318 Charge of offence against the person where section 31 or intoxication is a defence Upon an indictment charging a person with an offence against the person other than murder or manslaughter, if he is found not guilty of the offence charged or any other offence of which he might otherwise be found guilty upon that indictment by reason of the provisions of section 31 or intoxication, other than intoxication of such a nature that the provisions of section 43C apply, he may be found guilty alternatively of an offence against Part VI, Division 3A, Subdivision 2.
