76 Disclosure of confidential information
(i) is a public officer who obtains information because of the
officer's position; or
(ii) was a public officer who obtained information because of
the person's position as a public officer; and
(b) the information is confidential information and the person has
(c) the person intentionally engages in conduct; and
(e) the conduct results in the disclosure of the information and the
person is reckless in relation to the result.
(4) A person commits an offence if:
(i) is a public officer who obtains information because of the
officer's position; or
(ii) was a public officer who obtained information because of
the person's position as a public officer; and
(b) the information is confidential information and the person has
(c) the person intentionally engages in conduct; and

(e) the conduct results in the disclosure of the information and the
person is reckless in relation to the result; and
(f) the improper conduct is engaged in with the intention of
gaining a benefit.
(5) Strict liability applies to subsection (4)(a).
(6) Absolute liability applies to subsection (4)(d).
