364 Summing up (1) After the evidence is concluded and the counsel or the accused person or persons, as the case may be, have addressed the jury it is the duty of the court to instruct the jury as to the law applicable to the case with such observations upon the evidence as the court thinks fit to make. (2) After the court has instructed the jury they are to consider their verdict.
