388 Definition
summarily-triable offence means:
(a) a summary offence; or
(b) an indictable offence a charge of which may be heard and
determined summarily by the Local Court; or
Criminal Code Act 1983 305
(c) an offence mentioned in section 22(1) of the Misuse of Drugs
Act 1990 if:
(i) the prosecution has elected under section 23(2) of that
Act for the charge of the offence to be heard and
determined summarily; and
(ii) the Local Court has not discontinued those summary
proceedings under section 23(4) of that Act.
