7Employee

#### 7 Employee (1) In this Act, employee means a person (other than an AFP employee) employed by the Commonwealth or by a Commonwealth authority, whether the person is so employed under a law of the Commonwealth or of a State or Territory, or under a contract of service or apprenticeship. (2) Without limiting subsection (1): (a) a member of the Parliament; or (b) a justice or judge of a federal court; or (c) a member of the Defence Force; or (d) a person (other than a person mentioned in subsection (3)) who is the holder of: (i) an office established by a law of the Commonwealth; or (ii) a prescribed office established by a law of a Territory; is to be taken, for the purposes of this Act, to be employed by the Commonwealth. (3) Without limiting subsection (1), a person is to be taken, for the purposes of this Act, to be employed by a Commonwealth authority if: (a) the person constitutes, or is a member of, the authority; or (b) where the authority is a body corporate—the person is a director of the body corporate.
