109 Cancellation of good behaviour order made as
non-conviction order
(a) an offender’s good behaviour order was made under the Crimes
(Sentencing) Act 2005, section 17 (2) (b) (Non-conviction
orders—general); and
(b) a court cancels the order under section 108.
(2) The court must—
(a) convict the offender of the offence for which the good behaviour
order was made; and
(b) sentence the offender for the offence.
(3) The Crimes (Sentencing) Act 2005 applies to the sentencing in the
same way that it applies to the sentencing of an offender on conviction
for the offence.
