55 Evidence of negligence or failure to exercise appropriate diligence Negligence, or failure to exercise appropriate diligence, in relation to conduct of a corporation may be evidenced by the fact that the conduct was substantially attributable to— (a) inadequate corporate management, control or supervision of the conduct of 1 or more of the corporation’s employees, agents or officers; or (b) failure to provide adequate systems for giving relevant information to relevant people in the corporation.
