16 Offences counselled or procured in the Territory to be committed out of the Territory (1) Any person who, in the Territory, counsels or procures another to commit, at a place not in the Territory, an offence of such a nature that the conduct giving rise to it is also an offence in the Territory and that offence is in fact committed, is guilty of an offence of the same kind and, subject to subsection (2), is liable to the same punishment as if he had counselled or procured that other person to engage in that conduct in the Territory and he had done so. (2) A person found guilty under subsection (1) is not liable to greater punishment than that to which the person who actually committed the offence was liable under the law in force in the place where the offence was committed. Criminal Code Act 1983 19 (3) A prosecution cannot be instituted under subsection (1) except at the request of the government of the state having jurisdiction in the place where the offence so counselled or procured was committed.
