238 Interstate transfer—prisoner’s request to serve sentence in ACT (1) Section 237 does not apply in relation to a prisoner if, on the prisoner’s written request to the Minister, the Minister and the relevant Minister (or relevant Ministers) agree in writing that it is in the interests of the welfare of the prisoner to serve his or her imprisonment in the ACT. Interstate transfer—return to original jurisdiction Division 11.1.4 relevant Minister means— (a) if the prisoner is an ACT prisoner transferred from a participating state—the corresponding Minister of the participating state; or (b) if the prisoner is a joint prisoner transferred from a participating state— (i) the corresponding Minister of the participating state; and (ii) the Commonwealth Attorney-General; or (c) if the prisoner is a joint prisoner transferred from a non-participating territory—the Commonwealth Attorney- General.
