420 Presence of appellant (1) Neither an appellant seeking leave to appeal or to extend the time in which notice of appeal or notice of application for leave to appeal may be given, nor a respondent to the application for the leave or extension, is entitled to be present, except with the leave of the Court, at the hearing of the application or at any proceedings preliminary or incidental to the application. (2) An appellant who is in custody shall not be entitled to be present at the hearing of his appeal, application for leave to appeal or any proceedings preliminary or incidental thereto except by leave of the Court.
