#### 13 Proceedings for serious crime prevention orders are civil and not criminal 13 Proceedings for serious crime prevention orders are civil and not criminal > > (1) For the purposes of this Act, proceedings on an application for a serious crime prevention order are not criminal proceedings. > > > (2) Except in relation to an offence against this Act— > > > > > (a) the rules of construction applicable only in relation to the criminal law do not apply in the interpretation of the provisions of this Act, and > > > > > (b) the rules of evidence applicable in civil proceedings (including as to the burden of proof) apply, and those applicable only in criminal proceedings do not apply, to proceedings under this Act.
