323 Charge of theft or receiving
(1) Subsection (2) applies in relation to a person who is charged on
indictment with any of the following offences:
(a) theft of property;
(b) receiving property;
(c) theft of property or, alternatively, receiving the same property.
(2) The person may be found guilty of:
(a) theft of the property; or
(b) receiving the property; or
