magistrates Court at Perth. After issue, ensure the issuing justice files the original or a copy of the warrant and the verifying evidence in the Magistrates Court at Perth as mandated by s 4(3). If electronic filings are permitted or required under s 3B, comply with the courts’ e-filing procedures.

• Adhere to seizure handling arrangements. Arrange for seized objects to be handled in accordance with any ministerial arrangements under s 7, including documentation, chain-of-custody records and transmission instructions. If no arrangements exist for a jurisdiction, consult legal advisers and seek directions before cross-border transfer.

• Prepare and serve the prescribed notice after execution. Complete the prescribed-form notice specified in s 5(6), including officer name, rank, issuing justice and date/time of issue, and a description of seized objects, and give it to the occupier or leave it in a prominent place as soon as practicable.

• Document use of force and reasonableness. If force is used during execution, record why the force was necessary and that it was reasonably necessary (s 5(3)). Maintain contemporaneous statements, video, or other recordings where available.

• For vehicle stops and detention, satisfy the specific suspicion test. Under s 8(2) ensure reasonable suspicion that the vehicle is being or may be used for a journey outside WA for the purpose of doing or attempting to do an act that, if done in WA, would be an element of an offence. Record the facts that lead to that belief on operational forms and incident reports. When stopping, comply with ss 18-19 of the Criminal Investigation Act 2006 as applied by s 8(3).

• Be prepared for Magistrates Court review in vehicle cases. If detaining a vehicle under s 8(2)(c), be ready to explain detention, safekeeping and incurred expenses when the owner applies under s 8(4). Keep detailed logs of costs and safekeeping arrangements to support potential recovery orders under s 8(5)(c).

• For arrests under s 8A, be ready to take the arrestee to court promptly. Arrests for foreign offences under s 8A(2) require that the person be taken to the Magistrates Court or Children’s Court as soon as practicable (s 8A(3)). Ensure transportation and custody arrangements comply with that requirement. Record the grounds constituting reasonable suspicion.

• Notify custody and bail procedures. When an arrest under s 8A leads to remand, ensure magistrates have the factual material they need to set a return date and consider bail under the Bail Act 1982 as imported by s 8A(7)-(8). Comply with any bail terms or consequences if bail is breached.

For prosecutors and legal advisers

• Map foreign offences to WA equivalents. Before relying on the Act’s powers, map the elements of the foreign offence to equivalent WA offences to determine whether an alleged foreign offence would meet the "offence to which this Part applies" threshold for Part 2 or the statutory penalty threshold for s 8A.

• Check proclamations and ministerial arrangements. Confirm via Gazette searches and Minister’s office records whether corresponding laws have been proclaimed and whether s 7 arrangements exist for the foreign jurisdiction involved. Ensure any intended evidence transmission is lawful under the existing arrangements.

• Prepare for detinue actions. If representing an owner seeking return of property that was returned to the Commissioner under s 7, use detinue as the statutory remedy. Keep documentary proof of ownership and chain-of-custody records to support the action.

• Coordinate with Commonwealth authorities where necessary. Where arrest under s 8A might interact with Commonwealth arrest or extradition procedures, coordinate early with Commonwealth counterparts to clarify whether arrests will be superseded by Commonwealth warrants.

For Ministers and departmental legal officers

• Negotiate and document s 7 arrangements. If cross-border investigations are to be effective, enter clear written arrangements with counterpart Ministers covering transmission, custody, chain of custody, return procedures, costs, and disposal of objects, as authorised by s 7(1). Ensure the arrangements address ownership disputes, timelines for return, court disposal orders and responsibility for safekeeping costs.

• Keep proclamations current. Where it is appropriate to declare corresponding laws under s 3(3), ensure proclamations are prepared, gazetted and reviewed. When laws in other jurisdictions change, reassess whether corresponding law status remains appropriate.

• Issue guidance and forms. Use the regulation-making power under s 9 to create or recommend rules about the "prescribed form" notice required by s 5(6). Where s 3B applies, ensure forms and electronic filing formats align with courts’ e-processing systems.

For owners, occupiers and businesses

• Require sight of the warrant and notice. On being subject to a search, ask the executing officer to produce the warrant and, after execution, obtain the prescribed-form notice that s 5(6) requires. If the warrant is not produced or the notice is not provided, record details and seek legal advice.

• Preserve ownership proof. If property is seized, retain and be ready to produce proof of ownership to pursue return under s 7(2) and s 7(3). If an object is returned to the Commissioner, be prepared to bring an action in detinue to obtain the item.

• Challenge vehicle detention promptly. If a vehicle has been detained under s 8(2)(c), consider promptly applying to the Magistrates Court under s 8(4) to obtain release or impose reasonable conditions. Be aware that the court can order you to pay expenses if it finds that appropriate under s 8(5)(c).

Practical recordkeeping and evidential discipline

• Maintain contemporaneous records. For both searches and vehicle stops, maintain contemporaneous notes, video or audio recordings where lawful and practicable, and preserve chain-of-custody documentation for any seized objects. These records facilitate compliance with filing requirements and support any subsequent detinue actions, cost-recovery proceedings or criminal prosecutions.

• Train officers on thresholds. Provide training to police officers and sergeants on the statutory standards of "reasonable grounds" for warrants and belief for seizure (s 4(1); s 5(4)), and "reasonable suspicion" for stops and arrests (s 8; s 8A). Misapplication of those terms risks evidence exclusion or civil liability.

• Coordinate across jurisdictions. Before attempting to transmit evidence internationally or interstate, confirm s 7 arrangements cover the target jurisdiction, and liaise with the appropriate authority designated under s 3(1). For the ACT, note that the Commissioner of the AFP is the appropriate authority (s 3(1)(b)).

• Check Cross-border Justice modifications and court electronic-process rules. Verify the relevant Cross-border Justice Regulations that modify the Act and any contemporary court practice directions implementing the Courts and Tribunals (Electronic Processes Facilitation) Act 2013 Part 2 for e-filing and electronic service requirements.

Following these steps grounded in specific statutory provisions will reduce procedural invalidity risk, support admissibility of seized material, protect property rights where applicable and ensure lawful custody and processing of persons and vehicles detained under this Act.
