617 Cultivating offence—presumption if trafficable quantity cultivated If, in a prosecution for an offence against section 616 (Cultivating controlled plant for selling), it is proved that the defendant cultivated a trafficable quantity of a controlled plant, it is presumed, unless the contrary is proved, that the defendant had the intention or belief about the sale of the plant or its products required for the offence.
