236H Bribery – offence by agent (a) the person is an agent (the agent); and (b) the agent: (i) requests a benefit from a person for the agent or another (ii) obtains a benefit from a person for the agent or another (iii) agrees to obtain a benefit from a person for the agent or (c) the agent engages in the conduct mentioned in paragraph (b) (i) that the agent will: (A) be influenced or affected in the exercise of the agent's function as agent; or (B) do or not do something as agent, or because of the Criminal Code Act 1983 240 (C) cause or influence the agent's principal, or another agent of the principal, to do or not do something; or (ii) of inducing, fostering or sustaining a belief that the agent will: (A) be influenced or affected in the exercise of the agent's function as agent; or (B) do or not do something as agent, or because of the (C) cause or influence the agent's principal, or another agent of the principal, to do or not do something; and (d) the conduct mentioned in paragraph (b) is dishonest. (3) Strict liability applies to subsection (1)(a).
