225Going equipped for theft and related offences

225 Going equipped for theft and related offences (a) is in a place other than the person's home; and (b) possesses an item; and (c) engages in the conduct mentioned in paragraph (b) with the intention of using the item in the course of or in relation to committing the offence of theft or a related offence. (3) A person commits an offence if the person: (a) is in a place other than the person's home; and (b) possesses a firearm or any other dangerous or offensive weapon; and (c) engages in the conduct mentioned in paragraph (b) with the intention of using it in the course of or in relation to committing the offence of theft or a related offence. (4) Subsection (3)(c) is the fault element for the conduct in subsection (3)(b). (5) Strict liability applies to subsections (1)(a) and (3)(a).

Criminal Code Act 1983 216 related offence means an offence against any of the following: (a) section 218; (b) section 220; (c) section 221; (d) section 228AB.
